Rules The exhibition is open to EVERYONE, 16 years and older, professional and amateur photographers alike. To qualify for participation in the exhibition, you must be 16 years of age. Entries for young persons aged 16 years and under 18 years on 01 September 2017 must also provide an email address for a parent or legal guardian. 1. By entering the exhibitions, you hereby accept these rules. 2. Entries must be submitted no later than the deadline listed on the exhibitions submission page. 3. By entering the exhibitions, you agree and acknowledge that Reclaim Photography West Midlands and Reclaim Photography Festival are permitted to receive and review your registration data. Participants agree that personal data including, but not limited to, name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used for the purposes of conducting and administering this photo competition. At any time, participants have the right to access, review, rectify or cancel any personal data held by Reclaim Photography West Midlands and Reclaim Photography Festival by sending an email via the following address: info@reclaimphotographyfestival.org. 4. Photographs must be your own work. 5. Photographs can be black and white or colour. 6. Photographs can be landscape, portrait or square format. Diptychs are counted as 2 images. You must include your: title, full name, address, daytime telephone number and email address. 10. You must tick: I confirm I have read and understood the submission rules fully and wish to proceed with my entry. 11. For formal portrait and architectural (building/location/property) entries, you will be required to complete and retain a model, minor and building/location/property release form stating that you have full permission to enter and reproduce an image of the person(s) and building(s)/location(s)/property(ies) featured in the photographs. If a selected portrait contains an image of a minor (person under the age of 18) then photographers will be required to complete a minor release form signed by the parent or legal guardian of the minor. Building release forms are only required when the building/land owners require special permission. 12. You must tick: I confirm I have completed a model release form for portraits (portraiture) and buildings (architectural) featured in the photographs. 13. All entries will be reviewed and pre-screened by Reclaim Photography West Midlands and Reclaim Photography Festival project team. 17. You agree that the photographs submitted may be exhibited as part of the Reclaim Photography West Midlands and Reclaim Photography Festival exhibitions at any of the participating venues. 18. You agree that Reclaim Photography West Midlands and Reclaim Photography Festival is entitled to pass on your contact details, or your representatives, to the exhibition sponsors and partners, solely for the purpose of enabling the sponsors and partners to make enquiries about purchasing or commissioning photographs from the photographer. 19. Reclaim Photography West Midlands and Reclaim Photography Festival reserves the right, in its sole discretion, to disqualify and remove any photograph that does not comply with the following requirements, even after the photograph appears on the website. You warrant, in respect of the photographs submitted by you, as follows: 19.1 You are the sole copyright owner and creator of the photographs. 19.2. You have the right to enter your photographs in this exhibitions. 19.3. To the best of your knowledge, the photographs do not contain any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content. 19.4. To the best of your knowledge, the photographs do not contain any material that could constitute or encourage conduct which would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. 20 The photographs do not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person's rights of privacy or publicity, and your photograph does not include: 20.1. Trademarks owned by third parties. 20.2. Copyrighted materials owned by third parties. 20.3. Names, likenesses or other characteristics identifying celebrities or other public figures, living or dead. 20.4. Entries in which you have purchased or secured the rights to use stock images. 21. You agree to fully indemnify Reclaim Photography West Midlands and Reclaim Photography Festival in respect of all royalties, fees and any other monies owing to any person by reason of your breaching any of the foregoing. 22. The responsibility for damage or loss, however caused, is the responsibility of the photographer. You are therefore advised to arrange adequate insurance cover against such risks. Festival and its charity, directors, employees, members, officers, partners, sponsors, stewards, supporters, venues, volunteers shall not be liable for any loss or damage, whether or not caused by their negligence. 23. Reclaim Photography West Midlands and Reclaim Photography Festival recognises you retain full ownership of the copyright in each photograph that you have submitted. 24. All entrants agree that all photographs submitted to the exhibitions may be reproduced and used to conduct and promote Reclaim Photography West Midlands and Reclaim Photography Festival. Therefore, you hereby grant Reclaim Photography West Midlands and Reclaim Photography Festival with a right to use submitted photographs in the framework of such promotional activities, as Reclaim Photography West Midlands and Reclaim Photography Festival exhibitions exists in part to raise the profile of the exhibiting artists. 25. You agree to participate in related publicity and to the use of your name and images for the purposes of marketing, promotion, discussion and education in direct connection with Reclaim Photography West Midlands and Reclaim Photography Festival and the exhibitions, in all media worldwide including the exhibition programme, posters, the Internet and within television documentaries, and may license these specific, limited rights to others only for the same purposes, without additional compensation. Reclaim Photography West Midlands and Reclaim Photography Festival also reserves the right to reproduce selected images for core non-commercial purposes, for example, in the past Exhibitions page of a gallery website, indefinitely as a public record. Such requests will not be unreasonably withheld. 26. The processes of the exhibition may be filmed and photographed, and entering the exhibition constitutes agreement for the prints and labels to be included in such filming and photography, whether broadcast or not. 27. Any photograph used by Reclaim Photography West Midlands and Reclaim Photography Festival shall carry a credit line. Any failure to provide such credit line shall not be deemed to be a breach, as long as Reclaim Photography West Midlands and Reclaim Photography Festival uses its reasonable endeavours to rectify such failure within a reasonable period from the date of notice of such failure. 28. You acknowledge that Reclaim Photography West Midlands and Reclaim Photography Festival and its charity, directors, employees, members, officers, partners, sponsors, stewards, supporters, venues, volunteers assume no responsibility and are not liable for any image misuse. 29. Reclaim Photography West Midlands and Reclaim Photography Festival assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilised in the exhibition, and Reclaim Photography West Midlands and Reclaim Photography Festival assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the exhibitions. Reclaim Photography West Midlands and Reclaim Photography Festival assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. Reclaim Photography West Midlands and Reclaim Photography Festival is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail addressed to Reclaim Photography West Midlands and Reclaim Photography Festival on account of technical problems, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to your or any other person's computer related to or resulting from participation or downloading any materials in the project. If for any reason a participant's photograph cannot be viewed or is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failures, Reclaim Photography West Midlands and Reclaim Photography Festival assumes no responsibility. 30. In no event will Reclaim Photography West Midlands and Reclaim Photography Festival, charity, directors, employees, members, officers, partners, sponsors, stewards, supporters, venues, volunteers be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any participant s access to and use of the website and participation in the exhibitions.
