ge ne ra l c ondi ti ons of s a l e The validity of this price list starts from June the 1 s t 2012 and replaces any prior edition. Prices are in US $. Delivery of the goods: Ex Works Forlì, Italy. Prices are included standard export packaging. Carton boxes are available upon up charge. Leather Samples serve only as a color reference and must not be considered as an absolute reference. Natural variations within acceptable tolerance can occur to leather color, shade and grain. For leather care & maintenance please refer to the instructions attached to our products. We disclaim any responsibility for procedures or products which have not been recommended by us. No Warranty will be given on products upholstered with Customer s Own Leather. All our products are handmade. Measures may vary with a tolerance up to 3%. The direction of sectional elements is always given by the position of the arm while facing it: Right Arm Facing or Left Arm Facing. Orders for discontinued models or leathers will be accepted until stocks run out. Please contact our Sales Dept. for availability and cost of discontinued models or leather. Gamma reserves the right to change the product improving technical or esthetic features at anytime without notice. warranty Gamma products which are originals and exclusive in their design are the result of technical and esthetical research. They are manufactured through a quality certified production UNI EN ISO 9001:2000 (9001:2000)". Warranty coverage periods for Gamma products are as follows: Frame: 10 Years Suspensions: 5 Years Leather: 3 Years Stitching: 2 Years Cores: 2 Years Mechanism: 2 Years This warranty is offered to the original customer/owner; is not transferable; and begins from the date of purchase by the original customer/owner. Claims under this warranty should be made to the retailer where the product was purchased or through a retailer authorized by Gamma. Once the warranty coverage period expires, repairs will be charged by Gamma to the customer including but not limited to the labor, material, shipping and staff costs. Gamma will repair or replace, at its option, any defective workmanship or material found in the product but only after receiving authorization for such repair or replacement from one of its representatives. Defects In workmanship and materials are defined for the purpose of this warranty as (1) causing the product to be structurally or mechanically unsound, or (2) substantially altering the appearance of the Gamma product. The choice of a smooth and less firm aspect of some of the styles of our collection demands the use of a softer foam to give to the sofa a more relaxed and cushy image. This style is not to be considered as a defect, but a standard feature as shown in our brochures or during the several Fairs, at which we present our products. For these reasons and for the aforedescribed styles, the customer will receive a product in line with these standard features. The eventual softening of cushioning should be expected as a result of normal use and is not to be confused with loss of resiliency due to defects in construction or material. A different density of the foam may be requested through a written purchase order. In the event materials are needed for a replacement and they are not available, Gamma has the right to substitute these unavailable materials with ones of corresponding or equivalent quality. Gamma will not be liable to any person for any special, incidental, indirect or consequential damages, including without limitation, damages resulting from the use or malfunction of the products, loss of profits or revenues or cost of replacement goods. In any case, the liability of Gamma Arredamenti International Spa shall be limited to the purchase price of the product covered by this warranty or the value for a replacement. This warranty applies under conditions of normal usage and does not apply to defects resulting from misuse, accidents, negligence, normal wear and tear, acts of God or vandalism. The products are not warranted for commercial use, contract, rental trade or other non residential uses. This warranty does not apply for circumstances where there has been an improper cleaning abuse, utilization of chemical products, overexposure to sunlight, extreme heating sources, and sunlamp, spots caused by acids, solvents, staining, chemical corrosive agents, ink, paint, or bodily fluids. Every piece is identified by a numerical number located on the frame under each piece. Every removal or counterfeit of this number will cause the loss of the warranty. Gamma Arredamenti International Spa makes no other warranties. No modification of these terms or releases is allowed unless officially authorized by a Gamma official and in writing. This warranty gives the customer/owner specific rights which may vary from State to State. warranty procedure In order to proceed in the evaluation of alleged defects in Gamma products, it is essential to support any claim with detailed pictures. In case of defective or faded leather claims, the product in question will need to be examined by the tannery. For this reason it will be required to send the item to Gamma. The shipping costs may be paid by Gamma, but only in its sole and absolute discretion. It takes 15 days for an answer to be received by Gamma on the testing of the leather by the tannery. In the event it is determined that a defect was caused during the production of the leather, Gamma will proceed with the replacement under its warranty. Documentation Once the furniture has been delivered to the showroom, Gamma supplies the price list, the sales tools and depending from the country, also a technical sheet that specifies the standard features and details of the materials. The warranty applies only to the standard features as shown in the technical sheet or price list or an eventual modification that was previously requested in the purchase order. Cores The density of Gamma's cores in polyurethane can change worldwide. You have received standard cores for your country. If you wish a density of the cores that differs from the company s standard cores, you must specifically indicate it on the purchase order. Other way for the replacement of those cores you will be charged for the cost of the new cores, packing and shipping. The leather covering is guaranteed against tearing and splitting only for the residential use of the product. Gamma supplies, together with the sales tools for each type of leather, a technical sheet with a detailed description of the features. Even if the same method and the same color are used from the tannery for each lot of leather, the country of origin and the nutrition of the animal can define the final dye lot of the leather. Therefore the colors of the different leathers shown in our sales tools must be not be considered as an absolute reference. Wrinkling or natural markings from injuries to the skin, variations in grain or color variations resulting from the natural features of the leather are proof that only genuine leather has been used in the production of our products. Seams The standard seams we use to finish off our styles are identified with code numbers in the technical sheet enclosed in our price list. Threads The threads we use in our seams are to be considered "standard" when their color is a shade lighter than the color of the leather. NB: Any changes from the standard features (for example matching thread or different seams) are free of charge if specified on the purchase order. over all t ec hinc al inf or m at ion Frame Frames are made all in fir wood. All joints are reinforced with full corners blocks. Cushions filling material Every product produced by Gamma has a standard foam density which can vary depending from the comfort, look and design of the product. Certain styles may require the usage of feather down cushion while other may have double density foam. Firmer foam may be available upon request on selected products. Pls. check on price list features of each model. All filling materials comply with California Technical Bulletin 117 Sec. A.D.E. - License no. MFG 124950 Registry no. CA 34476 IT Coil Springs Standard suspension is made with crossed reinforced webbing. Stitches Different kinds of stitches are available on our products. Gamma offers the possibility to change stitching style on every frame with an up charge of: 5% for our Standard Stitching Collection 10% for our Special Stitching Collection Thread Colors Our standard thread color is one shade lighter than the leather. Matching thread is also available with no up charge. Piping Eleven different colors of piping are available to choose from at no additional charge. For self welt or any other color our leather collection requires a 3% up charge. Legs Every style comes standard with a specific leg style. Legs style can be changed choosing between our wood or metal leg collections. Up charge is required when changing leg from wood to metal only. Customization in the height of leg is also available upon request with an up charge. Finished Sides Leather finished sides on sectional elements are available with a 3% up charge. Two Tones Leather Sofas can be ordered with frames and cushions covered with leathers from different categories. The price will be determined by the arithmetic mean of the two leather categories Custom sizes Customization in length up to 12 longer or shorter requires a 25% up charge. Customization in length from 12 to 18 longer or shorter requires a 35% charge. For any other customization please contact the factory for a proper quote!!! mi ni mum re ta i l pri c e pol i c y me mo In keeping with Gamma s commitment to manufacturing and marketing high profile Italian fur niture and leather products for the most sophisticated tastes throughout the United States and the world, Gamma believes that to further foster that goal, it is in the best interests of Gamma, its dealers and customers to adopt a Minimum Retail Price Policy applicable to all dealers in the continental United States, excluding Alaska, effective on May 15th, 2011. The Policy will be applicable to all Gamma products including sofas, furniture and other leather products sold through Gamma s dealer network. Gamma will sell its products after the effective date to its dealers offering for sale Gamma products at prices no less than the Minimum Retail Price. All dealers are free to offer Gamma products at prices in excess of the Minimum Retail Price at any time. The policy would not be applicable to sale periods (twice a year for a 1 month period each time in February and October) nor to promotional activities approved or established by Gamma management from time to time. The sale of floor samples would also be exempt from the Minimum Retail Price Policy, if such floor sale prices, terms and sale periods (not to exceed 30 days length) are previously approved by Gamma management at the request of a particular dealer. Gamma has established minimum retail prices for each category of product which it manufacturers. Minimum Retail Prices will be available to dealers on the Gamma price list which dealers will receive prior to the effective date and which will be updated by Gamma from time to time. Minimum Retail Prices may be changed by Gamma only upon advance notice to its dealers. All Minimum Retail Prices are net of applicable shipping costs charged to dealers, and state and local sales taxes. Dealer may not reduce the price of any product to less than the Minimum Retail Price plus the full amount of the applicable state or local sales taxes. Dealers may not advertise Gammas Minimum retail Price Policy on the internet, on any dealer website nor in advertising literature. No dealer promotion or advertisement may include references to terms like Free Freight nor to any other terms contrary to the provisions of the Minimum Retail Price Policy. Gamma will provide answers to frequently asked questions by dealers regarding its Minimum Retail Price Policy and any changes to the policy, and any changes to the policy, via Gamma s web site and in bulletins to dealers issued from time to time. Gamma believes that the adoption of the Minimum Retail Price Policy will encourage dealers to advertise and promote Gamma s products to sophisticate and quality oriented buyers. Nevertheless dealers are free to sell all of Gamma s products at whatever price they choose, and receipt of this Policy Memo by the dealer does not constitute the agreement of any dealer to live up to its terms. The determination of whether a dealer is complying with Gamma s Retail Price Policy, and any actions or penalties relating thereto shall be taken or imposed by Gamma alone on a case by case basis whenever that decision has to be made. Gamma will investigate any claim of noncompliance discovered by Gamma or brought to Gamma s attention by any other competing dealer. Gamma will cease selling any of its products for a period of Ninety (90) days, for a second violation after first notification and one year (each subsequent violation), to a retailer who sells or offers to sell any piece in the Gamma collection to a price below the suggested minimum price. When the term Gamma is used in this Policy Memo it shall also include Gamma Arredamenti International, Inc., Gamma s wholly owned U.S. subsidiary.
