Flexibility will be observed to foster the industry s dynamism SOCIAL REGULATION Content developers must have incentives to invest and innovate in applications and services that promotes Malaysian culture, identity and values CONSUMER PROTECTION Consumers have the right to high quality service that are reliable, easily accessible, and affordable from the service provider of their choice TECHNICAL REGULATION Networks and services must be inter-operable, safe, secure, reliable and guarantee the integrity of services delivered ECONOMIC REGULATION Industry players must have incentives to invest, innovate and interconnect for the benefit of end-users. There should also be incentive to encourage the export of service

14 Technical Regulations Part VII of the Communications & Multimedia Act 1998 (CMA 98) establishes a framework to: facilitate the technical interoperability of networks promote the efficient allocation of resources promote the safety, security and integrity of network services and applications services.

16 INTRODUCTION Technical Regulations can be found in the Communications and Multimedia Act 1998 (CMA 98) as Part VII (Part 7) PART VII TECHNICAL REGULATION Chapter I Spectrum Assignment Chapter II Numbering and Electronic Addressing Chapter III Technical Standards

17 SPECTRUM ASSIGNMENT Section 157 prohibits the usage of spectrum without any assignment: No person shall intentionally transmit in any part of the spectrum to provide a network service unless The person holds a Spectrum Assignment; The person holds an Apparatus Assignment; or The use of spectrum is subject to a class assignment issued by the Commission Section 160 states that a spectrum assignment shall not be issued unless it is consistent with the spectrum plan

19 SPECTRUM ASSIGNMENT: Supporting Regulations (I) Spectrum Assignment under the CMA 1998 is supported by the Communications and Multimedia (Spectrum) Regulations 2000 These Regulations explain the following in detail: Spectrum Planning, Assignment, Spectrum Assignment, Apparatus Assignment and Class Assignment Class Assignment is detailed out under the Notification of Issuance of Class Assignments. The current Class Assignments covers: Citizens band radio Cellular mobile access device Leased channel radio device Spread spectrum device Trunked radio access device

20 SPECTRUM ASSIGNMENT: Supporting Regulations (II) Also supported by the Spectrum Exemption Order 2000 The current Spectrum Exemption Order 2000 covers Remote controlled consumer devices Cordless telephones Medical and biological telemetry devices Security devices Wireless microphones

21 NUMBERING AND ELECTRONIC ADDRESSING Numbering and Electronic Addressing basically covers: Section 179: Control, planning and administration of numbering and electronic addressing. Section 180: Numbering and electronic addressing plan Section 181: Management or maintenance of an integrated public number or electronic address database

22 TECHNICAL STANDARDS Technical Standards are necessary for 2 main reasons: To promote network interoperability; To promote public safety. It is an offence to use any technical equipment or system which hinders or compromises the above.

23 TECHNICAL STANDARDS Technical Standards will involve preparation and development of Technical Codes To achieve this, the Commission may designate an industry body to be the Technical Standards Forum

25 TECHNICAL CODE CONTENTS (I) A Technical Code shall include: Requirements for network interoperability such as provisions of network capabilities i.e. CLI and pre-selection capabilities Promotion of safety of network facilities

26 TECHNICAL CODE CONTENTS (II) A Technical Code may also include: Provisions of network facilities, network services and application services Provisions of customer equipment and cabling, Approval of customer equipment and other access devices Adoption of technical standards promulgated by international bodies Promotion of electromagnetic immunity and compatibility

27 TECHNICAL STANDARDS (CERTIFYING AGENCIES) Section 186 of the CMA on Certifying Agencies says: The Commission may register Certifying Agencies (CA), for the purposes of certifying compliance with codes or standards An approval by a registered CA shall be deemed to be an approval by the Commission

28 TECHNICAL STANDARDS: SUPPORTING REGULATIONS Supported by Communications & Multimedia (Technical Standards) Regulations 2000 In general, these regulations relate to Certifying Agencies (Part II), Communications Equipment (Part III) and Certification of Proficiencies (Part IV)
