Would like to thank all members of the Board for their service on the Board, and for taking their time to serve and assist the CILB. With nothing further to report the board voted unanimously to approve this report. PROSECUTING ATTORNEY S REPORT KYLE CHRISTOPHER Mr. Christopher gave the following report: For the month of May 2015, the overall license activity case load was 664, up from 661 in April of 2015, and up from 500 in May There were 416 cases currently in Legal to be reviewed, 7 cases set for probable cause, 62 cases where probable cause had been found/administrative complaints filed, 0 settlement stipulation approved, 1 informal hearings requested, 0 cases awaiting outside action, 25 cases ready for default, 50 formal hearings requested, 4 cases referred to DOAH, 0 cases in settlement negotiations, 0 case pending board date, 60 cases set for board presentation, 39 cases awaiting final orders, 0 cases under appeal and 0 cases had been re-opened. For the month of May 2015, 70 cases were closed. With nothing further to report the board voted unanimously to approve this report. ATTORNEY GENERAL S REPORT Douglas Dolan JACK BAGGS REQUEST FOR INFORMAL HEARING Mr. Baggs was present. Mr. Dolan presented this case stating Mr. Baggs application for a Certified General Contractors license denied at the March 2015 meeting of the Board for failure to demonstrate required experienced, as required by Florida Statute , and 61G Florida Administrative Code, and the Applicant failed to demonstrate the ability to supervise the construction work and business activities of the organization, as required by section , Florida Statutes. The Notice of Intent to Deny was filed in March of Mr. Baggs timely requested board reconsideration. 15 CHARLES CONNER RECONSIDERATION INFORMAL HEARING Mr. Conner was not present Mr. Dolan presented this case stating that Mr. Conner s application for a Certified General Contractors license denied at the February 2015 meeting of the Board for failure to appear as required by Rule 61G , Florida Statutes. The applicant failed to demonstrate the required experienced, pursuant to section , Florida Statute, and Rule 61G Florida Administrative Code, and the Applicant failed to demonstrate the qualifying agent would have the ability to supervise the construction work and business activities of the organization, as required by section , Florida Statutes. The Notice of Intent to Deny was filed in March of Mr. Conner s timely requested board reconsideration. After discussion, the board voted to uphold the denial MICHAEL HOLUB REQUEST FOR INFORMAL HEARING Mr. Holub was present. Mr. Dolan presented this case stating Mr. Holub s application for a Certified Mechanical Contractors license denied at the March 2015 meeting of the Board for failure to demonstrate the required experience, pursuant to section , Florida Statutes, and Rule 61G , Florida Administrative Code. The Notice of Intent to Deny was filed in March of Mr. Holub timely requested board reconsideration. After discussion, the Board voted to vacate the previous denial, and approve the application for a downgrade to a Class A Air Conditioning license. JONATHAN JASIEWICZ PETITION FOR VARIANCE & WAIVER Mr. Jasiewicz was present Mr. Dolan presented this case stating that Mr. Jasiewicz filed a petition for variance and waiver on May 1, The petition was noticed in the Florida Administrative Register on March 5, Mr. Dolan noted the petitioner is seeking a temporary variance from or waiver of Rule 61G , which requires for the purpose of certification, a passing grade shall be valid for a period of four (4) years from the date the list of successful candidates is approved by the Board. After discussion, the board voted to deny the petition due to the petitioner not having demonstrated how the purpose of the underlying statute will be or has been achieved by other means or how application of the rule creates a substantial hardship or violates principles of fairness. ROBERT MILLER PETITION FOR DECLARATORY STATEMENT Mr. Miller was not present. Mr. Dolan presented this case stating that Mr. Miller filed a petition for Declaratory Statement on April 9, The petition was noticed in the Florida Administrative Register on May 20, Mr. Dolan Page 15 of 19

16 noted the petitioner asks the Board whether he can build concrete swimming pools and advertise as such, or just the structure for concrete swimming pools. After discussion, the board voted to decline to answer due to the petition not being signed by petitioner, petitioner s attorney, or qualified representative. TIMOTHY QUINN REQUEST FOR INFORMAL HEARING Mr. Quinn was present. Mr. Dolan presented this case stating Mr. Quinn s application to qualify Epic Custom LLC, was denied at the April 2015 meeting of the Board for failure to appear as required by Rule 61-G , Florida Administrative Code, and applicant was not able to demonstrate how the qualifying agent would have the ability to supervise construction work and business activities of the organization, as required by Section , Florida Statues. The Notice of Intent to Deny was filed in. Mr. Quinn timely requested board reconsideration. After discussion, the Board voted to uphold the denial. VITO ROMANO REQUEST FOR INFORMAL HEARING Mr. Romano was present. Mr. Dolan presented this case stating Mr. Romano s application for a Certified Plumbing Contractors license was denied at the March 2015 meeting of the Board due to the applicant not demonstrating he has passed an examination that is substantially equivalent to the required Florida certification examination as required by section (3), Florida Statutes. The Notice of Intent to Deny was filed in March Mr. Romano timely requested board reconsideration. After discussion, the Board voted to grant a 60-day continuance. MITCHELL SACCARECCIA REQUEST FOR INFORMAL HEARING Mr. Saccareccia was not present.
