Motion to hold this case over to the September 8, 2010 meeting of the Omaha Plumbing Board. AYES: Estabrook, Miller, Reed, Salem, Wellendorf Motion carried 5-0 9/8/2010 David Radcliff appeared before the Board with a request for additional time to complete his 2009 continuing education requirements. Mr. Radcliff is missing four hours of continuing education in 2009. He has completed the requisite number of hours in past years. When asked why he did not complete his continuing education requirements within the deadline, Mr. Radcliff stated that he missed the classes offered by Plumber s Local Union 16 in the spring, and later in the year thought that he had completed the required number of hours until he was notified otherwise by the Board Secretary. Motion by Mr. Wellendorf to grant Mr. Radcliff an extension to December 31, 2010 to complete a total of four continuing education hours and four penalty hours for 2009. Mr. Radcliff must also complete his required eight hours of continuing education for 2010. Plumbing Board Page 3 10-9-130 Jon P. Miller 12616 S 218 Av Omaha NE 68028 Request for additional time to complete 2008 & 2009 continuing education requirements. 49-215 Jon P. Miller appeared before the Board to request additional time to complete his continuing education hours from 2008 & 2009. Mr. Miller is missing a total of twelve hours of continuing education. Mr. Jon Miller stated that in 2008, his company sought and was awarded approval by the Plumbing Board for a total of four two-hour continuing education classes (Case numbers 8-1-4, 8-12-178, and 8-12-179). These classes were taught by Mr. Jeff Miller (see next case). Mr. Miller received credit for the first and second classes; however, it appears that sign in sheets were not received for the third and fourth classes given by JTM Plumbing Service Inc. Mr. Jon Miller asked that Board if they would allow the Board Secretary to re-create the sign in sheets so that credit for his attendance may be recorded. Mr. Estabrook asked Mr. Virgil for the Plumbing Division s opinion on this matter. Mr. Virgil stated that the Board has traditionally accepted written verification from the instructor if a person s attendance at a class is in question. Mr. Virgil concluded that the Plumbing Division had no objection to the sign in sheet being reprinted for these classes. Mr. Jon Miller stated that in 2009, he attended a class given by the Rural Water Association, where he obtained his Grade VI Water Operator license. Mr. Miller stated that he was told by the Instructor of this class that it had been approved for continuing education hours through the City of Omaha. However, according to Plumbing Board records, the Rural Water Association did not request approval of continuing education classes in 2009. Therefore, Mr. Miller received no CEU credit towards his Omaha license. Mr. Miller submitted for the Board s review a certificate stating that he was in attendance at the class and that he received a Grade VI license. Mr. Miller asked the Board if they would grant him credit retroactively towards his 2009 hours. Mr. David Miller, Chairman of the Plumbing Board, stated that the Board does not grant credit for classes which have already taken place. Mr. Jon Miller asked if the Board would be willing to waive any penalty hours for 2009 if he were to make these hours up before the end of the year. After some discussion, Mr. Reed made a motion to allow Mr. Jon Miller to resubmit the necessary sign in sheets in order to bring his 2008 hours current; and to grant Mr. Jon Miller until December 31, 2010 to complete eight hours of continuing education towards his 2009 requirements. No penalty hours will be assessed for Mr. Jon Miller s missing hours in 2009. Mr. Miller must also complete his.required eight hours of continuing education for 2010. Second by Mr. Salem. 10-9-131 Jeff Miller 12410 Hickory Rd Omaha NE 68144 Request for additional time to complete 2009 continuing education requirements. 49-215 Jeffrey P. Miller appeared before the Board to request additional time to complete his 2009 continuing education hours from 2009. Mr. Miller is missing a total of eight hours of continuing education. Mr. Jeffrey Miller stated that in 2008, he attended the Continuing Education Make-up Class given by the Omaha Plumbing Division. Mr. Jeffrey Miller stated that he attended this class because he was missing continuing education hours. However, due to the Board s decision (see case no. 10-9-130) to allow JTM Plumbing Service Inc. to resubmit sign in sheets for credit, he will now have an overage of hours in 2008. Mr. Jeffrey Miller asked that the Board move eight hours of this overage to cover his missing 2009 continuing education hours. After some discussion, the Board denied this request, citing that the Board does not move hours in a forward direction. Unfortunately, Mr. Jeffrey Miller is current on his continuing education hours for all years prior to 2008; otherwise, the Board could move this overage to cover any delinquencies in those years.

Plumbing Board Page 4 Mr. David Miller, Chairman of the Plumbing Board, stated that Mr. Jeffrey Miller would be required under code to complete four penalty hours in addition to making up his missing eight hours of continuing education in 2009. However, after some discussion, the Board members agreed that this penalty would be waived due to Mr. Jeffrey Miller s attendance at the 2008 Continuing Education Make-Up Classes. Motion by Mr. Estabrook to grant Mr. Jeffrey Miller until December 31, 2010 to complete eight hours of continuing education towards his 2009 requirements. No penalty hours will be assessed for Mr. Jon Miller s missing hours in 2009. Mr. Miller must also complete his.required eight hours of continuing education for 2010. Second by Mr. Wellendorf. 10-9-132 Bill Condon Jensen Well Company 767 Iowa Street Blair NE 68008 Waiver to allow replacement of an existing well. Location: 13746 Military Rd, 68142 49-1510 Bill Condon of Jensen Well Company and Cathy Mertz, homeowner, appeared before the Board to request a waiver to allow the replacement of an existing well. The Plumbing Board has not received any information regarding this case from the Metropolitan Utilities District. Mr. Clark for the Douglas County Health Department stated that he had not been able to speak with his inspector regarding the specifics of this case. Mr. Miller asked if public water is available at this site. Ms. Mertz stated that a new housing development has gone up in her area, and the Metropolitan Utilities District has installed a line to service this development. Ms. Mertz stated that it was her intention to tie into municipal water once it became available. However, due to road easement issues, the main was not installed all the way to the street. Mrs. Mertz was informed by the Metropolitan Utilities District that she would be required to pay to bring the main line to the road, and to install lines along the entire frontage of her property. Preliminary quotes from the Metropolitan Utilities District to tie into the new water main are over $10,000.00. When asked if the Metropolitan Utilities District plans to extend the main line down to the street, Ms. Mertz stated that this was indicated, however, she was not given a definite timeframe for this extension from the Metropolitan Utilities District due to road easement issues. Mr. Salem stated that he would like to hear the Metropolitan Utilities District s opinion on this case before making a decision. This statement was echoed by Mr. Barrett, Mr. Miller and Mr. Estabrook. Mr. Miller inquired whether Ms. Mertz s current well is functioning at this time. Ms. Mertz confirmed that she does currently have access to water from the existing well at this time. Motion to hold this case over to the September 22, 2010 meeting of the Omaha Plumbing Board by Mr. Reed in order to allow the Metropolitan Utilities District more time to submit information regarding this case. Second by Mr. Salem.

Mr. Carlson stated that the property in question is located in the new Midtown Crossing Development. The tenant would like the Board to grant a variance of section 49-522, pipe and valve identification. Mr. Carlson stated that the tenant space has exposed vertical and horizontal piping. Mr. Carlson stated that the tenant would like to make pipe identification labels less conspicuous. Motion by Mr. Killian to allow requested variance of section 49-522, pipe and valve identification. Identification labels may be placed on the top side of a horizontal run, and in the least conspicuous place on a vertical rise. Second by Mr. Estabrook. AYES: Barrett, Estabrook, Killian, Miller, Salem, Wellendorf. ABSTAIN: Reed Motion carried 6-0-1 10-9-134 John Flores D.R. Anderson Constructors Co. Po Box 34340 Omaha NE 68134 Variance of section 49-1210(e), overflow drains and scuppers. Location: Metropolitan Community College, 2909 Edward Babe Gomez Avenue 49-1210(e) John Flores of D.R. Anderson Constructors Company appeared before the Board to request a variance of section 49-1210(e), overflow drains and scuppers at the Metropolitan Community College South Campus. Mr. Flores stated that this variance is for the backup roof drain system. This system will handle overflow and will be used in emergency situations only. Mr. Flores submitted for the Board s review a diagram of the drains, and a plan of the building where this system will be installed. Motion to approve requested variance by Mr. Reed. Second by Mr. Salem. AYES: Barrett, Estabrook, Killian, Reed, Salem, Wellendorf. ABSTAIN: Miller Motion carried 6-0-1 V. Discussion The Board will hold a special meeting on Wednesday, September 15, 2010 at 6:00 pm at the Common Grounds Community Center in Elkhorn. The purpose of this meeting will be to hold hearings for possible suspension or revocation of license(s) due to a violation of section 49-215, Continuing Education. All those who are required to attend this hearing have been sent a notice to appear via certified mail. The Board discussed an online course for plumber education. After discussion, the Board decided to discuss this topic again at their September 22, 2010 meeting.
