OFFICIAL TRANSLATION MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA REGULATION OF THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA NUMBER 12/M-DAG/PER/2/2017 CONCERNING AMENDMENT ON REGULATION OF THE MINISTER OF TRADE NUMBER 84/M-DAG/PER/12/2016 CONCERNING EXPORT PROVISIONS FOR FORESTRY INDUSTRIAL PRODUCTS BY THE GRACE OF THE ALMIGHTY GOD THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA, Considering : a. that to increase the effectiveness of forestry industrial product export performance, it is necessary to amend some provisions in the Regulation of the Minister of Trade Number 84/M- DAG/PER/12/2016 concerning Export Provisions for Forestry Industrial Products; b. that in connection with the stipulated Regulation of the Minister of Finance Number 6/PMK.010/2017 concerning Stipulation of Goods Classification System and Imposition of Import Duty Tariff upon Imported Goods, the adjustment towards Tariff Post/HS and goods description upon forestry industrial products is necessary to be conducted as regulated in the Regulation of the Minister of Trade Number 84/M-DAG/PER/12/2016 concerning Export Provisions for Forestry Industrial Products; c. that based on considerations as intended in letter a and letter b, it is necessary to stipulate Regulation of the Minister of Trade concerning Amendment upon the Regulation of the Minister of Trade Number

Law Number 7 of 2014 concerning Trade (State Gazette of the Republic of Indonesia of 2014 Number 45, Supplementary State Gazette of the Republic of Indonesia Number 5512); 2. Regulation of the Minister of Trade Number 08/M-DAG/PER/2/2016 concerning Organization and Administration of the Trade Ministry (State Gazette of the Republic of Indonesia of 2016 Number 202); 3. Regulation of the Minister of Trade Number 84/M- DAG/PER/12/2016 concerning Export Provisions for Forestry Industrial Products (State Gazette of the Republic of Indonesia of 2016 Number 2006); 4. Regulation of the Minister of Finance Number 6/PMK.010/2017 concerning Stipulation of Goods Classification System and Imposition of Import Duty Tariff upon Imported Goods (State Gazette of the Republic of Indonesia of 2017 Number 176); HAS DECIDED: To stipulate : REGULATION OF THE MINISTER OF TRADE CONCERNING AMENDMENT ON THE REGULATION OF THE MINISTER OF TRADE NUMBER 84/M-DAG/12/2016 CONCERNING EXPORT PROVISIONS FOR FORESTRY INDUSTRIAL PRODUCTS. Article 1 Some provisions in the Regulation of the Minister of Trade Number 84/M-DAG/PER/12/2016 concerning Export Provisions for Forestry Industrial Products (State Gazette of the Republic of Indonesia of 2016 Number 2006) are amended as follows: 1. Provisions of paragraph (1) Article 5 are amended, so that paragraph (1) Article 5 shall read as follows:

- 3 - Article 5 (1) Forestry Industrial Products including in Appendix I Group A with Tariff Post/HS Ex. 4407.11.00 to Ex. 4407.99.90, Ex. 4409.10.00 to 4409.29.00, Ex. 4418.10.00 to Ex. 4418.99.90 (except door and shutter), and 9406.10.90 can be exported besides to fulfill provisions of Article 4 paragraph (1), it also has to meet technical criteria. (2) Technical criteria as intended in paragraph (1) shall be attached in Appendix II which is inseparable part of this Regulation of Minister. (3) Forestry Industrial Products from coconut Wood and oil palm Wood in Surfaced Four Side (S4S) or its continued processing can be exported and excepted from technical criteria as intended in paragraph (2). 2. Provisions of paragraph (1) Article 8 are amended, and 1 (one) paragraph is inserted between paragraph (4) and paragraph (5) Article 8, namely letter (4a), so that Article 8 shall read as follows: Article 8 (1) Forestry Industrial Products as intended in Article 5 paragraph (1) can only be exported after Verification or Technical Investigation is conducted before loading goods. (2) Verification or Technical Investigation performance as intended in paragraph (1) shall be conducted by Surveyor stipulated by the Minister. (3) To be stipulated as the executor of Verification or Technical Investigation of Forestry Industrial Products, Surveyor shall have to fulfill requirements: a. having Survey Services Business License (SIUJS); b. having obtained accreditation as Inspection Institution from National Accreditation Committee (KAN); c. having obtained competence statement letter as admitted surveyor having technical skills in the field of

- 4 - Verification or Technical Investigation of Forestry Industrial Products; and d. having broad service network in Indonesian territory. (4) Verification or Technical Investigation of Forestry Industrial Products shall include: a. administrative validity verification activity towards 1. Industry Registration Certificate (TDI) or Industry Business License (IUI), for forestry industrial company; 2. Trade Business License (SIUP), for trading company in the field of Forestry Industrial Product export; 3. Company Registration Certificate (TDP); and 4. V-Legal Document. b. physical verification activity towards: 1. quantity, type, brand and packaging number; 2. quantity of goods; 3. type of Wood; 4. technical criteria fulfillment; 5. conformity investigation between goods description with Tariff Post/HS based on goods classification provisions; 6. loading supervision into container, if its shipping uses container; and 7. seal application onto the container if all goods in the container are inspected by Surveyor. (4a) Forestry Industrial Products as attached in Appendix I Group B which is inseparable part of this Regulation of Minister can only be exported after Verification or Technical Investigation is conducted in accordance with provisions of laws and legislations. (5) Result of Verification or Technical Investigation as intended in paragraph (4) shall be conveyed in the form of Surveyor Report (LS) to be used as customs

- 5 - supplementary documents required for export customs notification delivery to customs office. 3. 1 (one) article is inserted between Article 18 and Article 19, namely Article 18A, so that Article 18A shall read as follows: Article 18A As this Regulation of Minister comes into effect, recommendation as intended in Article 17 issued based on the Regulation of the Minister of Trade Number 89/M-DAG/PER/10/2015 concerning Export Provisions for Forestry Industrial Products (State Gazette of the Republic of Indonesia of 2015 Number 1554) as amended with the Regulation of the Minister of Trade Number 25/M- DAG/PER/4/2016 concerning Amendment on the Regulation of the Minister of Trade Number 89/M-DAG/PER/10/2015 concerning Export Provisions for Forestry Industrial Products (State Gazette of the Republic of Indonesia of 2016 Number 671) shall be declared to remain in effect to its validity period terminates. 4. Provisions of Article 19 are amended, so that Article 19 shall read as follows: Article 19 As this Regulation of Minister comes into effect: a. Regulation of the Minister of Trade Number 89/M- DAG/PER/10/2015 concerning Export Provisions for Forestry Industrial Products (State Gazette of the Republic of Indonesia of 2015 Number 1554) as amended with the Regulation of the Minister of Trade Number 25/M-DAG/PER/4/2016 concerning Amendment upon the Regulation of the Minister of Trade Number 89/M-DAG/PER/10/2015 concerning Export Provisions for Forestry Industrial Products (State Gazette of the Republic of Indonesia of 2016 Number 671); and b. provisions of Article 3 paragraph (6) of the Regulation of the Minister of Trade Number 35/M-DAG/PER/11/2011

- 6 - concerning Export Provisions for Rattan and Rattan Products (State Gazette of the Republic of Indonesia of 2011 Number 804), shall be revoked and shall be declared null and void. 5. Appendix I and Appendix II of Regulation of the Minister of Trade Number 84/M-DAG/PER/12/2016 on Export Provisions for Forestry Industrial Products (State Gazette of the Republic of Indonesia of 2016 Number 2006) are amended so that as attached in Appendix I and Appendix II which are inseparable parts of this Regulation of Minister. Article II This Regulation of Minister shall come into effect as from the date of its stipulation. Processing size and level a. Processed Wood in S4S (surfaced four side) including HS.4407: Processed wood products with its four sides flattened so that its surface becomes flat and smooth. - derives from merbau timber with cross-sectional area provision not more than 10,000 mm2. - derives from other than merbau timber with cross-sectional area provision not more than 4,000 mm2. b. All processed wood sizes to be exported are given size tolerance as follows: - thickness not more than 0.5 mm; - width not more than 1 mm; - length not more than 50 mm. b.
