The services and arrangements contained in this Tariff item and related MTS Allstream tariffs and agreements are made available only to: 1) ommission-approved ompetitive Local Exchange arriers (LE), and 2) Digital Subscriber Line Service Providers (DSLSPs), who can lease unbundled local loops (see 4.B.1) below) connecting links and collocation to provide only digital subscriber line based applications such as high speed internet access, Local Area Network extensions, and Voice over Internet Protocol (VoIP), not operating as a LE. B. The services and arrangements specified in this Tariff item and related MTS Allstream tariffs and agreements, which are provided to a LE, or DSLSP, will be billed to and payable by the LE.. The services contained in this Tariff item for S7 Transiting Services (S7 signalling messages) are based on existing S7 interconnection arrangements. D. Insofar as they are reasonably applicable and not inconsistent with this Tariff item, all other MTS Allstream tariffs, including any amendments to or replacements of them, extend and apply to this tariff item. The General Regulations or Terms of Service of MTS Allstream including any amendments to or replacements of them, apply to this tariff item, with such modifications, as the circumstances require. E. Subject to the terms, conditions, rates and charges set out in applicable tariff(s) for co-location, other tariffs and agreements as may be applicable and, where MTS Allstream s facilities permit, a LE may, except where expressly prohibited by MTS Allstream s tariffs: 1) Interconnect their local services and facilities to MTS Allstream's services and facilities, offered under this Tariff item, subject to availability of MTS Allstream's services and facilities; 2) Resell or share any of the MTS Allstream's services and facilities; 3) Provide local exchange telephone services; and, 4) Provide service to its customers, which incorporates interconnection to the Public Switched Telephone Network (PSTN), using its own facilities, MTS Allstream's facilities or the facilities of another facility provider. F. Interconnection with LEs will be made on a per Local Interconnection Region (LIR) basis. The only exception will be for LEs who are interconnected with MTS Allstream on a per-exchange basis as of the effective date of May 29, 2006, in which case, moves, additions and changes will be permitted within these exchanges to the extent permitted by the Master Agreement for Interconnection between the LE and MTS Allstream. Analogue Transmission is a telecommunications transmission which uses continuous signals to carry information. M B. Band is a collection or categorization of the MTS Allstream's exchanges or entral Office odes (NXXs) which may also be called Rate Band.. Bill and Keep is a process whereby the originating Local Exchange arrier (LE) bills its end-customer for the call and keeps the corresponding revenues; the originating LE does not compensate the terminating LE for call termination expense. D. S7 ross-onnection is the MTS Allstream-provided cross connection between the gateway STP connection and S7 link transport facilities. E. entral Office Building (O Building) is the premises which houses MTS Allstream s local switching equipment, and may also house toll switching equipment and co-located competitor transmission equipment. F. entral Office ode (NXX) is the second set of three digits of a ten-digit telephone number (i.e., NPA-NXX-XXXX) which identifies the local switching office (a 3-digit identification code). G. ompany Loop Termination (OLT) is the end point of the MTS Allstreamprovided transmission path which terminates at the MTS Allstream's distribution frame or other designated distribution device located in MTS Allstream s central office building or equivalent. H. entral Office Switch (O Switch) (may be referred to as a lass 5 or Local Switch) is the local switching equipment which connects to local end-customer lines and which enables end-customers to make and receive calls to and from other end-customers within the local calling area of their exchange and to access message toll services of MTS Allstream and Interexchange arriers. The O Switch is associated with one or more O codes (i.e., NXX codes). I. ompetitive Local Exchange arrier (LE) is a ommission-certified provider of local exchange service other than MTS Allstream. K. ommon Language Location Identifier (LLI) is an alphanumeric code used to identify physical locations and equipment, such as building, wire centres, poles and central offices. L. ustomer Network Interface (UST-NI) is the point of termination or demarcation of a local loop specified in the Tariff item for primary exchange service. M. "Digital Subscriber Line Access Multiplexor (DSLAM)" is a generic reference to the multiplexors provisioned for the purpose of providing MTS Allstream ADSL Access Service Special Services and Facilities Tariff Item 5800, including those provisioned within central office buildings, wire centres, remote switching facilities and standalone cabinets. N. "Digital Subscriber Line Service Provider (DSLSP)" is a provider of digital subscriber line based applications, such as high speed internet access, Local Area Network extensions, and VoIP, not operating as a LE. O. Digital Transmission is a telecommunications transmission which uses noncontinuous signals to transmit information. P. "Distribution Serving Area (DSA)" is a basic geographic area within a wire-centre area for the administration and furnishing of telephone service. There may be one or more DSAs within a given wire-centre area. DSA boundaries do not overlap one another. Q. "DS-0 Set" - a group of DS-0s which are of the same type (i.e., Feature Group D, Feature Group B, or 800/888) within the same DS-1, connected at the same location and ordered at the same time. R. End-customer is the ultimate user of all telecommunications services sold on a retail basis by LEs, DSLSPs, APLDS or MTS Allstream. S. Exchange is a basic geographical area for the administration and furnishing of telephone service, and normally includes a city, town or village and adjacent areas. The territory served by an exchange, within which local service rates apply, is known as the exchange area. See also Local alling Area. Interexchange arrier (IX) is a anadian carrier, as defined in section 2 of the Telecommunications Act, which provides interexchange services and is not MTS Allstream. U. Local alling Area is an area defined by MTS Allstream, wherein calls can be made by MTS Allstream's customers without the application of interexchange toll charges. A local calling area includes one or more exchange areas. See also Exchange. V. Local Interconnection Region (LIR) is a geographical area specified by MTS Allstream within which traffic is exchanged with LEs on a Bill and Keep basis as set out in Telecom Decision RT See Item W. Local Loop is a MTS Allstream-provided transmission path between, and including, the UST-NI located at the end-customer s premises and the OLT. X. Multi-Dwelling Unit (MDU) is a building with at least two units and at least one unit is occupied by a tenant. Y. Numbering Plan Area (NPA)" is also known as Area ode. An NPA is the 3-digit code that occupies the A, B, and positions in the 10-digit North American Numbering Plan (NANP) format that applies throughout the NANP serving area. NPAs are of the format NXX, where N represents the digits 2-9 and X represents any digit 0-9. In the NANP, NPAs are classified as either geographic or nongeographic. Z. Premises is the continuous property and the building or buildings located thereon, or the part or parts of a building, occupied at the same time by an endcustomer, a LE, or a DSLSP. AA. BB.. Reseller is a person engaged in resale, with or without adding value of a telecommunications service leased from an IX or from MTS Allstream. Signalling Point of Interconnection (SPOI) is a location specified by MTS Allstream at which LEs may choose to obtain D-link or A-link S7 interconnection Signal Transport Point (STP). Signal Transport Point is a packet switching point in the S7 Network which routes S7 signalling messages towards the intended network element. Trunk is a DS-0 time slot or channel within the MTS Allstream-provided digital connection between the trunk-side of MTS Allstream s local switch and the ross- onnect panel used to provide interconnection arrangements. Trunk Group is a group of equivalent trunks. M # # 3. TERMS AND ONDITIONS A. General 1) MTS Allstream will provide the elements of local network interconnection and component unbundling subject to the availability of suitable facilities. 2) A LE or DSLSP may subscribe to Local Loops within a single O building. 3) A DSLSP shall not use this arrangement to provide switched local voice services. 4) MTS Allstream does not make any representation that the services in this Tariff item, or related MTS Allstream Tariffs, shall at all times be available in the quantities requested and at the locations specified by the LE or DSLSP. MTS Allstream shall, however, make every reasonable effort to make such services available on request. 5) If a LE or DSLSP cancels an application for service after MTS Allstream has incurred costs associated with the provision of the service, the LE or DSLSP shall pay MTS Allstream all incurred costs. 6) The type, location and timing of facilities to provide the elements of this Tariff item must be specified, at the time of the order, by the LE or DSLSP. If the type, location or timing of facilities is changed by the LE or DSLSP, any additional expense incurred will be charged to the LE or DSLSP. 7) Responsibility for services provided by MTS Allstream to a LE may be assumed by another LE or DSLSP. The assuming LE or DSLSP of record shall be responsible for payment of all unpaid rates and charges incurred by the LE or DSLSP from whom it assumes the services and facilities. General continued 8) The elements of local network interconnection and component unbundling are provided in accordance with the specifications, interfaces and parameters described in this Tariff item and applicable technical references. MTS Allstream s primary obligation under this Tariff item is to provide local network interconnection and unbundled network components in accordance with such specifications, network interfaces and parameters. MTS Allstream does not warrant that its local network interconnection and unbundled network components are compatible with any specific facilities or equipment or can be used for any particular purpose or service. LEs or DSLSPs ordering unbundled network components are responsible to obtain and provide facilities and equipment that are compatible with such unbundled network components. 9) Traffic imbalance may occur for traffic that is interchanged between a LE and MTS Allstream over designated Bill and Keep trunks. For LIR based interconnection, commencing immediately after a LE s commercial launch date set by the ommission, once an imbalance is detected (in the case of exchange based interconnection, commencing six months after commercial launch, once imbalance is detected for three consecutive months on specific trunk group(s)), MTS Allstream will notify the LE of the imbalance. The monthly rates will be applied on the basis of actual traffic imbalances from the date of notification for as long as the imbalance exists. Billing would commence one month from the date of notification. 10) EAS transport and termination, transit, toll originating, and Message Reply Service traffic are on separate trunks. 11) Services provided under the terms and conditions of this Tariff item will be maintained in accordance with the technical references. 12) The provision of local network interconnection and component unbundling outlined in this Tariff item does not constitute a joint undertaking with the LE or DSLSP in the furnishing of any service. 13) In the furnishing of services in this Tariff item, MTS Allstream is not responsible to the LE or DSLSP or the LE s or DSLSP's endcustomers for end-to-end service. 14) The LE or DSLSP will furnish or arrange to furnish to MTS Allstream, at no charge, adequate equipment space and electrical power required by MTS Allstream to provide the connections under this Tariff item at the LE s premises, or at the LE's end-customer s premises, as appropriate. Network and Facilities hanges 15) Subject to limitations imposed in paragraph E, any facilities and services of MTS Allstream required by a LE, or DSLSP, for the purpose of resale or sharing may be acquired through any of MTS Allstream s Tariffs including this Tariff item. 16) The LE or DSLSP will furnish or arrange to furnish to MTS Allstream, at no charge, any additional facilities or protective apparatus that may be required to protect against any hazards associated with the particular nature or location of the connections. 17) When it is necessary for MTS Allstream to install special equipment or to incur unusual expense in order to meet a LE s or DSLSP's requirements, an additional charge may be assessed based upon the equipment installed or the expense incurred. # # # B. Network and Facilities hanges 1) MTS Allstream does not make any representation that its equipment, facilities and services are, or will remain, adapted for use in connection with LE or DSLSP equipment, facilities and services. 2) MTS Allstream reserves the right to change, in whole or in part, the design, function, operation, technology or layout of its equipment, apparatus, lines, switches, circuits, and devices as MTS Allstream, in its sole discretion, considers necessary. MTS Allstream shall not be responsible to the LE or DSLSP or the customers of the LE for their equipment, apparatus, lines, switches, circuits, devices, in whole or in part, which cease to be compatible with MTS Allstream facilities or which become inoperative because of such changes to MTS Allstream s equipment, apparatus, lines, switches, circuits, devices or other components. 3) MTS Allstream, the LE, and the DSLSP will each provide network-tonetwork notification to the other party in accordance with the network-tonetwork notification requirements established by Telecom Letter Decision RT and prior to implementing changes to the design, function, operation, technology or layout of its equipment, apparatus, lines, switches, circuits or devices. Network and Facilities hanges - continued 4) MTS Allstream shall have the right to modify its exchange or LIR boundaries from time to time. MTS Allstream shall provide to the LE, no later than December 31 of each year, a forecast of exchange or LIR boundary changes which MTS Allstream anticipates will be implemented during the following calendar year. In any event, MTS Allstream shall provide to the LE not less than six (6) months prior notice of any exchange or LIR boundary affecting the territory served by the LE. 5) The LE or DSLSP shall not implement any change to its operations, services or network which would, in the reasonable assessment of MTS Allstream, materially affect MTS Allstream's operations, services or network, without the prior consent of MTS Allstream, which shall not unreasonably be withheld.. Network Outages 1) MTS Allstream will provide the LE with the earliest possible notice of all network outages affecting the operation of the LE's networks. 2) MTS Allstream does not guarantee uninterrupted working of its service and/or equipment and shall not be liable to the LE, or to any other entity, for any failure or delay in performance of any service provided pursuant to this, or any other MTS Allstream tariff or agreement, to the extent that such failure or delay is attributable to causes or results from events beyond MTS Allstream's reasonable control. Nothing in this Tariff item shall extend the liability of MTS Allstream, as specified in MTS Allstream s Terms of Service or General Regulations, in the event of network outages or other service problems. D. Protection 1) The characteristics and methods of operation of any circuits, facilities or equipment of the LE or DSLSP, when connected to MTS Allstream, shall not: a) interfere with or impair service over any facilities of MTS Allstream or its connecting carriers involved in its services; b) cause damage to its plant; c) impair the privacy of any communication carried over its facilities; or d) create hazards to MTS Allstream s employees or to the public. Protection - continued 2) If such characteristics or methods of operation are not in accordance with the proceeding, MTS Allstream will, where practicable, notify the LE or DSLSP that temporary discontinuance of the use of any circuits, facilities or equipment may be required. When prior notice is not practicable, nothing contained within this Tariff item shall be deemed to preclude MTS Allstream from temporarily discontinuing forthwith the availability to the LE or DSLSP of any circuit, facility or equipment if such action is reasonable under the circumstances. In cases of such discontinuance, the LE or DSLSP will be promptly notified and afforded the opportunity to correct the condition which gave rise to the temporary discontinuance. 3) During any period of temporary discontinuance of service caused by a trouble or condition arising in the LE's or DSLSP's operations, facilities or network, no refund for interruption of service, as set forth in MTS Allstream's Terms of Service or General Regulations, shall be made. 4) The DSLSP's equipment must be certified in accordance with the requirements detailed in General Tariff Item Use of ustomerprovided Equipment with MTS Allstream Facilities. 5) All equipment acceptable for interconnection with ompany facilities within a wire centre shall be limited to those equipment types identified in the National o-location Equipment List as amended and updated from time to time. Such equipment shall conform to the terms and conditions pursuant to the co-location tariffs and associated agreements as applicable. E. Transit Services 1) Transit Services provide the exchange of local and toll traffic via MTS Allstream's networks between two carriers subscribing to the service, conditional on the existence of a business arrangement between two carriers originating and terminating traffic with each other and evidence of this business arrangement being provided to MTS Allstream. a) Local Transit Service is provided within an exchange, LIR or EAS area via MTS Allstream s network. The carrier originating local transit traffic is responsible for providing the underlying facilities required to deliver the traffic to MTS Allstream on dedicated one-way trunk groups. MTS Allstream will terminate local transit traffic via bill and keep trunks established between MTS Allstream and LEs. Transit Services - continued b) Toll Transit service is provided between IX and LE on the condition that the toll traffic destined for LEs end-customers is delivered by the IX to MTS Allstream s designated toll transit Access Tandem. The IXs may deliver transit traffic to MTS Allstream on existing toll trunk groups or on separate transit trunk groups. In those areas where toll transit calls will terminate to LEs on exchange based bill and keep trunks, MTS Allstream may deduct from the Direct onnection charge billed by the LE, any imbalance payment associated with toll transit calls. c) S7 Transit Service provides for the exchange of S7 signalling messages via MTS Allstream s S7 network between two different carriers i.e. LEs, WSPs, and IXs conditional on the existence of a business arrangement between the two carriers exchanging S7 messages and evidence of this business arrangement being provided to MTS Allstream. A LE may subscribe to S7 Transit services if S7 interconnection is in place at a gateway STP. Basic and Enhanced S7 Transit services are provided between LEs, LEs and WSPs, and LEs and IXs conditional on the implementation of direct message trunking. S7 Transit to a ompetitive Local Number Portability Service ontrol Point (LNP SP) service provides for the exchange of S7 Transaction apabilities Application Part ( TAP ) messages with a competitive LNP SP service provider only. Specific functionality associated with a competitive LNP SP must be obtained directly from the service provider. A LE transiting S7 messages from a third party will also be charged for each carrier where appropriate. Remote Switching and DSLAM Information The ompany will provide a paper copy of the following information for each exchange requested in an order from a LE or DSLSP: 1) 8 digit LLI code for each wire center. 2) Wire center name. 3) Exchange name. 4) ivic address of each wire center. 5) Remote switch name (if available). 6) 8 digit LLI code for remote switch. 7) Identification as to whether the remote identified in (5) above is fed by fibre or copper. 8) The maximum (core) capacity of each remote identified in (5) above. A charge per order shall apply. A charge shall apply for each exchange map provided as requested in an order. The provision of the above information will be within ten (10) business days of a request and will be subject to the signing of a non-disclosure agreement with the ompany. G. As a condition of service under this tariff, and in accordance with paragraphs 50, 66 and 104 of Telecom Regulatory Policy RT , Review of the Internet traffic management practices of Internet service providers (TRP ), customers employing Internet Traffic Management Practices (ITMPs) shall: 1) whether or not they are anadian carriers, abide by the requirements of subsection 27(2) of the Telecommunications Act with regard to any ITMPs they employ; 2) abide by the disclosure requirements described in TRP ; and 3) not use for other purposes personal information collected for the purposes of traffic management or disclose such information. Local Network Interconnection Rates and charges for the elements described below are specified in the individual tables following these descriptions, unless otherwise specified. 1) S7 Signalling Interconnection a) S7 Interconnection provides LEs with the ability to interconnect their own S7 signalling network with MTS Allstream s S7 signalling network in order to exchange the signalling information necessary to support the completion of calls between the two networks. b) S7 ross-onnection provides a digital transmission path which supports the transmission of a DS-0 channel signal from the LE s co-located transmission equipment to MTS Allstream s gateway STP. c) A one-time service charge applies for the engineering, operations and translations work required to provision the initial S7 Interconnection for LE switch to MTS Allstream s gateway STP connection. d) LE requests for rearrangements and subsequent additions to LE switch to MTS Allstream s gateway STP connections will be provided for through a Special Facilities Tariff, based on the expense incurred where applicable. 2) Routing of LE Toll-Free alls LE originated toll-free calls may be routed to MTS Allstream s gateway. MTS Allstream will perform the switching and aggregation, carrier identification and routing to the toll-free service provider. These calls may be routed over either one-way or Bill and Keep two-way trunks. If one-way trunks are used, the LE is responsible for all costs associated with provisioning the trunks between its switch and MTS Allstream s gateway, due to the unidirectional nature of the connection. If two-way trunks are used, the LE shares with MTS Allstream the costs of provisioning the trunks between its switch and MTS Allstream s gateway. Regardless of the directionality, trunk termination charges do not apply. Unbundled Network omponents 1) Local Loops a) A local loop is a MTS Allstream-provided transmission path between and including the ustomer Network Interface (UST- NI) located at the end-customer s premises and the OLT. LEs and DSLSPs will be able to obtain local loops from MTS Allstream subject to the availability of suitable facilities. b) In a multi-dwelling unit (MDU), where suitable entrance and inbuilding facilities exist, MTS Allstream will provide LEs with the option of terminating leased unbundled loops either at the service provider demarcation point or at the customer demarcation point. c) Additional charges apply for local loops provided outside of the Base Rate Area of an exchange. d) Additional charges also apply in situations where the provision of loops requires extra work or equipment (e.g., loop extenders for Type B loops). e) A Loop Selection harge applies whenever a LE or DSLSP requests the identification of the availability of a loop, in a given location, meeting a specific loop category profile. This service charge includes a report which identifies whether a loop meeting a specific loop category profile is available in a given location and provides the loop make-up. In the event that a loop which meets the requested loop category profile is not available in a given location, the LE may request the removal of bridge taps and/or loading coils from a loop at that location.
