Problem Analysis James Stewart was born 27 Feb 1772 Casey, Green Briar, West Virginia. Listed on FGS but not sourced as to where this came from. Another possible birth place of Rockbridge Co., Virginia is listed in History of Nathaniel (Nathan) Stewart 1807-1869 by Sherryl Stewart Allan supplied by client. Alternate spellings of surname: Stuart & Stewart Probably meant Casey County Kentucky or Greenbrier County, West Virginia. Keep in mind that West Virginia did not become a state until the Civil War. Conflicting birth places. Neither place had birth records at time of James birth. The Rockbridge County possibility looks weaker because there is no direct evidence James even lived there. The marriage record places James as having lived in Greenbrier County. But, if something is found that links James Stewart between Greenbrier County and Rockbridge County that would give Rockbridge more merit. James was an adult before census records were taken. So, he won't be listed with We might find him living near his parents so a search of the early census records should be done looking for someone old enough to be James parent living in the same places that he was known to live. Married Sally Fleshman 24 November 1796 at Greenbrier County, Virginia by John Alderson. Sourced by marriage certificate that stated it was recorded in Marriage record no. 1-A page. 136 & by photocopy of pages from marriage record book. Notes list different marriage date of 6 Nov 1795 being found on FWAVA11 part 41 Serial 32508. Source notes for the FGS makes the statement that there was also a James Stuart born the same day married to Eliza Stockton. James is listed as having died 1 May 1835 on FGS but not clear from the notes as to what the source of this date is. Tax records often fill in the gaps of the early census records. So, tax records of all the places James lived should also be searched looking for someone who could be his parent. Some times if a person's land was in a different county from where they lived the land tax record will say where the land is or say where the person currently lives. So a land tax record could also link James between all places he lived, if he owned land. Land records also should be searched because they often say where a person moved from or where they moved to. Probate records are one of the best evidences of relationships. Look for probate on persons with Stewart surname in places James lived. Because client had a source document showing the marriage date as 1796 it was assumed to be the correct date for James marriage to Sally Fleshman. Since James & Sally married in Greenbrier County, (West) Virginia, maybe James's family was there too. Where and when did the marriage of this James Stuart to Eliza Stockton take place? Is it another marriage for James or is this a different person? Date can't be right because will recorded date is before the death date. Will would not have been recorded before James died. James & Sarah had the following children listed on FGS and listed in source notes: Polly born 1797/8. Dorothy born 31 Aug 1800. Elizabeth born abt. 1803. Sarah born abt. 1805. Nathaniel (Nathan) born 9 Apr near Danville, Casey, Kentucky. Vesta born about 1808. and Lewis born 1812. Conflict between FGS & notes on Polly's birth place. FGS says Greenbrier, West Virginia but notes says Casey Co., Ky. Dorothy's birth place listed on FGS as Lincoln, Casey, Ky and notes as Casey Co., Kentucky. Not clear as to sources of all of their information. Their names except for Lewis are documented by James's will. Lewis not mentioned in will James & Sarah may have had three more children: Francis born about 1805 in Casey, Ky, Mary born about 1809 in Case, Ky and Nephi born about 1814. Information looks like it came from IGI. James's will dated 9 July 1834 recorded 4 Aug 1834 named Ephraim Owen executor; Children: eldest daughter, Polly Stewart, second daughter, Dorothy Fry, third daughter, Elizabeth Stewart, grand children, the children of well beloved daughter, Sara Adamson, deceased, son, Nathan Stewart, fourth daughter, Vesta Huey. Casey Co., Kentucky Tax Records to 1815 (1807-1815 -007,923) listed as source on FGS but no data listed from tax record. 1810 US Census of Casey County, Ky listed as sources on A cousin was suppose to do the census survey but I needed the data from census referenced in FGS sources to make research plan so searched Ancestry.com and got the Name: James Stuart; Home in 1810 (City, County, State): Casey, Kentucky; Free White Males - Under 10: 2 Free White Males - 26 thru 44 : 1 Free White Females - Under 10: 3 Free White Females - 10 thru 15: 2 Problem Analysis Continued Casey County, Kentucky was created 14 November 1806 from Lincoln County, Kentucky. Suggest all children born before this date born either in Lincoln County, Ky or Greenbrier County, West Virginia. Tax records of Greenbrier County, West Virginia and Casey County, Kentucky would determine when James left West Virginia and arrived in Kentucky. If James is listed in Casey County, in 1807 the tax records of Lincoln County Kentucky will need to be checked because it is Casey County's parent county. Why was Lewis not mentioned in the will? Did he die or was he given an inheritance earlier. To find out search the Why are they not mentioned in will. Did they die? Were they given their inheritance earlier? To find out search the No wife listed suggests she may have been dead. No mention of Lewis or the other three possible children suggest they were not part of the family, they were dead, or they were already given their inheritance. Response back indicated a complete study may not have been done. The age of oldest male on the 1810 census suggest the head of household was born between 1766-1774. No female listed on 1810 census old enough to be the mother of all of the children suggests that Sally was not in the household. She may have died. C. Problem Analysis Continued 1810 US Census of Casey County, Ky listed as sources on Name: James Stewart; Home in 1820 (City, County, State): Liberty, Casey, Kentucky; Enumeration Date: August 7, 1820 Free White Males - 10 thru 15: 1 Free White Males - 16 thru 25: 1 Free White Males - 26 thru 44: 1 Free White Females - 10 thru 15: 2 Free White Females - 16 thru 25: 2 Slaves - Males - Under 14: 1 Slaves- Females-Under 14: 6 Slaves - Females - 26 thru 44: 1 1830 US Census of Greene Co., Indiana listed as source on Name: James Stewart; Home in 1830 (City, County, State): Greene, Indiana; Free White Persons - Males - 50 thru 59: 1; Free White Persons - Females - 20 thru 29: 1 There are slaves listed on the 1820 census but not on the 1810. Why not? The age of the oldest male on the 1820 census suggest the head of household was born between 1776-1794. No female listed on the 1820 census old enough to be the mother of children suggests that Sally was not in the household. She may have died. 1820 census statistics shows no new persons had been added to the household and 1 female appears to have left the household. She could have married or died. Lack of a female old enough to be Sally suggest she died a lot earlier than the FGS indicated. At some point it should look for a of her death. James migrated between 1820-1830 into Indiana. No tax records in Indiana prior to 1842. So, have to rely on Casey County, Kentucky tax list to pinpoint a better departure/arrival date. Age of the oldest male on the 1830 census suggest that the head of household was born between 1771-1780. Female born between 1801-1810 matches one of the females from previous census years. C.
