Assessing the Impact of INSPIRE on Related EU Marine Directives Roger Longhorn Senior Information Policy Analyst, Compass Informatics Ltd (Ireland) Information Policy Advisor, The Coastal & Marine Union (EUCC) Member, INSPIRE Thematic Working Group Area Management Member, WG-DIKE (Data, Information & Knowledge Exchange) rlonghorn@compass.ie / compass.ie / www.eucc.net

Today s Presentation Drivers for Marine Information in the EU Brief background on INSPIRE for marine community INSPIRE & the Marine Strategy Framework Directive Hydro12, Rotterdam, 13 November 2012 2

Drivers for Marine Information in the EU Various Conservation & Habitat Directives (1992 ) Water Framework Directive (2000) ICZM Recommendation (2002) Bathing Water Quality Directive (2006) Water Protection Directive (pollution) (2006) Water Quality Directive (for shellfish) (2006) Flood Risk Assessment Directive (2007) EU Integrated Maritime Policy (2008 ) EC Regulation for development of an Integrated Maritime Policy (2011) Marine Strategy Framework Directive (2008) Hydro12, Rotterdam, 13 November 2012 3

Associated Information Provision Directives Legal Protection of Databases (1996) Personal Data Privacy Protection (1997) IPR Directives (and national legislation) 1998 Access to Environmental Information Directive (2003) Exploitation of Public Sector Information (2003) Directive implementing the Aarhus Convention (2003) Hydro12, Rotterdam, 13 November 2012 4

Underpinning Information Programmes & Initiatives (EC & EEA) SEIS - Shared Environmental Information System Goal is to underpin environmental reporting using harmonised data online WISE - Water Information System for Europe (water component of SEIS) WISE-Marine (marine component of WISE) EMODnet (European Marine Observation & Data Network) INSPIRE (multiple data themes) GMES (e.g. MyOcean services) International & Regional Seas Conventions Hydro12, Rotterdam, 13 November 2012 5

EMODnet European Marine Observation & Data Network EMODnet is being designed to deliver the data and data products that underpin indicators used to assess the state of the marine environment and pressures on it, thus supporting the future implementation of the MSFD Directive and WISE-Marine. EMODnet respects INSPIRE implementing rules for data and metadata. "Approved the process proposed by WG DIKE for further technical development on the data sets associated with the Initial Assessment, with a view to making selected priority data sets accessible in agreed formats by January 2013, working towards INSPIRE compliance where possible. Hydro12, Rotterdam, 13 November 2012 6

Marine Strategy Framework Directive Overall goal is to achieve Good Environmental Status via appropriate marine strategies. Provisions in the MSFD include: Assessment of current status of marine environment Analysis of pressures & impacts on marine environment Determining current GES ( via a set of characteristics for good environmental status, on the basis of the qualitative descriptors ) Establishing environmental targets Establishing monitoring programmes Identifying measures to achieve GES (the marine strategies) Reporting (to the Commission and public) Hydro12, Rotterdam, 13 November 2012 7

Marine Strategy Framework Directive Monitoring & reporting via Indicators Physical and chemical features Habitat types Biological features Other features Physical loss Physical damage Other physical disturbance Interference with hydrological process Contamination Nutrient & organic matter enrichment Biological disturbance Technical implementation specifications developed (DG ENV WG-DIKE advises) Hydro12, Rotterdam, 13 November 2012 8

INSPIRE Aim: To ensure that the SDI (spatial data infrastructures) of the Member States are compatible and usable in a Community and trans-boundary context Mechanism: INSPIRE Directive requires that common implementing rules be adopted in a number of specific areas across 34 data themes: metadata, data specifications, network services, data and service sharing, monitoring and reporting. Hydro12, Rotterdam, 13 November 2012 9

INSPIRE Data Themes (with marine relevance) ANNEX I 1. Coordinate reference systems 2. Geographical grid systems 3. Geographical names 4. Administrative units 5. Addresses 6. Cadastral parcels 7. Transport networks 8. Hydrography 9. Protected sites ANNEX II 1. Elevation (includes bathymetry) 2. Land cover 3. Orthoimagery 4. Geology (includes seabed sediments & coastal geomorphology Hydro12, Rotterdam, 13 November 2012 10

INSPIRE Data Themes (with marine relevance) ANNEX III 1) Statistical units 2) Buildings 3) Soil 4) Land use 5) Human health and safety 6) Utility and governmental services 7) Environmental monitoring facilities 8) Production and industrial facilities 9) Agricultural and aquaculture facilities 10) Population distribution/ demography 11) Area management / restriction / regulation zones (includes CZM) 12) Natural risk zones 13) Atmospheric conditions 14) Meteorological geographical features 15) Oceanographic geographical features 16) Sea regions 17) Bio-geographical regions 18) Habitats and biotopes 19) Species distribution 20) Energy resources 21) Mineral resources Hydro12, Rotterdam, 13 November 2012 11

INSPIRE v. Marine Strategy Framework Directive Can INSPIRE underpin MSFD reporting? Implementation timing incompatibility INSPIRE implementation roadmap MSFD reporting roadmap The data completeness test INSPIRE harmonised data v. MSFD data requirements for indicators and measuring GES INSPIRE implementing Regs do propose to use code lists from MSFD (and other Directives) Hydro12, Rotterdam, 13 November 2012 12

MSFD Implementation Roadmap Hydro12, Rotterdam, 13 November 2012 13

MSFD Implementation Roadmap Hydro12, Rotterdam, 13 November 2012 14

INSPIRE Implementation Roadmap Today Hydro12, Rotterdam, 13 November 2012 16

INSPIRE Implementation Roadmap Tomorrow Hydro12, Rotterdam, 13 November 2012 17

INSPIRE Implementation Roadmap the End! Hydro12, Rotterdam, 13 November 2012 18

INSPIRE v. MSFD Data Specification Issues w.r.t. detailed data specifications for harmonisation of data in INSPIRE Applies only to what we know now may change in future Produced in committee (not necessarily inclusive for all stakeholders/uses within a theme) Difficult to implement INSPIRE compliance for single datasets incorporating multiple themes Data specs are embedded in legislation (a 375 page EC Regulation for Annex II & III themes!) [489 pages total!] INSPIRE already has data access & sharing principles embedded in EC Regulation (law!) As with MSFD, existing international conventions must be taken into consideration including marine conventions Hydro12, Rotterdam, 13 November 2012 19

MSFD Data Requirements Issues - Marine Regional Boundaries MSFD simply states names for marine regions marine region means a sea region which is identified under Article 4. Marine regions and their subregions are designated for the purpose of facilitating implementation of this Directive and are determined taking into account hydrological, oceanographic and biogeographic features; Baltic Sea North-east Atlantic Ocean the Greater North Sea, including the Kattegat, and the English Channel the Celtic Seas the Bay of Biscay and the Iberian Coast in the Atlantic Ocean, the Macaronesian biogeographic region, being the waters surrounding the Azores, Madeira and the Canary Islands Mediterranean Sea the Western Mediterranean Se the Adriatic Sea the Ionian Sea and the Central Mediterranean Sea the Aegean-Levantine Sea Black Sea Hydro12, Rotterdam, 13 November 2012 20

MSFD Data Requirements Marine Regions Boundaries Still not fully agreed after nearly 2 years consultation! Hydro12, Rotterdam, 13 November 2012 21

An Issue Affecting All Initiatives The various Directives (WFD, MSFD, INSPIRE, ) set the general rules as to what data is to be collected and reported, however at implementation time, the experts groups developing the data and service specifications for implementing the Directives all contain different people, operating to different time-lines, with differing backgrounds, resource capacities, etc. So we should not be surprised that inconsistencies (and some confusion!) arise during actual implementation of the Directives. Hydro12, Rotterdam, 13 November 2012 22
