CLOUD COMPUTING ACQUISITIONS DATA MINING IP PROTECTION AND SECURITY DEEP IN RESULTS Patent Claims Dismissed Against Online Client Real Estate Executive Purchases Denver.com Technology Client Retains Government Contract Five Elms Capital Backs Tech-Enabled Businesses Plaintiff s IP Delay Saves Client Millions SKC Communication Secures Private Equity Situation A leading provider of webbased digital imaging products and services for professional photographers faced business disruption because of a patent infringement lawsuit brought by a media sharing technology company. Result We obtained dismissal in federal court of the multipatent infringement suit relating to online photo sharing technology. In addition, the U.S. Patent and Trademark Office rejected certain asserted claims that were submitted for re-examination. Situation A real estate executive who owns more than 600 domain names, including Boulder.com and DenverRealEstate.com, sought to expand his internet footprint in the Denver area. Acting as advisors, we guided the executive s purchase of the Denver.com domain name. This website is a guide to the city and its culture. Result Domaining.com called the transaction one of the priciest geodomain, or geographic name, sales in history. Our client is confident that Denver.com will drive more online traffic to the residential real estate brokerage company and will appreciate over time. Situation A technology-based design contractor that provides a range of products and services to military and commercial customers had a contract awarded by the Army to deliver a 3-D training system challenged by a competitor. Performance of the contract was put on hold pending the outcome of the challenge. Result The U.S. Small Business Administration Office of Hearings and Appeals accepted all the arguments raised on behalf of the contractor and rejected the competitor s challenge, allowing the contractor to retain the award and move forward with the design and development of the training system. Situation Private equity firm Five Elms Capital focuses on capitalizing servicebased businesses that use technology to improve value propositions, lower costs and accelerate growth. Our attorneys were engaged to guide Five Elms Phase I funding through its initial investment period. Result Understanding the unique aspects of leading Five Elms through its first fund, our attorneys had the right industry expertise to handle all issues related to fund formation, portfolio investment and ongoing services to portfolio companies. We continue to help Five Elms commit capital for additional companies. Situation A high-efficiency induction motor had been powering some of our client s air conditioners since the 1970s. Nearly two decades later, plaintiff claimed this motor was infringing on his patent, and he sought in excess of $450 million in damages. Result Citing the plaintiff s procrastination in asserting his claim, we obtained summary judgment on behalf of our client. Two federal courts agreed that our client was not at fault because the plaintiff had a duty to investigate the alleged patent infringement but had failed to do so. Our IP litigators made important new law under the doctrine known as laches. Situation SKC Communication Products works with pre-eminent manufacturers to deliver technology solutions that lower costs and increase productivity. SKC retained our corporate team of technology lawyers to provide counsel on an expansion investment by private equity firm McCarthy Capital. Result Our attorneys seamlessly facilitated SKC s expansion and helped set the stage for future acquisitions and growth beyond the 14 Midwestern states where the company currently operates.
