1 Rules and Regulations on the use of TATRYSKI pass Regulations on the use of electronic proximity cards and other transponders of the SKIDATA system in Ski Resorts belonging to the TATRYSKI common card system. I. GENERAL PROVISIONS 1. Rides by chair railways and ski lifts (hereinafter referred to in further parts of regulations - as railways and lifts respectively) of Ski Resorts belonging to the TATRYSKI common card system (hereinafter referred to as SR) are possible only on the basis of SKIDATA electronic proximity cards or other transponders used for collection of fees and supervision, hereinafter referred to as the Cards. 2. TATRYSKI Term Card entitles to use all the railways and lifts of the Ski Resorts affiliated to the system of TATRYSKI common card. 3. The Cards shall entitle to use the railways and lifts during the opening hours of individual Ski Resorts. The opening hours of individual railways and lifts vary and may change during the season. 4. Entry to the Ski Resorts belonging to the system of the TATRYSKI common card, as well as using the card is tantamount to getting familiar with these regulations and other rules applicable in the Ski Resorts belonging to the system of TATRYSKI common card, and with acceptance of their provisions. 5. TATRYSKI stipulates that individual ski runs or railways and lifts in Ski Resorts may be excluded from use for customers in the event of organization of ski competitions, events or training for organized ski groups - in such a case competitors or organized ski groups shall have the priority over the use of cable-supported transport devices. II. TICKET OFFICES 1. TATRYSKI system cards can be purchased only at the ticket offices of the affiliated resorts in TATRYSKI common card systems, at authorized points of sales and in presale available on the websitehttp://tatryski.skiticketshop.com 2. Cards are the property of the Affiliated Resorts in the TATRYSKI system. On account of issue of the card, the deposit shall be charged, referred to in point III Repayment of the deposit can be obtained at each ticket office and in ticket machines located in the Resorts, provided that the card is returned undamaged.

2 4. VAT invoices for acquired entitlements to rides by railway and lifts can only be obtained on the basis of a receipt at the customer service office in the Resort, where the pass was purchased. 5. Payments in tickets offices shall be made by payment cards or by cash of PLN currency. III. TYPES OF CARDS - THE FEE COLLECTION SYSTEM 1. The fee collection system operating in resorts belonging to the TATRYSKI common card system shall enable using railways and lifts by purchasing a term card entitling to use of the railways and lifts within the time period specified on the card. 2. Term cards shall entitle to use for, within the period of their validity, an unlimited number of rides. Information about the validity date of the card shall appear on the gate's reader display, and shall be printed on the card during the sale made at the ticket office of resorts. In the case of hourly cards, the possibility of taking rides shall end when the Ski Center is closed on the day on which the card was activated. 3. The term card shall be activated and personalized at the time of the first holding a card at the gate reader, during the period of validity of the card. The card shall be valid in the winter season in which it was purchased. 4. The only person authorized to use the term card in the period of its validity shall be the person, who has activated and personalized the card. 5. In the case of the purchase of a term card covering prices in the high season and off-season, a mixed price shall be automatically calculated. 6. It is not possible to exchange, renew or postpone the validity of the term card after its activation. 7. Term entitlements acquired with the card shall not be refundable after activation of the card - except for the cases indicated in point VI.2. Cards that have not been activated can be returned at the latest until the end of the period of validity of the card, in the winter season in which it was purchased. 8. Each time when issuing a term card, a refundable deposit of PLN 10 per card shall be charged. The deposit shall not be reimbursable in case of loss or visible mechanical damage to the card. IV. CONCESSIONS AND DISCOUNTS 1. Group discounts and concessions are available only when term cards are purchased. 2. Discount cards according to the price list published on the website are available to children under 9, young people under 15 and seniors over 60. Discount cards are

3 issued on the basis of a document confirming the age and allowing to identify the authorized person. 3. A child under 120 cm tall receives a term card free of charge. The offer is valid only if purchased together with a term card for the same period for an adult providing childcare, while one adult card is entitled to one pass free of charge. The offer shall not apply to combined passes entitling to use the services of TERMA BANIA. 4. The child's height measurement shall be carried out at the ticket offices in a ski wear together with a helmet (without skis or a snowboard). 5. Seniors over 75, on the basis of a document confirming the age and enabling identification of the entitled person, shall receive a card at a price of 5 PLN for each day of validity of the card. The offer shall not apply to combined passes entitling to use the services of TERMA BANIA. 6. Groups of 20 people shall be entitled to a discount on the purchase of term cards. When purchasing cards with the group discount, one in 11 people shall receive a card for PLN 5 for each day of the card's validity, and other persons shall receive a 10% discount on the price list for the selected age group. Discounts for groups shall not apply to combined tickets, which entitle their holders to using the services of TERMA BANIA. 7. Failure to comply with the rules contained in the Rules and Regulations, and in particular the use of a concession card by an unauthorized person shall result in the loss of the entitlements held on the card. 9. TATRYSKI is not be responsible for individual discounts and rebates provided by the resorts belonging to TATRYSKI and it stipulates the right of refusal to honor the card issued in violation of general Rules and Regulations. V. USE OF SKIDATA GATES 1. The card should be put in the pocket placed on the left side of the outfit - in the pocket on the left breast, on the left shoulder or thigh. 2. Items that may interfere with the reading of the card (e.g. mobile phones, car keys, payment and credit cards, etc.) should be placed on the right side of the outfit. 3. When using gates, only one card should be carried. The ski resorts belonging to the TATRYSKI common card system are not responsible for the consequences of noncompliance with this order.

4 4. One should remain within the field of influence of the gate antenna, until the reader confirms the validity period of entitlements. 5. Confirmation of the entitlement to passing through the gate and to read the card shall be indicated by an appropriate message on the reader's display and activation of the green light on the gate casing. 6. The activation of the red light on the gate casing means that passing through the gate is not allowed. 7. After passing through the gate on the basis of a term card, a temporary card lock is automatically activated, preventing the use of the same card by another persons. 8. Please pay attention to the audio signals and messages displayed on the gate reader screen and comply with the commands and messages resulting from these. VI. COMPLAINTS AND REFUNDS 1. The recovery of unused term entitlements - after activation of the card - shall be possible as a result of stoppage of all railways and lifts lasting more than 1 hour due to reasons attributable to SR, as well as as a result of an accident on the slope or in the case of force majeure, which should be understood as the event, which is: (a) external, (b) unpredictable, (c) of which effects cannot be prevented and which preclude the use of railways and lifts. 2. In order to receive a refund being in conjunction with the accident, a copy of the TOPR/GOPR accident report should be submitted. 3. An application for refund for unused entitlements may be submitted in marked ticket offices only in writing, whereas the application must contain the statement of justification. The application for refund shall be processed within 7 working days from the date of its submission. 4. The recovery of unused term entitlements shall be granted in a manner proportional to the validity of the term card. 5. The refund due for the deposit can be made at all ticket offices, self-service card return machines and at authorized points of sale. 6. Refunds for non-activated passes can be made at all ticket offices. 7. The deposit shall not be reimbursable in case of loss or visible mechanical damage to the card. 8. Reimbursement for the deposit shall be possible until April 30 each year in the opening hours of the ticket offices of individual ski resorts under to the TATRYSKI common card.

5 9. Refund for non-activated cards is possible only until the end of the winter season, in which the pass was purchased. Refunds can be made in all Ski Resorts affiliated as part of the common card. 10. Complaints shall be considered after submittal of the proof of purchase by the Customer. Complaints should be lodged at the Resort, where the ticket was purchased. 11. After use of the term card in the reader at the entrance gate, complaints regarding the type of issued term card shall not be taken into account. VII. TICKETS ENTITLING TO USE OF SERVICES OF TERMA BANIA 1. The ticket "4 h TATRYSKI + 3 H Termy" purchased by the Customer in the period from January 1, 2018 to March 4, 2018 shall entitle the purchasing Customer to an additional onetime entry to TERMA BANIA, for 3 hours to the Play and Relaxation Zone at 19:00 in the period from January 1, 2018 to March 4, Tickets 3of5 days and 5of7 days purchased by the Customer in the period from March 5, 2018 until the end of the 2017/2018 ski season shall entitle the purchasing Customer to onetime entry to Terma Bania for 3 hours, to the Play Zone from Monday to Friday in the period from March 5, 2018 to May 31, The mentioned tickets shall entitle to use the services of TERMA BANIA in the following periods: 31/03/ /04/2018, 28/04/ /05/ A ticket "4 hours + Terma" purchased by the Customer in the period between 4/11/2017 and 22/12/2017 and from March 5, 2018 until the end of the 2017/2018 ski season shall entitle the purchasing Customer to one-time entry to Terma Bania for 3 hours, to the Play Zone from Monday until Friday in the period from November 4, 2017 to December 22, 2017 and from March 5, 2018 to May 31, The specified tickets shall not entitle to use the services of TERMA BANIA in the following periods: 23/12/ /03/2018, 31/03/ /04/2018, 28/04/ /05/ The special offers specified above shall apply only to individual Customers, who have purchased the above-mentioned tickets at TATRYSKI ticket offices. 5. The special offer shall not be combined with other offers and discounts, in particular with those mentioned in point IV (3, 5 and 6) of these Rules and Regulations. 6. In the event of purchase of a combined pass that also entitles to enter TERMA BANIA, and after the activation of the card, refund for the partially unused entitlement related to consumer indisposition caused by an accident on the slope, shall be possible after delivery of a document confirming the injury, signed by a TOPR rescuer (Tatra Volunteer Search and

6 Rescue) or a doctor. The payout shall be made at selected ticket offices on the terms described in point VI Only a person identified by the staff of TERMA BANIA, based on the relevant program, as the person using the TATRYSKI pass can make use of the promotional entry. It is forbidden to dispose of the pass at no cost to the benefit of a third party. 8. Each Promotion Participant shall be obliged to strictly comply with the provisions contained in the Regulations of Facilities he uses. 9. In the event when making use of the Promotion was not possible due to overcrowding of the facility, TERMA BANIA reserves the right to issue to the Participant the voucher entitling to enter into TERMA BANIA, to the Play Zone or Play and Relaxation Zone, for a period of 3 hours on a different date, however no later than by the end of June 15, 2018 (excluding holidays expected) under the same conditions as provided for in the pass. 10. Persons who have activated the combined pass shall not be entitled to the refund of the equivalent of unused entitlements - subject to the provisions of point VII.6. VIII. INSPECTION AND SANCTIONS FOR BREACH OF RULES AND REGULATIONS 1. The term card shall be activated and personalized at the time of the first holding a card at the gate reader, during the period of validity of the card. 2. During each passing through the gate, photographs of the person using the card are taken. 3. The photographs shall be used only for control purposes. After expiration of the entitlement, photographs are removed from the device's memory. 4. Using the card is tantamount to agreeing to use the image for control purposes, and to save it in the access control system for the period of validity of entitlements on the card. 5. In the case of attempts of using the passage in a manner inconsistent with these Rules and Regulations or in the case of using a card by an unauthorized person, the possibility of further use of the card shall be locked. 6. At the request of the staff or control authorities, a card must be presented. Refusal to present the card shall result in blocking further use of the card. 7. Anyone who violates rules and regulations binding in the ski resorts under the TATRYSKI card, can be removed from the resort by authorized security personnel. 8. We reserve the right to change prices and these Regulations with the stipulation that an amendment to the regulations (including price changes) applies only to new customers and does not apply to counterparties, who have already entered into a contract (purchased the pass).
