Defendants. IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned attorneys for the parties herein, that Defendants' time to answer or otherwise respond to the complaint, served by Plaintiff Wimbledon Financing Master Fund, Ltd. on December 2, 2015, is extended to and including February 12, 2016. If a party moves to dismiss the Complaint, opposition papers, if any, shall be filed and served on or before March 28, 2016. Reply papers, if any, shall be filed and served on or before April27, 2016. All parties filing a motion in lieu of an answer shall designate April29, 2016 as the return date. Except as set forth in the following paragraph, any defense based on insufficiency of service of process or on a failure to comply with CPLR 012 is waived. However, nothing herein shall be deemed a waiver by any defendant of any other defense, including but not limited to any defense based on lack of personal jurisdiction. Nothing herein shall in any way affect any motions pending as of the date of execution of this Stipulation, nor shall this agreement in any way require an answer or response to be filed by a party whose claims have been dismissed prior to February 12, 2016. All parties reserve their rights to take discovery during the period in which any motions to dismiss have been filed and are pending.
