Decree No.1/2006. (II. 15.) of the Governor of Magyar Nemzeti Bank on the reproduction of the Hungarian legal tender and the euro Having regard to the authorization by Article 60 (1) d), f) and g) of Act LVIII of 2001 on Magyar Nemzeti Bank (hereinafter: MNB Act), I hereby decree the following: Scope Article 1 This Decree shall be applied to the following: a) reproduction of forint banknotes and coins, including collector banknotes and collector coins (hereinafter: forint banknotes and coins), issued by and put into circulation by Magyar Nemzeti Bank (hereinafter: MNB) and still in circulation, with the exception of point b), b) reproduction of euro banknotes and coins, in relation to Articles 10-11 of this Decree. Definitions Article 2 For the purposes of this Decree, the following definitions shall apply: a) banknote or security paper: special paper not containing optical whitening [dark, non-fluorescent paper preserving its characteristics observed in natural light when examined in ultraviolet (UV) light], possibly containing a watermark, security thread, fibres and metallic threads with a hologram effect; b) dpi (dots per inch): units of resolution, indicating the number of pixels per inch (~2,54 cm) running along a given axis; c) medal, token: objects similar in appearance and specifications to coins and collector coins, the production and commercial trade of which is not regulated by legislation granting exclusive rights for the issue of banknotes and coins, and as such, are not deemed to be legal tender; d) coin, collector coin: coins which are issued pursuant to the rules of legislation granting exclusive rights for the issue of banknotes and coins, and as such, are deemed to be legal tender;

2 e) user: person ordering the reproduction, or the producer if the reproduction is used by the actual producer. f) Main components of the forint banknote determined by MNB Announcement regulating the issue, denomination and appearance of such forint banknote published before 1 May 2004 (hereinafter: MNB announcement) or by MNB Decree published after 1 May 2004 (hereinafter: MNB decree): 1. denotation of denomination with numbers and letters, year, serial number, 2. inscriptions, particularly the name of the person depicted on the forint banknote issuer, the word forint, clause relating to the criminal liability of banknote counterfeiting, certifying signatures, 3. main parts of the printed image on the forint banknote: coat of arms of the Republic of Hungary, portrait, reverse image(s), 4. basic print of the forint banknote: banknote depicted without components listed under points 1-3), g) main components of the forint coin: determined by MNB announcement or by MNB decree regulating the issue, denomination appearance of such forint coin: 1. denotation of denomination with numbers, year of minting, 2. inscriptions, particularly MAGYAR KÖZTÁRSASÁG 1, the word forint, and the mint-mark BP., 3. image depicting the coat of arms of the Republic of Hungary or various other themes, h) producer: actual producer of the reproduction, i) paper or paper base: writing, printing paper clearly distinct from banknote or security paper, used for writing, reproduction, printing, containing optical whitening [fluorescent in bluish-white colour, changing its characteristics observed in natural light when examined in ultraviolet (UV) light], and other paper, basic paper freely obtainable in commercial trade, j) legal tender: banknotes and coins defined under Article 4 (2) of MNB Act. Reproduction of forint banknotes and coins Article 3 (1) The reproduction of a forint banknote or a coin (hereinafter jointly: reproduction) is a real or virtual depiction of the whole or part of a forint banknote or coin, produced with any procedure whatsoever, which can suitable for producing the impression of a forint banknote or coin, irrespective of the size, material, colour of the reproduction, and whether it depicts a banknote or coin image corresponding to the given forint banknote or coin, or also contains a component not found on such notes or coins. 1 In English: Republic of Hungary.

3 (2) The main components and specifications of forint banknotes and coins, with the exception of those defined under paragraph (3), are defined in MNB announcements of MNB regulating the issue, denomination and appearance of such banknotes and coins, and MNB decrees. (3) The Annex to this Decree defines the main components and specifications of collector coins issued before 17 December, 1967 and still currently in circulation. Prohibited reproductions Article 4 (1) It is prohibited to produce or order the production of reproductions (hereinafter jointly: production) which may be confused with a forint banknote or coin. (2) It is prohibited to produce and to market in domestic and foreign trade objects from metal or any other material, deemed to be forint coin reproductions, particularly tokens, medals, plaques, chips, metal discs, toy and accessory money which are distinct from the given forint coin not including blanks intended striking coins if a) it contains the image depicted on the obverse, reverse and edge of the given forint coin, the word forint, the mint-mark BP. furthermore b) among its technical specifications 1. its diameter, varies within ±0.4 millimeter limits set from the diameter of any forint coin of which diameter is not larger than 30 millimeters, or within 5 millimeter limits set from the diameter of any forint coin of which diameter is larger than 30 millimeters, or 2. its weight varies within ±5% limits set from the weight of any forint coin which diameter is not larger than 30 millimeters or ±10% limits set from the weight of any forint coin of which diameter is larger than 30 millimeters. Compliant reproductions Article 5 (1) The forint banknote reproduction is compliant and may be produced with a paper base without the authorization of MNB if a) its material is clearly distinct from the banknote or security paper, and b) it does not include the coat of arms of the Republic of Hungary, the inscription Magyar Nemzeti Bank, certifying signature, and c) in relation to one-sided forint banknote reproductions, produced on the basis of only the front side or reverse side of a forint banknote, if 1. its size does not reach 75% of the length and width of the given forint banknote, or exceeds 125% of the length and width of the given forint banknote, or 2. it depicts only a detail of the front side or reverse side of the given forint banknote, and the size of the depicted detail is smaller than one-third of the given forint banknote,

4 or d) in relation to two-sided forint banknote reproductions, produced on the basis of the front side and reverse side of a forint banknote, if 1. its size reaches at least 200% or does not exceed 50% of the length and width of the given forint banknote, and 2. on its front side the framed inscription MÁSOLAT 2 diagonally, on the reverse side the framed inscription COPY is marked with an Ariel font in red or other colour contrasting with the background; the length of the framed inscriptions reaches 50% of the length of the forint banknote reproduction, its width reaches 15% of the width of the forint banknote reproduction, and the length of the frame corresponding to the colour of the inscription reaches 75% of the length of the forint banknote reproduction, and the width reaches 30% of the forint banknote reproduction. (2) Paper based forint banknote reproduction is compliant and may be produced for illustration purposes without the authorization of MNB a) in numismatic, specialized professional publications and public relations publications, not including educational materials (hereinafter: professional publications), if 1. the size of the published forint banknote reproduction corresponds to the size defined in paragraph (1) c) 1, or 2. the inscription MINTA 3 is marked in accordance with paragraph (1) d) 2, b) in advertisement publications, flyers, posters and other paper based advertising material (hereinafter: other publications), if the forint banknote reproduction is in accordance with rules set out under paragraph (1) a)-b) and c) 1. (3) The non-paper based forint banknote reproduction is compliant and may be produced without the authorization of MNB if a) its material is clearly distinct from banknote or security paper, and b) it is in accordance with rules set out under paragraph (1) b). (4) The forint banknote reproduction made accessible through electronic means, on an internet web site, with line or wireless facilities or any other procedure is compliant and may be produced without the authorization of MNB if a) it is in accordance with rules set out under paragraph (1) b), and b) it bears the MÁSOLAT and COPY inscription, as defined under paragraph (1) d) 2, and c) the resolution of the electronic reproduction in original size does not exceed 72 dpi. Article 6 (1) The forint coin reproduction is compliant and may be produced without the authorization of MNB if a) it does not bear the inscription MAGYAR KÖZTÁRSASÁG, the coat of arms of the Republic of Hungary, the mint-mark BP., and the word forint if the denotation of denomination is displayed, or the denotation of denomination if the word forint is displayed, and b) its technical specifications are in accordance with rules below: 2 In English: copy. 3 In English: sample.

5 or 1. its size exceeds 200% of the size of the given forint coin or is less than 50% of its size, 2. its weight is at least ±10 % clearly distinct from the weight of the given forint coin and its material is clearly distinct from the material of the forint coin. (2) The paper based forint coin reproduction is compliant and may be produced for illustration purposes in professional and other publications, without the authorization of MNB. Reproductions bound to authorization Article 7 (1) If the reproduction intended for production does not comply with any one rule relating to the given type of reproduction, set out in Articles 5-6 of this Decree, or any doubt arise as to compliance with these rules, it may only be produced with the authorization of MNB based on Article 34 (1) of the MNB Act. (2) The authorization application to be submitted by the user in writing, shall contain the following, with the exception of items set out under paragraph (3): a) name, address of the user; in relation to a legal entity or the name, registered office, chief executive officer of the organization in non-legal entity organization (hereinafter: organization), b) documents certifying data on the organization listed under point a) (in relation to organizations pending incorporation, incorporation application with attached receipt certification of the court of registration or other registration organs, incorporation certificate issued not later than three months for incorporated organizations, and document certifying registration for organizations registered in other records), c) data on the producer, as defined under point a), if the user and producer are not the same, d) the intended reproduction s 1. description, 2. number, 3. accurate graphic design (graphic illustration) and size, e) utilization purpose; f) description of the applicable reproduction procedure; g) definition of the basic material. (3) The authorization application for the production of reproduction used for illustration purposes in educational publications shall indicate the name and address of the user and items set out under paragraph (2) d) 1, 3 and g). (4) MNB authorize the production of a reproduction defined under paragraph (1) only if it cannot be confused with a forint banknote or coin. (5) If the user and producer are not the same, the reproduction may be produced on the basis of the authorization issued for the user, in compliance with the rules set out therein, without a separate (additional) authorization.

6 (6) The user shall present to MNB a sample of the reproduction produced in compliance with the authorization eight working days prior to the commencement of use. (7) Should the forint banknote reproduction, produced in accordance with the authorization of MNB, differ from the rules of Article 5 (1) d) of this Decree relating to the size of the reproduction and the inscriptions displayed thereon, in the course of the production and use of the reproduction, the user shall act in accordance with the rules of Article 8 of this Decree, relating to the registration, safekeeping and destruction of forint banknote reproductions. Rules relating to the registration, safekeeping and destruction of forint banknote reproductions Article 8 (1) Records shall be kept on forint banknote reproductions a) by the producer which allow the accurate determination of the number of forint banknote reproductions produced, handed over to the user and possibly misproduced reproductions, per denomination, date of the commencement, completion of production and the handover date of forint banknote reproductions to the user, and data set out under point b) if the forint banknote reproductions are used by the producer, b) by the user which allow the accurate determination of the number of forint banknote reproductions received from the producer, used for the purpose defined in the authorization, unused reproductions (hereinafter: remainder), per denomination, date of the receipt, delivery and return of forint banknote reproductions, address and location of use and safe keep, the number of forint banknote reproductions per denominations received and returned there, and number of persons participating in the implementation of the targeted use. (2) The user or the producer if the forint banknote reproductions are used by the producer shall separately, securely store and safe keep the forint banknote reproductions in a locked place until the produced forint banknote reproductions are handed over to the user, following receipt and until use, or until the destruction of the remainder. (3) The producer shall destroy upon the completion of production scraps arising during the production of forint banknote reproductions, as well as instruments used in the production process (e.g. film, plates, computer files, CDs, DVDs, floppy disks) before a committee composed of at least two persons and prepare a report on such destruction. The report shall indicate the number of destroyed forint banknote reproductions per denomination, name and quantity of plates or other instruments, place and date of the report and the signature of the committee members. (4) The user, or the producer if the forint banknote reproductions are used by the same, shall destroy the remainder before a committee, by the deadline set out in the authorization, and prepare a report on such destruction. The rules set out under paragraph (3) are governing in respect of the size of the committee and the content of the report.

7 (5) The producer or the user shall appoint a person responsible for compliance with handling rules relating to the registration, safekeeping and destruction of forint banknote reproductions set out in this Article and the authorization of MNB, and safe keep the records, reports made on the forint banknote reproductions for the period set out in the authorization. (6) The producer and the user shall provide information on the records, use, safekeeping and destruction of forint banknote reproductions in the manner and at the times indicated in the authorization, or as may be required in the written notice by MNB. Other rules relating to the production and use of reproductions Article 9 The issues relating to the production and use of reproductions not regulated herein shall be governed by the copyright law. Reproduction of euro banknotes and coins Article 10 (1) The European Central Bank holds the copyright on the design of the euro banknotes. Rules of the European Central Bank on the production of euro banknote reproductions and the enforcement of measures to counter non-compliant reproductions of euro banknotes in force shall be applied to euro banknote reproductions. (2) Rules of the Commission on the copyright protection of the common face design of the euro coins in force shall be applied to euro coin reproductions. Article 11 (1) Medals and tokens produced before 21 December, 2004 which do not comply with requirements set out in Articles 2-4 of Council Regulation EC (No) 2182/2004 of 6 December, 2004 concerning medals and tokens similar to euro coins, but are unsuitable for replacing euro coins, and may thus remain in use until 31 December, 2009, shall be reported by the user (distributor) to MNB for registration purposes. (2) Such report shall indicate the name of the user (distributor) and the producer, if the user (distributor) and the producer are not the same, the number of medals, tokens produced and the number of medals, tokens in stock on the date of reporting, and the accurate graphic illustration of the medal, token shall be attached. (3) The user shall send a report once annually to MNB on the number of medals, tokens in stock on 31 December until the year 2009, by the 15 th working day following the reference year. (4) MNB shall keep records on reported medals, tokens, and maintain records on the basis of reports on annual stocks.

8 (5) MNB shall notify the European Technical and Scientific Center (ETSC) on the records of medals and tokens. Provisional, closing provisions Article 12 (1) This Decree shall enter into force on the 30 th day following its announcement. (2) Reproductions produced before the effective date of this Decree, which are prohibited reproductions on the basis of Article 4 of this Decree, or not in compliance with rules set out in Articles 5-6 of this Decree and possibly confused with any forint banknote or coin, shall be handed over to MNB within 30 days following the effective date of this Decree, or destroyed in accordance with Article 8 (4) of this Decree. (3) Professional, educational and other publications issued before the effect of this Decree, using forint banknote reproductions for illustration purposes may be used in the future. (4) The reporting obligation set out under Article 11 (1) shall be fulfilled within 30 days following the effective date of this Decree. Article 14 (1) Article 10 of this Decree serves compliance with the EU legal acts below: a) Article 2 of Decision of the European Central Bank of 20 March 2003 on the denominations, specifications, reproduction, exchange and withdrawal of euro banknotes (ECB/2003/4), b) Articles 1-3 of Guideline of the European Central Bank of 20 March, 2003 on the enforcement of measures to counter non-compliant reproductions of euro banknotes and the exchange and withdrawal of euro banknotes (ECB/2003/5), c) Commission Communication of 22 October, 2001 on copyright protection of the common face design of the euro coins (COM/2001/0600). (2) Article 11 of this Decree sets out provisions required for the enforcement of the following EU provisions: a) Article 5 of Council Regulation (EC) No 2182/2004 of 6 December, 2004 concerning medals and tokens similar to euro coins, b) Council Regulation (EC) No 2183/2004 of 6 December, 2004 extending to the nonparticipating Member States the application of Regulation (EC) No. 2182/2004 concerning metals and tokens similar to euro coins.
