6 DECISION No 676/2002/EC on regulatory framework for radio-spectrum policy in the European Community (Radio Spectrum Decision) (2) The management and use of the radio-frequency spectrum according to national legislation is based on the principles of rationality, efficiency, transparency and non-discrimination, and includes the following: 1. Planning of the allocation and assignment of radio-frequencies pursuant to relevant international agreements and recommendations and in line with the interests of citizens, the economy, and the security and defence policy of the country; 2. Assignment of radio-frequencies according to the Allocation and Assignment Plans; 3. Coordination of the use of radio-frequencies; 4. Radio-frequency spectrum monitoring, identification and elimination of harmful interferences. 6

25 COMMISSION DECISION 2010/166/EU on harmonised conditions of use of radio spectrum for mobile communication services on board vessels (MCV services) in the EU Commission Recommendation 2010/167/EU on the authorisation of systems for mobile communication services on board vessels (MCV services) 900 MHz and MHz bands Commission Decision 2010/166/EU: (10) - This Decision cannot be considered to impose obligations on Member States that do not have territorial seas. This is without prejudice to the authorisation of MCV services, which is outside the scope of this Decision, but which may require action by Member States in conformity with EU law in regard to vessels of their nationality. National regulations are unharmonized with 2010/166/EU and 2010/167/EU since the Republic of Serbia does not have territorial seas. 25

Mobile telephony system on board of aircrafts must not cause harmful interference to terrestrial mobile telephony systems. Upon request of the users of aircrafts, the authorizations for the provision of mobile telephony services onboard of aircrafts shall be issued by the Agency.
