Hamilton Township Trustee s Meeting February 7, 2018 Trustee Board President Rozzi called the meeting to order at 7:00p.m. Mr. Rozzi, Mr. Walker, and Mr. Cordrey were present. The Pledge of Allegiance was recited by all in attendance. Motion was made by Mr. Rozzi with a second by Mr. Walker to adopt the proposed agenda, for the February 7, 2018 meeting. Motion made by Mr. Rozzi with a second by Mr. Walker to approve the meeting minutes from the meeting on January 17, 2018. Motion made by Mr. Rozzi with a second by Mr. Cordrey to amend the motion from January 17, 2018 concerning employee 2.5% raises to be retroactive to January 1, 2018. Motion made by Mr. Rozzi with a second by Mr. Walker to approve Payroll for pay cycle December 31, 2017 January 13, 2018, Electronic Fund Transfer Direct Deposit Vouchers 1132188592-1132188662. Public Comments Trustee Joe Rozzi made a motion to open the floor to the public at 7:04pm, and seconded by Trustee. Lisa Wilson, 22/3, what is the progress of the citizen advisory committee? Is there any consideration being made to change the park committee back to a park board? Trustee Joe Rozzi the advisory committee is in its planning and there has not been discussion on a park board. Mr. Rozzi stated it was his opinion for the advisory committee to have some park functions too. Trustee stated he thinks the big thing right now is getting an Administrator hired and start filling the rest of the pieces in. Trustee stated once we get an Administrator in place, then all the principles will be in place, and start putting the advisory committee will be put together. Chris Dattilo, 5664 Cabernet Ct., wanted to bring to the attention about an issue he and some of his neighbors have had for quite some time. Mr. Dattilo stated the property that is adjacent to his property was put up for rent about 2 ½ years ago. It was rented out to what Mr. Dattilo calls a nuisance tenant. The tenant has been having parties late at night, play music very loudly, and shooting firearms very close to the residences. Mr. Dattilo tried to address the issue personally and he also talked to the landlord. Mr. Dattilo had a folder with the violations for this individual. Mr. Dattilo stated after talking to some Police Officers, he found out there is no noise ordinance in Hamilton Township. Mr. Dattilo took the landlord to court. Mr. Dattilo stated he thinks there should be some repercussion in place for a type of person like this. Mr. Dattilo stated he believes that if this individual would have received a citation 2 ½ years ago, that he would be here today. Police Chief Scott Hughes stated that the noise issue has been brought to his attention before. Part of the concern of having a noise ordinance is lumping farm equipment into that. Chief Hughes that the language could exclude farm equipment, garbage trucks, construction, the ones making a living.

Trustee Joe Rozzi stated this is happening within 600 feet of his home. He stated he is use to hearing shots in the distance, however, this individual does it all day long. Marianne Miller, 5474 Chancellor, stated she was afraid to sit in her back yard because the gun shots are so close. Brenda McAfee, 228 Terwillergers Run, stated the discharge of firearms has led to her not being able to use her backyard several times and she also does not use her sunroom. Jim Brokaw, 5698 Cabernet Ct, something is necessary to draft a noise ordinance. Mr. Brokaw stated he does think that the township has the responsibility to insure the comfort and safety of the citizens. He asked that the township come up with some solution. Trustee stated this is not a unique thing brought before the Board and feels that this will be brought before them again as the township continues to grow. Mr. Cordrey asked if there was a way to start looking at a noise ordinance in a way to protect the rural areas of the township? Chief Hughes stated yes there is. You can restrict the time of day as well. Chief Hughes stated he can gather some language and examples. Trustee stated it is worth discussing and find a happy medium and still protecting the farmers. Trustee stated his concern is the farmers, construction workers not being able to do their job. Trustee Joe Rozzi stated as a resident is becomes frightening as it keeps going on all day long. Chief Hughes stated a lot of the firearm laws are written except when you are on your own property. Kevin Ehling, 5465 Zoar Road, stated he doesn t think the noise is the problem, he thinks the person is the problem. He stated the noise can not be regulated, noise to one person can be music to another person. Mr. Ehling stated he sees a lack of action by the police department. Mr. Ehling stated if you video of something happening and he has been drinking. Mr. Ehling stated surely you can smell alcohol when you pull somebody over, you can smell it when you go up to the door. He believes it is a Police Department issue and not a noise issue. Trustee Joe Rozzi stated the question is catching it while it is happening. Trustee Joe Rozzi closed the floor to the public at 7:40pm. Human Resource Manager, Kellie Krieger, requested the Board make a motion to remove David Brown and Rachel Macaluso from the Hamilton Township roster effective February 3, 2018. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Human Resource Manager, Kellie Krieger, requested the Board make a motion to approve filling two full time firefighter positions upon completion of a set hiring process. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee.

Human Resource Manager, Kellie Krieger, requested the Board make a motion to approve the purchase of two cemetery plots by Sandra Dawson at the township rate of $1,200.00. They are in Lot 621, graves 3 and 4 in the Maineville New. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Human Resource Manager, Kellie Krieger, requested the permission to extend the posting of the Zoning Commission position. All trustees agreed. Trustee stated that Kenny and Michelle have done an outstanding job as the Co- Administrators. Trustee made a motion to have Michelle Tegtmeier go back solely as Community Development Coordinator and have Kenny Hickey as the sole interim administrator, and seconded by Trustee. Roll call as follows: Joe Rozzi No Police Chief, Scott Hughes requested the Boards approval of purchasing 4 Panasonic Toughbook 33 laptops to replace 6 computers that are currently done. The department has had the current laptops since 2006. The price of 4 computers would be $25,022.60 and would include the equipment that is needed. Trustee Joe Rozzi stated he would like some time to look over it. Trustee asked if there was a cheaper alternative? Kenny Hickey stated this falls under state bid. Trustee Joe Rozzi asked how it would affect budget? Chief Hughes stated it would come out of the reserve as a capital expense. Trustee and Trustee stated they were okay with the purchase since it is replacing laptops that out of commission. Trustee Joe Rozzi stated that as long as the two on either side of him is okay with it, then he is too. Public Works Director, Kenny Hickey requested the Boards approval to write a 3 year contract with Biggs Farms for farming at Marr Park. All trustees agreed. Resolution # 18-0207D, approving a concession stand lease. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Public Works Director, Kenny Hickey requested the Board approve the hiring of Brian Pichecka of Denisonmore, Schull for legal representation of the Masters Row flooding at $235.00 per hour. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee.

Resolution # 18-0207, authorizing a contract with the Warren County Engineer s office for the Warren County 2018 resurfacing, chip seal, and striping projects. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Resolution # 18-0207A, approving a proposal for security systems in township buildings and authorizing a contract with Trident Security Solutions for their installation and operation. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Resolution # 18-0207B, authorizing and approving an increase in township appropriations to reconcile budgets for calendar year 2018. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. a large purchase order for $6,045.00 to upgrade the maintenance system. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Resolution # 18-0207C, authorizing an advance from the General Fund (1000) to the Lighting District Fund (2401). Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Fiscal Officer, Jim Hunter, requested the Board make a motion to approve a large purchase order in the amount of $13,500.00 to Carpet Depot Family Flooring for carpet for the Police Department. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee.

Fiscal Officer, Jim Hunter, requested the Board make a motion to pay a final bill for 2017 to Porter-Wright in the amount of $5,615.81. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Fiscal Officer, Jim Hunter, requested the Board make a motion to pay Glatfelter Claims Management in the amount of $11,060.00 for reimbursement of suit filed against former Trustee David Wallace. Trustee Joe Rozzi made the motion as stated above, and seconded by Trustee. Public Comments Trustee Joe Rozzi opened the floor for public comments at 8:03 pm. Rusty Holman, Whalen Lane, thanked Trustee Rozzi, Trustee Cordrey, Michelle Tegtmeier, and Police Chief Scott Hughes for attending the Little Miami School Board meeting. Mr. Holman stated he believes it is important to build a bridge between the township and the Little Miami Schools. Fiscal Officer, Jim Hunter, stated he is required by State law to complete a certain amount of training annually, and he has completed that training through the Ohio Ethic Commission. Trustee Joe Rozzi stated he wanted to go on record that he does not agree with removing Michelle Tegtmeier as interim administrator. Trustee Joe Rozzi closed the floor to public comments at 8:10 pm. Mr. Rozzi made a motion, and seconded by Mr. Walker to enter into Executive Session to discuss pending litigation and compensation of a public employee at 8:11 pm. In Executive Session were Joe Rozzi,,, Law Director, Chief Hughes, Chief Reese, Fiscal Officer Jim Hunter, and Kenny Hickey. Mr. Rozzi made a motion, and seconded by Mr. Walker to come out of Executive Session at 9:18 pm. Trustee Joe Rozzi made a motion to approve the signature of Kenny Hickey to sign the notice of appeal by Mark Stemm if requested, and seconded by Trustee.

Trustee Joe Rozzi made a motion to increase the pay rate of Fire Chief Brian Reese and Police Chief Scott Hughes by 2.5% retroactive to January 1, 2018, and seconded by Trustee Darryl Cordrey. With no other business at hand a motion made by Mr. Rozzi with a second by Mr. Walker to adjourn at 9:19 pm.
