Urban Reserves: A Forum on Aboriginal Economic Development Zones is an Investors EVENTS Academy Event, brought to you by Richard Wintrup & Associates. The Urban Reserves Forum is unique in design, with a focus on creating a comfortable and supportive venue for technical discussion and collaboration between First Nations and private sector development & business groups. The four (4) plenary sessions will cover all aspects of land development on urban reserves, foster learning, collaboration, and networking. Most importantly, this event will equip you with the tools and knowledge for tackling both the process of development and investment on reserve lands, and how to create successful partnerships between First Nations and the development industry. The Urban Reserves Forum is the first of many future events that will focus on urban development topics. 5 ABOUT THE EVENT Our four (4) plenary sessions and eight (8) guest speakers will help highlight the importance of fostering positive relationships between the private sector and First Nations as we move forward in this exciting time in Winnipeg. Urban Reserves: A Forum on Aboriginal Economic Development Zones is an exciting and unique opportunity to learn about the process of developing on urban reserves. This topic remains an enigmatic issue in Manitoba, and our event aims to clarify the process of land development on urban reserves. This event is about moving beyond discussing the creation of the urban reserve, and looking into how they are actually developed. Presentations cover issues such as financing, legal and taxation, and demystifying the entire development process. 6 PART - I URBAN RESERVES IN SASKATCHEWAN THE SASKATOON EXPERIENCE Paul Ladoux, Council Member, Muskeg Lake Cree Nation, Saskatchewan If you d like to see the success of urban reserves in Canada, look no farther than Saskatoon. Our neighbours to the west christened their first urban Aboriginal economic development zone in 1988, and the relationship between the Muskeg Lake Cree Nation and the City of Saskatoon has benefited the First Nations community and city in tandem. Since then, dozens of First Nations organizations and businesses have set up on the 35-acre commercial reserve near the corner of College Drive and McKercher Drive. The urban reserve includes offices, financial institutions, retail stores, and gas stations. Muskeg Lake Cree Nation s Cattail Centre and Asimakaniseekan Askiy is an excellent example of how urban reserves can provide much-needed economic stimulus for First Nations and urban centres as a whole. This urban reserve has generated hundreds of jobs and has been cited as a model for similar developments across Canada. The arrangement between the City of Saskatoon and Muskeg Lake Cree Nation has become a template for other urban reserves across Canada. In 2015, Muskeg Lake put the finishing touches on their latest development - a new 16,000 square foot office building development in Saskatoon. The building is 100% leased out by local businesses looking for modern facilities in a convenient location to downtown, the university, and nearby residential areas. The building includes a sports medicine rehabilitation centre and a Ready-to-Move home distributor. Muskeg Lake Cree Nation is planning further urban reserve development in Saskatchewan, and is looking forward to continued economic success. Join us as Paul Ladoux, former General Manager of MLCN Investment Management Corporation, the economic development arm of Muskeg Lake Cree Nation provides expert insights into the process of urban reserve development in Saskatoon, including the First Nations perspective of partnering with private sector developers, and what private sector developers need to know and understand before investing in urban reserves. What do First Nations see as opportunities? And what do they see as roadblocks? What are the challenges and impediments to getting private sector developers involved in urban reserves development? 6 6
7 PART - II THE FUNDAMENTALS OF DEVELOPMENT ON URBAN RESERVES BASIS FOR URBAN RESERVES Michelle Richard, Partner, Richard Wintrup & Associates Nathan McCorrister, Executive Director, Peguis First Nation TLE Implementation Unit Nathan McCorrister will kick off Part II with a presentation on the foundations of urban reserves and how they work in Manitoba. The focus will be on the basis for Treaty Land Entitlements, and intergovernmental relations including those with municipalities. Michelle Richard will detail the steps to establishing an urban reserve, and provide an overview of the Municipal Development and Service Agreement (MDSA). The presentation will look at land use planning from an on and off reserve perspective. FINANCING FOR URBAN RESERVE DEVELOPMENT Chris Sicotte, First Nations Business Development Manager, Affinity Credit Union Chris Sicotte will provide a lenders perspective on the emerging trends in financing for development on urban reserves in Canada. The presentation will cover the role for private sector investment, the emerging issues and opportunities for partnering with First Nations, and the challenges and impediments to getting the private sector involved. This presentation will provide the financing facts that are often perceived as show-stoppers for private investors. LEGAL AND TAXATION ASPECTS OF LAND DEVELOPMENT Brenda Johnston & Bradley Regehr, Lawyer,s D Arcy & Deacon LLP Aboriginal law specialists Brenda Johnston and Bradley Regehr will provide an overview of the different land regimes applicable to real estate development on urban reserves, including an overview of head-leases and sublease structure for development. The focus will be on ownership, taxation, and competitive advantage of urban reserves development. The presentation will also include discussion of legal structures for governance following project build-out. 8 SPEAKER BIOGRAPHIES JAMES B. WILSON - Commissioner, Treaty Commission of Manitoba Treaty Commissioner Jamie Wilson is a progressive young leader originally from the Opaskwayak Cree Nation, who moves with equal ease in both First Nations and non-indigenous communities. Jamie s greatest leadership strengths are as a facilitator and relationship builder where his calm and thoughtful demeanor enables him to navigate to positive and successful outcomes. Now in his second complex discussions and often highly charged situations, mandate as Treaty Commissioner, Jamie sees education and economic development as twin pillars to grow a more vibrant future for both First Nations and Manitoba. Drawing on his extensive knowledge of the Treaties, from which economic security and the ability to earn a livelihood are fundamental promises, Jamie is passionate about bridging the gap between First Nations and business communities, to help create greater educational opportunities, joint ventures and partnerships. PAUL LADOUX - Council Member, Muskeg Lake Cree Nation, SK Paul has spent his career working for First Nation organizations and his community Muskeg Lake Cree Nation in various management capacities. He is the former General Manager of MLCN Investment Management Corporation, and a current Council member of the Muskeg Lake Cree Nation. Paul is also a Board Member and delegate with Affinity Credit Union in Saskatoon. Paul has had the opportunity to take numerous courses in facilitation, management, finance, leadership, conflict resolutions, organizational governance and human resource development, and graduated in 1989 with a diploma in Business Administration from the Saskatchewan Indian Institute of Technologies. He is also an active volunteer with the Prince Albert Food Bank and coach s basketball at Westview Public School, and owns and operates a small business in the City of Prince Albert, Saskatchewan. 8 8
9 CHRIS SICOTTE - First Nations Business Development Manager, Affinity Credit Union, SK As the First Nations Business Development Manager, Chris leads the delivery of complex, integrated solutions to First Nations businesses and economic entities. He is an expert in providing integrated financial services for First Nations bands, businesses, and economic affiliates. Leveraging a history of earned credibility, Chris leads a team of dedicated Account Managers in delivering lending and investment services. Through Affinity Credit Union, Chris provides delegates of the First Nations District with recommendations regarding business strategies that are designed to achieve growth and assist in business and cultural awareness that enhance the understanding of First Nations business and financial needs. Chris is also the Saskatchewan Board representative and Vice Chair of AFOA Canada, and is a Director and Co-Chair of the First Nations and Métis Opportunities Committee at the Greater Saskatoon Chamber of Commerce. MICHELLE RICHARD - Partner, Richard Wintrup & Associates With 20 years of planning, strategic policy and economic development experience, Michelle knows how planning and economic development interface. Michelle holds both Master of City Planning and Bachelor of Arts degrees from the University of Manitoba. She has worked as a Treaty Land Entitlement coordinator with a specialization in land claims in rural and urban municipalities. She coordinated the OurWinnipeg plan for the City of Winnipeg and now runs her own planning and development firm. Michelle knows every aspect of community-based engagement and integrated planning. 9 9
10 NATHAN MCCORRISTER - Executive Director, Peguis First Nation TLE Implementation Unit Nathan McCorrister is Anishnabe/Cree and a proud member of the Peguis First Nation located in Manitoba. Nathan is currently the Executive Director for the Peguis First Nation TLE Implementation Unit, and has extensive experience working with First Nations in Manitoba in implementing Treaty Land Entitlement (TLE) claims. In his home community of Peguis, Nathan has worked in various community development initiatives including assisting in establishing community Trusts, comprehensive community planning, and land use planning. Nathan s professional focus has been with Treaty rights of First Nations relating to land bridge between Indigenous values of development and community economic issues and economic development. Nathan is an advocate for developing a development, and trying to find balance between the two. BRENDA A. JOHNSTON - Partner, D Arcy Deacon LLP Brenda is a partner with the law firm of D Arcy & Deacon LLP, and a member of the Peguis First Nation. She practices primarily in the areas of Aboriginal Law, Business and Commercial Law. Brenda has extensive experience in advising First Nation clients on Treaty Land Entitlement Agreements ( TLE ) including the drafting and interpretation of Trust Agreements. Brenda also has a wealth of experience in working with First Nations on private land acquisitions and the creation and establishment of new Reserves, including the development and drafting of Head Leases between Canada and First Nation entities and sublease agreements. Brenda is sought after for her in-depth knowledge on the issues of pre-reserve land designations under the Manitoba Claim Settlements Implementation Act and land designations generally under the Indian Act. She recently assisted a First Nation in the negotiation, development and drafting of a municipal development and services agreement with the City of Winnipeg respecting the first urban economic development zone in Winnipeg. 1010
11 BRADLEY D. REGEHR - Lawyer, D Arcy Deacon LLP Brad Regehr is a lawyer with the Winnipeg law firm of D Arcy & Deacon LLP and a member of the Peter Ballantyne Cree Nation. Brad advises numerous First Nations on a wide variety of matters, including land transactions, real property taxation, new reserve creations, natural resource and legislative consultations, negotiations with all levels of government, hydro developments and governance matters. Brad has recently appeared before the Manitoba Clean Environment Commission and the Manitoba Public Utility Board on behalf of a First Nation proponent in respect of the Keeyask Generating Station, in the Federal Court of Appeal in respect of the Kapyong Barracks matter and in the Federal Court of Canada in the first court case concerning the First Nations Fiscal Management Act. Brad has taught courses in Aboriginal Law in the Department of Natives Studies at the University of Manitoba, and in the Department of Politics at the University of Winnipeg. Prior to working at the Winnipeg law firm of D Arcy & Deacon LLP, he worked at the Treaty Land Entitlement Committee of Manitoba and the law firm of Pitblado & Hoskin. Brad graduated from the University of Manitoba - Faculty of Law in 1996 and was called to the Manitoba Bar in Brad lives in Winnipeg with his family. TROY WESTWOOD - Former Kicker, Winnipeg Blue Bombers Troy is a former professional Canadian football place kicker and punter who played 18 seasons for the Winnipeg Blue Bombers, and holds several club records, including most points scored in a career and most points scored in a single season. He is known by many as a member of Manitoba s Eagle & Hawk and as a solo artist Little Hawk. To date, the band has won 33 music awards including a Juno Award, Western Canadian Music Award, and numerous Native American Music Awards. Years ago, Troy was traditionally adopted by Dave and Orianna Courchene of the Sagkeeng First Nation. His adopted father Dave is a highly respected traditional Annishinabe elder and leader. Troy is a sundancer and frequently attends ceremonies. Troy worked 7 years on the front lines in social services in a family reunification program. Troy is currently part of the The BIG Show mornings on Winnipeg s TSN 1290 sports radio
12 EVENT ORGANIZERS RAK HAYER - Planning Consultant, Richard Wintrup & Associates Rak is a planning consultant with a Master of City Planning from the University of Manitoba. He also holds a Bachelor of Arts (Sociology-Honours) from the University of Winnipeg. Rak has experience leading public engagement initiatives in urban, rural, and First Nation communities, and has worked on planning projects at the regional and local level. He is also experienced in planning and design for age-friendly communities. Rak s professional focuses include collaborative planning, sustainable development, placemaking, and intercultural planning. DENISA GAVAN-KOOP - Planning Consultant, Richard Wintrup & Associates Denisa is an urban planner and community engagement expert with experience in the federal, municipal and non-profit sector. Denisa holds a Master of Environmental Studies (Urban Planning) from York University and a Master of Arts (Political Science-Honours) from the Simon Fraser University. She had led community engagement initiatives at the University of Manitoba, the University of British Columbia and the City of Toronto. Denisa is also a founding member of the International Association for Public Participation (IAP2) Prairies Chapter and IAP2 practicing professional.
