Call to Order. Mayor Dugatto called the meeting to order at 7:00 PM. 2. Pledge of Allegiance. Mayor Dugatto led the Pledge of Allegiance. 3. Roll Call. Mayor Dugatto requested roll call. The Board of Aldermen / Alderwomen members present were Barbara DeGennaro, Thomas Donofrio, Joseph DiMartino, Arthur Gerckens, Ronald Sill, Carmen DiCenso, Peter Olenoski and Tony Staffieri. Stephen Iacuone was excused. 4. Additions, Deletions, Corrections and Adoption of Agenda No changes were made. 5. Public Portion Mark Anthony Izzo 328 Olivia Street: Apologized to the Board for catching them by surprise at last month s meeting. He asked why he is not on executive session again tonight. Attorney Teodosio said he wasn t privy to the case against the city. The counsel and the carrier are not in a position to discuss the case yet. Additionally, the city s counsel was advised that Mr. Izzo is being represented by an attorney and therefore the city s counsel needs to speak with his attorney directly. Attorney Teodosio stated that the defense attorney doesn t feel the need for executive session based on the current status of the case. Mr. Staffieri disagreed with this and would like the defense attorney to attend the next meeting. Attorney Teodosio will make the request to the defense attorney. Rich Dziekan Spoke regarding Strang Road and stated that there is oil coming through the new road. Mr. Defala said it wasn t oil, it s a tak coat bonding agent and it s safe. Robert Galuzzi, Hawkins Street Spoke regarding the blight committee regarding 3 (245) Francis Street. The building is vacant and there is wildlife living in the building. He said he s approached the city several times and he was told that the building would be cleaned once the city owned the property. The city owned the property last year and it was auctioned off and never surveyed. The property has not been cleaned and there is now a conflict regarding the property line. Mark Anthony Izzo Asked what happens if the city s attorney doesn t show up? Attorney Teodosio asked if he was still represented by an attorney. Mr. Izzo said the attorney is not needed, but he never officially separated. 6. Approval of Minutes 6.1. Move to approve refund of excess taxes paid in the amount of $1,738.27 as recommended by the Tax Collector Denise Cesaroni Motioned by Mr. DiCenso, seconded by Mr. Sill and the motion carried. 8. Committee Reports 8.1. Blight Committee 8.1.1. Move to add 196 Hawkins Street to the Blight List. Motioned by Mr. DiCenso, Mr. Donofrio seconded and the motion carried. 8.1.2. Move to add 278-280 Derby Avenue to the Blight List Motioned by Mr. DiCenso, seconded by Mr. Donofrio and the motion carried. 8.1.3. 310 Sentinel Hill Road Update Only. Mr. Cota and Mr. Sarmiento were not in attendance. It was stated that payment was made. 8.1.4. Move to authorize Corporation Counsel Francis Teodosio to have a survey completed on 3 Francis Street aka 245 Francis Street. Motioned by Mr. DiCenso, seconded by Mr. DiMartino. Mr. DiCenso said he didn t know how property could be sold without the survey. Mr. DiCenso motioned to have the city pay for the survey. This was not an official motion. He made the statement as a point for discussion. Ms. DeGennaro asked to make a friendly amendment and have the survey fee split three ways. Mr. DiCenso and Mr. DiMartino rescinded there motion. Ms. DeGennaro motioned to authorize Corporation Counsel Francis Teodosio to have a survey completed on 3 Francis Street aka 245 Francis Street with the caveat that the cost is divided between the City of Derby and the two land owners. Mr. Olenoski seconded. The motion carried. Mr. DiCenso opposed. 8.1.5. Move to accept proposed compromise agreement regarding 201 Hawkins Street as discussed at the October 10, 2017 Blight Committee meeting. Motioned by Mr. DiCenso, seconded by Mr. Sill and the motion carried 8.2. Community Relations 8.2.1. No action items. 8.3. Operations & Procedures 8.3.1. No action items. 8.4. Road Bond 8.4.1. Move to approve payment of the following invoice for the 2015 Road Bond and Emmett Avenue Project: 8.4.1.A.1. Baltazar Contractors, Inc. Mr. Donofrio recused. 8.4.3. 2015 Road Bond Project Phase 4 Update Only Mr. DeFala stated that Emmett Avenue will have a light coat of asphalt, but the final paving will be completed next spring due to concerns of settling. 9. Department Reports 9.1. Board of Education Mr. DiMartino asked about the pipe that was broken at Irving. Dr. Conway said they were able to repair it. 9.2. Cultural Commission Ms. DeGennaro asked about the report for the farmers market. Ms. Brezina said she wasn t able to get it completed. 9.3. Public Works Mr. Gerckens asked Mr. DeFala about the missing Christmas tree. Mr. DeFala said it was installed today. Mr. Olenoski asked if there were any events planned on the Green that would affect the seeding. Mr. Garofalo stated that there is a Veteran s Day Ceremony and the Tree Lighting event. 9.4. Building Department 9.5. Facilities Inspectors Mr. Gerckens stated that they asked them to look into the Beard Property and he wanted to thank them. The property was cleaned up and graffiti gone. 9.6. Fire Marshal Mr. DiCenso stated that no one should be permitted into the old Spooner House location and asked if the electricity is still on. Mr. DeFala had the water company shut off the water. Ms. Brezina said all their supplies are stored there. The Fire Marshal said per code no one can be in there, but it s the Board s call. 9.7. Fire Department Mr. Gerckens said the report was excellent. Ms. DeGennaro said she saw in the Valley Indy that the state gave permission to use the building that are being demoed. Mr. Lenart said that the request was for last December and that the fire department decided to pass on the State s offer. Mayor Dugatto said they are still discussing it with the Fire Department and they may hold training there. 9.8. Office of Emergency Management Page 3 of 5

Corporation Counsel Update Ms. DeGennaro stated that there is a typo on the deed for 92-94 Hawkins Street. She asked what was going on with 12 Joyce Avenue. Attorney Teodosio said it was a payoff letter and the property went into foreclosure. She asked what the FOIA complaint for Silva was about. He stated that the individual is incarcerated but is looking for information that the FIOA Commission is reviewing. 9.14. Storm Ambulance Corp 9.15. Parks and Recreation 9.16. Revolving Loan Fund Mr. Gerckens asked about the case that Attorney Skowronski is working on. Ms. DeGennaro feels someone else should handle it. Attorney Teodosio stated that they could call the file back. 9.17. Counsel to Planning and Zoning Commission 9.18. Website Report of Tickets for the Month Mr. Gerckens asked Mr. Garofalo why there are so many open tickets. Mr. Garofalo said he responds at night and over the weekend so it might not reflect as closed. He said the report was for September and they closed a lot of them this month. 9.19. Finance Director 10. Other Committee Reports 10.1. Capital Planning Commission 10.2. Infrastructure Committee 10.3. Building Committee for Athletic Complex 10.4. Building Committee for Field House and Baseball Field Dr. Conway said the meetings are ongoing. Mr. Lenart asked the Board that the fire departments be included in projects like this because they are going Page 4 of 5
to have issues responding to a building of that size and distance from the road. Additionally, Griffin will now need a new landing area for the medical helicopter. 11. New Business 11.1. Move to approve the acceptance of the FEMA Assistance to Firefighters Grant EMW-2016-FO-05223 for the Derby Fire Department in the amount of $53,250.00 Motioned by Ms. DeGennaro, seconded by Mr. Sill and the motion carried. 11.2. Move to approve request of St. Mary Church Ladies Guild to post a sign on the steel frame at the corner of Main Street and Bridge Street for their Annual Cookie Walk from November 10, 2017 to December 4, 2017. Motioned by Mr. DiCenso, seconded by Mr. Staffieri and the motion carried. Mr. Donofrio recused. 12. Old Business 12.1. No action items. 13. Executive Session 13.1. No action items. 14.
