Littleton Blvd. in reference to a detox hold. INVESTIGATION: Prior to my arrival, I was advised that an Asian male wearing a purple jacket was staggering in the street and appearing to be intoxicated. Upon arrival, I observed Michael David Gash (DOB 02/13/1957) who was identified by his CO ID, and matching the description provided by LPD dispatch. I observed Gash purchasing alcohol from the cashier, Jonathan Alberto Miceli (DOB 07/27/1990). Miceli sold Gash a 25 oz. can of Bud Ice for $1.63, a 40 oz. bottle of Magnum beer for $2.33, and a 200 ml. bottle of Skol vodka for $2.75 (the total amount was $7.19 including tax). I observed Gash pay Miceli cash for the alcoholic beverages. I then contacted Gash outside of Pyramid Liquors. Upon contacting Gash, I could smell a strong odor of an unknown alcoholic beverage on his breath, his speech was extremely slurred, his balance was very unsteady, and his eyes were bloodshot. Gash submitted a breath sample into a PBT which showed his BrAC to be 0.226. Gash was then released to a sober party at his residence located at 42 W. Ida Ave. I then contacted Miceli and advised him that he sold alcohol to an intoxicated person. I issued Miceli a municipal citation for sale to an intoxicated person 3-2-10(F) (citation # M1083301). While writing Miceli his citation, he demanded that I move my patrol vehicle into a parking space. I advised Miceli that I would move my patrol vehicle when I am finished issuing him a citation. Miceli then accused me of being "power hungry." Miceli then called my police uniform a "costume," and insulted me because of my height. Miceli was then released on his own recognizance. I recovered Gash's receipt for evidence. Nothing further to report at this time. CA0000178
