INVOCATION Chairman Dave Burns gave the invocation. III. PLEDGE TO THE FLAG Chairman Dave Burns led the pledge. IV. AGENDA APPROVAL Chairman Dave Burns asked if there were any changes to the agenda. Board Member Juanita Golden made a motion to approve the agenda as read. Board Member Alan Zipperer seconded the motion. The motion carried by unanimously. V. APPROVAL OF MINUTES Chairman Dave Burns asked if there were any corrections or additions to the January 23, 2017 meeting minutes. Board Member Jamey Stancell made a motion to approve the minutes as read. Board Member Peter Higgins seconded the motion. The motion carried by unanimously. VI. NEW BUSINESS Chairman Dave Burns stated all items voted on would be presented at the March 21, 2017 Board of Commissioners meeting as a public hearing (with the exception of residential business and pond requests) RHTC, LLC Murray Marshall SKETCH PLAN (1): The applicant requests a sketch plan for [Map# 374 Parcel# 18C] located on Zittrouer Road for a residential development Hunters Walk Phase II. (First District) Mr. Murray Marshall stated that Phase I of Hunters Walk will have three lots at approximately seven acres each. Phase II of Hunters Walk will have five lots with approximately seven acres also. Both phases of the development will tie into the county water system with separate septic systems on each lot. The whole development will have eight lots on 60 acres. He already has an approved sketch plan by the county for 47 half acre lots but wants to abandon that sketch plan and have a new sketch plan approved with less lots and more acreage. Mr. RC Barenchik stated that the engineering staff has reviewed the submitted items and recommends approval. Sketch plan meets the requirements of the subdivision regulations. Mrs. Juanita Golden made a motion to approve the request. The motion was seconded by Mr. Peter Higgins. The motion was carried by all. Justin Moore PUBLIC HEARING (2): The applicant requests to rezone 1 acres for [Map# 269 Parcel# 43] located at 2457 Hwy 17 from AR-1 to AR-2 to allow for a home site (Third District) that The Moore s wanted to cut off one acre to give to their son to live in the existing mobile home that is on the property. Mr. Alan Zipperer made a motion to approve the request with the following stipulations: 1. Lot meets the requirements of the AR-2 zoning district. The motion was seconded by Mrs. Juanita Golden. The motion was carried by all. Kimberly Starr Dickey PUBLIC HEARING (3): The applicant requests a variance for [Map# 264A Parcel# 12] located at 129 Quarters Street to reduce - 2 -
the side setback to 10 feet from the property line and the front setback to 30 feet from the property line, zoned AR-1. (Third District) that this property is a smaller lot and there is an existing septic system. The new mobile home will be placed length wise on the property and would still need for reduced setbacks, the lot is only 60 feet wide. Mr. Peter Higgins made a motion to approve the request. The motion was seconded by Mr. Jamey Stancell. The motion carried unanimously Kimberly Starr Dickey PUBLIC HEARING (4): The applicant requests a variance for [Map# 264A Parcel# 12] located at 129 Quarters Street to allow a camper as a temporary residence until home can be brought to the property, zoned AR-1. (Third District) that Ms. Dickeys mobile home has to be special built in order to meet the proposed new setbacks. The new mobile home will take about 10 to 12 weeks to be built before it will be finished and would like to move her camper onto the property until her home is ready. Mr. Peter Higgins motioned to approve the request with the following 1. The camper must be removed within six months. Mr. Alan Zipperer seconded the motion. The motion carried 4/1 with Mr. Jamey Stancell opposed. Ann Baker PUBLIC HEARING (5): The applicant requests to rezone 1.71 acres for [Map# 405 Parcel# 25B] located at 4211 Hwy 119 North from AR-1 to AR-2. (Third District) that Ms. Baker wants to subdivide the front portion of the property to sell. Mr. Alan Zipperer motioned to approve the request with the following 1. Lot meets the requirements of the AR-2 zoning district. Mr. Jamey Stancell seconded the motion. The motion carried unanimously. - 3 -
Morgan Corp. PUBLIC HEARING (6): The applicant requests to rezone 150.56 acres for [Map# 369 Parcel# 5] located on Courthouse Road from AR-1 to I-1. (Fourth District) Mr. Warren Ratchford stated that they wanted to mine the dirt and sand to sell. They would use the top soil to create a two to four feet berm to help with the noise. There is existing timber one the property that will continue to stay there as a buffer. They plan to mine about 60 acres over a three to five year span and possibly a little longer, but the property would revert back to AR-1 once the job has been completed. There is an existing peanut field on the property and they plan on mining the field. Mr. Ceaser Bennett lives at 1043 Courthouse Road and is opposed to the proposed project due to the air pollution from the dust and dirt, increased traffic. Mr. Eddie Ashley owns the property on the back of the property where the gas lines run, he is concerned about the dust and dirt and the noise of construction. Mr. David Walton lives in the area and is concerned with the increase of traffic with so many small children being in the area. He also asked about the storage of equipment. Mr. Dave Burns stated that this is a state mining permit and they are only permitted to dig dirt. Mrs. Kristy Canas asked about when the surface mine was finished being dug will it become a pond, and then what will happen to the water table and her well? She was also concerned about the noise from the trucks, and the dust dirt and pollen. Mr. Warren Ratchford stated that the area being mined is a peanut field, and there are more dust and food allergens from peanuts than sand mine. Most of the hours of operation are being planned to take placed during the time that most children will be in school. The only trucks being used are for Morgan Corp. projects only. Mrs. Lydia Walton wanted clarification on days and hours of operation. Mr. Jamey Stancell motioned to approve the request with the following 1. Lot meets the requirements of the I-1 zoning district. 5. Follow the requirements of Section 3.17 -Excavation, mining, ponds, and fills of land and/or state/federal jurisdictional waters or wetlands. 6. Days and hours of operation to be from Monday through Saturday, from sun up to sun down. 7. Closed on Sundays Mr. Alan Zipperer seconded the motion. The motion carried unanimously. - 4 -
HH Real Estate Investment, Inc.. PUBLIC HEARING (7): The applicant requests to rezone 3.9 acres for [Map# 465N Parcel# 2&3] located on Hwy 21 South from B-2 to B-3. (Fifth District) Mr. Gregg Howze wants to rezone the property to B-3 for a potential customer wants to use the property to sell sports cars and use the property as a car lot. Mr. Peter Higgins motioned to approve the request with the following 1. Lot meets the requirements of the B-3 zoning district. Mr. Jamey Stancell seconded the motion. The motion carried unanimously. Effingham County AMENDMENT (8): Request to amend Sec. 5.1.2 Conditional Uses, Sec. 5.9.1 Permitted Uses & 5.10.1 Permitted Uses. Mr. RC Barenchik created a Private/Public events to allow for conditional uses to keep from having to get a Special Event Permit Mr. Peter Higgins motioned to approve the request. seconded the motion.
