ORDNANCE NO AN ORDNANCE APPROVNG A SPECAL USE PERMT TO ALLOW THE EXPANSON OF A CHURCH (Twn Cty Bble Church West Mchgan Avenue) WHEREAS, after due publcaton n accordance wth Secton X-7 of the Urbana Zonng Ordnance and wth Chapter 24, Secton of the llnos Revsed Statutes, the Urbana Plan Commsson held a publc hearng on November 19, 1992 to consder a petton by James Mller on behalf of the Twn Cty Bble Church n Plan Case #1487-SU-92 for a Specal Use Permt to allow a 2,600 square foot expanson of the Church at 810 w. Mchgan Avenue; and WHEREAS, the Plan Commsson voted on November 19, 1992 to recommend that the Urbana Cty Councl approve the request so that a Specal Use Permt shall be granted to allow the expanson of the Church on the propertes heren descrbed below and commonly known as 806, 808 and 810 West Mchgan Avenue and 807 West ndana Avenue, whch are zoned R-7 (Unversty Resdental), R- 2 (Sngle Famly Resdental), and R-3 (One and Two Famly Resdental); and WHEREAS, the recommendaton of the Plan Commsson to approve sad Permt s subject to the condtons stated below n Secton 2; and WHEREAS, after due and proper consderaton, the Cty Councl has determned that ths Specal Use Permt conforms to the goals, objectves and polces of the Comprehensve Plan and t s n the best nterests of the Cty to approve the Specal Use Permt as descrbed heren. NOW, THEREFORE, BE T ORDANED BY THE CTY COUNCL OF THE CTY OF URBANA, LLNOS that a Specal Use Permt s hereby approved as follows: Secton 1. A Specal Use Permt s hereby granted to the Twn cty Bble Church to allow the expanson of the Church n an R-7 (Unversty Resdental), R-2 (Sngle Famly Resdental), and R-3 (One and Two Famly Resdental) Zonng Dstrct at 806, 808 and 810 West Mchgan Avenue and 807 West ndana Avenue, whch propertes are legally descrbed as follows, and subject to the condtons set forth below n Secton 2 of ths Ordnance: Tax Parcels # , 006, 007 and 008, Lot 1 and the south half of Lot 2 plus Lot 7 except the east 6.0 feet plus Lot 5 except the east 6.0 feet, all sad Lots wthn Lncoln Place Subdvson; all of these parcels stuated n the Cty of Urbana, Champagn County, llnos. 1

The Specal Use Permt approved heren s granted only for the expanson of the prmary church buldng at 810 West Mchgan Avenue as shown on the approved ste plan attached hereto; and b. A varance s granted to allow a Floor Area Rato of 0.69 at 810 w. Mchgan Avenue where the maxmum allowed s c. The Twn Cty Bble Church shall not be permtted to sell the property at 808 W. Mchgan separately from the property at 810 W. Mchgan. The two propertes are consdered a sngle zonng lot for the grantng of ths Specal Use Permt and must reman n sngle ownershp. Secton 3. The cty Clerk s drected to publsh ths Ordnance n pamphlet form by authorty of the corporate authortes, and ths Ordnance shall be n full force and effect from and after ts passage and publcaton n accordance wth the terms of Secton of the llnos Muncpal Code.
