1 ANCOM s Laboratory for Electromagnetic Compatibility and Radio Equipment Testing My name is Adrian Bădulescu and I have coordinated most of the activities regarding the construction, equipping and implementation of the quality management system of this laboratory. The European Framework: New Approach Directives were created with a view to ensuring a single European market, where the free movement of equipment must meet certain requirements. Market supervision is necessary to ensure the integrity of the single market. New Approach directives created to allow free marketing of products in the EU: - Directive 1999 /5 / EC (R & TTE) directive of the European Parliament and of the Council on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity - Council Directive 2004/108 / EC ( EMC ) of the European Parliament and of the Council on the harmonization of the laws of the Member States relating to electromagnetic compatibility and repealing the Directive 89/336 / EEC. -

Nevertheless, the principle of subsidiarity applies: market surveillance is a national issue and Member States shall entrust market surveillance authorities with the abilities, resources and knowledge necessary to properly perform their duties. As well, market surveillance authorities must exert their powers in accordance with the principle of proportionality. The Romanian Situation To comply with the Romanian information and communication obligations arising from the provisions of EC Regulation no. 765/2008, - since ANCOM has established sector programs for the equipment market surveillance in accordance with the applicable European legislation (Directive 1999/5/EC and Directive 2004/108/EC), published them on its website and sent them to the European Commission. Within ANCOM, such equipment market surveillance activities take place in the following terms: - based on the market surveillance Sector Program, developed in accordance with the provisions of EC Regulation no. 765/2008; - following petitions/ complaints from consumers or from providers of electronic communications networks and services; - in case of finding harmful interference; - by participating in market surveillance campaigns organized within the European Union by ADCO-RTTE and EMC-ADCO; - following activities performed on ANCOM s decision. The verifications carried out by the ANCOM control personnel may be: - verifications regarding the administrative compliance; - verifications regarding the technical compliance.

3 The Laboratory In an accredited laboratory, compliance with the substantial requirements is verified in detail, using complete and accurate procedures and test methods, set out in the relevant standards, and analysing the results in the test reports. For any market surveillance authority, a testing laboratory is an essential and effective means of verifying technical compliance of the available equipment on the market, based on the relevant standards. The reports generated following tests in an accredited laboratory are undisputable evidence for any economic operator. Currently, ANCOM has a laboratory located in Prejmer, near Brasov, where the quality system EN/ISO/IEC has been implemented. This standard has two main sections that include management requirements and technical requirements. Management requirements are primarily related to the operation and effectiveness of the quality management system in the laboratory. Technical requirements include factors that determine the accuracy and reliability of tests performed in the laboratory. Laboratories use the standard EN/ISO/IEC to implement a quality system aimed at improving their ability to consistently produce valid results. The standard is thus a basis for accreditation from an accrediting body. Since the standard relates to competence, accreditation is simply a formal recognition of the demonstrated competence. Our laboratory s activity is aimed at monitoring and assessing the tested equipment/products (samples taken from the market), having regard to the essential requirements provided in Directive 1999/5/EC and in Directive 2004/108/EC.

4 The electromagnetic compatibility and radio equipment testing laboratory includes 4 shielded rooms, an anechoic chamber, a G-TEM cell and measuring devices and last generation software from the leading manufacturers in the world. The anechoic chamber s dimensions are 8.5 X 5.5 X 5.0 and it can measure objects situated three meters away, under the applicable standards both for immunity and for measuring the radiated emissions.
