1 Minutes The Physical Therapy Committee of the Board of Medical Licensure and Supervision met on April 22, The meeting was held at the office of the Board, 101 NE 51 st Street, Oklahoma City, Oklahoma in accordance with the Open Meetings Act and the Administrative Procedures Act. Members present were: Member absent was: Others present included: Staci Freudiger, PT, Chair Mary Staley, PT, Vice Chair Suzanne Reese, PT Nancy Davis, PTA Craig Gavras, Public Member Robyn Hall, Director Licensing Kathy Plant, Executive Secretary Gay Tudor, Assistant Attorney General Elizabeth Scott, Assistant Attorney General The meeting was called to order at 9:00 a.m. The minutes from the February 10, 2010, Committee meeting were reviewed. Ms. Staley moved to approve the minutes. Ms. Reese seconded the motion and the vote was unanimous in the affirmative. SUSAN DAWN FAIN appeared in support of her application for Physical Therapist licensure. Ms. Fain had met with the Committee in December and again in February. The Committee had suggested that she take the Federation of State Boards of Physical Therapy's Practice Review Tool (PRT) exam. Ms Fain presented those results. After discussion, Ms. Reese moved to recommend approval of the application pending satisfactory completion of practice under direct supervision until December 31, Ms. Staley seconded the motion and the vote was unanimous in the affirmative. CYNTHIA RAY BROCK appeared in support of her application for licensure as a Physical Therapist. Ms. Brock's last practice as a PT had been in

2 1991. Ms. Brock testified regarding her plans for re-entering practice. Ms. Brock would need 180 hours of continuing education to bring her into compliance with current requirements. The Committee discussed the PRT with Ms. Brock, saying the exam may reduce the number of hours she would be required to obtain. They suggested Ms. Brock attend the same nine day review course that Ms. Fain had attended. Ms. Reese moved to table the application until the October 28, 2010 Committee meeting when Ms. Brock can return with an update on her progress towards meeting the required 180 hours of continuing education. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. TROY GEARY appeared in support of his application to sit for the Physical Therapist Assistant licensing exam and for licensure pending passing the exam. Mr. Geary testified regarding his arrest for DUI and felony conviction for leaving the scene of an accident. Mr. Geary also had a public intoxication arrest many years ago that he did not disclose initially but he had admitted to the arrest when he met with staff prior to this meeting. Ms. Scott presented a proposed Agreement for Licensure that would allow the Board to monitor Mr. Geary. Ms. Staley moved to recommend the Board accept the Agreement for Licensure, allow Mr. Geary to sit for the exam and approve the application for licensure under terms of the Agreement after passing the exam. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. (See attachment #1) Applications for licensure were reviewed. Ms. Staley moved to recommend approval of the following applications for licensure as Physical Therapists. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. Ms. Staley moved to recommend approval of the following applications to sit for the Physical Therapist licensure exam. She further moved to recommend approval for licensure pending passing the exam. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. Mr. Do was not present. Mr. Do had an arrest for DUI in He received an assessment, which was reviewed by the Committee. After discussion, Ms. Reese moved to recommend approval to sit for the exam and approve for licensure, pending Mr. Do's passing the exam, under terms of an Agreement allowing the Board to monitor him for substance abuse. Ms. Staley seconded the motion and the vote was unanimous in the affirmative. A request from Demarcus Grayson for special testing accommodations for the Physical Therapist licensing exam was reviewed. Mr. Grayson had submitted the appropriate documentation and requested time and a half to take the exam. Ms. Staley moved to grant the accommodation. Ms. Reese seconded the motion and the vote was unanimous in the affirmative.

5 Requests for approval of continuing education courses were reviewed. The Committee discussed approval of multi-discipline courses. A licensee had submitted a question regarding separation of PT continuing education from other professions such as chiropractic, Athletic Training, etc. The Committee said it would be impossible to limit attendance to just PTs and PTAs, and probably would be undesirable to do so. Ms. Tudor said the rules do state that the speaker's credentials must reflect qualifications to teach Physical Therapists and Physical Therapist Assistants. Recommendations from the Continuing Education Subcommittee were reviewed. The Subcommittee had recommended further review by the Committee on several courses. After review, Ms. Stately moved to approve the list as amended. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. (See attachment #2) A request from Kristi Robare, PT to earn all hours from Category B was reviewed. The Committee was concerned that she seemed to still be working. If that was the case, she should have been able to attend short courses with accommodations. The Committee applauded her for continuing to work, but said active practice bears some responsibility to maintain current continuing education hours. After further discussion, Ms. Reese moved to deny the request. Ms. Staley seconded the motion and the vote was unanimous in the affirmative. The Committee asked that Ms. Robare be reminded that course instructors will make accommodations for her. Updates to PT Practice Act were discussed. Ms. Reese presented proposed changes. A few changes were made based on the discussion. Ms. Reese and Ms. Staley said they would make those changes and forward to staff and Ms. Tudor for review. (See attachment #3) Amendments to the continuing education rules were given a final review. Ms. Freudiger asked that the proposed changes be placed on the web site. The public hearing will be held at the August 5 th Committee meeting. The Committee discussed a position, Early Interventionist, being expanded by the Oklahoma Department of Education. A letter had been sent to Sooner Start from the Board regarding the proposed position expressing concerns that the Early Interventionist would be performing evaluations that would be considered the practice of physical therapy. The Early Interventionist

6 would then direct the care of the child. Occupational Therapists and Speech Therapists were also concerned about the proposed job classifications. Ms. Staley reported that she would not be present at the August meeting but the Committee needs to discuss the jurisprudence exam. She said she would like to update the exam to include feedback and legal references to licensees on the questions they miss. She said Missouri has such a process. She offered to provide the information to staff who then can begin working on updating the online exam. There being no further business, the meeting was adjourned. The time was 11:07 a.m.
