The meeting was called to order at 4:00 p.m. by Chairperson Metter. 2. Tinder and Jennings made a motion to approve the minutes of the regular meeting of April 11, 2017. Motion carried 5-0. 3. Consideration of renewal applications for license period 7/1/17 to 6/30/18 a. Members Tinder and Tilley made a motion to approve the applications for renewal of the Class A Beer. Motion carried 5-0. b. Members Cronin and Jennings made a motion to approve the applications for renewal of the Class A Beer and Class A Liquor. Motion carried 5-0. c. Members Jennings and Tilley made a motion to approve the applications for renewal of the Class B Beer. Motion carried 5-0. d. Members Tinder and Cronin made a motion to approve the applications for renewal of the Class B Beer and Class C Wine. Motion carried 5-0. e. Members Tinder and Cronin made a motion to approve the application of Club Ballyhoo dba Tilley s Pizza for renewal of a Class B Beer and Class B Liquor License. Motion carried 4-0 with Member Ronald Tilley abstaining. f. Members Jennings and Cronin made a motion to approve the applications for renewal of the Class B Beer and Reserve Class B Liquor Applications. Motion carried 5-0. 4. Application for a Class B Beer and Reserve Class B Intoxicating Liquor License for HRNS V Entertainment LLC., d/b/a Adiktion, 1310 Cranston Road, Edgardo Garrido Mateos, Agent for license period ending June 30, 2017. a. City of Beloit Police Chief, David Zibolski, presented background to the committee in addition to his recommendation for denial based on the facts provided, pattern of behavior and exhibits he provided. b. City of Beloit Assistant City Attorney, Patrick Bruce, presented to the committee legal considerations with this application and recommended denial as well. c. Attorney Jeffrey E. Livingston of Bolgrien, Koepke, Kimes & Livingston LLC spoke on behalf of the applicant seeking approval of the application and presented three people 1 Alcohol Beverage License Control Committee City of Beloit May 9, 2017 3

for testimony: Lilia Rangel, general manager/primary applicant; Edgardo Garrido, the agent; and Parvinder Singh with Watchdog Security. Each of them spoke stating their reasons why they believed this license would be different from the license that was revoked in 2015. d. Committee members and Captain Dan Risse asked several questions of the applicant and agent pertaining to their testimony and the application data provided them. City of Beloit Assistant City Attorney, Patrick Bruce, provided additional concerns and discrepancies to the applicant s testimony. Members Tilley and Jennings made a motion recommending denial of the application. Motion carried 5-0. 5. Citizen Comments: None 6. Committee Comments: None 7. Police Department Comments: Captain Risse presented his monthly report of service calls. 8. City Attorney Comments: None 9. Tinder and Tilley made a motion to adjourn at 5:05 p.m. Motion carried 5-0. CITY OF BELOIT REPORTS AND PRESENTATIONS TO ABLCC Topic: Late Annual Applications for Beer/Liquor Licenses 2017-2018 Date: June 13, 2017 Presenter(s): Lorena Stottler Department: City Clerk-Treasurer Overview/Background Information: ALL licenses shall expire on June 30 of each year and a renewal process is necessary to maintain operations. The renewal process in the Clerk s office began March 15 when letters were mailed to current license holders with a renewal application (AT-115), Auxilliary Questionaire (AT-103), instructions for filing with clerk and a list of applicable fees. They were asked to return the paperwork and pay the publication fee by April 17, 2017. The list was assembled and brought to Council for referral to the ABLCC upon which a recommendation to the City Council is made at the 1 st meeting in June. However, a group of licenses were not returned to the City Clerk s office in a timely manner and have been included in a second group. The Licensees have paid a $100.00 late fee and a $50.00 Publication fee. The group is placed on the June 5, 2017 City Council meeting for referral to the ABLCC June 13 th meeting upon which a recommendation to the City Council will be made at the June 19 th City Council meeting. Key Issues (maximum of 5): 1. The Municipal Clerk is responsible for receiving all applications for timely referral to ABLCC This is the last meeting to refer if the renewal is to be approved prior to June 30 expiration. 2. The Municipal Clerk must publish all applications (the list will publish on published June 8, 9 & 12, 2017) 3. The ABLCC will review the list at the June 13, 2017, 2017 regular meeting. Upon committee recommendation, this list will return to the Council for approval at the June 19 regular meeting. 4. The Municipal Clerk will issue check sheets and inspection forms to pertinent parties, collect all fees and upon successful completion of the application checklist, will issue a new annual license to be effective July 1, 2017 June 30, 2018. 5. By July 15, 2017, the Municipal Clerk is responsible for submitting a list containing the name, address, trade name, type of license and name of agent to the Department of Revenue. Conformance to Strategic Plan (List key goals this action would support and briefly discuss its impact on the City s mission.): This conforms to Goals 2 & 3 supporting economic development, business retention and proactively partnering with businesses to promote a safe and healthy community. Sustainability (Briefly comment on the sustainable long term impact of this policy or program related to how it will impact both the built and natural environment utilizing the four following ecomunicipality guidelines.): This does not apply Action required/recommendation: Staff recommends that the City Council refer this item to the Alcohol Beverage License Control Committee for review and recommendation Fiscal Note/Budget Impact: Alcohol Licensing brings $52,000 in revenues annually Attachments: Late Listing of Businesses applying for Beer/Liquor Licenses for 2017-2018 5

CITY OF BELOIT REPORTS AND PRESENTATIONS TO CITY COUNCIL Topic: Application of a new Class B Beer and Class C Wine License for Fresco La Casa De Las Fajitas LLC, d/b/a Fresco Fajita House, located at 315 State Street, Jennifer Dominguez, Agent for the license period July 1, 2017- June 30, 2018. Date: June 5, 2018 Presenter(s): Lorena Rae Stottler Department: City Clerk Overview/Background Information: Jennifer Lynn Dominguez, president and agent for Fresco La Casa De Las Fajitas LLC, d/b/a Fresco Fajita House is applying for a Class B Beer and Class C Wine License. This is a new owner at 315 State Street (formerly Royal Enterprizes LLC, d/b/a The Fajita House, James Bennett Jr., Agent who held a Class B Beer and Class C wine license for the current license year). Royal Enterprizes, LLC, d/b/a Mama s Chicken & Fish Carryout, James Bennett Jr, Agent has applied for a license at the property for the July 1, 2017- June 30, 2018 license period and was approved at the May 9, 2017 ABLCC meeting. Mr. Bennett has filed a letter and will surrender his license once this license is approved. Key Issues (maximum of 5): 1. This business (formerly The Fajita House) is located at 315 State Street Avenue, in the City of Beloit. 2. Jennifer Lynn Dominguez, is applying for a Class B Beer and Class C Wine license. The applicant has been provided the DOR Pub 302 and other documentation on applying for a liquor license and understanding the responsibility that comes with the application. 3. Ms. Dominguez has completed the necessary paperwork with the WI DOR and has supplied my office with a complete application for the referral and consideration by the ABLCC and the City Council. 4. The ABLCC will review this application at their June 13th regular meeting and make a recommendation for approval and will refer back to City Council for final approval at the June 19, 2017 meeting.
