As one of the country s largest chambers of commerce and economic development organizations, the Chamber actively engages in the legislative process to promote pro-business legislation that will foster economic growth and make Oklahoma City an attractive place to do business. 6 2014 LEGISLATIVE AGENDA Workers Comp Reform The Chamber will support additional workers compensation reform, both legislative and through rule-making, to ensure the successful and constitutional implementation of SB Economic Development Incentive Programs All economic development incentives should provide the state with a benefit that out-weighs the cost to the state of the incentive. The Chamber therefore supports increased scrutiny, transparency and openness in evaluating the effectiveness of the state s business incentives and the creation of a process to do so. The Chamber relies heavily on a number of the state s economic development and incentive programs to recruit companies to the Greater Oklahoma City area and to enhance expansion opportunities for our existing companies. The Chamber believes it is critical that certain programs be retained by the state. Our position on specific economic development incentives is as follows: The Chamber supports retaining the state s premier economic development incentives that are critical in attracting new businesses to the Greater Oklahoma City area and in providing existing businesses an economic incentive to expand. These incentive programs are, for the most part, unique to Oklahoma and separate the state from what other states and competing locations are offering. The Chamber will oppose attempts to sunset, repeal or unreasonably modify the following economic development programs: - Quality Jobs Act (QJA), 21st Century QJA, Small Employer QJA and the Prime Contractor QJA; - Aerospace Engineer Tax Credits. The Chamber supports protecting Oklahoma s foundational incentive programs, which are basic incentives offered by virtually every other state and competing location. Without the following programs, Oklahoma will not be considered a viable location by many companies looking to locate in Oklahoma: - Five-year ad valorem tax abatement and sales tax exemption on facilities and equipment used in manufacturing and warehouse and distributions systems; - Freeport (Inventory) Exemption; - Investment Tax Credit. The Chamber supports retaining several industry specific incentives that are necessary for the development of industries important to Oklahoma s economic future. Those programs are: 4

7 - Oklahoma Quality Events Act; - Tax Credit for Electricity Generated by Zero-Emission Facilities; - Sales Tax Exemption & Refund for Aircraft Repairs and Modification and the Sales Tax Exemption & Refund for Aircraft Maintenance or Manufacturing Facilities; - Oklahoma Film Enhancement Rebate Program; - Excise Tax Exemption on Aircraft Sales. Additionally, the Chamber supports retaining the following Community Development Programs (which have different policy objectives than the economic development incentive programs and should therefore be evaluated under different metrics): - Tax Credit for Qualified Rehabilitation Expenditures for Historic Buildings; - Tax Credit for Energy Efficient Residential Construction. During the 2014 Legislative Session, the Chamber will support legislation to extend the Aerospace Engineer Tax Credits, extend and fund the Oklahoma Film Enhancement Rebate Program, extend and strengthen the Oklahoma Quality Events Act and amend the Small Business Quality Jobs Act to ensure all rural areas of the state may participate. Pension Reform The Chamber supports legislation to strengthen the long-term financial condition of the state s pension plans. American Indian Cultural Center and Museum The Chamber supports legislation to allow state bonds (or other state funds) to be issued to match privately raised money to complete the American Indian Cultural Center and Museum (AICCM). The Chamber s support is based upon the AICCM having a viable plan to fund the ongoing operations of the AICCM. Oil & Gas Tax The Chamber is monitoring discussions regarding oil and gas tax structure, which is vital to promote the investment of drilling capital in Oklahoma. If necessary, the Chamber will engage in support of the energy industry. Water The Chamber will work with the governor, state legislature, City of Oklahoma City and other stakeholders to ensure the availability of a long-term water supply for central Oklahoma. Lawsuit Reform The Chamber supports the following lawsuit reform measures: Enacting an eight-year statute of repose for medical liability; Allowing evidence of plaintiff s reimbursement from collateral sources; Adopting the Rational Use of a Product Act. Research and Development The Chamber supports full funding of the Oklahoma Center for the Advancement of Science & Technology (OCAST) as it relates to the Seed Capital Fund and other programs managed by i2e to support the creation and growth of small businesses and jobs in Oklahoma. Quality Events Act The Chamber supports legislation to strengthen and extend the Oklahoma Quality Events Incentive Act to allow Oklahoma communities to attract and retain high economic 5

8 impact events in increasingly competitive regional, national and international markets. Judicial Reform The Chamber supports the following Constitutional Referendums: MAPS 3 Projects The Chamber supports the timely completion of the MAPS 3 projects. Amending the single-subject provision to provide clear direction to the Legislature; Amending the special law provision to replace ambiguous definitions. Internet Sales Tax On the state level, the Chamber supports legislation to clearly define the state s nexus laws (which requires retailers with a physical presence in Oklahoma to collect and remit sales tax on internet sales) to ensure sales tax is collected to the full extent of the law. On the federal level, the Chamber supports enactment of the Marketplace Fairness Act, which would place electronic and internet vendors on a level playing field with Oklahoma s brick and mortar companies with regard to the collection and remission of sales tax. Oklahoma Quick Action Closing Fund The Chamber supports funding the Oklahoma Quick Action Closing Fund to a level that will allow Oklahoma to be competitive with surrounding states. Increased funding for this economic development tool will assist the state in attracting high quality jobs and industry to Oklahoma. Municipal Revenue The Chamber supports reducing the Oklahoma Tax Commission (OTC) fee to municipalities for collecting and remitting sales tax to cover only OTC s incurred costs. Dog Kennels The Chamber supports legislation to amend state law which restricts the location of dog kennels, grooming, boarding and dog day-care centers within 2,500 feet of a public or private school or children s daycare facility. As currently written, the statute unreasonably restricts the rights of business owners and hinders development of needed services in high-density urban environments. TRANSPORTATION I-40 Crosstown Reconnection The Chamber believes restoring full access between I-40 and downtown Oklahoma City is critical, and will therefore advocate for the reconnection of the old I-40 (new boulevard) from Western Avenue west to the new I-40 by The Chamber will further advocate for the completion of the remaining reconnection corridor between Gaylord/Shields and Western Avenue as promptly as the environmental process allows. Downtown Boulevard The Chamber will work with the Congressional delegation, the Oklahoma Department of Transportation, and the City of Oklahoma City to ensure the timely completion of the Downtown Boulevard as soon as it is practicable. The Chamber believes that significant delays in completing the Downtown Boulevard could impair access to downtown and negatively impact current and future businesses located along the proposed boulevard route and within the downtown core. 6

9 Major Projects The Chamber will advocate for funding and completing work on major interchanges located at I-44 and Broadway Extension, I-240 and I-35 (Crossroads), and I-40 east of I-240 as well as necessary improvements to S.H. 74 (north of Lake Hefner Parkway). Governor s Bridge Improvement and Turnpike Modernization Plan The Chamber supports providing adequate annual appropriations to implement Gov. Fallin s Bridge Improvement and Turnpike Modernization Plan to repair or replace all of Oklahoma s structurally deficient bridges on the state s highway system by ODOT Eight-Year Plan The Chamber supports annual appropriations necessary to preserve and implement the Oklahoma Department of Transportation s (ODOT) eight-year construction work plan. Transit The Chamber supports implementation of transit programs that will best serve Central Oklahoma including the Central Oklahoma Transit and Parking Authority (COTPA) 2005 Fixed Guideway Transit Study (commuter rail study) and its following components: ACOG s Commuter Corridors Study to examine mitigation strategies for future congestion. The Chamber supports amending state laws to facilitate the development of a Regional Transit Authority in Central Oklahoma. The Chamber supports an increased allocation of state revenues into the state Public Transit Revolving Fund to meet citizen demand for public transit. Federal Highway Trust Fund The Chamber will work with our Congressional delegation, ODOT and the City of Oklahoma City to secure a permanent funding solution for the Federal Highway Trust Fund (including Mass Transit programs). The Chamber supports full funding for the current MAP-21 Transportation bill which expires in September The Chamber supports reauthorization of a multi-year Surface Transportation Act before the current two-year MAP-21 bill expires in September Association of Central Oklahoma Government s (ACOG) Regional Transit Dialogue Committees to identify regional transit alternatives/solutions for Central Oklahoma; 7

10 Ports of Entry The Chamber supports providing adequate annual state appropriations and staffing levels for the timely completion and effective use of weigh stations at Oklahoma s ports of entry to ensure the protection of Oklahoma s roads and bridges from unnecessary damage caused by overweight freight loads. Intermodal Hub The Chamber will work with the City of Oklahoma City, ACOG, COTPA, ODOT and the state legislature to develop and fund an intermodal hub at the present Santa Fe Station that will effectively integrate various modes of transportation and enhance economic development opportunities. 10th Street Ramp The Chamber will advocate for completion of the I-235/ Harrison/10th Street Ramp access improvements by Heartland Flyer Passenger rail service is a key component of the development of the Oklahoma City intermodal hub and the future development of commuter and light rail throughout the metropolitan area. The Chamber will work with the Congressional delegation, ODOT and ACOG to oppose efforts to reduce or eliminate the federal subsidy received by Oklahoma to operate the Heartland Flyer Amtrak service to Fort Worth, Texas. The Chamber supports continued dialogue on extending the Heartland Flyer Amtrak service to Newton, Kansas which would connect Oklahoma City to St. Louis, Chicago and other locations on the Amtrak system. The Chamber supports continued study by ODOT and the state legislature of the potential for establishment of inter-city rail between Oklahoma City and Tulsa that would create a new, and possibly more time-efficient, travel option between Oklahoma s two largest cities. Parking The Chamber supports increased funding for construction of additional parking to allow continued economic development downtown. Quiet Zones The Chamber will work with the City of Oklahoma City and the Alliance for Economic Development to establish a Railroad Quiet Zone on the BNSF mainline running through downtown Oklahoma City. Alternative Transportation The Chamber supports increased construction of sidewalks, trails and bike lanes. HEALTH CARE Insure Oklahoma The Chamber supports broadening Insure Oklahoma to provide health insurance to more of the state s uninsured. To ensure the continuation and success of this program, pursuit of all available funds should be considered to reduce the costs of uncompensated care that are currently shifted onto health care providers, employers and individuals. 8 Additionally, the Chamber supports efforts by Oklahoma s leaders to develop an Oklahoma Plan to extend health insurance coverage to more Oklahomans.

11 Mandates The Chamber opposes new health insurance mandates and liability that will undermine an employer s ability to provide quality health insurance at reasonable cost to employees. Research and Development The Chamber will support efforts to foster an environment that is conducive to further research and will oppose efforts to unreasonably restrict the continued development of the state s bioscience and research programs. Physician Shortage The Chamber supports providing incentives to recruit and retain Primary Care Physicians and Allied Health Professionals in Oklahoma, especially in rural and underserved areas, through expansion of residency programs in the state s medical schools, scholarships, loan forgiveness and other incentives. The Chamber further supports efforts to identify new funding streams dedicated to this initiative. The Chamber also supports the expansion of Telemedicine as a means of addressing the physician shortage and issue of limited health care access in rural Oklahoma. Any Willing Provider The Chamber opposes any willing provider legislation which would eliminate the incentive for medical providers to contract with managed care networks and, as a result, potentially frustrate efforts at cost and quality control and ultimately deny consumers the benefits of cost-reducing arrangements with providers. Wellness/Oklahoma Health Improvement Plan The Chamber supports state wellness and disease prevention programs that serve to improve the physical and mental health of Oklahoma citizens such as the Oklahoma Health Improvement Plan supported through the State Department of Health, Outreach initiatives, as well as workplace and school-based wellness programs. E-Cigarettes The Chamber will oppose measures that would restrict an employer from banning the use of e-cigarettes in the workplace. Penalties for Sale of Over-the- Counter Products The Chamber will oppose measures that would limit access to the sale of legal over-the-counter products. Federal Issues The Chamber supports improving health care quality, access and affordability without imposing new mandates and/or taxes on business. Therefore, the Chamber opposes a single-payer government-run/public option or health care system with government mandates. The Chamber believes that employers drive innovation in health benefits and that market-driven health reforms are the best approach to reducing costs while promoting efficiency, wellness and quality of care. 9

12 EDUCATION & WORKFORCE DEVELOPMENT PRE-K-12 EDUCATION ISSUES Common Core Curriculum Standards The Chamber supports full implementation of the core standards in English and math. We will oppose any attempts to slow or halt full implementation. Attract and Develop High Performing School Leaders Top-notch leadership by school superintendents and principals is critical to school performance. Additionally, Oklahoma is facing a shortage of experienced school leaders because of retirements and aging workforce. The Chamber supports creation and implementation of initiatives that attract, retain, and develop innovative and high performing school leaders. Charter Schools The Chamber has been a strong advocate for Charter schools and education choices. We support creating more charter schools and enabling successful charter schools to grow. We should: Enable charter schools to fund infrastructure and/or allowing charter schools to utilize bond funding; Lift the caps on how many students can attend charter schools by: - allowing charters schools to be located anywhere in the state; - encouraging authorizers to expand caps on charter school attendance. Early Childhood Education The Chamber has been a steadfast supporter for early childhood education and full funding of prekindergarten and kindergarten programs. Targeted spending on our youngest children is simply a smart investment. The Chamber supports legislative initiatives to maintain early childhood education programs and initiatives. Fully Funding Recent Education Reforms The Chamber supports protecting existing education reforms in particular the Achieving Classroom Excellence (ACE), Reading Sufficiency Act and Teacher Leader Effectiveness by fully funding the strategies necessary to successfully meeting these expectations. Targeted Incentives for STEM Excellence and Achievement There is a growing demand for students that can work in Science, Technology, Engineering and Math (STEM) fields. Oklahoma does not produce enough students that excel in STEM. The Chamber supports programs to improve quality of teaching and student performance in the STEM fields. 10

13 We support higher education programs and partnerships to better prepare teachers for reallife classrooms and enable higher education to monitor graduates classroom performance. We support National Board Certification (NBCT) model as a basis for teacher improvement or a similar model. Increased Instruction Time Oklahoma currently requires only 175 instructional days, which is among the lowest in the nation, and some schools have instructional days of 6 hours or less. We support legislation that facilitates increasing instruction time in the classroom and time on-task for students. Teacher Preparation and Support Pipeline Oklahoma s teacher preparation system needs to be improved in order to train, attract, and retain high quality teachers. Preparation of prospective teachers, on the-the-job improvement opportunities and enabling high-performing teachers to pursue a financially attractive career ladder without leaving the classroom, are critical issues. We support development of a competitive market-based salary and benefits package for teachers which encourages high-performing teachers to stay in the classroom. Maintain and Protect Graduation Requirements The Chamber wants all high school graduates to be prepared to enter college or the workforce. We supported the Achieving Classroom Excellence (ACE) law that requires students to complete rigorous coursework and pass four of seven end-of-instruction exams. The Chamber opposes weakening graduation requirements or curriculum standards. We oppose legislative and administrative actions that could reduce the rigor of the testing system. Oklahoma School of Science and Mathematics The Oklahoma School of Science and Mathematics (OSSM) has consistently ranked among the nation s top public high schools. More than half of OSSM graduates stay in Oklahoma, and 85 percent are choosing STEM careers. The Chamber supports full funding of Oklahoma School of Science and Mathematics (OSSM) FY 2015 budget request. Recently completed dorms will make it possible to admit an additional 30 to 40 Oklahoma students. A modest increase in funding will allow OSSM to accept more qualified Oklahoma students, realize economies of scale, allow Oklahoma s best and brightest to realize their full potential and help fuel Oklahoma s economic engine. 11

14 School and Campus Safety In the past three years, legislation has been introduced that would allow certain students to carry concealed weapons onto college property. The Chamber continues to oppose efforts to permit the carrying of weapons at any early childhood facility, Pre-K - 12 school, Career Tech or on college campuses. CAREER TECHNOLOGY AND HIGHER EDUCATION College Degree Completion and Funding In 2011 Gov. Fallin, in conjunction with the Oklahoma State Regents for Higher Education, announced Oklahoma s entry into the national degree completion initiative Complete College America (CCA). The ultimate goal for Oklahoma is to add 20,400 private and public sector degrees and certificates to the state s workforce over the next 12 years. The first year of CCA proved highly successful with more than 2,900 new degrees and certificates being produced; far exceeding the annual goal of 1,700. As this effort enters its second year, it has become an important foundation of Gov. Fallin s workforce initiative as of the National Governors Association. The Chamber supports prioritizing funds to ensure continued success for the Complete College America initiative. More locations. More services. More peace of mind. 15 Business & Industry Training The Oklahoma CareerTech System is acknowledged as one of the top systems in the nation. CareerTech is a key ingredient in attracting industry to Oklahoma through its Training for Industry Program (TIP). The Chamber supports enhancement of CareerTech programming and ongoing funding to assure that training needs for new and existing industry are being met. Career Readiness & Certification The Chamber believes Oklahoma needs more of our workforce to have post-secondary education targeted toward the skills that are in demand and meet industry needs. The Chamber supports creation of Industry Recognized Credentials training programs as funding is available. We also support the scholarship programs of Oklahoma Tuition Equalization Grants (OTEG), Oklahoma Tuition Aid Grants (OTAG), and concurrent enrollment, which are vital in reaching the Complete College America goals by ensuring more students can enter college and obtain a college degree. than the student population in general. There have been efforts to alter family income criteria and/or student performance requirements of the program. These changes would change the intent of the program by reducing access and lowering the production of college graduates by the system. We oppose legislation that would change the focus and intent of this successful program. Oklahoma Military Connection Oklahoma will continue to see a high number of military veterans re-enter the workforce. CareerTech and higher education are both positioned to provide fast-track certification and job placement for veterans who need help transitioning their skill to the job market. The Chamber supports outreach programs for returning military personnel as funding is available. The Chamber supports higher education capital and maintenance improvements to support record enrollment growth as funding is available. Oklahoma s Promise Oklahoma s Promise is one of the most successful college access programs in the country. Oklahoma s Promise students perform better and graduate at a higher rate 13

16 Collaborating for BUSINESS The decisions made at the Capitol have far-reaching impacts on all Oklahomans and Oklahoma business owners. The Chamber recognizes that all businesses in the state should have the opportunity to grow and succeed in a positive business climate. By collaborating with various partner organizations on issues, the Greater Oklahoma City Chamber can help promote a business-friendly environment throughout Greater Oklahoma City and the State of Oklahoma. During the 2014 Legislative Session, the Chamber will partner with the Tulsa Regional Chamber on a joint agenda. The Chamber is also joining forces with the Tulsa Regional Chamber and the State Chamber to promote issues in a joint jobs agenda. 18 Oklahoma State Legislature Pro-Business SCORES It is critical for the business community to suppport candidates and elected officials who will advance probusiness legislation at the Capitol. One measure the Chamber uses to identify pro-business legislators is a legislative scorecard produced by the statewide Research Institute for Economic Development (RIED). This organization has been tracking legislative votes on probusiness legislation since The Greater Oklahoma City Chamber is a founding sponsor of RIED and serves on a committee of business and economic leaders who meet each year to identify which legislation to consider for the annual score. Likewise, the Chamber selects specific legislation that is critical to the growth and development of the Oklahoma City region to help identify pro-business legislators. In 2013, there were 10 key business and education measures used to determine the Oklahoma City ranking, including: Provider Fee legislation, Quality Jobs incentives, income tax reform, pension reform, workers compensation reform, changes to the makeup of Oklahoma Water Resources Board, school safety and efforts to weaken graduation standards. Oklahoma County, like all counties in Oklahoma, is divided into three districts. The districts are as equal in population as possible, numbered 1, 2, and 3, and subject to alteration by the Oklahoma Legislature not more than once every 10 years. Main (405) OKLAHOMA CITY GOVERNMENT Oklahoma City is governed by a council/manager system established by an amendment to the city charter in The charter, adopted in 1916, originally called for a commission form of government. The mayor and eight city council members are elected to four-year terms. In order to keep continuity within city government, half of the council is elected every two years. The city is divided into eight wards. The voters of each ward elect a council member to represent them, and the mayor is elected at large. The mayor and the council appoint a city manager to serve as the city s chief administrative official. Primary elections are held the first Tuesday of March. The general election is held the first Tuesday of April. The filing period is neither more than 29 days nor less than 24 days before the primary election. Elections for the city wards are always held in odd-numbered years, while the mayoral election is held in an even-numbered year.
