Contribution ID: e248d932-fc94-4748-9974-fa75c390c3df Date: 16/12/2016 13:55:04 Public consultation for the evaluation of Directive 2006 /42/EC Fields marked with are mandatory. Introduction This open consultation concerns the evaluation of the Machinery Directive 2006/42/EC. The Machinery Directive aims to facilitate the functioning of the internal market for machinery while ensuring a high level of health and safety protection for machinery users (workers, consumers and other exposed persons) as well as environment protection for machinery used in pesticide applications. It defines mandatory essential health and safety requirements for machinery placed on the market or put into service within the EU (expressed by means of CE marking), and sets out requirements for associated conformity assessment, monitoring and enforcement procedures. Examples of products covered by the Machinery Directive include small hand held power tools, gardening machinery, construction machinery, industrial robots, etc. The provisions of this Directive have been incorporated into national laws. This consultation asks for your experience of the Directive as applied directly, and also as implemented through national laws. For simplicity however, we will refer to both as Machinery Directive in the questionnaire. The information you provide will be used strictly in accordance with the provisions of Regulation (EC) 45/2001 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. The content of your contribution and identity will be published on the Internet, unless you ask to remain anonymous. Are you aware that some products are labelled with a "CE marking"? Yes, and I understand its meaning Yes, but I do not understand its meaning 7. Does the presence of CE marking affect your purchasing decision? Yes, positively Yes, negatively t at all opinion 4

8. How effective do you believe authorities are in relation to: t at all To a limited extent To a large extent Entirely Don't know Monitoring machinery manufacturers on their adherence to health and safety requirements for their products Identifying unsafe machinery and removing it from the market Assisting economic operators in manufacturing and selling machinery 5

9. Over the past 10 years, based on your experience what has happened to: Decreased Decreased Increased Increased Don't significantly slightly change slightly significantly know The cost of ensuring that machinery is safe Usefulness of information provided with machinery when purchased The range and quality of machinery products available 6

The rate and extent of innovation in the machinery sector Turnover and profitability of the European machinery sector /businesses The international competitiveness of the European machinery sector /businesses The volume /value of intra- EU trade in Machinery 7

Barriers to enter the EU internal market/free movement of machinery User confidence in machinery safety The number of machineryrelated accidents and injuries The severity of machineryrelated accidents and injuries 8

The number of un-safe/noncompliant machinery on the market/in use The level of safety /protection for users of machinery (workers /consumers) 9

If you can, please provide explanations and examples: The sales of turbines in Europe decreased strongly and as a consequence intra- European trade decreased. 10. In your opinion, how important are the following objectives? t at all Slightly Moderately Very Don't important important important important know Ensuring the free movement of machinery within the European single market Ensuring a high level of health and safety for users of machinery (workers /consumers) Protecting the environment in relation to machinery for pesticide/herbicide application 10

If you have a good level of awareness about the Machinery Directive, would you spend a few more minutes and answer to the following more detailed questions? Yes Specific questions 11

11. In your experience, does the Machinery Directive (i.e. its scope and provisions) contribute towards these objectives? t at all To a small extent To a moderate extent To a large extent Entirely Don't know Ensuring the free movement of machinery within the European single market Ensuring a high level of heath safety for users of machinery (workers /consumers) Protecting the environment in relation to machinery for pesticide/herbicide application 12

12. To what extent, in your experience, the Directive: t at all To a small extent To a moderate extent To a large extent Entirely Don't know takes account sufficiently of new innovations and new technologies (e.g. robotics, advanced manufacturing, etc.)? sufficiently takes into account the recent changes in business environment? is likely to be able to deal with new innovations and technologies over the next 10 years (e.g. digitalisation of the single market: Internet of Things, Industry 4.0)? Please explain: The essential requirements of the Machinery Directive are about Health and Safety and do not prevent to apply protective measures using innovations and new technologies. However, in some cases, the use of more advanced manufacturing technologies and/or more innovative choices (less regulated and less consolidated) makes it more difficult to demonstrate compliance with the Machinery Directive (being not supported by specific public standards of reference). 13

13. On the contrary, can you point to particular areas where the Machinery Directive creates obstacles to: Innovations/new technologies Changes in the business environment Others Please specify: See explanation in question 12. Additionally, awareness of the importance of the directive needs to be raised. This is particularly relevant in the case of refurbishment of existing equipment. 14. To what extent is each of the following aspects of the Machinery Directive clear to you? t at all To a small extent To a moderate extent To a large extent Entirely Don't know The scope of the Directive (in terms of the machinery products covered) The essential health and safety requirements specified by the Directive in Annex I The requirements /obligations on you /your organisation (where relevant) 14

The scope of the Directive (in terms of the machinery products covered) Definitions of product categories Definition of partly completed machinery Obligations in case of modifications and refurbishment of machinery Others Please specify: Considering the field relevant for EUTurbines members, clarifications on the requirements and obligations in the case of 'interventions' (repairs or modifications) on Machinery / Partly- Completed Machinery are a very important aspect. 15. Have you encountered problems with the following? 15

Yes opinion Implementation of the Directive in EU countries The conformity assessment procedures available to companies The appointment of notified bodies to carry out conformity assessment The assessments undertaken by notified bodies The suspension, withdrawal or placement of restrictions on certificates issued The number of market surveillance activities The approach of national market surveillance authorities to determining compliance Inaction of national authorities to remove non complaint machinery from the market Fairness, proportionality and discouraging effect of penalties for infringements Others 16

Please explain: Based on EUTurbines members experience, there have been some problems related to market surveillance authorities, as there is not always a common interpretation of the Machinery Directive in the various Member States (the same problem also applies to Local Authorities in the same Member State). Such differences can have consequences in terms of costs and administrative burden. Main problematic areas: repairs and aftermarket replacements, substantial modifications, partly-completed machinery, safety components, assembly of machinery, some types of lifting accessories. In which EU country? Examples of cases mentioned above have been experienced in Italy, France and Germany Please describe the problem: Differences in views about the mandatory application of the Machinery Directive and / or National Legislation, depending on the type of intervention (modification or repair). 16. How would you rate the Guide to Application of the Machinery Directive? Very poor Poor Good Very good I am not aware of such guidance The Machinery Directive offers the choice of up to three different conformity assessment procedures, depending on the machinery in question and on the use of European harmonised standards. 17. Do you have experience with conformity assessment procedures? Yes Don't know 17

18. If you are aware of these conformity assessment options: Assessment of conformity with internal checks for products not covered by Annex IV Assessment of conformity with internal checks for products covered by Annex IV, where a European Harmonised Standard is applied that covers all applicable essential health and safety requirements EC-type examination for Annex IV products Approval by a notified body of a full quality assurance system for Annex IV products, which was introduced by the latest version of the Directive Please answer, how is the assessment of conformity with internal checks for products not covered by Annex IV... Very helpful Moderately helpful Rather not helpful t helpful at all opinion...facilitating the internal market for machinery (your ability to export to other countries)?...protecting the health and safety of machinery users?...protecting the environment in pesticide applications? 18

Please answer, how is the assessment of conformity with internal checks for products covered by Annex IV, where a European Harmonised Standard is applied that covers all applicable essential health and safety requirements... Very helpful Moderately helpful Rather not helpful t helpful at all opinion...facilitating the internal market for machinery (your ability to export to other countries)?...protecting the health and safety of machinery users?...protecting the environment in pesticide applications? Please answer, how is the EC-type examination for Annex IV products... Very helpful Moderately helpful Rather not helpful t helpful at all opinion...facilitating the internal market for machinery (your ability to export to other countries)?...protecting the health and safety of machinery users?...protecting the environment in pesticide applications? 19

Please answer, how is the approval by a notified body of a full quality assurance system for Annex IV products... Very helpful Moderately helpful Rather not helpful t helpful at all opinion...facilitating the internal market for machinery (your ability to export to other countries)?...protecting the health and safety of machinery users?...protecting the environment in pesticide applications? 19. Have you encountered any problems with: Yes opinion Assessment of conformity with internal checks for products not covered by Annex IV Assessment of conformity with internal checks for products covered by Annex IV, where a European harmonised standard is applied that covers all applicable requirements EC-type examination for Annex IV products Approval by a notified body of a full quality assurance system for Annex IV products which was introduced by the latest version of the Directive Has it happened during the last 5 years that approval of your product in one EU country was not recognised in another? 20

In which EU country? Cases have been experienced at least in Germany, France and Austria. Please describe the problem: Generally, minor issues, regarding interpretative aspects of the Machinery Directive for Machinery and Partly-Completed Machinery and Safety Integrated Systems (see also answers to previous questions). In other cases, CE marked components have not been considered acceptable and specific country requirements are being asked for which a special local market marking may be requested. EUTurbines members have also experienced cases of different risk evaluations, causing product modifications. In order to prove conformity to the essential health and safety requirements of the Directive, manufacturers can make use of technical specifications (standards). Harmonised standards at European level support the application of the Directive by translating the essential health and safety requirements into detailed requirements for certain types of products. 20. Have you been using European harmonised standards? Yes, mainly European harmonised standards Yes, both harmonised and other standards, only other standards, I have not been using any standards Please explain the reasons for your choice: There is no harmonised standard specific for Turbines and Electric Generators for Power Plants. In this sense, a combination of both harmonised and other standards are used on the basis of contractual requirements and specific products Codes, supporting the conformity to EHSR of the Machinery Directive. 21

21. How would you rate the following aspects relating to European harmonised standards supporting the Machinery Directive? Very poor Poor Good Very good Don't know The length of the European harmonised standards development process The cost and availability of European harmonised standards The product coverage of European harmonised standards The frequency with which existing European harmonised standards are revised How well European harmonised standards explain the rules or guidelines or definitions? The frequency of usage of European harmonised standards vs. other technical specifications The availability of European harmonised standards for new innovative products 22

Please explain your answers and if possible provide examples and quantifications: The process of reviewing standards may be long and burdensome, while at the same time, the review frequency, very high in some cases, may also hamper providing a stable framework to industry. Once a new standard is released, inconsistencies (due to references to old versions) should be addressed. Safety standards should be free of charge so that everybody is encouraged to use them. There is no harmonised standard specifically for Turbines and Electric Generators for Power Plants. In this sense, a combination of both harmonised and other standards are used on the basis of contractual requirements and specific products Codes, supporting the conformity to EHSR of the Machinery Directive. The peculiarity of certain products may lead to the use of international standards. 22. Are there areas where European harmonised standards are missing/not sufficient? Yes opinion Please explain: There is no harmonised standard specifically for Turbines and Electric Generators for Power Plants yet, but work within CEN is addressing this matter. A combination of both harmonised and other standards are used on the basis of contractual requirements and specific products Codes, supporting the conformity to EHSR of the Machinery Directive. The peculiarity of certain products may lead to the use of international standards. The Directive requires Member States to take all appropriate measures to ensure that machinery may be placed on the market/put into service only if it satisfies the relevant provisions of the Directive, and should establish an authority for monitoring conformity of machinery, as well as effective, proportionate and dissuasive penalties for infringements. 23

23. How effective do you believe national authorities are in relation to: t at all To a limited extent To a moderate extent To a large extent Entirely Don't know Identifying noncompliant products Removing noncompliant products from the market 24. From your experience, national authorities from which country or countries are especially effective/could serve as the best examples? Germany. Please explain why? Germany seems to be the country most thorough, where machinery is verified against most of the safety requirements. It should be noted that this verification, is, however, linked to the requirements before approval for operation, not the placing on the market. Still, this verification has then an impact on the product, which may need to be modified. Another issue identified in Germany, as mentioned in question 19, related to specific local requirements. 24

25. Can you point to any specific problems or barriers to: Lack of cooperation between customs t enough staff Wrong targeting of inspections /actions Others The effective identification of noncompliant products: The removal of noncompliant products from the market: Please specify: The lack of specific product knowledge may be a barrier to identify and remove non-compliant products. 26. What is your view on the likelihood of an individual company being inspected? Too low About right Too large Don't know 27. During past 5 years, have you been subject of a machinery related inspection? Yes What is the average number and frequency of inspections per product type you are subject to? Difficult to assess. Are there any countries where the number of inspections is especially high? Which are these and for which product category? Germany. 25

Are there any countries where the number of inspections is especially low? Which are these and for which product category? - Has it ever happened that you have been subject to multiple inspections for the same product in different EU countries? Yes Please explain: - 28. During the past 5 years have you introduced a new/modified machinery to the market? Yes What is a typical time from market entry to inspection? Difficult to assess. In the case of Germany, based on EUTurbines members experience, inspections are conducted before operation, not market entry. Are there any countries where this time is especially high? Which are these countries and for which product category? - Are there any countries where this time is especially low? Which are these countries and for which product category? - 26

29. What percentage of your products types have never been inspected during the past 5 years? Due to the similarities of products in terms of risk and design for safety, once a product is inspected, one may consider that all other similar products are covered. 27

30. What has been the impact of the Machinery Directive on: Substantial Some Some Substantial increase increase change decrease decrease opinion The costs and burdens on businesses The prices for users (workers /consumers) The costs and burdens on authorities The range and quality of machinery products available Quality of information and instructions relating to the safe operation of machinery 28

The rate and extent of innovation in the sector Turnover and profitability of the European machinery sector /businesses The international competitiveness of the European machinery sector /businesses Barriers to the internal market /free movement of machinery The volume /value of intra- EU trade in Machinery 29

Please explain your answers and if possible provide examples and quantifications: CE marked machinery is well accepted outside of Europe (except in rth America). Some areas have even created rules similar to the directive (e.g. EAC). 30

31. What has been the impact of the Machinery Directive on health, safety and environment? Substantial Some Some Substantial increase increase change decrease decrease opinion The level of user confidence in machinery safety The The number of machineryrelated accidents and injuries severity of machineryrelated accidents and injuries 31

The number of un-safe/noncompliant machines on the market/in use The level of safety /protection for users of machinery (workers /consumers) The level of environment protection in pesticide applications 32

Please explain your answers and if possible provide examples and quantifications: - 32. Could you give a specific example of where the Machinery Directive has had: a significant positive influence on innovation: For the requirements of technical specificities, Manufacturers are free to use any means of innovation tools, provided they meet the Essential Safety Requirements of Annex I. a significant negative influence on innovation: In some cases, the use of more advanced manufacturing technologies and/or more innovative choices (less regulated and less consolidated) makes it more difficult to demonstrate compliance with the Machinery Directive. 33

33. What benefits does the Machinery Directive bring to you, your organisation or the wider machinery industry/economy/society? The CE marking is positively influencing sales outside EU One standardisation procedure instead of 28 national standards saves time and money The existence of European harmonised standards saves time in finding appropriate technical specifications Self-certification cuts certification costs significantly The Directive protects the internal market from hazardous products made abroad Others Please specify: EUTurbines considers the Machinery Directive as one of the best functioning directives as it uses the New Approach and is based on the principle of selfcertification. Please explain and provide examples of your choice/s: Self-certification as used in Machinery Directive, clearly allows Manufacturers to be more competitive. By complying with the specific essential requirements, a high level of health and safety protection and the environment is guaranteed and documented. 34

34. In your opinion, are there any negative impacts of the Directive? Costs of certification is high Random ex-post checks are not eliminating all non-compliant products Divergent strictness of checks by national authorities creates a room for circumventing the rules European harmonised standards are not up-to-date with technological developments There are areas where European harmonised standards are non-existent or insufficient Process of European harmonised standards setting does not consider views of industry Self-certification procedure is too complex Risk assessment is too complex Others Please specify: - Please explain and provide examples of your choice/s: EUTurbines would like to point out that the Machinery Directive provides a well-functioning, stable legal framework for European Manufacturers that allows them to be present and remain competitive both in EU and global level. In some cases, different interpretations may lead to problems in application. This, however, does not mean that the directive has a negative impact, but rather that efforts to sort these issues out need to be made. 35

35. To what extent are the costs triggered by the Directive proportionate, given the benefits for: Benefits significantly outweigh costs Benefits slightly outweigh costs Benefits and costs are equal Costs slightly outweigh benefits Costs significantly outweigh benefits Don't know You/your organisation specifically Businesses Member State authorities Users (workers /consumers) Overall 36

36. Are there particular aspects/areas that you would highlight where the costs are disproportionate? - 37. Are there areas of the Directive s application where burden could be reduced? Assessment of conformity with internal checks for products not covered by Annex IV Assessment of conformity with internal checks for products covered by Annex IV, where a European harmonised standard is applied that covers all applicable requirements EC-type examination for Annex IV products Approval by a notified body of a full quality assurance system for Annex IV products Content of EC declaration of conformity Others Please specify: - Please explain and provide examples of your choice/s: comment. 38. To what extent does the Machinery Directive differentiate or fit with other EU legislation (e. g. Lifts Directive, Low Voltage Directive, Medical Devices Directive, Tractor Regulation, Directive on Use of Work Equipment at Work, Electromagnetic Compatibility Directive, Radio Equipment Directive, etc.)? t at all To a small extent To a moderate extent To a large extent Don't know 39. What kind of overlaps or inconsistencies with other EU legislation exist? Different definitions are used causing divergent interpretation Same product is regulated by two or more directives causing additional burden There is potential for regulatory arbitrage (choose less stringent rules) There is potential for multiple, repetitive inspection on same/similar issue Others 37

Please specify: Different approaches and surveillance by Authorities in the Member States (possible checks for each directive by different services, causing overlapping). It would be appropriate to define a clear common approach, able to guarantee compliance with all the essential safety requirements, but without having to use different procedures for assessing conformity, thus avoiding increases in time, costs and administrative burdens. Please explain stating which other piece(s) of EU legislation you refer to: - 40. What areas of implementation/application of the current Machiney Directive do you believe could or should be improved? How and why? There is not always a common interpretation of the Machinery Directive at Member State level. A challenging area is the partly-completed machinery. These challenges can be solved by means of guidelines/guidance of interpretation, outlining a common approach. 41. What areas could or should a future revision of the Machinery Directive aim to address? Why? EUTurbines believes that the Machinery Directive is a well-functioning piece of legislation, which should not be revised at this stage. The areas that could be improved that are been pointed out with this questionnaire, refer to areas that should be addressed through guidelines (for interpretation questions) or harmonised standards. Final questions If you have any studies, analysis or reports concerning the functioning of the Machinery Directive that you can share with us, please upload them here or send them to our functional e-mail box GROW-MACHINERY@ec.europa.eu (these documents will not be published). May we contact you to explore your answers in more detail? Yes 38
