SCMA Distinguished Speaker Series 2016 ABOUT THE SPEAKER Following his graduation from Copenhagen University and the Institute of Maritime Law, Søren Larsen joined BIMCO in August 1985. Søren Larsen Deputy Secretary General BIMCO He was appointed Head of Department for Documentary and Legal Affairs in 1993 and became Deputy Secretary General, with primary responsibility for BIMCO s documentary affairs, in 1999. From 2005 to 2009, Søren Larsen assumed particular overview of the Documentary, Security & International Affairs, and Services Departments at BIMCO and is currently primarily responsible for BIMCO s Documentary and Education Departments. In addition, he represents BIMCO s and shipowners interests in various international fora, such as the IMO, UNCITRAL, ICC and CMI and works closely with the Secretary General in the management of the BIMCO Secretariat. He has represented BIMCO at meetings with various government bodies in the United States.

ABOUT THE CHAIRPERSON SCMA Distinguished Speaker Series 2016 Alvin joined North in September 2009 as part of the Freight, Demurrage and Defence (FD&D) department, having previously worked as a maritime lawyer in Gurbani & Co, Rajah & Tann LLP and at Skuld P&I Club. Alvin Looi Director The North of England P&I Association Limited He is based in the Singapore office of North since March 2010 and currently heads the FD&D team in Singapore, which has responsibility for the provision of in-house legal advice and the handling of FD&D work for Members of North in the Asia-Pacific region. Alvin sits on the SCMA Procedure Committee and the LMAA Supporting Members Liaison Committee (Asia Pacific).

SYNOPSIS OF SØREN LARSEN S SPEECH SCMA Distinguished Speaker Series 2016 BIMCO and Maritime Arbitration in the Asia Pacific The Baltic and International Maritime Council (BIMCO) is the world s largest international shipping association, with more than 2,200 members globally providing a wide range of services to their global membership which includes shipowners, operators, managers, brokers and agents. Their core objective is to facilitate the commercial operations of their members by developing standard contracts and clauses, providing quality information, advice and education. In promoting fair business practices, free trade and open access to markets, BIMCO also strongly advocates for the harmonisation and standardisation of all shipping related activity including the application of globally agreed regulatory instruments. Accredited as a Non- Governmental Organisation (NGO) with all relevant United Nations agencies and other regulatory entities, BIMCO in its agreement with the Singapore Chamber of Maritime Arbitration in November 2012 included the SCMA arbitration clause in BIMCO s dispute resolution clause which makes Singapore the third choice seat after London and New York. The address will touch on the history of BIMCO, how it came to be the leading generator of standard form maritime contracts and the origins of the London/LMAA, the New York/SMA and Singapore/SCMA arbitration clauses in BIMCO s Standard Dispute Resolution Clause. Getting Singapore/SCMA arbitration clause into BIMCO s Standard Dispute Resolution Clause was a significant milestone for SCMA and the paper will discuss the importance of what a presence in such forms represent, given that a substantial volume of maritime commerce is concluded using printed forms. It would also explore other areas which remain open to SCMA and what the future holds for Singapore and SCMA arbitration, including an insightful look at what Singapore and SCMA can do to assist BIMCO in encouraging parties to use BIMCO forms with Singapore/SCMA clauses.

SCMA Distinguished Speaker Series 2016 ABOUT THE PANELLIST Cameron is corporate counsel with Rio Tinto in Singapore practising in commercial law and disputes, having been in Singapore for 7 years. He was a disputes resolution partner in an Australian law firm and a barrister at the independent Bar, Head of Dispute Resolution for four States at National Australia Bank, acting Head of Legal for Rio Tinto in Mongolia before returning to Singapore. He is a Security of Payment adjudicator and a qualified mediator, having participated in many mediations either as counsel or mediator. He is a Fellow of the Chartered Institute of Arbitrators, the Singapore Institute of Arbitrators, the Australian Centre for International Commercial Arbitration and Fellow(Master) of the Association of Forensic and Advanced Valuation Executives. Cameron Ford Corporate Counsel Rio Tinto (Singapore) He is on the arbitration panels of the SIAC, SIArb, KLRCA, HKIAC and the Beijing Arbitration Commission and has conducted a number of arbitrations. He has an LLB from the University of Queensland, an LLM from the University of Melbourne and a Graduate Certificate in International Arbitration from NUS. He is a PhD candidate at Monash University on the topic of security of costs in international arbitration. He is a Member of the SIAC Users Council Executive Committee and Chair of the SIAC Users Council Committee for Australia and New Zealand. Nick Fell joined BW on 9 January 2012 as head of Corporate Services and General Counsel, and holds responsibilities for the Legal, Insurance, Corporate Secretarial and Communications departments. He holds an MBA in Finance from the University of Chicago, a Master of Laws from the University of Leicester and Bachelor of Laws from the University of Liverpool. He is admitted to practice law in England, New York, California and Hong Kong. Nick Fell Corporate Services and General Counsel BW Group Prior to joining BW, Nick was Chief Administrative Officer and General Counsel for AET Group (formerly known as American Eagle Tankers) based in London, where he led the Group s Legal, Risk Management and Compliance, HR and IT functions. From 1999 to 2005, Nick worked in San Francisco as In House Counsel at GATX Financial Corporation where he was responsible for the shipping, aviation and technology businesses worldwide. Nick is currently a Director of North of England P&I Association Limited.

SCMA Distinguished Speaker Series 2016 ABOUT THE PANELLIST David Martin-Clark Chartered Arbitrator & Commercial Mediator David Martin-Clark is an experienced maritime and commercial arbitrator, with an extensive background in P&I insurance. Before commencing his arbitration practice in 2002, he was Chief Executive and then Chairman of the Thomas Miller Group, managers of the UK P&I and Defence Clubs, the Through Transport Club and the Transport Intermediaries Club. After leaving Thomas Miller Group, David became an Associate Member of Stone Chambers in Gray s Inn, London and developed there an arbitration and mediation practice. He left Stone Chambers in March 2016 and since then been conducting his practice from his home address in Wallington, Surrey. He is a Chartered Arbitrator and Fellow of the Chartered Insurance Institute, a full member of the LMAA and a panelist with SCMA and SIAC in Singapore, with the KLRCA in Kuala Lumpur, with the HKIAC in Hong Kong and the CMAC in Beijing. He also arbitrates in Germany, as a member of the GMAA, Hamburg and in references administered by the ICC in Paris and Hong Kong. Elizabeth Leonhardt General Counsel SwissMarine S.A and group of Companies Elizabeth is a Solicitor (admitted to the Law Society of England & Wales) and also a Brazilian lawyer. Before joining Swissmarine in 2010 as General Counsel she was a partner at Clyde & Co in London. A primary part of her focus as General Counsel is the provision of in-house legal advice and the handling of all dispute resolution work for the Swissmarine group of companies in connection with contracts of affreigtment, charterparties, bills of lading and bunker supply contracts; she is also responsible for and/or oversees the insurance, corporate, compliance and regulatory affairs of Swissmarine. Elizabeth and her legal team are recognized by Legal 500 General Counsel Powerlist Switzerland as one of the leading in-house legal teams in Switzerland. Elizabeth is also a Consultant to Holman Fenwick Willan LLP specializing on Latin America related work. Elizabeth is a member of the International Bar Association Committee for Arbitration, Maritime & Transport and Insurance. She often attends international conferences as panelist or leading speaker and contributes articles to the related shipping and insurance press.

ABOUT THE PANELLIST SCMA Distinguished Speaker Series 2016 Dr. Colin Y.C Ong Arbitrator Dr Colin Ong Legal Services Dr. Ong is a member of the Brunei; English, and Singapore Bars. He is an associate member barrister and Chartered Arbitrator at Stone Chambers and Counsel at Eldan Law LLP in Singapore. He is a Master of the Bench of the Inner Temple and Arbitration Fellow at various institutions. He is the President of Arbitration Association Brunei Darussalam, the statutory default appointing authority. He has extensive court experience with important reported judgements in Brunei and English Law Reports. He is regularly instructed as counsel or arbitrator on major commercial and construction arbitrations within Brunei, England, China, Hong Kong, India, Qatar, Indonesia, Malaysia, Singapore and Thailand. He is a visiting professor of civil law as well as common law jurisdictions and has handled cases under many different governing laws. He was identified as one of 45 leading arbitrators under most major rules including AAA, BANI, HKIAC, ICC, LCIA, LMAA, KLRCA, SIAC, TAI and the UNCITRAL Rules. Dr. Ong is experienced in all aspects of commercial arbitration and construction arbitration, including: bridges, downstream plants, power stations, malls, pipelines, ports, rigs and roads; insurance; mining and minerals disputes; and energy disputes (coal mining and supply disputes, production sharing contracts, electricity supply, gas contracts and oil exploration joint ventures). He is Vice-President of the Asia Pacific Regional Arbitration Group ( APRAG ), former Vice President of the London Court of International Arbitration (Asia Pacific Users Council), and former Vice-Chair of the Arbitration Committee of the IBA. He is Advisory Board Member of the Indonesian National Board of Arbitration (BANI) and an Advisory Committee Member of the China-ASEAN Legal Research Centre, and is one of the members of the Cambodian National Commercial Arbitration Centre (NCAC). He is or has been a visiting professor of law at both civil law and common law universities including: Kings College London; Queen Mary University (London); National University of Malaysia (UKM); National University of Singapore (NUS); University of Hong Kong; University of Malaya; Universitas Indonesia; and Padjajaran University (Indonesia).
