Introduction 1.1 Terms of Reference Following the judicial conference held at Napier on 26 June 1998, the Presiding Officer directed on 2 July as follows: 18. Inquiry boundary mapping exercise - The Tribunal will produce maps displaying its current understanding of the area claimed by each claimant group. These will be released to parties in draft form, seeking comment and amendment. The maps will not address or determine the customary rights in any area. The purpose is to clarify each claim area and, thus, the boundary of the entire Mohaka ki Ahuriri Claims Inquiry district. The specific terms of reference were a) To produce draft maps, together with an explanatory commentary on each, displaying the Tribunal's current understanding of the area claimed by each claimant group and to circulate these to all parties in draft form seeking comment and amendment. b) Taking account of comments received, to prepare final versions of the maps and to integrate them into a composite map of the inquiry district with an explanatory memorandum. In phase 1 of the project, draft maps of each claim boundary were prepared on the basis of information provided in statements of claim and any associated documents. During September 1998, the draft claim maps were circulated for comment to claimants and their counsel together with an explanatory memorandum, each receiving the map of their claim area only. Comments and additional information supplied by claimants and their counsel were collated during October and November They were supplemented by new information and definitions extracted from recent amended statements of claim. In addition, a draft map was drawn for the Wai 692 claim, which was consolidated into the Mohaka ki Ahuriri inquiry in November On the basis of all the information and comments provided, the individual claim maps have been revised and the results are presented in this report. No account has been taken of information given in evidence to hearings, in research reports for the Mohaka ki Ahuriri inquiry or in other documentation except where relied upon in the statement of claim or requested by claimants. The boundaries of the 20 claim areas have also been combined into an integrated inquiry district map, which appears at the beginning of the map section. It should be emphasised that this

Inquiry District Overview 2.1 Defining Boundaries It must be stressed at the outset that this report does not consider at all the substantive origins of the areas defined as subject to claim. These origins are as diverse as the grounds of claim to which they relate: pre-colonial rohe, Crown purchasing, raupatu, Native Land Court titling, public works takings, allocation of reserves, zones of economic activity, areas subject to particular use-rights, wahi tapu, service delivery areas - all feature amongst the claims before the regional inquiry. The purpose here is rather to draw out their implications for the definition of geographical boundaries to the areas subject to claim. For most claims which raise historical grievances, the geographical implications of statements of claim are often in fact quite complex. On the one hand, they point to large-scale changes over time, from pre-colonial rohe through the titling and progressive alienation of specific blocks to a residuum of land remaining currently in Maori ownership. On the other, they indicate overlapping categories of grievance which may combine within the same claim spaces ranging from small sites, for instance of takings or wahi tapu, to broad zones, such as rohe or confiscation districts. Conversely, several of the claims are sharply focused on particular land parcels at a specific point in time. Setting a single boundary for a claim may therefore sometimes turn out to be a complicated task. In general, adopting the largest area indicated by the claim commonly accommodates many or all of the smaller areas, which tend to be defined at later stages in a process of loss of land and resources. An inclusive approach will also usually provide a better fit where the proposed means of redress refers to Crown-owned property within the general area of the claim. The method adopted in this report has been to establish so far as possible the outer boundaries of the spatially specific grievances or zone of interest identified in a claim. Typically, these refer to pre-colonial rohe, early Crown purchases or first-stage Land Court block titling. It should be borne in mind, however, that within such outer boundaries not all the area may be subject to claim. This is particularly the case where a claim describes a pre-colonial rohe but does not state grievances relating to the whole of that rohe. Conversely, the zones and sites of specific

The two-dimensional simplicity of claim boundaries will commonly conceal a multi-dimensional mosaic of grievance categories. The claim areas drawn in the maps in this report are thus designed to represent a composite geographical picture of all the grievances in a claim which have a spatial dimension or alternatively, a rohe within which a set of grievances are located. Grievances are quite often, however, not articulated with sufficient geographical precision to derive accurate descriptions of the areas affected. Even where they are, precise lines on a map may obscure an essential imprecision in the geographical meaning of the concept. Such imprecision typically applies in respect of pre-colonial rohe and of mobile economic resources such as hunting zones. Boundaries between rohe are more appropriately conceived as fluid border zones serving the management of political relationships between hapu than as exclusive cadastral divisions permanently fixed by survey lines. Alongside them were many particular border zones defined for different associations of hapu and whanau, over differing types of resource, wahi tapu and living space, and for varying seasons and periods. Overlapping, shared, reciprocal and shifting rights were more characteristic of economic, social and political arrangements than the large-scale exclusivities of modern political authorities such as states and territorial bodies. It is not at all surprising to find a number of overlaps in claim boundaries between adjacent hapu claims as well as sub-hapu or whanau claims articulated within a larger multi- hapu claim area. Boundary lines drawn on a map can be misleading in another important sense: their uniform appearance tends to signify equality of weight. Cadastral boundaries defining land blocks and administrative boundaries defining the jurisdiction of local authorities have a more or less precise single meaning which applies uniformly. But individual claim boundaries reflect a varying mix of determining criteria. They also exhibit differing degrees of precision, most obviously between the fluid zones of pre-colonial rohe and the fixed, exact areas of surveyed land parcels. When comparing claim boundaries depicted, as in this set, by single lines of uniform appearance, it is important to keep in mind the particular bundle of grievance issues each encloses and the nonexclusive, complementary character of many apparent overlaps.

12 Mohaka ki Ahuriri claims mapping Page Towards an Inquiry District Boundary A principal objective of this mapping project is to assist the Mohaka ki Ahuriri Tribunal in identifying and defining the boundary of its inquiry district. The Chairperson's memorandum of 20 July 1995, which addressed 'claims in the Mohaka to Napier locality' and the binding recommendation sought by the Wai 299 claimants in respect of the Esk Forest, outlined a geographical basis for the grouping of the claims:[5] Following upon the Tribunal's previous practice, it appears the claims in anyone district should be heard at one and the same time in case of overlaps, either in tribal or post-contact history, or in the relief that is now sought. It cannot be assumed that the Tribunal could proceed with the Esk Forest claim alone (Wai 299) without also considering or hearing other claimants in the district. Following upon the opinion in the Muriwhenua claim of30 January it also appears that the total claims of a district should be heard, and relief considered, before any binding recommendation is made in respect of a forest. For those reasons and at this stage, the Tribunal contemplates the contemporaneous hearing of the claims [listed previously]... to the extent that they relate to the hapu of the Mohaka-Napier district. The geographical coverage of the inquiry was thus initially related to the scope of the Wai 299 claim and the area of the Esk Forest. All claims relating to the district were to be heard jointly, excluding any parts of such claims that concerned other areas. The adoption of this practice has been interpreted to include new claims presented during the course of the Tribunal's hearings. The Chairperson's memorandum went some way towards specifying the inquiry district, stating that 'the claims thus grouped prescribe an area covering the 1851 Mohaka and Ahuriri purchases and the Mohaka-Waikare confiscations'. This area forms a large, contiguous block extending from the southern boundary of the Ahuriri block to the Mohaka River and inland to the Hawke's Bay provincial border. The memorandum contemplated adding one claim concerning land north of the Mohaka River (Wai 430) and 'two ancillary claims' which 'are either within or adjoin the Ahuriri block' (Wai 168 and 127).[6] Thus at the outset the inquiry centred on three claims concerning large areas of land: the Ahuriri Crown purchase (Wai 400), the Mohaka-Waikare confiscation district (Wai 299) and the Mohaka 5 Memorandum, 20 July 1995, (Wai ), para 3. 6 Memorandum, 20 July 1995, (Wai ), para 2(f), 4. The results of research on the Wai 119 claim, submitted in mid- 1996, led to an expansion of its claim area to include ten Native Land Court blocks and the Waihua Crown purchase north of the Mohaka River.[7] Also included in the inquiry were a number of claims to smaller areas, most of them within the three large claim areas. Exceptions were Wai 168, concerning land adjacent to and partially overlapping the Wai 400 claim area to the south, and Wai 436, which was geographically undefined except by reference to the 'Mohaka Forest'. The inquiry thus began its first hearing in November 1996 with a core district in focus but lacking a comprehensive statement of its geographical coverage. Although several new claims have been consolidated or aggregated into the inquiry since then and a number of claimants have presented amendments or additions to their original statements of claim, all except three fall completely within the areas of the three large claims. Apart from clarifying uncertainties about the precise boundary of the Mohaka-Waikare confiscation district, these exceptions raise the only remaining questions to be settled in finalising the inquiry district boundary. The first exception is Wai 692, the Napier Hospital services claim, which was brought into the inquiry very late and currently awaits completion of research and a hearing. The claim is unique in that it concerns not land but services. The claim area is thus the applicable service catchment area, which is likely to be capable of approximate definition at best. Although the claimants have not yet had the time to submit their views, it appears that the catchment area may extend south of the Tutaekuri River near the coast but otherwise remain within the Wai 400 and Wai 299 claim areas. Since Wai 692 concerns service delivery rather than land and resources, it may not be necessary to take its claim area into account in defining the inquiry district boundaries. The second exception is Wai 436, the Ngai Tane claim. In October 1998, the Wai 436 claimants presented an amended statement of claim which attached two maps, the first marking as 'Ngai Tane's rohe' an area stretching northeastwards from Lake Tutira across the Waiau River to the shores of Lake Waikaremoana and the second dividing the rohe according to grievance 7 Finally defined in Wai 119'5 Third amended statement of claim, n.d. 14 Mohaka ki Ahuriri claims mapping Page 8 categories.[8] The only grievance alleged in respect of the land northeast of the Waiau River is that it was confiscated, which appears to be based on the erroneous assumption in the statement that it was part of the Mohaka-Waikare confiscation district. It does not appear appropriate to include this land within the inquiry district. The remainder of the Wai 436 claim area overlaps with the Wai 119 and Wai 436 claim areas. The third exception is Wai 168, which focuses on specific titles and sub-sections in the Waiohiki block, the nearby Waitanoa reserve, the Otatara Pa Historic Reserve and the lower Tutaekuri River. This land abuts on and in one respect (Otatara Pa) overlaps the Ahuriri block. The claimants have, however, defined their claim area more broadly in terms of their 'traditional' lands, which they say extend near or down to the Ngaruroro River and around the coast to include all of Napier and the southern part of Te Whanganui a Orotu. Nevertheless, their amended statement of claim alleges no specific grievances in respect of the additional area. The smaller pieces of land in respect of which relief is sought might therefore constitute a more appropriate claim area. Within this area one ambiguity remains to be clarified: to which channel of the Tutaekuri River below Otatara Pa the claimants assert ownership, the old channel through Maraenui to Te Whanganui a Orotu or the modem diverted channel to the coast. Three further issues remain to be briefly addressed, both concerning the definition of the inquiry district's southern boundary. First, the Crown has previously raised the question whether the interests ofhapu represented in the Wai 400 claim in land south of the Ahuriri block should be brought into the inquiry so as to achieve a more comprehensive consideration of the totality of their claims. [9] Such an approach is broadly reflected in the construction of the Wai 119 claim area, which is defined primarily in terms of Ngati Pahauwera's rohe and includes both the Mohaka and Waihua Crown purchases and the adjacent land later processed through the Native Land Court. 15 Mohaka ki Ahuriri claims mapping Page 9 have made it necessary to include a number of other existing and new claims, partly defeating the purpose of the extension. The second issue is the relationship between the areas of the Mohaka ki Ahuriri and Te Whanganui a Orotu inquiry areas. The latter Tribunal's Report on remedies took the position that 'recommendations should not be made on [the Wai 55] claim if overlapping claims exist and those claimants have not had the opportunity to be heard... We are satisfied... that no other claims to Te Whanganui-a-Orotu exist',rll] In so doing, it reviewed five areas of uncertainty: [12] Overlap with Wai 400: The Tribunal noted that the Wai 55 and 400 claimants had resolved any overlap between their respective claims and that Wai 400's amended statement of claim excluded Te Whanganui a Orotu in general and Roro 0 Kuri in particular. Te Pahou: The Tribunal referred to its detailed consideration in its 1995 report of the titling and alienation of the Te Pahou block, which included the important lagoon island ofroro a Kuri and two other islands, Te Ihu 0 Te Rei and Parapara. In its view, it was 'entirely appropriate that Roro 0 Kuri remains included within the Wai 55 claim area' and further that the two other islands be also included 'along with any other part of the Te Pahou block that is within the claim boundary'. Overlap with Wai 168: The Tribunal noted that despite including the southern part of Te Whanganui a Orotu within their 'traditional' boundaries, the Wai 168 claimants had explicitly excluded it from their request for relief. Pukemokimoki: Reviewing previous evidence and argument, the Tribunal noted that the English translation of the Ahuriri deed referred to the wahi tapu Pukemokimoki as 'the only portion of Mataruahou reserved for ourselves'. The wording implies that it was regarded as part of the transaction but reserved from the sale. The Tribunal concluded: 'Accordingly, we exclude the area ofpukemokimoki from the claim area. 16 Mohaka ki Ahuriri claims mapping Page 10 that remedial action for the loss ofpukemokimoki will be addressed by the Wai 400 or Ahuriri block claimants'. The southern lagoon boundary: Pointing out a difference between its 1995 estimate of 9,500 acres for the 'pre-european settlement state' ofte Whanganui a Orotu and the 8,959 acres within the 'defined boundary' agreed between the Wai 55 claimants and the Crown, the Tribunal concluded that 'the difference can be explained by how much of the swamp and mudflats in south Napier are included'. It accepted that the Crown/claimant boundary 'should be used to define the claim area for the purposes of this report'. It would clearly be inappropriate for any definition of the Mohaka ki Ahuriri inquiry boundary either to overlap with any part of the Wai 55 claim area as defined by the Te Whanganui a Orotu Tribunal, or to leave any gaps between their adjacent areas. This guideline, if adopted, would have three particular implications: The Wai 55 claim area would define the boundaries of the adjacent Wai 168,400 and 299 claim areas. Wai 299's intended inclusion of the Te Pahou block within its claim area would be interpreted to excluded the three lagoon islands. Pukemokimoki would fall within the inquiry district. The final issue concerns land within the district that is not subject to claim. The recent clarification by the Wai 299 claimants that they intend to extend their claim to the Te Pahou block means that the entire area between the southern Ahuriri and northern Wai 119 claim area boundaries is now subject to claim. The only remaining area of uncertainty is the coastal zone in and south of Napier. This land forms a major part of the rohe claimed by Wai 168 and identified as their claim area. In addition, they lay a specific claim to one or both of the channels of the Tutaekuri River.

17 Mohaka ki Ahuriri claims mapping Page 11 With that exception, however, neither Wai 168 nor any other claimant has yet asserted particular grievances relating to the area. One view might be that since substantial research has been available for some considerable time, interested parties have had adequate opportunity to articulate and present claims should they have wished to do so. If that view is accepted, an appropriate southern district boundary might run from the Waiohiki block along the old channel of the Tutaekuri and PapakuralWhataangaanga No.2 block boundaries to the coast at Awatoto Station. This area would include the Crown purchases of the Tutaekuri block and land adjoining Mataruahou in and of the Tutae 0 Mahu and Te Whare 0 Maraenui blocks in 1867 and 1869 respectively. Unlike much of the land on the Heretaunga plains, these sales were to the Crown.[13] The area was, moreover, part of the swamp, river drainage and water transport system leading into Te Whanganui a Orotu. Today, it would have the practical advantage of including within the inquiry district the large suburban and commercial sections of Napier and Taradale that do not fall within the boundary of the Ahuriri block itself. Alternatively, it could be argued that the land immediately to the south of Napier has much in common historically with the Heretaunga plains. As a focus of settlement and resource use, it was subject to intense and complex hapu patterns of association, which tended to be aligned along the principal river and coastal lines of communication rather than occupy the contiguous blocks surveyed for titling and alienation. The fact that leading rangatira and hapu had interests both here and on the plains suggests that these lands may well become the subject of new claims when the Tribunal's Heretaunga district inquiry gets under way. A further practical consideration is that since an explicit southern boundary was not fixed at the outset of the inquiry, the attention and efforts of potential claimants may have been focused on adjacent claims already grouped for hearing. This alternative view would suggest a cautious approach which would keep open the chance for any claims on the land south of Napier to be heard under a future Heretaunga district mquiry. In conclusion, the preceding review suggests that the Tribunal adopt an inquiry district boundary that encloses the Wai 119, 299 and 400 claim areas, plus the land specified in the Wai 168 statements of claim that lies outside the Wai 400 claim area (Waiohiki block, Waitanoa). The boundary would thus include Te Taha (Western Spit) and Mataruahou (Scinde Island) as parts l3 Waitangi Tribunal, Te Whanganlli-a-Orotll report 1995, (Wellington: Brookers, 1995), pp.80-6.

18 Mohaka ki Ahuriri claims mapping Page 12 of the Ahuriri Crown purchase, together with Pukemokimoki. Excluded would be the inland part of the Wai 436 claim area beyond the Waiau River. Also excluded would be Te Whanganui a Orotu (including the three lagoon islands), on which the Tribunal has previously reported. The question whether the area south of Napier should be included or not may require further consideration.

19 Mohaka ki Ahuriri claims mapping Page Information on Claim Boundaries The following sections are arranged in Wai number order. For each claim they describe the information used in this report for defining the claim area; analyse and interpret the information; and suggest the boundaries which might appropriately be adopted to define the claim area for the purposes of the Mohaka ki Ahuriri inquiry. The text avoids detailed referencing to statements of claim, which are listed at the front of the report. 3.1 The Wai 119 Claim In their third amended statement of claim (Wai (c)) the claimants say that they represent the descendants and rightful successors of the rangatira and those people of Ngati Pahauwera who were the tangata whenua and exercised rangatiratanga principally over the claim area set out in the map attached to this Statement of Claim ("the claim area"). The marked area includes the Mohaka and Waihua Crown purchases and ten blocks lying between them stretching from the coast inland to Maungataniwha. The claimants also 'note that their influence and rangatiratanga also extends beyond this area'. This extension is presumed to include parts of the Mohaka-Waikare confiscation district, regarding which they have submitted a joint memorandum with other claimants in Wai 299.[14) The memorandum states that 14 Joint memorandum on behalf of all claimants in Wai 299, unsigned, faxed 5 November 1998 (Wai ).

20 Mohaka ki Ahuriri claims mapping Page 14 b) The Wai 299 claim committee (of the Maungaharuru Tangitu Society Inc) on behalf of all the Wai 299 recognises that Ngati Pahauwera have a beneficial interest in the Wai 299 claim area. c) The parties acknowledge and agree that the nature of the Ngati Pahauwera beneficial interest in the Wai 299 claim area is by way ofwhanaungatanga and whakapapa connections and by direct interests held by specific Ngati Pahauwera whanau in specific blocks between the Waikare and Esk Rivers. The memorandum does not provide sufficient detail to allow the Ngati Pahauwera interests between the Waikare and Esk Rivers to be geographically defined and they have therefore not been mapped for the purposes of this project. Accordingly, it should be borne in mind when viewing the Wai 119 boundary line that all claimants in the Wai 119 and 299 claims acknowledge that such interests exist. The map attached to the amended statement of claim provides the most appropriate basis for drawing the boundary of the claim. The map includes the 1851 Mohaka Crown purchase, the 1864 Waihua Crown purchase and ten Native Land Court blocks between and inland of the two Crown purchase blocks. 3.2 The Wai 168 Claim In their amended statement of claim dated 1 December 1996 (Wai (c)), the claimants identify themselves as 'the hapu ofngati Paarau and Ngati Tahuahi'. It states that the two hapu are associated with Waiohiki Marae and Otatara Pa and Hikurangi Pa and certain land and entities over which they exercise rangatiratanga or legal ownership or both and being described in this Statement of Claim as the subject matter ofthis claim and which is declared to be taonga of theirs. The statement identifies 'land and other entities being taonga of the claimants' as falling into two overlapping categories, which distinguish 'the context in which they arise' from 'land and other entities [which] are to be specifically the subject of the claimants' prayer for relief. The first or contextual category comprises:

21 Mohaka ki Ahuriri claims mapping Page 15 (i) Otatara, Hikurangi and surrounds (ii) The Tutaekuri River (iii) Te Whanganui a Orotu (iv) Pania (v) Te Pakake, Pukemokimoki, Te Whare 0 Maraenui (vi) Waiohiki Reserve The statement adds the qualification that 'no prayer for relief is sought regarding Te Whanganui a Orotu'. The claimants have indicated that they regard their claim area as being defined by their 'traditional boundaries', which they have marked on maps filed in support of their claim.[15] This area includes most of Napier and Taradale, the southern end of the former Ahuriri lagoon, and the land between Waiohiki, the Ngaruroro River and the coast. It appears to extend a little more widely than the area described as 'context', in particular towards the coast south of Napier and into land south of the Tutaekuri River. The statement of claim proceeds to list a set of land parcels as being 'the subject of the Claimants' Prayer for Relief: 1. Waiohiki IB, 1D & IE. 2. '... certain lands, namely within or without block IE (respectively the "quarry" and "gravel pit"). 3. 'Otatara and Hikurangi and surrounds'. 4. 'The Tutaekuri River... as within the claimant's traditional boundary'. Four Hawke's Bay CTs (108/110,85/296,85/285, ElI1223), plus the river, are given as defining the above areas. Omitted are a number ofwaiohiki partitions (la, 1C, 2 and 3). 'Otatara and Hikurangi and surrounds' specifies an area on the north bank of the Tutaekuri within the 1851 Ahuriri Crown purchase and appears to refer to the land parcels within the present Otatara Pa Historic Reserve. The stretch of the Tutaekuri River deemed to fall 'within the claimant's traditional boundary' is defined as running 'from its mouth or points at the sea to Otatara Pa and at a point on the river IS In particular, Map of the city of Taradale-Napier, 1997, (Wai 201 N25(d)).

Unfortunately the amended statement does not indicate whether it refers to the modem or old channels, which have differed radically below the eastern comer of the Waiohiki block since the diversion scheme implemented in the 1930s. Whereas the present channel cuts eastwards to the coast, the old channel turned northwards through Maraenui into Te Whanganui a Orotu. The amended statement's references to taonga, to ownership and to exclusion from the 1851 Ahuriri Crown purchase imply that the claimants' interest is primarily in the course of the old channel. A further amendment to the statement of claim (Wai (e)) extends it to include the Waitanoa block, a small section of the adjacent Papakura block that was excluded from the latter's sale to the Hawke's Bay Provincial Council. The claimants state that they identify the area of their claim with their rohe. However, the area within which they seek relief is limited to Waiohiki, Otatara and Hikurangi and surrounds, Waitanoa and the lower Tutaekuri River. It is this smaller area that is the focus of grievances articulated in the amended statement and in evidence previously presented to the Tribunal. The 'traditional boundaries' as defined by the claimants specify the area that sets the 'context' of the claim and that meets the criteria of this report for indicating the claim area. It should be noted, however, that the area subject to detailed statements of grievance and claims for relief is smaller and is defined with reasonable precision. 3.3 The Wai 191 Claim The claimants describe themselves as 'the proprietors of the Tarawera C9 Block which is the remnant of the original Tarawera Block'. Their statement of claim (Wai ) refers principally to the confiscation of the land and asks the Tribunal to recommend 'that all confiscated land within the district stated above be returned to its owners'. These statements may be interpreted as indicating that the boundary of the claim is that of the Tarawera block as a whole, including those parts retained by the Crown under the 1870

23 Mohaka ki Ahuriri claims mapping Page 17 agreement (Tarawera Crown block[16], Te Haroto rural sections, the Te Haroto block and the Mohaka Ferry Reserve). 3.4 The Wai 216 Claim In their amended statement of claim (Wai (c)) the claimants say that they are 1....members of the Te Matai Lands Trust and are authorised by the Trust Board to make this claim on behalf of the beneficiaries of the Te Matai Lands Trust. 2. The beneficiaries are affiliated to the Tribes oftutemohuta, Hineuru and Kahutapere. The amended refers to 'the wrongful confiscation ofte Matai and Pakaututu Blocks in 1867'. It later states that 'the claimants claim that both parcels of land now known as Te Matai and Pakaututu were initially one block and were customarily owned and occupied as one block'. The January 1867 confiscation included all ofpakaututu and most ofte Matai, excluding only the small area outside the Hawke's Bay provincial boundary which became Te Matai No.1. The two original surveyed blocks, Te Matai and Pakaututu, may be taken as defining the claim area. 3.5 The Wai 299 Claim Identical third amended statements of claim (Wai (c) & (d)) have been submitted by Ngati Pahauwera and by Ngati Hineuru, Ngati Tu, Ngati Kurumokihi and Ngai Tatara. As the joint memorandum recently submitted by all claimants confirms, they can be treated as one.[17] They state that the claimants 'were the tangata whenua and exercised tino rangatiratanga over the land now described as the Mohaka Waikare block'; and further that 'the Claim relates to the areas of land, lakes and rivers and other resources in the area now described as the Mohaka 16 Although commonly described as Tarawera Reserve, the land was never accorded reserve status and became waste land of the Crown. 17 Joint memorandum on behalf of all claimants in Wai 299, unsigned, faxed 5 November 1998 (Wai ). The claimants agree that 'a Fourth Amended Statement of Claim will be filed on behalf of the Wai 299 claimants which will include Ngati Pahauwera as set out in this memorandum'.

24 Mohaka ki Ahuriri claims mapping Page 18 Waikare block'. They refer further to the confiscation of 'the Mohaka-Waikare Block' under the New Zealand Settlements Act 1863 and amendments. Counsel for Wai 299 also indicated verbally that Te Pahou was included and that the claimants would amend their statement of claim accordingly. Several complications arise in determining the appropriate boundaries of the Mohaka-Waikare confiscation district, since those boundaries changed in a number of places at different times. Furthermore, the maps presented by the claimants[18] do not accurately represent the boundaries of the confiscation district. The following points of interpretation are noted: The district includes the Moeangiangi Crown purchase. The status of the Petane block title was anomalous. It passed the Native Land Court in August 1866 and a Crown grant was issued to its 10 owners the day before (11 January 1867)l19] it was included within the area confiscated by proclamation, which was defined to the south by the course of the Waiohinganga (Esk) River. It was not listed in the 1870 agreement as one of the blocks either retained or returned by the Crown and was subsequently treated as lying outside the confiscation district. Since it was unambiguously located within the confiscation boundary described by the wording of the 1867 proclamation, it is here included in the confiscation area. The status of the Te Pahou block, on which is situated the present-day Bay View, has an element of ambiguity. The uncertainty concerns which channel of the Waiohinganga River was recognized as the boundary near its mouth, its old course turning south parallel with the coastline and entering Te Whanganui a Orotu, or its modem outlet through the coastal bar direct into the sea. The January 1867 confiscation proclamation ostensibly included all the area between the Ahuriri and Mohaka Crown purchases and its author, Donald McLean, had also negotiated the Ahuriri Crown purchase which defined the block boundary as running along the old channel. It might be presumed that his intention was to include Te Pahou, a small strip of coastal land that would otherwise have formed the only exclusion from Crown purchase or confiscation in the entire 18 Mohaka-Waikare confiscated lands mapping. 25 Mohaka ki Ahuriri claims mapping Page The Wai 318 Claim The claimant refers to 'the wrongful disposition of the lands mentioned below by the Maori Land Court and by the Crown' (Wai ). Included in the list alongside blocks outside the inquiry district are 'Tarawera Block C' and 'Tataraakina Block 1'. Tarawera C was formed in 1953 out of the remaining Maori-owned land in the Tarawera block when the title was overturned by legislation and after two small partitions were passed as Tarawera A and B. There has never been a title known as Tataraakina J; the claimant may possibly have intended to indicate Tataraakina C, the current parent title, which was also formed in 1953 in the same circumstances as Tarawera and later had two small partitions cut out. In an amended statement of claim (Wai 1.48(b)) the claimant clarifies his interest as being in three specific former partitions: Tarawera 11, Tarawera 10C4A and Tataraakina 12. These partitions were made in the 1920s and abolished by the title revision in Only those parts of the claim concerning lands within the Mohaka ki Ahuriri district have been aggregated into this inquiry. The claim area thus comprises the three partitions indicated in the amended statement of claim. 3.7 The Wai 400 Claim In their amended statement of claim (Wai ( d)), the claimants say that they represent the descendants and rightful successors of the rangatira and those people ofnga Hapu o Ahuriri who were the tangata whenua and exercised rangatiratanga principally over the claim area set out in the map attached to the Statement of Claim... The claimants note that their influence and rangatiratanga also extend beyond the claim area. The map attached to the statement is a copy of the original 1851 survey sketch map of the Ahuriri Crown purchase lodged with the deed of sale. This map is itself controversial in respect of its marking of the coastal boundary of the purchase block, which it takes along the shoreline, thus including Te Whanganui a Orotu, and southward ofmataruahou (Scinde Island) before branching inland. Exactly which land around Te Whanganui a Orotu was included in the sale, as well as the status of the lagoon itself, is a complex issue which received detailed discussion in the Tribunal's

26 Mohaka ki Ahuriri claims mapping Page The Wai 430 Claim The statement of claim (Wai ) refers to the 'Rawhiti Block', in which, it states, 'by 1936 the Crown had acquired a major part'. In 1936 the Crown's interests were consolidated, which 'entailed a transfer of some Maori owners to areas outside of the Rawhiti block'. The Crown is also said to have acquired additional parts under Part XXIV of the Maori Affairs Act The statement of claim refers to 'two research reports' submitted with the claim. These reports contain a large quantity of copies of primary records, recent correspondence, extracts from secondary sources and the claimant's own analysis and descriptive notes. It is not possible to determine with confidence from this material precisely what land is subject to claim. However, a 1993 DOSLI cadastral plan supplied to the claimant refers to the 'Rawhiti Station' and has its boundaries drawn thereon by marker pen. This area embraces a number of consolidated partitions in the northern part of the Mohaka block, east of the Mohaka River. Counsel for Wai 119 has notified the Tribunal by letter that 'Wai 430 comes within the umbrella and is represented by Wai 119' y2j The Wai 430 claim area falls wholly within the Wai 119 claim area. Under these circumstances, it is not considered appropriate to produce a separate map of the Wai 430 claim area. The claim area may be interpreted as comprising the Rawhiti Station. 3.9 The Wai 436 Claim The statement of claim (Wai ) says that 'we the descendants ofngai Tane were alienated and dispossessed from the lands on which the Mohaka Forest grows today'. The state-owned Mohaka Forest covers large tracts stretching from the Waikare River to the middle Mohaka River and down its northeastern side to the coast. It occupies the inland section of the 1851 Mohaka Crown purchase and parts of the Putere, Whareraurakau, Mohaka and Waihua Native Land Court blocks. 22 Letter from WaIters Williams & Co, counsel for Wai 119,21 October 1998.

27 Mohaka ki Ahuriri claims mapping Page 24 An amended statement of claim presented in November 1998 (Wai (a» has attached to it two maps, on the first of which is marked the area affected by the claim, labelled 'Ngai Tane's rohe'. The boundaries include a corridor stretching northeastwards from Lake Tutira across the inland Mohaka Crown purchase, Maungataniwha and adjacent blocks to the vicinity of Lake Waikaremoana. The section beyond the Waiau River lies outside the Wai 119 claim area. The map leaves undefined the northeastern boundary towards Lake Waikaremoana. The amended statement identifies the claimants as 'Wi Te Tau Huata for and on behalf ofngai Tane... ' and relates them to the area marked on the map: The claimants represent the whanau and hapu who traditionally had mana whenua over significant portions of the land generally known and the Mohaka Forest in Wairoa, and other land extending in a band from Lake Tutira north to Lake W aikaremoana... Although not explicitly stated, it appears that the claimants regard this rohe as their claim area. The amended statement divides the area into four parts, which are marked on the second map: the inland Mohaka Crown purchase block; a section of the Mohaka-Waikare confiscation district; the Putere and Maungataniwha blocks; and the area northeast of the Waiau River, categorised as confiscated land. The amended statement refers only briefly to the two areas of alleged confiscation, saying only that: In January 1867, as a result of alleged pai marire rebellion in the area, lands totalling 270,000 acres were wrongfully confiscated from Maori owners. It then implies that 'the land wrongfully confiscated from Ngai Tane' was part of this area. The reference appears to be to the Mohaka-Waikare confiscation district, in which case the description ofland northeast of the Waiau River as also confiscated would be in error. The latter land is not mentioned elsewhere in the amended statement. The boundaries indicated on the maps attached to the amended statement of claim may be interpreted as the claim area. It should be noted, however, that the only grievance alleged in respect of land northeast of the Waiau River appears to be mistaken as to the applicable area.

The Tataraakina 2 and 5 partitions were ordered in 1923 and abolished in 1953 when the title was overturned by legislation. The claim area comprises the former Tataraakina 2 and 5 partitions The Wai 602 Claim The statement of claim (Wai ) is headed 'the Tataraakina No.6 block claim' and the claimants say they represent 'the beneficiaries of Tataraakina No.6 block'. The Tataraakina 6 partition was ordered in 1923 and abolished in 1953 when the title was overturned by legislation. The claim area comprises the former Tataraakina 6 partition The Wai 608 Claim The statement of claim (Wai ) is headed 'the Tataraakina No.9 block claim' and the claimants say they represent 'the beneficiaries of Tataraakina No.9 block'. The Tataraakina 9 partition was ordered in 1923 and abolished in 1953 when the title was overturned by legislation. Claimant counsel has clarified that the statement should refer to Tataraakina 8 and not 9.[23] The claim area comprises the former Tataraakina 8 partition The Wai 627 Claim The claimant states that he lodges his claim 'for and on behalf of those people who can establish recognised descent from Rewi Haukore' (Wai ). He requests the Tribunal to 'investigate 23 Letter, 1 October 1998.

29 Mohaka ki Ahuriri claims mapping Page 27 the Tataraakina lands in that our ancestor Rewi Haukore was named in the title of 1870' and states that' legislation has left Rewi Haukore out of Tataraakina...'. The claim area is interpreted as comprising the whole of the Tataraakina block The Wai 638 Claim The amended statement of claim (Wai 201 I.SI(a)) was submitted 'on behalf of Ngati Hineuru whanau claimants', who it indicates represent the tipuna and rightful successors of those people of Ngati Hineuru who were the tangatawhenua and exercised rangatiratanga over the land now described as the Tataraakina Block. It goes on to state that The claim relates to the areas of land, lakes and rivers and other resources in the area now described as the Tataraakina Block. The claim area comprises the whole of the Tataraakina block The Wai 639 Claim The claimant states (Wai ) that this claim 'replaces Wai 491 lodged by the Waimakuku Whanau Trust and that he acts on behalf ofthe descendants of Pane Te Kanga who are the past owners of the land acquired under sao ofthe Public Works Act in the Tarawera Township... which was used to establish the former Ministry of Works Depot. The statement describes the land to be acquired as 'eighteen quarter acre sections... and other parcels of flat land totalling 9 acres..., situated east and west of SHS at Tarawera'. It refers to a later 'offer back' of the whole Depot site for repurchase and a mortgage which the claimants held and then were obliged to relinquish over the land.

30 Mohaka ki Ahuriri claims mapping Page 28 The Ministry of Works Depot was located on confiscated land retained by the Crown under the 1870 agreement and on parcels at the southern end oftarawera Township, a paper rural township which was surveyed in 1873 into town and suburban sections. During the mid-1970s, the Ministry of Works expanded its Depot site by combining land already in state ownership with purchases from Pakeha and Maori owners of most of the quarter acre town sections either side ofsh5. The state of the title as of late 1997, following the repurchasing transactions of the early 1990s, appeared to be as follows: All state-owned land east of the road had been amalgamated into a single Highway Depot title (P1I543), which was now in the formal ownership of the Waimakuku Whanau Trust Board. The purchased town sections west of the road remained in state ownership and designated for Highway Depot purposes. The suburban section behind the western town sections remained as it had been since 1945, in state ownership and designated for a 'roadman's cottage'. The relief sought by the claimants refers only to the property east of the road subject to repurchase and mortgage. However, the town sections purchased from them by the Ministry in the 1970s were all west of the road. The claim area is interpreted as comprising the Highway Depot title east of SH5 (P1I543) together with the nine town sections west of the road that were purchased from Maori, including members of the Baker whanau, by the Crown in the mid-1970s The Wai 692 Claim The three named claimants state that they act 'for ourselves and Te Taiwhenua 0 Te Whanganui a Orotu and the Peoples within the Ngati Kahungunu Tribal region' (Wai ). It should be stressed that the claim is unique amongst the claims before the Mohaka ki Ahuriri Tribunal in

31 Mohaka ki Ahuriri claims mapping Page 29 that the grievances it states do not relate to land but the loss of 'hospital services and facilities from the present hill site on Mataruahou'. The amended statement of claim (Wai (a)) does not indicate a precise claim area but refers to a fundamental breach of the Agreements entered into between our tipuna and the Crown to provide a hospital and associated services for the people of the region from the site of Mataruahou. A number of different interpretations of the applicable 'region' are possible. For the purposes of this report, it has been loosely defined as the approximate catchment area within which descendants of the hapu involved in the 1851 Ahuriri Crown purchase used the services of Napier Hospital at the time of its closure. The Wai 692 claimants originally applied for urgency and it was only in November 1998, after the consultative phase of this mapping project had concluded, that the claim was consolidated into the regional inquiry (Wai ). They have not yet had adequate time to comment; furthermore, the research on their claim is still in progress and the claim itself has yet to be heard. The claim area adopted for this report is therefore provisional and tentative and awaits claimant input The Wai 731 Claim The claimant states (Wai (a)) that he acts for 'the descendants of Hen are Taka Kupa' and that all the "Kupa descendants" have been adversely disadvantaged and alienated from our turangawaewae by the Crown due to the Mohaka Consolidation Maori Scheme... His amended statement of claim does not define a specific claim area, referring instead to 'the Mohaka lands more particularly set out in the map annexed to the Amended Statement of Claim filed in Wai 119'. The Wai 731 amended statement does refer to 'the land in which they had an interest including the Mohaka, Waipapa, Waihua, Whareraka [Whareraurakau] and Putere

32 Mohaka ki Ahuriri claims mapping Page 30 blocks' and later to 'part of the Kupa whanau interests in Mohaka 40, Mohaka 42, Mohaka 43, Whareraurakau 3A and Putere IB3'. The landed interests of Henare Taka Kupa formed a sub-set of a larger cluster of land parcels owned by members of the Kupa whanau before and after the title consolidation of Since the statement of claim refers specifically to Henare Taka Kupa, his interests have been taken as the reference point for identifying the claim area. Those interests comprised a number of sections, many of them small, which both before and after consolidation were scattered across the consolidation zone, mainly in the Mohaka, Waihua and Waipapa blocks.[24] These three blocks are taken to define the general area of the claim but it should be borne in mind that the claim refers only to specific sections within that area. As the amended statement indicates that Kupa whanau affiliates to Ngati Pahauwera, its interests in early colonial and pre-colonial times, which extended over a much larger terrain, are taken to be represented by the Wai 119 claim.
