5 MARK A. LEMLEY WILLIAM H. NEUKOM PROFESSOR OF LAW STANFORD LAW SCHOOL *keynote luncheon speaker DIRECTOR, STANFORD PROGRAM IN LAW, SCIENCE AND TECHNOLOGY Mark A. Lemley is the William H. Neukom Professor of Law at Stanford Law School, the Director of the Stanford Program in Law, Science and Technology, and the Director of Stanford s LLM Program in Law, Science and Technology. He teaches intellectual property, computer and Internet law, patent law, and antitrust. He is also of counsel to the law firm of Keker & Van Nest, where he litigates in the areas of antitrust, intellectual property and computer law. A learned and engaging speaker with broad expertise, Professor Lemley is a noted expert in IP and antitrust areas. He is the author of six books (all in multiple editions) and 81 articles on these and related subjects, including the two-volume treatise IP and Antitrust. He has testified five times before Congress and numerous times before the California legislature, the Federal Trade Commission and the Antitrust Modernization Commission on patent, trade secret, antitrust and constitutional law matters, and has filed numerous amicus briefs before the U.S. Supreme Court, the California Supreme Court, and the federal circuit courts of appeals. Professor Lemley has been named California Lawyer s Attorney of the Year (2005), one of the 100 most influential lawyers in the nation by the National Law Journal (2006), one of the top 25 intellectual property lawyers in California (2003), one of the 100 most influential lawyers in California by the Daily Journal (2004, 2005 and 2006), and one of the 500 leading lawyers in the country by Lawdragon Magazine. Professor Lemley received his J.D. from Boalt Hall School of Law at the University of California at Berkeley, and his A.B. from Stanford University. In 2002 he was chosen Boalt s Young Alumnus of the Year. After graduating from law school, he clerked for Judge Dorothy Nelson on the United States Court of Appeals for the Ninth Circuit, and practiced law in Silicon Valley. Until January 2000, he was the Marrs McLean Professor of Law at the University of Texas School of Law, and until June 2004 he was the Elizabeth Josslyn Boalt Chair in Law at the Boalt Hall School of Law, University of California at Berkeley. e Lawyers. 11 BREAKOUT SESSION 3B PATENT TRACK Reverberations of EchoStar: Does It Still Make Sense to Rely on an Opinion of Counsel? The Federal Circuit s decision in In re EchoStar last May held that uncommunicated work product need not be disclosed when an infringement defendant invokes reliance on an opinion of counsel in response to a charge of willfulness, unless it reflects a client communication. EchoStar seems, however, to have raised a number of unanswered questions about the scope of the waiver of privilege, spawning a number of district court decisions and at least two writ petitions seeking appellate review, In re Seagate Technology, LLC and In re CA, Inc. The cases reflect a clash between the demand for full discovery into the state of mind of the defendant, and preservation of the attorney-client privilege as it relates to trial strategy and litigation advice. BADGE PICK-UP All badges will be held at Will Call, which opens at 7:30 a.m. on the morning of the Institute. Registration and Will Call are located downstairs in the Crystal Foyer of the Hotel.
