The Village of Cuba Board of Trustees held their monthly board meeting on Monday, March 10, 2014 at 7:00 pm in the Cuba Village Hall. PRESENT: Mayor Thomas Taylor, Trustees Lon Sweet, Michael Doyle, Andrew Swift and Judith Zayac. ALSO PRESENT: Richard Hall, SPW; Diane Wilson, Clerk Treasurer; Darlene Donahue, reporter Olean Times Herald. MAYOR TAYLOR OPEND THIS MEETING WITH THE PLEDGE OF ALLEGIANCE AND WELCOMED EVERYONE. MINUTES: The Board was given copies of the minutes of 2 10 14. There was one typo in the minutes, third paragraph (second Motion) should say DWELLING UNITS not SWELLING UNITS. A MOTION WAS MADE BY TRUSTEE JUDITH ZAYAC AND SECONDED BY TRUSTEE MICHAEL DOYLE TO APPROVE THE MINUTES OF 2 10 14 WITH THE ABOVE CORRECTION. THIS MOTION WAS APPROVED UNANIMOUSLY. BILLS: Clerk/ Treasurer gave to the Board the Abstract of Vouchers 551 604. Trustee Sweet asked if the Clerk would check in to bidding out costs for National Fuel like what was done with National Grid. The Clerk will check the internet on this. A MOTION WAS MADE BY TRUSTEE MICHAEL DOYLE AND SECONDED BY ANDREW SWIFT TO APPROVE THE PAYING OF THE MONTHLY BILLS TOTALING $65,590.02 WITH THE BREAKDOWN BY FUND AS FOLLOWS: GENERAL FUND $35,948.96 WATER FUND $19,083.11 SEWER FUND $10,557.95 THIS MOTION WAS PASSED UNANIMOUSLY. POLICE REPORT: Chief Burch could not attend this meeting due to another obligation. He will bring his report into the Board in a couple days. The Board wanted to remind everyone of the next Neighborhood Network Meeting on Wednesday, March 26 th at 7:00 pm in the A. Arnold Center. This meeting will focus on the recent home invasion and safeguards residents can take to defend themselves against this type of attack as well as center on being a key witness in these types of incidents. BUILDING INSP./CEO: Mr. Cummings left his report for the Board. He thanked the Board for updating the Williamson Law building codes program. He also sent letters to three residents per complaints filed. One for 22 Maple St. and another to 1 Windsor St. for the complaints regarding garbage cans being left to the curb. A letter was sent to 3 Keller St. regarding tires, trash and the poor state of the property. There was a question from a resident on Orchard St. regarding fences. He said that cement footing of the fence put up by his neighbor is on his property. Mr. Cummings discussed this

with the complainant. Mr. Cummings also asked the Board if there was a fee for fire inspections as he did not see one on the fee chart. ANIMAL CONTROL: Ms. Botens gave her report to the Board. Most of the report consists of problems with a dog on 87 South St., with a complaint filed by the post office. She also talk to some people on the pooper scooper law and responded to barking dog complaints. PUBLIC WORKS REPORT: Superintendent Hall reported the following: Plow/sanded streets, shoveled/salt walks and bridges as needed. Hauled snow from behind bank and fire hall. Cold patching potholes. Unplugged frozen storm drain on Champlain Ave. at creek which let Grove Street which was flooded drain. Sluice pipe that crosses Spring Street just above tracks froze solid. Thanks Town of Cuba helping with their steam jennie. Town of Cuba sewer line froze up in driveway for the third time this year. Froze from pump station toward main also (never before). Cuba Post Office sewer lateral line froze under parking lot for the second time this year. Under drain is frozen under the curb at 99 W. Main Street and no telling how far. Have been pumping water out of hole to keep out of driveways and basements. Read water meters and checking high/low reports for any high usage. Water issues: Called to multiple houses for trouble calls of low water pressure or no water due to frozen pipes. Water mains break at the intersection of Hill Street Extension and Old East Main. New York Leak Detection will be here to survey our system and find our leaks so we can begin repairs right away. Equipment repairs: New PTO cable and rear wheel seal in International dump truck as well as being inspected. New fuel tank on plate tamp. Rick also gave the Board a list of sidewalk contractors to give to property owners. At this time Rick thanked Mike Doyle for his term on the Board and has enjoyed working with him. Rick informed the Board that he will be having surgery on April 8 th and will be off of work for about two months. CLERK/TREASURER REPORT: Clerk Wilson informed the Board that, after much searching she has finally employed the Election Inspectors for the March 18 th, 2014 election which is from noon to 9:00 pm in the Village Hall. The two inspectors will be Lois Lester and Kathryn Plants. The following amendments and transfers to the 2 13 2014 budget were given to the Board for approval:

WITH NO QUESTIONS FROM THE BOARD A MOTION WAS MADE BY TRUSTEES TO GIVE APPROVAL FOR THE CLERK/TREASURER TO MAKE THE ABOVE AMENDMENTS AND TRANSFERS. THIS MOTION WAS MADE BY TRUSTEE JUDITH ZAYAC AND SECONDED BY TRUSTEE LON SWEET AND APPROVED UNANIMOUSLY. Clerk Wilson informed the Board that water shutoffs for delinquent water/sewer bills were sent out. There wasn t as many as in the past and the last day to pay in March 14, 2014. COMMITTEE REPORTS: none MAYORS REPORT: Mayor Taylor also thanked Mike for his many contributions to our community and for being elected Citizen of Year by the Chamber of Commerce. NEW BUSINESS: Discussion took place on changing the Board Meeting as the Mayor would not be in town for the April 14, 2014 meeting. A MOTION WAS MADE BY TRUSTEE JUDITH ZAYAC AND SECONDED BY TRUSTEE ANDREW SWIFT TO CHANGE THE APRIL BOARD MEETING FROM APRIL 14 TO APRIL 7 AT 7:00 PM. THIS PASSED A MOTION WAS MADE BY TRUSTEE LON SWEET AND SECONDED BY TRUSTEE JUDITH ZAYAC TO HOLD THE PUBLIC ON THE 2014-15 TENTATIVE BUDGET ON APRIL 7, 2014 AT 7:00 PM IN THE CUBA VILLAGE HALL. Trustee Swift was given a letter from the Commander of the Cuba Amvets asking that the Board declare April 2 nd, 2014 as Because We Care Day for National Amvets Supporting Veterans in the hospital. The Board of Trustees does so declare. A MOTION WAS MADE BY TRUSTEE SWEET TO ADD TO THE BUILDING PERMIT FEES A FEE OF $25.00 FOR FIRE INSPECITONS BY THE CODE ENFORCEMENT OFFICER. THIS MOTION WAS SECONDED BY TRUSTEE DOYLE AND APPROVED. OLD BUSINESS: RESOLUTION AUTHORIZING THE SALE OF VILLAGE PROPERTY NOT NEEDED FOR PUBLIC USE WHEREAS, the Village of Cuba is the owner of the following property located on Champlain Ave., which the well house sets on; and WHEREAS, said property is not needed for public use; and WHEREAS, the Village is authorizing the sale of said property.

NOW THEREFORE BE IT RESOLVED, by the Board of Trustees of the Village of Cuba that: 1. The property is located on Champlain Ave., Cuba, NY. 2. The property to be purchased by John Hupp of 22 Stevens Ave. at the appraisal property value of $1,000. This property is approximately a fifteen foot swath and is located directly behind Mr. Hupp's garage. 3. Mr. Hupp also proposed to pay fair market value and any expenses incurred in the transfer of property. A MOTION WAS MADE BY TRUSTEE JUDITH ZAYAC AND SECONDED BY TRUSTEE MICHAEL DOYLE TO ACCEPT MR. HUPPS PROPOSAL TO PURCHASE A PIECE OF LAND ON CHAMPLAIN AVE. ROLL CALL VOTE: TRUSTEE JUDITH ZAYAC TRUSTEE LON SWEET TRUSTEE ANDREW SWIFT TRUSTEE MICHAEL DOYLE MAYOR THOMAS TAYLOR APPROVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF CUBA ON THIS TENTH DAY OF MARCH, 2014. Trustee Sweet asked about getting more picnic tables in Willowbank Park. This was supposed to be a winter project for the Public Works Dept. Rick said that with all the water issues and street work this winter, they have not been able to get to it. It was thought maybe the lumber should be bought and stored and when time permits work on them. Rick said that after the paving is done at the park basketball court he will take a look at the parks funds and see what is left. A MOTION WAS MADE BY TRUSTEE JUDITH ZAYAC AND SECONDED BY TRUSTEE LON SWEET TO GO INTO EXECUTIVE SESSION FOR PERSONNEL ISSUES.
