BACK GROUND: In the fast paced world of today where time is more expensive than money, litigation is no longer a viable option for dispute resolution. In this backdrop, Alternative Dispute Resolution Mechanisms, especially Arbitration, have emerged as life savers since they have significantly reduced the amount of time and money spent in the resolution of mutual disputes. The Union of India has thus recently amended the arbitration act and enacted from 2015. Also Union of India recently enacted the Commercial Courts, 2016 and Insolvency & Bankruptcy Code 2016. These need to be understood for better applications in the CPSEs. Moreover, along the growth of CPSE s, the number of Domestic and International arbitration cases are increasing manifolds and the settlement of these cases is taking considerable time. A huge amount of money of CPSEs is involved in the process of arbitration. In order to assist the CPSE s for faster settlement of such cases, SCOPE has created a Forum i.e. SCOPE Forum of Conciliation and Arbitration (SFCA), which provides arbitration services through its empanelled conciliator/arbitrator as well as provides platform for sharing latest developments in the area of Arbitration, Conciliation, legal laws, International contracts, Company Laws etc. through interactive session and seminars. For speedy and efficient disposal of disputes the Arbitration and Conciliation (Amendment) Act, 2015 was enacted vide which certain important amendments were carried out in the Arbitration and Conciliation Act, 1996, Civil Procedure Code, 1908. The act on insolvency is now called the Insolvency and Bankruptcy Code. These shall be applicable to all Corporate persons. Being the new Code authorities from the concerned Boards shall be invited for sharing the salient provisions and issues of concerns. We also propose to cover the important provisions of the Company Law and the functions, procedures and powers of NCLT. In order to deliberate on the amendments & other provisions, an interactive Seminar focusing on crucial issues those emerges during the course of arbitration, national & international procurement, formation of cross border joint ventures, Insolvency Act along with related case studies by eminent professional & experienced speakers is being conducted. In order to provide a platform to CPSEs, two days Seminar has been organized by SCOPE from August 3 rd 4 th 2018 (Friday & Saturday), at SCOPE Convention Centre, SCOPE Complex, Lodhi Road, New Delhi. OBJECTIVE: The objective of the seminar is to provide indepth knowledge on various facets and changes which have accrued in the field of Arbitration Law, Commercial Courts, Insolvency and Bankruptcy Code 2016 etc. 2

Role of Courts before, during and after arbitration proceedings focusing on: Section 8, 9 and 11 Section 34 3. Recent Court Approach towards the amendments focusing on: Sharing Judgments in the past one year Application of Amendment Act with respect to Post Arbitration Proceedings pending before Courts under Section 34 and 37. 4. Case Management of arbitration proceedings by CPSEs focusing on: Petroleum Sector (EPC) Power Sector (EPC) Manufacturing Sector (Marine) 5. Arbitration in International Contracts focusing on: Execution of Foreign Award Section of Arbitration Institutions 6. Salient features of Insolvency and Bankruptcy Code 2016 7. Salient features, challenges/powers of the Resolution Professionals 8. The functions procedures and powers to NCLT METHODOLOGY: The programme shall consist of presentation on latest developments, by professional, experienced & knowledgeable eminent speakers, sharing of experiences by the CPSE s, interaction with participants etc. Also, it shall include panel discussions, case studies on legal & contractual issues and landmark court decisions.
