Change Your Mind Set - There is No Safe Level of Lead Lead is a neurotoxin Values assigned to safe lead levels whether it is in blood, in coatings, or in dust continue to decrease Poisoned, elevated, blood lead level of concern, reference value the goal is 0 µg/dl History of coatings and the definition of dangerous level of lead has similar history Loose paint (leaded or unleaded) can be a Sanitary Code violation Help your owners protect themselves and children living in their units. Stress the need for maintenance 5

New Regulations: Blood Lead Levels Definition of Lead Poisoning: Venous 10 µg/dl or greater Mandatory code enforcement inspection and deleading Definition of a Blood Lead Level of Concern Venous 5-9 µg/dl CMS strategy»educational outreach, code enforcement determinations (local BOH), private full inspections»2,350 cases in 2016»Potential for HUD linkages 6

New Regulations: Confirmatory Screening Mandatory Screening Requirements: Children screened at ages 1, 2,and 3 and if they live in a high risk community at age 4 Mandatory venous re-screening for capillary blood tests 5 µg/dl or greater - Proof of screening prior to entry into daycare or prekindergarten CLPPP website and statistics www.mass.gov/dph/clppp 7

Regulations: Accessible, Mouthable Lead Hazards A/M 1. Windows Sills (5 ft. or less from floor, stair tread, or ground) 2. Handrails 3. Railing caps 8

Accessible, Mouthable Deleading Standard Nothing has changed: Lead-based paint, other coating, plaster or putty shall be abated on accessible, mouthable surfaces to a height of five feet, and four inches in from each edge, or such surfaces may be contained. Encapsulants applied to suitable accessible, mouthable surfaces must be applied to the entire surface, rather than only to a height of five feet and only four inches in from each edge. 9

Deleading Options VS Deleading Standards A Deleading Standard sets the minimum requirement. It is not meant to encourage or promote coating removal. Deleading Options include high risk coating removal, moderate risk removal and replacement, low risk covering and encapsulation. Which option is best depends on a lot of variables and will vary from home to home. Maintenance Wear and tear Cost Aesthetics Who can do the work Occupancy restrictions Not a one size fits all approach Teach your client the Pros and Cons 10

Regulations: Friction Lead Hazards (F) 1. Doors (edge) 2. Door jambs 3. Treads 11

Friction Deleading Standard- New Standard: Lead-based paint, other coating, plaster or putty shall be abated on friction surfaces at all points of potential friction where the components meet Stair treads must be abated in their entirety to the wall or balusters, or such surfaces may be contained Friction surfaces may not be encapsulated 12

Loose Lead Hazards Nothing has changed: Regulatory definition -means paint, other coating, plaster or putty on a surface that is peeling, flaking, chipping, crumbling, cracking, deteriorated or damaged in any manner Field Guidance: When any layer of paint on the surface is coming away from another layer of paint or the substrate. Check by running your finger or top of a pen over the surface. If any paint falls record the surface as loose Be conservative 13

Moveable, Impact Parts of Windows (w/sills 5 ft. or less from floor, tread, or ground) Nothing has changed: Lead on M/I windows must be deleaded in their entirety: 1. Sills 2. Header stop 3. Interior stops 4. Interior sash 5. Exterior Sill 6. Parting Bead 7. Blind Stop 8. Exterior Sash 14

All Together Lead Hazards - Loose Lead paint Lead on M/I windows Lead on A/M surfaces: 1. Window sills 2. Handrails 3. Railing caps Lead on F surfaces: 1. Doors (edge) 2. Door jambs 3. Stair treads 15

Less $ to Delead Easier to Comply More Maintenance More Responsibility 16

Metal and Masonry Surfaces -Old and New Masonry Surfaces Everything has an intact standard, including masonry windows sills and treads Metal Surfaces - Nothing has changed: Metal sills, handrails, and railing caps are A/M everything else is intact 17

Encapsulation- Exterior use for A/M s in good condition - Sills Hand rails Railing caps Prohibited on: Treads, M/I parts of windows, thresholds, and floors (no change) Doors and jambs (new friction surfaces) 18

Regulation De Minimis and RA Field Work Exterior moderate risk de minimis standard expanded from 10 ft 2 to 20 ft 2 for the entire exterior Risk Assessor field work reduced to 25 inspections 19

Comprehensive Initial Inspection- How to Test Testing Protocol in a Nutshell: Walls, Chair Rails, Baseboard, test the flat part not the corners find the lead Doors test the middle of the face find the lead (if neg, cross off door edge) Test the door edge above 5 feet- if the edge is positive, then circle the F Door header casing find the lead Header Jambs - if it s positive, then circle the F Shelf and shelf supports ab 5 find the lead M/I s If it s positive, circle M/I, A/M, L as appropriate Window Sills If it s positive, circle M/I, A/M, L as appropriate Window header casing -find the lead Window header stops find the lead Aprons middle section find the lead Treads inside the baluster in the corner against the riser if it s positive, then circle the F Risers inside the baluster in the corner against the tread -find the lead Staircases test above 5 feet handrails, railing caps, stringers, newel posts, balusters, floor edge and casing, tredge test above 5ft find the lead Support columns above 5 feet find the lead 20

How to Test - Walls, Chair rails, Baseboards Test the flat part not the corners -find the lead 21

How to Test - Door Systems 1. Test the face of the door in the middle find the lead If it s negative, then cross off the door edge box (new), and you are done with the door 3 2 4 1 If it s positive, circle the F 2. Test door edge above 5 ft. 3. Test header casing find the lead 4. Test header jamb, If it s positive circle the F If there is no door, then there is no Friction 22

Friction Surfaces: Other Door Types Double doors F door jamb and door edge F door edge 34

Friction Surfaces: Other Door Types Accordion-style doors are not friction surfaces as long as the door is functioning properly. 35

Friction Surfaces: Other Door Types Bi-fold doors The top edge of the door and header jamb are not friction surfaces as long as the door is functioning properly. F 36

Friction Surfaces: Other Door Types Pocket Doors Will have to be assessed in the field for friction The top edge and possibly the face of the door may be friction Repairing, plaining down doors to remove friction is a high risk activity 37

Friction Surfaces: Other Door Types Garage Doors: On garages with no finished space and no egress to the interior of the unit/house, garage doors are assessed closed and held to an intact standard (same as pre-2017 A/M rules, CLP-1) 38

Friction Surfaces: Other Door Types Garage Doors: Garages that have finished space and/or attached garages that serve as a passage to a finished living space must have the interior of the garage deleaded according to the same standards as any interior room. (same as pre-2017 A/M rules, CLP-1) 39

Friction Surfaces: Other Door Types Garage Doors: If interior standards, the inspector must assess and determine if a friction surface exists Is it on tracks? Double swinging door? Are there friction surfaces? 40

Door Jambs Door jambs without doors are not a friction hazard If doors are removed as a deleading method, then they must be replaced if It is a rental unit and the occupant is protected under MGL Ch. 93A The Sanitary Code requires it, e.g. bathrooms, and exterior doors If the door is not replaced, then the hinges must be removed and the holes and hinge area on the jamb must be repaired and finished (intact and filled), in a workmanlike fashion. 41

How to Test - Shelf and Shelf Supports Test above 5 feet 42

How to Test -Cellar Windows/Exterior Garages Windows sills are A/M, everything else is intact If there is finished space or the attached garage serves as an entry to the home, then it s interior standards (M/Is and Fs) 44

How to Test - Staircases - Staircases are deleaded the same regardless of where they are: Inside the unit, common area, or exterior To unfinished space (if no door) Staircases stop at the next floor (not a landing) Always test above 5 feet Find the Lead Treads are F hazard Handrails and railing caps are A/M hazard Everything else is intact 45

How to Test - Staircases Accessible Mouthable Hazard 1. Test the Treads Inside the baluster where it meets the riser If it s positive circle the F 2. Tread edge Test outside the balusters above five feet Record on tread edge tredge 3. Risers Inside the baluster where it meets the tread 4. Test everything else above 5 feet Handrails, railing caps, stringers, balusters, newel posts, lower rail, floor edge, floor casing Handrails and railing caps are A/M and get done all the way up Friction Hazard 1 3 4 4 4 2 er 4 Railing Cap Floor 46

How to Test - Common Area Stair Cases and Landings Test landing separately Common area includes the staircase to the next floor (above or below) All treads are F A/M on entire flight of stairs 47

How to Test - Porches Support Columns test above 5 feet 48

How to Test - Porch Floors Porch Floors Loose porch floors are made intact and sealed (new) Test where the paint is thickest Move furniture, look in corners Find the loose lead paint Avoid replaced boards 49

Grandfathering Properties Complied pre-1988 Minor Changes: Took out references to True PCADs because it s not practical and the old formatting too different 12B policy almost 30 years ago very small percentage of requests. Reminder: Documents issued pre-1988 need a grandfathering waiver/letter from CLPPP 52

Maybe we should call 2017 rules Grandmothering? 53

PCADs/Grandfathering 2017- Rule Compliance Letters do not expire (except Interim Control) Properties where compliance is legitimate, deleading methods were appropriate, and the property has been maintained can remain under pre-2017 standards and are automatically grandfathered To verify this standard was met you must have the following: 1. The compliance letter with an address that is an exact match (or you have a mis-match address waiver in your hand) 2. LOFIC and Comprehensive Initial Inspection Report (no signs) 3. LOFDC s and the Final Deleading Reinspection Report documenting the appropriate deleading method for each and every surface. 54

PCADs/Grandfathering 2017 How to Assess True PCAD is visual using the report (deleading report or initial without hazards), to identify: 1. Loose paint (Pb, NA, Met, Masonry) Make intact 2. Damaged but appropriate Encapsulants or Coverings Repair 3. Missed components Test and bring to current standards 4. Inappropriate deleading methods; missing/incorrect reinspection information Bring to current standards 55

True PCAD Reminders (Refresher 2008, Refresher 2011): The first 3 steps in the process when conducting a True PCAD: 1. Collect past documents 2. Make copy of the re-inspection report and mark it with a red pen as the working copy 3. Using the red pen, audit the report in the field by checking off to make sure each component is identified and still in compliance 56

How to Assess Inappropriate Deleading methods - Encapsulants Failed encapsulants and Step-Up-Step Down, or inappropriate use Is the surface an A/M (sill, handrail, railing cap)or F (door, door jamb) hazard? Yes It must be deleaded using a different method No It must be made intact (i.e. baseboards, walls, other former A/Ms) 57

How to Record Inappropriate Deleading methods - Encapsulants Failed encapsulants and Step-Up-Step Down or inappropriate use: A/M hazards (sills, handrails, railing caps) Record as A/M and L, and add a note to use a different method F hazards (doors and door jambs) -- Record as F and L, and add a note to use a different method to bring to current standards. Discourage Scraping 58

How to Assess and Record Damaged Encapsulants Localized failure (damage, small break due to an isolated impact) and no step up and step down, can be repaired on A/M surfaces (sill, handrail, railing cap). If not loose, circle the A/M with a note that the encapsulant needs to be repaired. If loose, circle A/M and L with note that surface needs to be made intact and then encapsulant repaired Field standard for Loose Surface must be reinspected and documented as intact before the encapsulant is re-applied. 59

How to Assess and Record Damaged Encapsulants Localized failure (damage, small break due to an isolated impact) and no step up and step down can be repaired on F surfaces (doors and door jambs) Encapsulants on doors and door jambs that are damaged but not loose: Do not circle F it is grandfathered Make a note that it should be repaired If damaged and loose, circle L with note that surface needs to be made intact and then encapsulant repaired Field standard for Loose Surface must be reinspected and documented as intact before the encapsulant is reapplied. 60

How to Assess Inappropriate Deleading methods -Coverings Exterior porch and stairs CARPET 61

How to Assess and Record Damaged Coverings Broken, damaged, or loose coverings For sills, handrails, and railing caps, circle the A/M If you can see coating underneath is loose circle the L with a note that the covering is loose/damaged broken and needs to be repaired If the surface has an intact standard and is loose circle the L If you can t see underneath, circle NA with note that covering is loose/damaged broken and needs to be repaired 62

Properties with Missing Documentation Missing Inspection/Reinspection Documentation: Cannot do a visual; the report is missing Because the reports identifying lead hazards and how they were deleaded are missing you must test We cannot accept inappropriate methods or drive-bys Previously dipped, scraped, or encapsulated surfaces may test positive Friction surfaces will have to be brought to current standards We err on the side of caution and identify the hazards Units with compliance documents or with compliance indicated in our database are still eligible for PCAD rules so long as the address is an exact match and waiver granted if needed 63

Full Inspection Acting as a PCAD- How to Test 1. Test Walls, Chair Rails, Baseboard, test the flat part not the corners find the lead Doors test the middle of the face find the lead (if neg, cross off door edge) Test the door edge above 5 feet- if the edge is positive, then circle the F Door header casing find the lead Header Jambs - if it s positive, then circle the F Shelf and shelf supports ab 5 find the lead M/I s If it s positive, circle M/I, A/M, L as appropriate Window Sills If it s positive, circle M/I, A/M, L as appropriate Window header casing -find the lead Window header stops find the lead Aprons middle section find the lead Treads inside the baluster in the corner against the riser if it s positive, then circle the F Risers inside the baluster in the corner against the tread -find the lead Staircases test above 5 feet handrails, railing caps, stringers, newel posts, balusters, floor edge and casing, tredge test above 5ft find the lead Support columns above 5 feet find the lead 2. Apply and receive a PCAD No-Docs waiver if the LOC isn t in your hand Hey, this sounds familiar The testing protocol is the same 3. 30 Day Maintenance Rules - Encourage Covering, and replacement. DISCOURAGE SCRAPING 64

PCADs and Poisoned Children - No authorized person requirement within 30-days RRP licensed contractor for any unit where a contractor is hired and for all rental units After 30 days all deleading rules apply No change to 2017 grandfathering standards Pre 88 grandfathering has some deleading standard caveats if there is a poisoned child 65

2017 Partial PCADs in Multi-Unit Buildings Common Area deleading is grandfathered only if you have the LOC and the report in your hand: In the Field (True Partial PCAD): Visual using appropriate common area pages / working copy/ red pen No loose paint (Pb, NA, Met, Masonry) Missed components - test and delead to current standards Failed encapsulants and Step-Up-Step Down delead to current standards Missing or inappropriate coverings delead to current standards Localized encapsulant failure (or damage, small break due to an isolated impact) and no step up and step down can be repaired Back in the office: Attach clean copy common area pages to Comprehensive Initial for the new unit Attach the Determination, Partial PCAD page if any new common area hazards Partial PCAD - No Maintenance rules. Nothing has changed. - You MUST submit the LOC with your paperwork to CLPPP 66

2017 Partial PCADs in Multi-Unit Buildings How to Test No Reinspection Report- Testing Common Area Protocol: Walls, Chair Rails, Baseboard, test the flat part not the corners find the lead Doors test the middle of the face find the lead (if neg, cross off door edge) Test the door edge above 5 feet- if the edge is positive, then circle the F Door header casing find the lead Header Jambs - if it s positive, then circle the F Shelf and shelf supports ab 5 find the lead M/I s If it s positive, circle M/I, A/M, L as appropriate Window Sills If it s positive, circle M/I, A/M, L as appropriate Window header casing -find the lead Window header stops find the lead Aprons middle section find the lead Treads inside the baluster in the corner against the riser if it s positive, then circle the F Risers inside the baluster in the corner against the tread -find the lead Staircases test above 5 feet handrails, railing caps, stringers, newel posts, balusters, floor edge and casing, tredge test above 5ft find the lead Support columns above 5 feet find the lead Hazards are deleaded to current standards 67

Unauthorized Deleading Enforcing the regulation requiring authorized deleading means there are consequences for not following the regulation; otherwise it s a recommendation not a regulation Deleading should be done by authorized people Protects children Protects occupants Protects workers Protects the environment Levels the playing field» Inspectors» Authorized deleaders» Owners doing it the right way 68

Signs of Unauthorized Deleading (No prior history)- One and Done Signs: Scraped door edge Leaded door faces (both sides positive) and edge is negative Scraped Treads Negative inside the balusters and positive outside Unusual coverage/boxing still a sign for surfaces that are M/I, A/M, or F hazards 3 Strikes: Leaded door casings but negative jamb Leaded window trim (casings and apron) but negative sill Report must be submitted for Compliance Evaluation 69

Demarcation Lines and No Prior History Under the new protocol, you are not required to test side casings or shelves below 5 feet. You are required to find the dangerous level of lead, new testing protocol Complete the inspection according to new protocol and check off the box on cover indicating demarcation lines Delead lead hazards to current standards Units with no prior history and demarcation lines do NOT need to be submitted for compliance evaluation: The surfaces with the demarcation lines either do not meet the new definition of a lead hazard or will require more deleading It unlikely, that there would be demarcation lines and no new hazards especially on jambs, but if no hazards, get passing dust wipes, and call CLPPP 70

Letters of Full Initial Compliance and Demarcation Lines Letter of Full Initial Compliance and demarcation lines Complete the report using the new testing protocol Check off the new demarcation line box on the cover If no hazards take dust»it is unlikely that there would be demarcation lines and no new hazards, especially for jambs and treads Submit to CLPPP for Compliance Evaluation CLPPP response: Rescind the Letter of Full Initial Compliance Allow a new LOFDC as long as current standards are met 71

DES Conversions - After 3 years from issuance date, the owner can (not must) convert to an LOC: Requirements: 1. Addendum Full Inspection- new testing protocol 2. Current standards for lead hazards 3. Authorized People must be used 4. No new signs 5. Passing dust 6. Issue the LOC 72

UD Conversions - Real Deal Property Transfer (not LLC with a new name and not a straw sale) 3 years post issuance of UD, new owner can (not must) apply for LOC 1. New Testing Protocol 2. Current standards 3. Authorized People 4. No new signs 5. Passing dust 6. Submit to CLPPP for review 73

Dust Not New But Added to Policy Extra dust, informational wipes that FAIL LOFDC s, COMC with work, or CORC s (and even RRP) you must re-wipe until passing wipes are achieved Initial (no signs) or COMC (no work) cannot require; however we strongly recommend that passing wipes be achieved to protect both the children and owner HUD Rules another meeting, but. MA Reoccupancy and Compliance documents: Use the date dust meets MA standards 74

Dust Wipes and Loose Leaded Floors - Loose Leaded Floors must be: 1. Made Intact 2. Cleaned 3. Sealed* 4. Wiped * Sealed with polyurethane, urethane, paint, etc. Wax or Mop & Glow type products are not acceptable sealants Check off box on report as a reminder to take dust Deleading method will be MI/SLD 75

Dust Wipes and Loose Leaded Closet Floors Loose Leaded Closet Floors must be: 1. Made Intact 2. Cleaned 3. Sealed 4. Wiped (if room floor doesn t require deleading) Check off box on report as a reminder to take dust Deleading method will be MI/SLD 76

Dust Wipes and Loose Lead Landing Floors Stair landings are floors» Tested separately from treads» New line on report page Loose Leaded Landings/Floors must be: 1. Made Intact 2. Cleaned 3. Sealed 4. Wiped Check off box on report as a reminder to take dust Deleading method will be MI/SLD 77

Dust Wipes and Loose Leaded Floors How many: Minimum of 7 samples/standard set You must take a sample on each sealed leaded floor (it may be part of the standard set (2 floors) or may be in addition if. If there is high/moderate risk in the interior of the unit and there are more than 7 rooms, then take an additional wipe for each additional 2 rooms In many situations, the rule for how many won t change; it s where you have to wipe. 78

Dust Wipes and Loose Leaded Floors Timing for Loose leaded common area floors: Sealed leaded common area floors can be sampled at reoccupancy reinspection or at the final deleading reinspection Failing wipes- floors must be cleaned and the re-wiped If common area floors fail at Reoccupancy, then the reoccupancy reinspection fails. Follow the rules. Floors must be cleaned, and re wiped Issue re-occupancy after passing wipes for the common area floors If taking at final deleading reinspection (and there was already dust at reocc.), then just take the wipe(s) on the sealed leaded floor(s) and a blank. 79

Leaded Exterior Porch Floors - Loose Exterior Porch Floors 1. Made Intact 2. Cleaned 3. Sealed No dust wipes, unless HUD funded abatement program 80

Dust Wipes and Unfinished Space Cement floors in basements or garages are not good places to take dust wipes For concerns about contamination, take the wipe on the floor or landing in the closest finished area. If it fails, counsel occupants on keeping children out of basements/garages and how to avoid tracking dust. 81

Re-painting Dipped and Stripped Components - Components with coatings that are chemically removed (stripped or dipped) can be dangerous. Must be reinspected bare (no film, no residue) Must be coated and then reinspected painted/sealed Reoccupancy after components are sealed and properly installed You can reinspect these components bare while other deleading work is on-going This is similar to the rule for windows taken out dipped, reinspected bare, and then reinstalled and reinspected Record reinspections as stp/sld or dip/sld 82

Pre 12/1/17 Initial Report w/o Deleading Owner s Options: 1. Delead using old report to current standards, the inspector will catch any mistakes at reinspection 2. Hire an inspector to do an addendum full inspection using new reports and testing protocol Hazard yes to hazards no, submit to CLPPP for compliance evaluation: Only UD, if there are new signs (door edge scraped, etc.) Take dust We ll note the database about discrepancy Issue the LOFIC 83

Thirty Day Grace Period Active Deleading Properties that are in the process of deleading when the regulations change may delead to either pre-dec. 1 standards or new standards if: Deleading notification must show deleading began before December 1, 2017 Compliance must be obtained before January 1, 2018. Inspector must note on coversheet of the report if pre- Dec. 1 standards were used. It is fine to delead to the new standards now, but compliance can t be issued until 12/1/17. Can come under IC and delead the frictions liability protection and no need to relocate twice. 84

Units with a Partial Deleading Piece-meal Deleading/Reoccupancy, and Interim Control In all of these instances lead hazards were identified and full deleading compliance was not achieved. Grandfathering rules do not apply. So long as the unit passes a final deleading reinspection by January 1, 2018, the owner can decide, which standard to use: There are many variables that affect which standard will require less deleading If most of the interior hazards were already deleaded, and the exterior doesn t have a lot of hazards, then the old standard may be less expensive If the exterior has a lot of accessible, mouthable components then the new standard may be less expensive The chosen standard must be applied to the entire unit (inside commons, exterior) 85

Units with Interim Control or with Reoccupancy post 1/1/18 Conduct a final deleading reinspection Be sure to reinspect to the new standards (friction hazards) If there are hazards, delead to current standards If no hazards, then take dust wipes and issue an LOFDC Reminder: a reoccupancy certificate does NOT mean no interior lead hazards. It is NOT compliance for the inside. The interior could have leaded doors, jambs and window sills that were going to be deleaded using low risk methods, or it could have been piece-meal deleading in one or two rooms. 86
