1 CCG Chief Financial Officers Financial Control NHS England Quarry House Quarry Hill Leeds LS2 7UE 11 th January 2017 Gateway reference number: Dear Colleague Update on proposed 2016/17 non-recurrent increase in allocation due to impact of NHS Property Services move to charging market rents Background You may recall that I wrote to you in October 2016 to confirm that the increase in rent charges proposed by NHS Property Services (NHSPS) for your direct tenancies, any void costs you incur, the impact on your main providers and the impact on local CSUs would be funded through an additional non-recurrent revenue allocation in 2016/17. That October communication was accompanied by a statement setting out the proposed increase in charges, based on information provided by NHS Property Services at that time. We requested positive confirmation that the information provided to you represented properties that were either directly payable by your CCG or related to properties from which you commission services from Providers, highlighting any properties which you did not believe to be accurately attributed. I had hoped that those confirmed allocations could be actioned before Christmas. The responses identified a number of changes required to the information provided by NHSPS to improve the accuracy of the data and a large number of queries regarding implementation of the move to market rent policy. Therefore the Masterfile data is still not yet robust enough from which to action the 2016/17 non-recurrent allocations, hence the delay. Actions since October We have been working through the responses received in conjunction with NHSPS. Having chased missing responses, there remain a number of CCGs who have yet to reply. Please can the CCGs included at Appendix 1 respond immediately to the above address; funding allocations will not be made in the absence of a response.

2 The initial letter in this process (sent by Steve Wilson in January 2016, being Director of Financial Control at that time) identified that the net impact of the increase on the freehold estate and decrease on the leasehold estate would be funded. However, due to the later than planned provision of detailed information by NHSPS, we appreciate the difficulty this causes you in 16/17 to ensure funds are reallocated appropriately. Therefore, we have updated the information to currently exclude the reduction in costs on leasehold properties for 2016/17 arising from the cut of the administration charge from 10% to 5%. We will continue to work with NHSPS and DH to confirm funding arrangements for 2017/18 onwards. From the review of responses, we have also so far actioned and/or agreed the following: Amended the information in the NHSPS Masterfile to reallocate properties appropriately, where incorrect alignment was identified, including reallocation of pharmacy and dental to NHS England. There are a small number of properties flagged as incorrectly allocated that we have not yet been able to reallocate and we await further information from NHSPS regarding the tenant. We have excluded these from the current proposed allocations. Excluded PFI properties which had erroneously been included within the initial NHSPS information as these will continue to be charged under separate arrangements. Excluded the impact arising from increases within the CSU estate, which NHS England proposes to mitigate directly, rather than through additional allocations to CCGs to be passed on to CSUs. Excluded the impact arising from properties for which CCGs identified they did not have a commissioning/contractual commitment with the occupier. Included the irrecoverable VAT and depreciation against all properties, which was previously funded directly by the Department of Health (DH) but which will now be incorporated into the total revised impact from NSHPS and the funding passed to NHS England by DH. Included an estimated split of additional allocation between Admin and Programme. This split is based on the assumption that CCG occupied space is admin and charges to CCGs for void & subsidies are programme. Following the above amendments and revised approaches, Appendix 2 sets out the indicative additional non-recurrent allocation for 2016/17 for each CCG, based on the current version of the NHSPS Masterfile. This separately identifies the value being allocated for leasehold irrecoverable VAT and depreciation. Amounts for freehold VAT and depreciation are included within the impact of the move to market rents columns. I hope this information assists in the preparation of your month 9 draft accounts.

3 Next steps re 2016/17 We are continuing to work with NHSPS on outstanding issues and queries which may result in further refinements to the Masterfile over the next few weeks, hence the sharing of the attached information as an indicative allocation at this time. If you require a breakdown of the figures included in Appendix 2, please contact england.psmarketrents@nhs.net. The next steps are as follows: (i) Allocation agreed: Please respond to england.psmarketrents@nhs.net by 27 th January 2017 to confirm agreement with the proposed 2016/17 allocation set out in Appendix 2. In your response, please confirm the Admin/Prog split is acceptable or provide an alternative representation. The corresponding non-recurrent allocation transfer will be actioned by the end of the first week in February. (ii) Allocation not agreed: For those CCGs who still do not agree with the proposed allocation, we must action the allocation transfer in the first week of March, which will be based on the most updated information available at that time. This will reflect resolution of as many remaining issues and queries as possible. CCGs should continue to work with their NHS PS local contact. On the basis of the attached indicative allocation and the subsequent allocation transfers, I would ask that each CCG make appropriate funds available to those who require them as soon as possible (including in advance of the receipt of the formal allocation) and strongly encourage full settlement (or partial settlement as a minimum) of outstanding bills with NHSPS. These additional funds are being provided to mitigate the increases in charges from NHSPS and should not be used for any other purpose. 2017/18 and 2018/19 As explained previously and above, the NHSPS Masterfile is the basis of the funding allocations with regard to move to market rents (previously notified estimate of 127m in total) and is some way from being as accurate as we can make it. Therefore the 2017/18-19 planning guidance previously issued regarding the 58m already in CCG baselines should continue to be followed whilst we complete work with CCGs, NHSPS and DH regarding the detail within the Masterfile and associated funding.

4 For your information regarding 2017/18 onwards, Appendix 3 shows the current version of allocation impacts which follow the basis set out in the initial letter dated January 2016, that is the net impact of the increase of freehold properties charges and reduction of leasehold charges. Once all of this work is completed to the best standard possible, the 2 year nonrecurrent allocation of top up funding to CCGs will be confirmed. This is likely to be at the start of 2017/18, with the intention that the funding is incorporated into CCG recurrent baselines from 2019/20.
