Regulation for the Digital Regulatory Challenges and Opportunities in the new ICT Ecosystem Economy: Mario Maniewicz Deputy Director of the Radiocommunication Bureau International Telecommunication Union - ITU

Regulation for the digital economy Digital economy comes of age Regulation serves as the interface between governments, investors, service and content providers, and consumers New market realities call for new regulatory approaches and tools Challenges and opportunities go hand-in-hand and ICT regulators are under pressure to make the most of it

Regulation for the digital economy 55 out of 122 countries reported in 2016 the adoption of policies, regulation/legislation related to e-applications and m-applications and their relationship with and across other sectors of the economy.

Regulation for the digital economy There is a continuum of possible regulatory responses/measures which provides options in theory, from minimalistic interventions such as behavioural remedies (lower) to those that are more structural (higher) requiring legislative amendments and/or issuing of subsidiary legislation.

Suggested advice to policy makers and telecommunication/ict regulators Undertake a review of the regulations applicable to network operators and OTT players: Update the license conditions and as required provide deeming provisions for non-res-ident OTT providers, etc.: Assess and continually monitor the state of competition in the market: Assess and investigate the implications on domestic operators and stakeholders from the take up of online services: Secure fair and equitable taxation arrangements Establish co-ordination procedures between regulators: Collaborate with tax authorities Engage in greater public awareness and advocacy campaigns in relation to digital/ict services: Promote and facilitate ubiquitous broadband Engage more broadly with education and training sector: Ensure adequate and up to date data protection, privacy and cyber security legislation based on global exemplars Concert at the regional level to come up with harmonized regulatory responses

ITU BDT Digital Ecosystem Portal ITU is working on the Digital Economy from the point of view of: New Business Models The dynamic perspective of Telecommunicating/ICT regulation in the changing markets and new opportunities Socio-economic impact of the App Economy Region/countries case studies (e.g. Africa) ITU is working on policy and regulatory research, collecting data on the evolution of the Digital Ecosystem and the impact of ICTs on the national and international economy. Recognizing the importance of the new Digital Ecosystem, this portal gathers information on its evolution, key findings from publications and research, country case studies, as well as models to measure the impact of ICTs on the national economy.
