1 TARIFF for Charges Collected by the Communications Regulation Commission Pursuant to the Electronic Communications Act Adopted by virtue of Decree of the Council of Ministers 297 of , promulgated SG, No. 106, , in force as of Art. 1. The amount of the one-off administrative charge for the issuance of an authorization for use of individually assigned scarce resource and of the annual charge for use of individually assigned scarce resource shall be differentiated by s, as follows: 1. 2 Art. 2. (1) For the issuance of authorizations for use of individually assigned scarce resource radio-frequency spectrum for provision of electronic communications via electronic communication network, an one-off administrative charge shall be collected as follows: No. Type of network/service Charge (BGN) 1. Networks for transmission and/or distribution of radio and television programs based on the following technology: 1.1. terrestrial analogue television broadcasting for each station terrestrial digital television broadcasting DVB-Т - for each single-frequency network terrestrial VHF FM radio broadcasting for each station terrestrial digital radio broadcasting T-DAB for each single-frequency network terrestrial analogue radio broadcasting in the LW, MW and SW ranges for each station terrestrial digital radio broadcasting DRM for each station Electronic communications networks of the mobile service for own needs, analogue or digital, except networks in accordance with TETRA standard, for each simplex radio frequency channel in coverage with maximal size: 2.1. up to 2 km up to 20 km up to 50 km up to 120 km for at least one radio station at altitude over 1000 m above seal level with national range 1900

Electronic communications networks from the fixed satellite service or of the mobile satellite service for each station and maximum peak power at the output of the transmitter: 3.1. below 0 dbw from 0 dbw to 10 dbw over 10 dbw Electronic communication networks of the fixed service of the point-to-point type - for each SHF transmitter Public electronic communications network for maritime search and rescue operations and propagation of current information for the safety of navigation Electronic communications network for maritime search and rescue operations and propagation of current information for the safety of navigation Electronic communications network of the services: aeronautical mobile, radiolocation and radio navigation for air traffic control and provision of aeronautical navigation servicing of the flights of the civil aeronautical space Electronic communications network for search and rescue and propagation of current information for the support of the safety of aviation Position on the geostationary orbit determined for the Republic of Bulgaria Electronic communications network of private mobile service in accordance with TETRA standard, for each simplex radio frequency channel in a coverage up to 50 km 5000 (2) Charges under Para 1 shall be collected, as follows: 1. For radio and television stations under Para. 1, item 1, located within the 20-kilometer border, including the stations along the Black Sea coast with reduction by 20 per cent; 2. For radio stations and radio networks under Para. 1, item 2 for the needs of the health care
4 establishments within the meaning of art. 2, Para 1 of the Medical Institutions Act with reduction by 90 per cent, but not less than 100 BGN; 3. For radio stations and radio networks under Para. 1, item 2 for the needs of state institutions that are in charge by law of the traffic safety and traffic control systems and are funded by the state budget, when the radio stations and radio networks are designated for traffic security and safety control for preserving the life and health of people with reduction by 50 per cent, but not less than 100 BGN. (3) The charge under Para. 1, item 2 is determined for width of the frequency band of the simplex channels of 12,5 khz. For channel width of 25 khz, the charge shall be increased twice. For channel width below 12,5 khz, the charge under Para 1 shall be reduced by 30 per cent. (4) The charge under Para. 1, item 10 is determined for width of the frequency band of the simplex channels of 25 khz. For channel width of 12,5 khz, the charge shall be reduced by half. (5) The condition in Para. 1, item 2.4 for altitude above sea level over 1000 m shall not be applied to populated s located at altitude of over 1000 m. (6) For issuance of authorizations for use of individually assigned scarce resource radiofrequency spectrum, for provision of electronic communications via electronic communications network an one-off administrative charge shall be collected in relation to art. 1, item 2, as follows: Charge (in BGN) No. Type of network/service І ІІ ІІІ ІV V VІ 1. Electronic communications networks from broadcasting and fixed services for multimedia applications within the range of 40 GHz for 10 MHz occupied frequency band Electronic communication networks according to DECT technology (7) For issuance of authorization for use of individually assigned scarce resource - radiofrequency spectrum, for provision of electronic communications via public land mobile networks with national coverage according to the standards: NMT 450 and/or CDMA - PAMR, GSM 900 and/or GSM 1800 or UMTS, as well as according to TETRA и GSM - R standards, an one-off administrative charge shall be collected, determined according to the following formula: P = П 3 c= 1 ЧЛс ЕЦс Where: Р is the amount of the one-off administrative charge; П is the duration of the authorization in years; ЧЛ is the radio-frequency band in Hz/kHz provided by the authorization; ЕЦ is the unit price for 1 Hz/kHz pursuant to Art. 4; c - the number of used frequency ranges pursuant to Art. 4. Note: For private land mobile network in accordance with GSM - R standard, the duration of the authorization in years shall not be considered in the formula. (8) For issuance of authorizations for use of individually assigned scarce resource numbers, for provision of electronic communications via public electronic communications network, an one-off administrative charge shall be collected, as follows: No. 1. Type of network/service Networks for public telephone service provision Charge (in BGN) Networks with access through numbers of
6 2.1. the National Numbering Plan (NNP) Networks providing carrier selection service Networks providing Internet access service 2000 (9) For issuance if temporary authorizations the one-off charge amounts to 700 BGN. (10) When authorization is issued for more than one network, an one-off administrative charge shall be collected for each network. Art. 3. (1) When an auction is conducted for the issuance of an authorization for use of individually assigned scarce resource, the final auction price shall include the one-off charge for authorization issuing. In this case, the one-off administrative charge pursuant to Art. 2 shall not be paid. (2) The initial auction price shall be determined by the Communications Regulation Commission and cannot be in amount less than the one-off authorization issuing charge for the use of the respective individually assigned scarce resource. Art. 4. (1) When granting additional radio-frequency spectrum to undertakings authorized for utilization of individually assigned scarce resource radio-frequency spectrum for provision of electronic communications via public mobile land networks, an additional one-off administrative charge shall be collected for the activities under art. 2, Para 7 depending on the time left until the expiration of the term of the original authorization, for which the granted additional scarce resource radio frequency spectrum will be used: No. Public land mobile networks Charge (in BGN) 1. According to NMT 450 standard for each 1 Hz for each one year of the authorization term 2. According to CDMA - PAMR standard - for each 1 Hz for each one year of the authorization term 3. According to GSM 900 MHz standard - for each 1 Hz for each one year of the authorization term 0,23 0,23 0,25 4. According to GSM 1800 MHz standard - for each 1 Hz for each one year of the 0,19
7 authorization term 5. According to GSM - R standard for each 1 Hz 6. According to UMTS standard - for each 1 Hz for each one year of the authorization term 7. For private land mobile network under GSM - R standard, the one-off administrative charge does not depend on the duration of the authorization term in years. (2) When granting additional frequency resource for electronic communication networks under art. 2 Para 1 and 6 (except networks/services pursuant to Para 5, items 5 9), an one-off administrative charge shall be collected for provision of additional resource in the amount specified in art. 2, Para 1 and 6. (3) In case of amendment and/or supplement of authorization for utilization of scarce resource numbers, for provision of electronic communications via electronic communication network, when numbers and codes are to be released and/or provided, a charge in the amount of 100 BGN shall be collected. In such case the charge pursuant to art. 2, Para 8 shall not be collected. Art. 5. (1) For the provision of regulation-related activities an annual administrative charge for control shall be collected from the undertakings, determined as a percentage of the annual gross revenues from the provision of electronic communication networks and/or services exclusive of Value Added Tax after deduction of the transfer payments to other undertakings for network interconnection and access, transfer, roaming, value added services, as well as expenditures for arranging intellectual property and similar rights for radio and television programmes. (2) For undertakings under Para 1 with annual gross revenues over BGN, the annual charge pursuant Para 1 for 2008 shall amount to 0,2 per cent. (3) For undertakings under Para 1with annual gross revenues below BGN, the annual charge pursuant to Para 1 for 2008 shall amount to 0 per cent. Art. 6. (1) For the use of individually assigned scarce resource radio-frequency spectrum for provision of electronic communications via electronic communication networks, an annual charge shall be collected as follows:

12 (in BGN) (in BGN) (in BGN) 1. up to up to up to over (3) The charges under Para. 1 and 2 shall be collected with a reduction as follows: 1. for national networks for transmission and/or broadcasting of radio programmes depending on the coverage of population: а) coverage of over 65 per cent - by 20 per cent; b) coverage of over 75 per cent - by 30 per cent; c) coverage of over 85 per cent - by 40 per cent; d) coverage of over 90 per cent - by 50 per cent; 2. For radio and television stations under Para. 1, item 1 located in the 20-kilometer border by 20 per cent; 3. For radio stations and radio networks under Para. 1, item 2 for the needs of medical institutions within the meaning of art. 2, par 1 of the Medical Institutions Act - by 90 per cent, but not less than 100 BGN; 4. For radio stations and radio networks under Para. 1, item 2 for the needs of state institutions vested by law with the management of the traffic control and safety systems and funded by the state budget, when the radio stations and the radio networks are designated for the provision of traffic safety and security in order to preserve the life and health of people by 50 per cent, but not less than 100 BGN; 5. For radio transmitters, operating within the ranges of long, medium and short waves under Para. 2 and used for own needs, depending on the permitted power at the output of the transmitter - by 50 per cent. (4) The reductions under Para. 3, item 1 and 2 shall be used simultaneously. (5). The charge under Para. 1, item 2 shall be for width of the frequency band of the simplex channels 12,5 khz. For channel width of 25 khz, the charge shall be increased 2,5 times. For
13 channel width below 12,5 khz, the charge under Para. 1, item 2 shall be reduced by 30 per cent (6) The charge under Para. 1, item 9 shall be for channel width of 25 khz. For channel width of 12,5 khz, the charge shall be reduced twice. (7) For the networks under Para. 1, item 2 for the range of 160 MHz, for s II, III and IV, in conformity with art. 1, item 1, the charge shall be increased by 35 per cent. For the range of 80 MHz, the charges for all the s shall be reduced by 25 per cent. (8) The condition for altitude above sea level of over 1000 m for the networks under Para. 1, item 2.4 shall not be applied to populated s located at an altitude of over 1000 m. (9) The charge for temporary use of the individually assigned scarce resource shall be proportional to the time period, for which the authorization is issued, and shall be in the amount of 0,50 BGN for 1 MHz per day. Art. 7. (1) For utilization of individually assigned scarce resource radio frequency spectrum for electronic communications via electronic communications networks, an annual charge shall be collected in accordance with the occupied frequency band, as follows: No. For provision of electronic communications via: Charge for 1 MHz (in BGN) 1. Electronic communications networks of fixed satellite service or mobile satellite service Public mobile terrestrial networks: 2.1. standard NMT standard CDMA - PAMR standard GSM 900 or standard GSM - R standard UMTS standard TETRA Electronic communications networks of fixed service of the point-to-point type for 1 km, for operational frequency:
14 3.1. up to 10 GHz up to 35 GHz over 35 GHz 2 (2) The amount of the charge under Para 1, item 1 for a band, other than 1 MHz, shall be determined in proportion to the permitted frequency band, but not less than 20 per cent of the charge under Para 1, item 1. (3) For provision of electronic communications via networks from the fixed service used for the transfer of radio and television programmes, the charge under Para. 1, item 3 shall be reduced by 20 per cent, but it may not be less than 100 BGN. (4) The amount of the charge under Para. 1, item 3 for a section with length up to 10 km shall not be less than the amount of the charge for a section with length of 10 km, when the frequency is up to 10 GHz. For frequencies between 10 GHz and 35 GHz the amount of the charge for a section with length up to 5 km shall not be less than the amount of the charge for a section with length of 5 km. For frequencies of over 35 GHz the amount of the charge for a section with length up to 1 km shall not be less than the amount of the charge for a section with length of 1 km. (5) The charge for temporary use of individually assigned scarce resource shall be proportional to the time period, for which the authorization is issued, and shall be in the amount of 0,50 BGN for 1 MHz per day. Art. 8. (1) For utilization of individually assigned scarce resource numbers and addresses for provision of electronic communications, an annual charge shall be collected, as follows: No. For utilization of individually assigned scarce resource Charge (in BGN) 1. (3) For use of numbers from one or from two of the million groups of the block, the charge under Para. 1, item2 shall be reduced by 60 per cent. (4) For use of numbers from three, from four or from five of the million groups of the block, the charge under Para. 1, item 2 shall be reduced by 30 per cent. (5) For the initial provision of numbers and addresses the charge for the provided numbers and addresses shall be reduced by 50 per cent for the first 6 months, counted from the date of authorization issuance. (6) For reserved numbers the charge pursuant to art. 8, Para 1, item 1 shall be reduced by 80 per cent for the period of reservation.
16 (7) For the national numbers for access to services for performance of emergency calls, to the single European number 112 and for the numbers of the range 116 for harmonized services of social value, no charge shall be collected. (8) For the provision of a carrier selection code at the choice of the applicant or for a change of a provided code for carrier selection at the choice of the operator and in the event that the requested code is vacant, an one-off charge in the amount of 7500 BGN shall be collected. Art. 9. (1): For administrative services provided by the Communications Regulation Commission, a single charge for administrative services shall be collected, as follows: No. 1. Activity type Conducting an examination for qualification of radio amateur Charge (in BGN) Issuing a certificate for radio amateur Re-issuance of document certifying qualification of radio amateur For the issuing of: 4.1. harmonized radio amateur certificate (НАRЕС) in the Bulgarian, English, German and French languages 4.2. СЕРТ license for a radio amateur in the Bulgarian, English, German and French languages 5. For issuance of certificate for entry in the register pursuant to art. 33, Para 1, item 1 of the ECA, in the event the undertaking has not been registered ex-officio by the commission. 6. 18 15.2. on paper /hard copy/: - for the first page - for each following page 10 0,50 (2) Individuals with disabilities shall be exempt from charges under Para 1, items 1 4. Art. 10. (1) In case of amendment of an authorization for utilization of scarce resource radio frequency spectrum upon the request of the undertaking, an one-off charge shall be collected depending on the type of the electronic communications network and/or service, as follows: No. Activity type Charge (in BGN) 1. Amendment of identity data: 1.1. For one authorization for a specific type of network and/or service For each following authorization For change of the term of validity of the authorization For transfer of authorization 500 (2) For amendment of technical characteristics of networks: 1. without new frequency planning the charge shall be 100BGN; 2. with new frequency planning (modification of frequency, transmission point, power, antenna system), the charge for amendment shall be equal to the one-off administrative charge pursuant to art. 2, Para 1 and 6; for electronic communications networks of fixed satellite service or of mobile satellite service, when modifying the frequency resource of the same satellite, for which the station has an authorization issued, the charge shall be in the amount of 20 per cent of the charge under art. 2, Para 1, item 3.
19 (3) For amendment and/or supplement of an authorization at the request of an undertaking for the activities pursuant to art. 2, Para 7, except for the cases under art. 4, a charge in the amount of 360 BGN shall be collected. (4) For amendment of authorization for activities pursuant to art. 2, Para 8, when the undertaking starts utilizing subscriber numbers of a new million group from the provided block of national significant numbers and this is related to amendment of the charge under art. 8, a charge of 100 BGN shall be collected. Art. 11. (1) For amendment and supplement of an authorization under the procedure of art. 115, Para 1 of the Electronic Communications Act, no charge shall be collected. (2) Charges pursuant to art. 2, 3 and 10 are due as of the issuance of the respective document. (3) Charges pursuant to art. 9 shall be paid at submission of the application. Art. 12. (1) The charge pursuant to Art. 5 shall be paid in quarterly instalments by the 15 th day of the month, following the quarter for which they are due. (2) The instalment for the fourth quarter shall be adjusting and shall be paid within 15 days after the deadline, specified in the Accountancy Act for submission of the annual financial statement. The instalments deposited during the year shall be adjusted on the basis of a copy of the annual financial statement presented by the undertaking along with the attachments to it. (3) The undertakings, which also perform other trade activities, shall keep separate analytical accounting for their revenues from the activity related to provision of electronic communications networks and/or services, and shall enter them separately in the Profit and Loss Account. Art. 13. (1) The charge pursuant to art. 6-8 shall be paid in 4 equal instalments by the end of the month preceding the quarter. (2) Upon the request of the undertaking, the charge pursuant to Para 1 may be paid by the end of the first quarter of the current year. In this case the charge shall be paid with a discount of 5 per cent. (3) Charges for scarce recourse at issuance of temporary authorization pursuant to art. 6 8 shall be paid one-off within 14 days as of receipt of the notice for the issued temporary authorization. Art. 14. (1) The due charges shall be paid through a bank transfer to the account of the Communications Regulation Commission. (2) The effected bank payments shall be certified by means of a certified copy of the payment order. Art. 15. Charges paid, but not due shall be refunded upon the request of the interested party. FINAL PROVISION Single paragraph. This Tariff is adopted on the grounds of art. 147, Para. 1 of the Electronic Communications Act.
