TALLMADGE MUNICIPAL CEMETERY Rules & Regulations 2018 The 12-acre cemetery is located south of the Historic Tallmadge Circle between South and Southwest avenues. The City of Tallmadge desires to provide a choice for the needs of those dealing with loss and bereavement. The City offers grave sites and a columbarium as a final resting place for loved ones, ensuring they are protected and safe in a beautiful surrounding for eternity. Preface To promote a safe and respectful environment for families and friends of the deceased and for the mutual protection and benefit of the owners and/or purchasers of the Right of Interment and the City of Tallmadge, the following provisions, conditions and restrictions shall be the Rules & Regulations of the Tallmadge Municipal Cemetery. Any agreements made prior are subject to all terms, regulations and conditions of these Rules & Regulations. All determinations as to the interpretation of these dictates shall be at the sole and final discretion of the City of Tallmadge Director of Public Service, who serves as Cemetery Sexton for the Tallmadge Municipal Cemetery. The Tallmadge Municipal Cemetery is located on South Avenue and off Southwest Avenue and has two sections; the Old Cemetery and the New Cemetery. The Old Cemetery is located at 35 Southwest Avenue and can be accessed from the entrance from Southwest Avenue. The New Cemetery is located at 112 South Avenue and can be accessed from five entrances off South Avenue. All cemetery arrangements are handled through City Hall at 46 North Avenue. The Certificate for Right of Interment, these Rules and Regulations, and any amendments thereto, shall constitute the sole agreement between the City of Tallmadge and the owner/purchaser of the Certificate for the Right of Interment. 2

Definitions Tallmadge Cemeteries Columbarium: A vault with niches for urns containing the ashes of cremated bodies. Deed: The document by which a Right of Interment or burial in the cemetery is conveyed. Disinterment: The recovery of human remains by exhumation, disentombment or disinurnment. Foundation: A poured concrete base or support on which monuments and markers are placed. Growing Season: The time period from March 16 to November 14 of the same year. Interment: the burial of a corpse in a grave or tomb, typically with funeral rites. Inurnment: placing of cremated remains in an urn to be buried in a grave or placed within a niche of a columbarium. Lot: A numbered subdivision of a section within a cemetery, as depicted on a cemetery map. For Tallmadge Cemetery, a lot is 20 x 20, and contains 10 graves or gravesites each 4 x 10. Niche: A space in a columbarium used, or intended to be used, for inurnment of cremated human remains. Potter s Field: Paupers' grave or common grave is a place for the burial of unknown or indigent people. Resident (Tallmadge): A person who has been a resident of the City of Tallmadge for one day or more, or was a resident immediately prior to entering a nursing home or similar elder care facility. Section: A subdivision of a cemetery, as typically shown on cemetery maps or plats. Vault: A prefabricated container usually of metal or concrete into which a casket is placed at the time of burial. Veteran: An individual recognized for Armed Forces veteran s status by the Federal Government. Winter Period: The time period from November 15 to March 15 of the following year. 3

Ground Rules All cemetery property is sacred ground devoted to the burial of loved ones. A respectful atmosphere shall be maintained at all times. Cemetery Hours are 6 AM to dusk. The Cemetery Department is located on the lower level of City Hall, 46 North Avenue, Tallmadge Ohio. Office hours are Monday Friday, 7:30 AM to 4 PM. The following is strictly prohibited on cemetery property: Visiting the cemetery grounds between dusk and 6 AM. Having pets of any kind, whether loose or leashed, on cemetery grounds. Driving or riding wheeled vehicles including bicycles anywhere other than in paved areas, with the exception of wheelchairs used by disabled persons. Playing, loitering or exercising anywhere on the cemetery grounds. Picking flowers, whether wild or cultivated. Destroying, defacing, removing, sitting or standing on, or performing any disrespectful act to any grave, monument or any other. Certificate for Right of Interment A Certificate for Right of Interment in a grave space or columbarium may be purchased by residents or non-residents. The cost for a non-resident is higher as City of Tallmadge taxes are used to maintain and care for the Cemetery. Upon application, the City of Tallmadge will sell at a price set in the Schedule of Fees (Exhibit A), established by City Council. Any available burial space may not be reserved without payment in full. Any document previously recorded and distributed as a deed does not convey or grant ownership of any space or lot in the Tallmadge Cemetery. The Certificate for Right of Interment conveys only the right of burial and cannot be sold to another individual. The Right of Interment in a niche of the Columbarium only gives a right or privilege of interment of cremated remains. The ownership to land and structure remaining always in the City of Tallmadge. Change in Address It shall be the duty of the holder of the Certificate for Right of Interment to notify the office of the Cemetery of any change in address. Notice sent to a holder at the last address in the Cemetery s records shall be considered sufficient and proper legal notification. Terms of Sale When a purchase of the Right of Interment is made, a list of the names and addresses of the persons to whom the Deed would pass can be included in writing. Should a subsequent change be necessary, the purchaser should notify the City of Tallmadge in writing the name and address of any to whom the Right of Interment would descend. If the City of Tallmadge becomes aware of the death of all parties, failure of their heirs or executors to claim the Right for Interment within five (5) years, forfeits the Right for Interment. Claims to this Right by an heir or executor must be accompanied by a death certificate/obituary and by a Certified Letter of Authority for Executors/Administrators. 4

Interments All interments are conducted by City of Tallmadge employees. As such, the City reserves the right to insist on at least forty-eight (48) hour notice prior to scheduling any burial or inurnment within the cemetery. Before any interments, all payments must be made, and Burial Transit Permits must be filed in the Cemetery Department at the City of Tallmadge. No Sunday or holiday interments are permitted. Any grave/niche opening on Monday through Friday commencing at 3 pm and on Saturdays are subject to an additional charge according to the established schedule of fees. All interments shall be for human remains only. Vaults are mandatory for full size (adult) interments. For infant graves, combination casket and vault units shall be made of suitable materials and cannot exceed 48 in length. Each 4'-0" x 10'-0" adult grave space may be used for one interment, and/or the inurnment of eight (8) cremains maximum. No double depth casket interments shall be permitted. Each 2'-0" x 3'-0" infant grave space may be used for one interment, or for the inurnment for one (1) infant cremains. Cremains shall be interred by means of inurnment. The scattering of cremains is not permitted anywhere in the cemetery. A columbarium niche is for the interment of human cremains only. Only one human cremains per single niche and two per double niche will be allowed. Deceased pets, valuables, flowers, mementoes, etc. will not be allowed in a niche. The container for cremated remains to be interred shall be of material approved by the City of Tallmadge and be of a size suitable for the niche. The City or its representative shall have full authority to refuse to accept for interment any receptacle deemed unsuitable. Columbarium The City of Tallmadge provides a Columbarium for the interment of cremains. The Columbarium offers niches in two sizes. SINGLE NICHE 11 x 11 x 11 deep. DOUBLE NICHE 11 x 11 x 22 deep The cost for a niche space or spaces are set by City Council and listed in our Schedule of Fees (Exhibit A) and shall include the interment and name plaque. If an owner of a Deed chooses to relinquish their Right for Interment in a grave site to purchase a Right for Interment in a niche, the original price to purchase the Deed will be allowed in part payment for the said space. Likewise, if an owner of the Deed for a niche chooses to purchase the Right for Interment into a grave space, the original price for the niche will be allowed in part payment for the space less the cost of replacing the plaque. Plaque engraving The engraving of the name plaque shall be done by a firm selected by the City of Tallmadge. All text shall be in the Vermarco font. Exhibit B lists available emblems or images. Decorations The Columbarium is a vault-like granite structure that has 72 niches for cremated remains. The adornment of a niche falls under different regulations than a grave space would. 5

No flower arrangements, plants, wreaths, artificial flowers, toys or mementos will be allowed to be placed near the columbarium at any time, except at the time of interment. The City of Tallmadge reserves the right to remove any such ornamentation or correct any such alteration at the expense of the owner without being deemed guilty of any manner of trespass. Funeral decorations will be removed in seven days after the interment or at the discretion of the Cemetery Sexton. The City will assume no responsibility for the safe keeping of any floral memorial or container. Grave Sites Monuments & Markers All monuments, headstones and markers shall be installed under the authority, direction and supervision of the City of Tallmadge. Foundations Concrete foundations are required for all monuments, including flat markers and shall not exceed 42 x 16 in size. All foundations will be installed by the City of Tallmadge. Concrete foundations (once requested and prepaid) will be poured twice a year (typically in May and October) on those graves that have properly settled by those dates. Veteran Marker foundations are charged the same charge as regular foundations according to the established fee schedule. Headstones and footstones Headstones may be either upright monuments or flat markers. They shall only be installed within the 1'- 6" long, by 3'-6" wide space (for a single grave space) or 7' 6" wide space (for double width sites) designated for such monuments at the west end of the grave space. Upright monuments shall be limited to a height to 4'-0" and 14 in thickness, with a width commensurate with the overall width of the graves space(s). A granite base is recommended (but is not mandatory) under all upright monuments. Such bases will reduce the chances of damage to monuments and could be used as a base for the permanent placement of fixed flower vases on one or both sides of the monument. As of June 1, 2018, the City of Tallmadge reserves the right to limit benches to seat-benches (benches without back or side rests). These benches must meet the size restrictions and are subject to final approval by the Director of Public Service. Footstones are permitted only when a headstone cannot be installed. Footstones when permitted shall be flat markers of granite, marble or bronze and shall be installed flush with the surrounding ground. Foundations for footstones shall be kept 2 inches from the lower grave space boundary (to facilitate installation of headstone foundations for the adjacent grave). To avoid damage to a monument, the headstone may be temporarily moved to allow a burial in an adjacent grave. 6

Plantings and Adornments Tallmadge Cemeteries For purposes of this section of Rules and Regulations, the total grave space area of 4'-0" by 10-0" is divided into two areas, as shown in the diagram. The top of the grave site, in a 1 6 x 4 0 section, a total area 16" long by 42" wide is dedicated to the "Monument/ Decoration Area," consisting of a monument area and the planting area. The bottom section is the "Grass Area," of 3'-2" wide by 8'-0" wide within the remaining grave space area. Grave Site Dimensions The total grave space area of 4'-0" by 10-0" is divided into two areas: All items planted or placed on the grave spaces should be limited to the Monument/Decoration Area. All items become City property at the time of placement. It is important to note that NO trees, shrubs, bushes, bulb, perennial flowers or groundcover may be planted anywhere on the grave space. This will eliminate any chance of infringing on any of the burial sites. Annual flowers are permitted in the Monument/ Decoration Area only. No edging or border is permitted. The only acceptable mulch for such flower beds is the decomposing variety, e.g., bark or wood chips. Artificial flowers/decorations are not permitted and will be removed immediately. Any items outside the Monument/ Decoration Area will be removed. Any planting in violation of these rules shall be removed without notice. Should you have questions regarding plantings, contact the Cemetery Department before purchasing your flowers. If potted plants or cut flowers are being used to adorn the grave space, the area for these are still the Monument/Decoration Area and the following rules and restrictions apply: 1. Preferred containers are permanent floral urns, recessed or flush flower vases and holders, and vases permanently mounted on the monument base. 2. Absolutely no glass containers or vases. 3. Such plants and flowers will periodically be removed and disposed of by the City. 4. If the family wants to retain temporary plant or flower containers, the family shall remove them in a timely manner when the plants or flowers become unsightly. United States flags are permitted at all times in the Monument/Decoration Area, provided they are posted in an upright position, maintained in good condition, and removed when soiled. Permitted maximum size flag is 12" x 18". No plantings or decorations of any type or description are permitted in the Grass Area during the grass growing season. 7

8 Tallmadge Cemeteries Only grave blankets and wreaths, all properly secured so they stay in place, are permitted in the winter period. These will be removed on or about March 15, or sooner, if they become unsightly. Funeral flowers (never in glass or other breakable containers), wreaths, and other decorations or memorabilia are permitted to be placed in the Grass Area of the grave space and allowed to remain there for a maximum period of seven (7) days after the interment. After this time, the City will remove and discard such items. (Should the family wish to retain any such temporary decoration or memorabilia item, the family is responsible for their removal prior to the end of the 7-day period.) Figurines, statuettes, decorations or adornments not specifically listed are strictly prohibited. The City of Tallmadge is responsible for maintaining the Grass Areas of grave spaces and the complete maintenance of all common areas of the cemetery. Plantings may be removed when roots raise, displace or obscure monuments, or are unkept, overgrown or those that interfere with adjacent grave spaces. Plantings, urns or any other objects will also be removed. The City assumes no responsibility whatsoever for trimming or maintaining any plantings on a grave space other than those in the "Grass Area" of a grave space and reserves the right to remove any plantings whose roots raise, displace or obscure monuments, those that are unkempt, unsightly, overgrown, or those that interfere with adjacent grave spaces. The City assumes no responsibility for the disappearance of, or damage to, any plantings, adornment or decorations on any grave space. Indigent Burial An application for Indigent Burial can be made in the Cemetery Department at the City of Tallmadge. There shall be no charge of any kind for burial in Potters Field. Only City residents are eligible to be buried therein. The Potters Field is Section A, Lot 42 Burial or cremation of body at expense of township or municipal corporation (ORC 9.15). When the body of a dead person is found in a township or municipal corporation, and such person was not an inmate of a correctional, benevolent, or charitable institution of this state, and the body is not claimed by any person for private interment or cremation at the person's own expense, or delivered for the purpose of medical or surgical study or dissection in accordance with section 1713.34 of the Revised Code, it shall be disposed of as follows: (A) If the person was a legal resident of the county, the proper officers of the township or municipal corporation in which the person's body was found shall cause it to be buried or cremated at the expense of the township or municipal corporation in which the person had a legal residence at the time of death. (B) If the person had a legal residence in any other county of the state at the time of death, the superintendent of the county home of the county in which such body was found shall cause it to be buried or cremated at the expense of the township or municipal corporation in which the person had a legal residence at the time of death. (C) If the person was an inmate of a correctional institution of the county or a patient or resident of a benevolent institution of the county, the person had no legal residence in the state, or the person's legal residence is unknown, the superintendent shall cause the person to be buried or cremated at the expense of the county.

Such officials shall provide, at the grave of the person or, if the person's cremated remains are buried, at the grave of the person's cremated remains, a stone or concrete marker on which the person's name and age, if known, and date of death shall be inscribed. A political subdivision is not relieved of its duty to bury or cremate a person at its expense under this section when the body is claimed by an indigent person. (Effective Date: 2007 HB119 09-29-2007) Disinterments All disinterments are subject to city, county and state rules. The City of Tallmadge will use utmost care in making removals but will not assume any liability for damage incurred in doing so. When a disinterment has been made, all monuments shall be promptly removed from the gravesite at the expense of the party requesting the disinterment. There shall be no disinterments for graves between October 31 and March 1 of any year. Permits for disinterments shall be issued in accordance with Ohio Revised Code 517. Payment for disinterment shall be paid in advance by the requesting party or parties. There will be a second opening and closing fee if the remains are buried in the cemetery. Burial errors shall be corrected in accordance with Ohio Revised Code 517. 9
