We have made a preliminary determination that the aquatic resources that would be impacted by the proposed project are regulated by the Corps of Engineers under Section 44 of the Clean Water Act. Our jurisdictional review and final jurisdictional determination could result in modifications to the scope of the project s regulated waterbody/wetland impacts and compensatory mitigation requirements identified above. Any approved jurisdictional determination made prior to reaching a permit decision will be posted on the St. Paul District web page at http://www.mvp.usace.army.mil/. Project Description and Purpose (As stated by the applicant): The applicant is proposing to utilize grading, rip rap, and vegetation along approximately,5 linear feet of the Minnesota River to prevent erosional migration of the river towards a buried gas pipeline. Currently, the top of the riverbank is 5 feet from the pipeline and without bank stabilization the migration is expected to continue, eventually exposing the pipeline.

On the eastern side of the project, approximately.57 acre of types,, 4, and 6 wetlands will be permanently impacted by grading and riprap placement. On the western side of the project approximately.87 acre of type wetland will also be altered by grading and riprap. The access road to the river bank will follow an existing gravel access road to avoid disturbing vegetation and soils in the project area. Name, Area and Types of Waters (Including Wetlands) Subject to Loss: The applicant has proposed to place rip rap along,5 linear feet of the Minnesota River and to discharge fill material into.66 acre of wetlands comprised of a mosaic of flood plain forest, fresh (wet) meadow, and shrub carr wetland plant communities. Compensatory Mitigation: The applicant is proposing to replace the.66 acre of impact by purchasing compensatory credits from a Corps-approved bank within the same bank service area at a : ratio (.3 credits).
