1 Rule of Ministry of Information and Communication No. 180, Sept. 29, 2005 Rules on Certification of Information and Communication Equipment (Unofficial Translation) Article 1 (Purpose) This rule aims to specify the relevant matters regarding type approval of telecommunications equipment conforming to Article 33 of the Framework Act on Telecommunications, type official approval or type registration of radio equipment pursuant to Article 46 of the Radio Waves Act, and EMC registration of electromagnetic interference equipment and/or electromagnetic susceptibility pursuant to Article 57 of the Radio Waves Act. Article 2 (Definitions) The definition of terms used in this rule are as follows. 1. "Certification" means type approval pursuant to Article 33 of the Framework Act on Telecommunications, type official approval or type registration pursuant to Article 46 of the Radio Waves Act, and/or EMC registration pursuant to Article 57 of the Radio Waves Act. 2. "Information communications equipment" means telecommunications equipment conforming to Article 2, Paragraph 6 of the Framework Act on Telecommunications, radio equipment conforming to Article 2, Paragraph 5 of the Radio Waves Act, and electromagnetic interference equipment and other equipment affected by electromagnetic waves conforming to Article 57 of the Radio Waves Act. 3. "Certification marking" means the following identifications. a. Type approval marking pursuant to Article 33, Paragraph 4 of the Framework Act on Telecommunications b. Type official approval label or type registration label pursuant to Article 46, Paragraph 3 of the Radio Waves Act. c. EMC registration marking pursuant to Article 57, Paragraph 2 of the Radio Waves Act. 4. "Telecommunications network" means an agglomeration of telecommunications facilities, which have been systematically and jointly linked and configured for the purpose of telecommunications. 5. "Infrastructure communications network" means a telecommunications network configured/operated by common carriers in order to partake in telecommunications business.

"Transmission network" means a telecommunications network configured/operated by a transmission network operator (hereinafter, "transmission operator") pursuant to Article 2, Paragraph 14 of the Broadcasting Act and transmission line facilities independently configured and operated by a system operator under Clause B of Paragraph 3 of Article 2 in order to engage in transmissions networking business. 7. "Demarcation point" means a designated point established to clarify the accountability limitation in relation to the configuration and maintenance of telecommunications facilities when in connection with other telecommunications facilities in accordance with Article 4 of the Rules on the technical requirements for telecommunications terminal equipment or Article 79, Paragraph 1 of the Broadcasting Act. 8. "Hazards" means any damage inflicted on a telecommunications network, defective operation of telecommunications rate charging functions, electric shock inflicted on an operator and/or user of the telecommunications network, and quality deterioration of telecommunications services provided to telecommunications network users. 9. "Information equipment" means a device with major functions to input/output/store/retrieve/search/transmit or control communication data and messages, equipped with one or more terminal ports to transmit information and a power supply voltage under 6M volts. 10. "Manufacturer" means the manufacturer under Article 33 of the Framework Act on Telecommunications and the producer under Article 46 of the Radio Waves Act (a person who receives equipment by the trademark attachment method, including a person in charge of designing, manufacturing and producing the respective equipment). 11. Surveillance means check or test of the compliance of the certified information and communications equipment to the requirements pursuant to Article 36, paragraph 2 of the Framework Act on Telecommunications and to Article 53 of the Radio Waves Act Terms used in the this rule not defined by paragraph 1 will conform to definitions provided in the Framework Act on Telecommunications and the Radio Waves Act. Article 3 (Information and communications equipment subject to certification) Telecommunications equipment subject to type approval pursuant to Article 33, paragraph 6 of the Framework Act on Telecommunications are listed in supplement 1. Radio equipment subject to type official approval pursuant to Article 46, paragraph 2 of the Radio Waves Act are listed in supplement 2. Radio equipment subject to type registration pursuant to Article 46, paragraph 2 of the Radio Waves Act are listed in supplement 3. Electromagnetic interference and electromagnetic susceptibility equipment subject to EMC registration pursuant to Article 57 of the Radio Waves Act are listed in supplement 4. 3 Article 4 (Information and communications equipment exempted from certification) The scope of exemption from certification of Information and communications equipment in accordance to provisions mentioned in Article 33, paragraph 1 of the Framework Act on Telecommunications and Article 46, paragraph 1 and Article 57, paragraph 1 of the Radio Waves Act are as follows: 1. Information and communications equipment that are exempted from all the certification items are as follow. a. Equipment manufactured (or produced, applies to all below) or imported for research purposes. b. Equipment manufactured for export only not on domestic sale. c. Equipment to be used for exhibitions or events not for the purpose of sales d. Equipment brought in by foreign technical expert on the asking of domestic industry on the condition that the respective equipment be taken back out of the country in certain period. e. Equipment or equivalent/alternative equipment installed in ship or airplane brought in from a foreign country (including the cases of lease or chartering contracts) 2. Equipment that are exempted from some parts of the certification items and their exempted scope are as follow. a. Equipment (excluding internal telecommunications facilities and terminal equipment that special category telecommunications service providers use for operation under Article 3, Paragraph 13 of the Rules on the Technical Requirements for Telecommunications Terminal Equipment)to be used by common carriers, special category telecommunications service providers or transmission network operators (hereinafter referred to as "providers") are exempted from type approval. b. Equipment (excluding the equipment purchasable from others besides providers) offered by providers to respective service users are exempted from type approval. c. Equipment brought into the country by a traveler for personal use not intended for sale are exempted from type approval and EMC registration. d. Parts/components of main computer systems imported for the maintenance/repairing of the system are exempted from EMC registration. e. Amateur telecommunication radio equipment that are assembled or manufactured or imported for the personal use not intended for sale are exempted from type registration. 3. Other information and communications equipment noticed by the Minister of Information and Communications of its scope of exemption.

4 The Director General of the Radio Research Laboratory (here in after referred to as Director General) is authorized to determine the number of Information and telecommunications equipment that are exempted wholly or partly from certification pursuant to a, c, d and e of paragraph 1, and c and d of paragraph 2 of. Article 5 (Applying for certification) In order to get certification, the manufacturer, imported, seller should submit to Director General the application from as shown in Form 1 plus the following supplementary documents listed below. 1. Description of equipment which includes a summary, specification, composition and operational guide (in case of an application for EMC registration a user guide such as that shown in Supplement 5 has to be included). 2. Comprehensive system diagram 3. Circuit diagram (however, in case of an application for type approval, this clause applies only to the parts directly connected to the power and backbone communications network; in case of using equipment with type approval, type official approval, or type registration, said parts are excluded; and in case of an application for EMC registration, this clause is not added). 4. Photographs or Drawings of external view and arrangement of internal components (component arrangement and certification markings has to be identifiable). 5. Parts list of major components (in case of an application for EMC registration a list does not have to be submitted, while components which can bring changes to items in relation to technical standards pursuant to Article 6, paragraph 1, number 2 as indicated on the circuit diagram need to be listed and electrical specification must be presented). 6. Product Specifications as shown in supplementary form No. 5 (for type official approval and type registration only) 7. Test Report issued either by the foreign test lab that are recognized under MRA pursuant to article 33-3 of Framework Act on Telecommunications and paragraph 1 of article 79 of Radio Waves Act, or by the head of a designated testing lab as pursuant to article 13 of Rules on designation and management of testing laboratories for information and communication equipment or by the Director General pursuant to article 17 of the same Rules. 8. The list of the components of equipment noticed by the Director General, in case the equipment is manufactured from the components that are provided by different manufacturers and that has same electrical characteristics, In case a supplementary document specified in paragraph 1 is in foreign language, Korean language version has to be submitted additionally. Notwithstanding the provisions in paragraph 1, if any of the conditions listed below applies, the supplementary documents mentioned in paragraph 1, number 1 to number 6 do not have to be submitted. 5 1. In case the object of an application for type official approval or type registration is a single unit of equipment to be used directly by an end user which has been endorsed and given notice by the Director General or; 2. A test report issued by the Director General is submitted. Notwithstanding the provisions in Paragraph 1, in case an application for EMC registration for components of a equipment which was certified as a finished product is made with accompanying document(including the electronic copies) issued by either the Director General or the head of a designated testing lab confirming that the components belong to a certified equipment, the attached documents referred to in each clause of Paragraph 1 need not be submitted pursuant to Article 7. The Director General shall assign and give notification for detailed procedures and methods regarding the certificate application for equipment having one or more certification criteria under Article 3, Paragraph 1 or Article 4. In case a foreigner applies for certification, he/she may assign a domestic agency for the equipment concerned and submit the assignment document(including the electronic one) of Numbers 1-2 Supplementary Form. Article 6 (Evaluation) In accordance with Article 5, the Director General must evaluate the following items for each application. 1. The applicability of the supplementary documents. 2. The compliance to technical standards as stated in the below items. a. In case of an application for type approval : Technical standards as prescribed in Article 25 of the Framework Act on Telecommunications b. In case of an application for type official approval and/or type registration : Technical standards as prescribed in Article 45 and Article 47-2 of the Radio Waves Act and Technical Requirements for the human protection against Electromagnetic waves. c. In case of an application for EMC registration : Electromagnetic interference prevention standards for electromagnetic interference equipment and protection standards for equipment as prescribed by Article 56 of the Radio Waves Act. In the case supplementary documents have not been satisfactorily submitted or items in the application are unclear, the Director General may grant time to make the necessary changes. In case the review result under Paragraph 1 is considered inappropriate, the Director General shall give the applicant written notification of the review result. In relation to the methods of determination of compliance with technical standards as stipulated in paragraph 1, number 2, the guidelines will be issued by the Director General.

6 Article 7 (Issue of certification) If Director General considers the evaluation result confirmative, a certificate of information and a communication equipment (electronic certificate, hereinafter referred to as certificate) as shown in supplementary form 2 has to be issued and the each following items have to be noticed at the official gazette. 1. Type of certification 2. Name of certification recipient 3. Name/model name of the equipment 4. Certification number 5. Type code (limited to equipment requiring type official approval and type registration; and mark of the type code shall be at the Director General's discretion.) 6. Manufacturer and country of origin 7. Date of certification The certification display method of equipment that is certified under Paragraph 1 shall abide by Supplement 7. In case of Article 5, Paragraph 3, Clause 1, the Director General shall issue the certification indicator to the applicant notwithstanding the regulations of Paragraph 1,and may omit the official notification. Article 8 (Report of changes in certificate) In case a certificate holder pursuant to Article 7 wants to give some changes related to technical standards as set out in Article 6, paragraph 1, number 2 to the equipment, the holder have to submit to the Director General a report of certificate changes as shown in Supplementary form 3 (printed or electronic one), together with proving document (printed or electronic one) and a test report (printed or electronic one). But if the change is of the replacement of components with same electronic characteristics, the report is unnecessary. Pursuant to Article 7, in case a certificate holder wants to change(add) items (including trademarks given to parties who is not a certificate holder) not specified in Paragraph 1, the certificate holder should submit to the Director General a report of certificate changes (printed or electronic one) as shown in Supplementary Form 3, together with proving document (printed or electronic one). The Director General shall re-issue or additionally issue the certificate to the applicant and notice the changes in the official gazette. In relation to stipulations in Article 6, evaluation of amendmentrevision applications pursuant to paragraph 1 is applied. Regarding the scope of amendmentrevision/addition applications conforming to stipulations in Paragraphs 1 and 2, the Director General shall determine the required items. 7 Article 9 (Re-issuance of certificate) In case a recipient of a certificate pursuant to Article 7, paragraph 1 or Article 8, paragraph 2 applies for re-issuance of the certificate because the certificate has been lost or damaged beyond recognition, a new certificate will be re-issued. Article 10 (Post surveillance) The Director General shall test and monitor the compliance of the certified products on the market and in the case, he can purchase the equipment or ask the certificate holder to provide the equipment. However the certificate holder submits his own quality control result based on the test by the designated testing labs, the surveillance on the holder s products may be omitted. As a result of post surveillance pursuant to paragraph 1, when correction order is given by the Director General for the equipment not in compliant with the certification status, a written order specifying the reason and deadline should be delivered. The person who received a correction order in accordance with paragraph 2 should submit in written the result of the action to the Director General without delay. The details of the post surveillance pursuant to paragraph to are noticed by Director General. Article 11 (Identification) Identification pursuant to Article 36, paragraph 4 of the Framework Act on Telecommunications and Article 53 of Radio Waves Act is issued in the form of Supplementary form 4. Article 12 (Cancellation of certification) In case the equipment is no more produced or imported, the certification can be terminated by applying in written form with the issued certificate. If and when the Director General receives a termination application pursuant to paragraph 1, the Director General has to inform the applicant that the certification has been terminated and news of the termination is required to be published in the official gazette. Article 13 (Cancellation of certification and administrative measures) Guidelines for the cancellation of certification pursuant to Article 35 of the Framework Act on Telecommunications, and Articles 74 and 75 of the Radio Waves Act, are as set forth in Supplement 8. The Director General has to specifically clarify the reason and time period in regards to a cancellation of certification and/or stoppage of production. If and when the Director General has cancelled a certification pursuant to paragraph 1, the event has to be officially disclosed and the Party receiving notification of the cancellation of the certification is obligated to return the certificate to the Director General without delay. Article 14 (Period of confinement for certification applications) The time period set by the Ministerial decree as mentioned at Article 35, paragraph 2 of the Framework Act on Telecommunications, and Article 74, paragraph 2 and Article 75 of the Radio Waves Act, means 5 months.

8 Article 15 (Processing term) The Director General has to process any applications or reports mentioned below within 5 days of application/report. 1. Application for certification pursuant to Article 5 2. AmendmentRevision notification pursuant to Article 8 3. Re-issuance application pursuant to Article 9 The unavoidable time required to undertake additional procedures such as a professional technical review while applying the processing term referred to in Paragraph 1 shall not be calculated as the processing term. In this case, the Director General may give notification to the applicant of the reason and expected term required in writing, Article 16 (Fees) The fees for equipment certification in accordance with Article 33, Paragraph 5 of the Framework Act on Telecommunications and Article 69, Paragraph 1 of the Radio Waves Act are shown in Supplement 9. A party making an amendmentrevision/addition notification pursuant to Article 8 has to pay the fees approved by the Minister of Information and Communications and be given notification by the Director General. 9 ADDENA (Ministerial rule 94, May 22, 2000) Article 1 (Enforcement date) This rule shall enter into force after promulgation, Article 2 (Abrogation of other laws) The following rule shall be abrogated. 1. Ministerial Decree for type official approval and type registration of radio equipment 2. Ministerial Decree for EMC registration Article 3 (Transitional measures regarding type approval applications currently being processed) For type approval applications, confirmation applications of identical equipment, amendmentrevision notifications of type approval items, and termination applications for type approvals, which were accepted prior to the enforcement of this regulation, will the law adhere to the previous Ministerial Decree for the Framework Act on Telecommunications. Radio equipment type official approval applications, confirmation applications for identical equipment, radio equipment type registration applications, and applications for serial number and amendmentrevision notifications, which were accepted prior to the enforcement of this regulation, the law will adhere to the previous Ministerial Decree for type official approval and type registration of radio equipment. EMC registration applications, confirmation applications for identical equipment, and amendmentrevision notifications, which were accepted prior to the enforcement of this regulation, the law will adhere to the previous Ministerial Decree for EMC registration. Article 4 (Transitional measures regarding type approval) Certification of type approval, type official approval and type registration of radio equipment, and EMC registration, issued in accordance to previous regulations prior to the enforcement of this regulation will be recognized as infomation and communications equipment certificates issued pursuant to Article 7, paragraph 1 of the amendrevised regulations. Labels of type approval, type official approval and type registration, and EMC registration, issued in accordance to previous regulations prior to the enforcement of this regulation will be recognized as certificate labels issued pursuant ta Article 7,paragraph 1 of the amendrevised regulations. Article 5 (Transitional measures regarding application of administrative measures) Administrative measures in progress prior to the enforcement of this regulation will be processed pursuant to previous regulations. Article 6 (AmendmentRevision of other laws) The following amendmentrevisions shall be made to the Presidential Decree concerning the Radio Waves Act. Chapter 6-2 (Article 197-6) shall be newly established as follows;

10 Chapter 6-2 Standards for Prevention of Electromagnetic Interference, etc. Article (Standards for Prevention of Electromagnetic Interference and Protection from Electromagnetic Waves) The standards for prevention of electromagnetic interference caused by equipment, that emits electromagnetic waves as set forth in Article 56 and the standards for protection from electromagnetic waves for equipment influenced by electromagnetic waves are as follows: 1. Electromagnetic waves emitted by equipment should not adversely affect the performance of other equipment. 2. Equipment, devices, and/or systems should operate without deterioration of performance in an environment where electromagnetic interference exists. Detailed standards regarding the provisions of paragraph 1 will be formulated and officially disclosed by the Minister of Information and Communication. Addenda (by the Ministerial Decree No. 122 Feb. 1, 2002) (Enforcement date) These regulations enter into effect on April 1, (Interim measures regarding the certificate application in process) The previous regulations are applied to certificate applications already received and being processed when these regulations are enforced. (Interim measures regarding the application of punitive measures standards) The previous regulations are applied to a person with the punitive measures being undertaken when these regulations are enforced. Supplementary Provisions (Decree of the Ministry of Information and Communication: No. 149, Apr. 27, 2004) (Enforcement Date) This regulation shall enter into force from the date of its promulgation. (Application Example) The revised regulation in No. 8 of Table 4 shall be applied to the apparatus of high-speed railroads, being manufactured or imported after the enforcement of this regulation. 11 [Attachment 1] Telecommunication Equipment Subject to Type Approval (Related to Article 3, Paragraph 1) 1. Telecommunication apparatus that can be directly connected to the backbone communications network via cables at a demarcation point 2. Telecommunication apparatus, which cannot be directly connected to the backbone communications network and can cause harmful effects to the backbone communications network as well as to operators and users of the network, are listed in the following: A.Peripherals or components that are used along with if a telecommunication system, which is subject to apparatus to be a type approved for type are is a systemal (excluding peripherals or components that can be used separately independently without a system) B. Terminal apparatus for integrated service digital network (ISDN) C. Digital communication equipment directly connected to channel service units (CSU) 3. Telecommunication apparatus that can be directly connected to the demarcation point of a transmission network

Portable radio telegraphy apparatus for lifeboats installed on ships 3. Radiocompass for ship stations 4. Apparatus of radio equipment that is required to be installed in aircrafts, pursuant to the provision of Article 28 of the Radio Wave Act 5. Automatic warning telephone devices 6. Emergency positions- indicating radiobeacon 7. Transmitting and receiving device with a single channel using a single side band, which is used for maritime mobile service or aeronautical mobile service 8. Radar for radionavigation installed on ships as well as its automatic radar plotting devices 9. Two-way radio telephone for ship stations, using radio waves of F3E and G3E 10. Apparatus of digital selective calling equipment 11. Narrow band direct-printing telegraphy apparatus 12. Transmitting and receiving apparatus for maritime mobile services by usingthat use digital selective calling devices to have communicationscommunicate 13. Receiver exclusive for digital selective calling 14. Navitex receiver 15. Apparatus of radar transponder for search and rescue 16. Apparatus of satellite emergency position-indicating radiobeacon 17. Apparatus of radio equipment for radio data communication using a frequency band of radio waves 900MHz 11. Frequency sharing radio phone equipment 12. Apparatus of radio equipment for specified low-power radio stations 13. Apparatus of radio equipment for life radio stations 14. Apparatus of radio equipment that can be used without declaration, pursuant to Article 30, No. 1 and 2 of the Enforcement Decree of the Radio Wave Act (hereinafter referred to as Radio equipment using extremely low-power radio waves ) 15. Apparatus of radio equipment for maritime mobile telephones 16. Apparatus of equipment for satellite portable communication radio stations 17. Apparatus of radio equipment for amateur radio stations (excluding apparatus manufactured or assembled for personal use)

14 18. Apparatus of radio equipment for radio-detection services 19. Apparatus of radio equipment for subscriber lines 20. Apparatus of radio equipment for emergency radio telephones 21. Apparatus of radio equipment for radio CATV 22. 15 [Attachment 4] Electromagnetic interference equipment and Electromagnetic susceptibility equipment Subject to Electromagnetic Compatibility Registration (Related to Article 3, Paragraph 4) 1. Industrial/science/medical apparatus using high frequenciesy: Industrial/science/ medical/home equipment or apparatus, generating high frequency energy or being designed to use the energy partially, so itthey requires type approval in accordance with the Electric Product Safety Management Act and the Pharmacy Law (excluding radio wave application equipment pursuant to Article 58, Paragraph 1 of the Radio Wave Act) 2. Automobile and spark-ignition engine driven apparatus: Automobile or apparatus interfering with radio wave communications or broadcasting reception, so it requires type approval in accordance with the provisions of the Automobile Management Act (excluding motorcycles and automobiles running at a maximum speed 25 or less per hour or less) 3. Broadcasting Reception Apparatus: Sound and TV receiver to receive broadcast or similar information within a frequency band between 9 and 1, or apparatus generating or regenerating sound or visual information that is directly connected to the receiver, so they need type approval in accordance with the Electric Product Safety Management Act 4. Home electric apparatus and electric-motor driven apparatus: home electric apparatus, portable tools, electric heating equipment, and other electric apparatus, requiring type approval in accordance with the Electric Product Safety Management Act 5. Lighting apparatus, such as fluorescent lights: Fixtures or equipment withof fluorescent lights and lighting functions at a frequency band from 9 to 400, which requires type approval in accordance with the Electric Product Safety Management Act 6. High Voltage equipment and its auxiliary apparatus 7. Information apparatus: Apparatus specified by the provisions of Article 2, Paragraph 1, No.9, including computers and itstheir peripherals, computer built-in components with terminal ports, and wired communication terminal apparatus 8. High-speed railroad apparatus: High-speed cars, apparatus in high-speed railroad cars, such as power supply and control equipment, signal apparatus for speed control, telecommunication apparatus, and other fixed power equipment 9. Telecommunications equipment that send more than 9 KHz current on the electric wire.(except for the radio application equipment pursuant to Article 58, paragraph 1, item 2 of the Radio Waves Act.)

16 [Attachment 5] User Information (Related to Article 5, Paragraph 1, No. 1) Type User Information A Class Equipment (Equipment for business) B Class Equipment (Equipment for home use) This apparatus has a radio wave acceptability registration, so sellers or users should be aware of this. If it is sold or purchased wrongincorrectly, it should be exchanged with a home apparatus. 18 [Attachment 7] 1. Design Model Approval No. : AAA-BBBBBBBBBBBBBB 2. Display of certification A. The size of a design model can be adjusted flexibly by a fixed ratio depending on the size of approved apparatus B.The approval indication can be manufactured in an appropriate method of raised index/sticker or print, depending on the materials of apparatus. However, for small products, such as a modular type connector, for which it is difficult to indicate approval, only an approval year and serial numbers can be indicated. C. In the case of EMC registration, (A) should be added for business use equipment or (B) shall be added for home use equipment at the end of an approval number. D. Certificate holder s trade name and code, equipment name (model No.), manufactured date, manufacturer/country and should be indicated on the package or the users manual. E.
