In the seminar we will concentrate on European Patent Law, but lectures about Community Trademarks and patent and trademark infringement will also be given. Extensive reference to relevant Board of Appeal decisions will be made. All lectures will be held in English by members of our firm as well as guest speakers from the European Patent Office and other institutions. Apart from the legal aspects, the lectures will also include practical exercises. Additionally, we will provide the opportunity to attend oral hearings in an opposition proceeding before the European Patent Office in Munich. Furthermore, various leisure activities will be offered to the participants, for example a trip to the famous castle Neuschwanstein, a cultural event, as well as a trip to the beautiful city of Salzburg in our neighboring country Austria. Level of the course: As mentioned above, our seminar is directed to participants who already have knowledge of patent law and wish to improve their expertise in European patent law.
Costs: The costs for the 10 day seminar will amount to EUR 1,500.00. This includes all lectures and materials, leisure events, as well as lunches and the Gala Dinner on Thursday night. Flights and accommodation are not included in the fee. However, we shall be pleased to assist you with the booking of your hotel room. KADOR & PARTNER The Lectures Presented by the Kador & Partner attorneys, the lectures will be enriched by the valuable contribution of prominent IP professionals from the EPO, private practice and industry. First, an overview of the European patent system and of the major procedural steps up to the granting of the application and of the available post grant procedures will be provided. Then, the following topics will be discussed in more details. Exceptions to patentability Subject matter not accessible to patent protection will be discussed in light of the most recent board of appeal decisions. Particular emphasis will be given to the EPO practice with respect to biotechnology inventions. Exemplary topics cover methods for treatment, diagnostic methods, dosage regimen, biological inventions and breaches of morality. Novelty The established principles of novelty will first be presented. Then, drawing from the existing case law, the lecture will focus on the novelty requirements of selection inventions; medical and non medical use claims; product by process claims and disclaimers. Availability of information to the public for the purpose of assessing novelty as well as public prior use will also be discussed. Inventive step The well-defined problem-solution-approach to assess inventive step using the perspective of the skilled person will be outlined and explained in detail by way of examples. The session will also deal with the definitions of person skilled in the art, state of the art and with the use of these definitions in the assessment of inventive step. Specific attention will be given to partial problems, selection inventions, optimizations of parameters and new uses. Clarity/Disclosure of the invention The requirements of Art. 83 EPC concerning sufficiency of disclosure and of Art.84 EPC concerning the clarity of the claims will be analyzed. The extent of disclosure necessary, in particular with reference to the examples of the invention as well as the extent of generalization allowed under the EPC will be outlined. The principles for drafting claims in conformity to the clarity requirements will be discussed.
Amendments The allowable amendments of the application and claims will be discussed in view of the increasingly stringent requirement of Art. 123(2) EPC and the most recent, relevant board of appeal decision will be presented. The extent to which voluntary amendments are possible will be described. Community patent The main principles behind the EU patent, European Patent with unitary effect in the countries of the EP community, will be presented. The correlation between the EPC and the EU patent, translation requirements and the upcoming patent court system receive specific attention. The most recent developments as well the date of entry into force will be discussed. A prospective view on the unified patent litigation system will be given. Opposition and Appeal procedure The lecture will offer a summary of background information and recent development in the practice of opposition and appeal in front of the EPO. Drawing on case law and on the speakers experience, strategies to defend or attack a European patent in these third parties proceedings will be presented. The lecture will also focus on admissibility of evidences and amendments. Attending to an oral proceeding in an opposition case is envisaged. Patent filing strategies and patent policies The importance of developing a patent filing strategy and a patent policy to improve the efficiency and to save costs in a global patent department will be discussed. Guidance to define the policy that suits your needs will be provided. Litigation and infringement proceedings An overview of the different patent infringement-litigation systems in Europe and differences among them will be given. A more detailed discussion will concern patent infringement-litigation procedure in Germany. The lecture will cover principles of the doctrine of equivalence, preliminary injunctions, calculation of damages, cost issues and deal with settlements and litigation strategies. Community trademarks A general overview of community trademarks and the registration process together with the advantages of a community trademark registration will be outlined. Further, recent important decisions from the OHIM Boards of Appeal as well as the Courts (General Court and Court of Justice of the European Union) will be provided. -2-

Not far from Neuschwanstein Castle is the famous Wieskirche, a church of pilgrimage that was added to the UNESCO World Heritage List in 1983. The church is a exceptional masterpiece of baroque architecture. Our Gala Dinner at restaurant Käfer: Käfer is a traditional Munich restaurant with high class cuisine. It is well visited by local and foreign celebrities. Visit to Salzburg: Dreaming spires, green hills and romantic gardens - the city s attractions are loved by millions of visitors from all over the world. Salzburg means "salt castle", referring to its massive fortress and the white gold from the mountains. The city s magnificent baroque town centre is rated as a UNESCO World Cultural Heritage site and we will explore it together by foot, also visiting Mozart's birthplace where the celebrated composer, was born on January 27, 1756.
