7 Quality & Timeliness What processes do we have in place to ensure quality and timeliness of patent work product? Internal/external training to the patent drafting team The drafting team supervised by senior US counsels on our team. Client training We provide training as per client s request. The most common training for clients entails: training scientists and engineers on patent protection; brainstorming sessions with inventions; and teaching legal principles in context of the patent laws in India and US. Quality Control We have quality checks conducted by senior US counsels, each with more than 20 years of US patent law experience, at every step of any patent project.

8 Harvesting Ideas what is our model for inventor interviews, brainstorming and patent preparation? Face-to-face interview and brainstorming session. Secure all the required information immediately after the interview Record interview with inventor consent. Transcribe interview recording. Document the potential inventions in invention disclosures and work with the client to narrow down or combine inventions for patenting. Review prior art and undertake patentability search, if instructed by the client. Complete first draft almost ready for filing, typically requiring one round of review.

10 Global Prosecution Management Foreign patent prosecution must be managed with the same care as the U.S. prosecution because foreign prosecution history may be used when interpreting the scope of corresponding U.S. patent claims. See Caterpillar Tractor Co. v. Berco, 714 F.2d 1110 (Fed. Cir. 1983). The Federal Circuit continues to use statements made to foreign patent offices to determine how a person of ordinary skill in the art may construe U.S. patent claims. See Gillette Co. v. Energizer Holdings, Inc., 405 F.3d 1367 (Fed. Cir. 2005).

11 What Does This Mean For Clients and Practitioners? Foreign patent prosecution must be managed carefully to avoid an unintentional loss in patent claim scope and hence a decrease in patent value. While national patent laws differ around the world, avoid using different arguments and claim amendments to obtain related patents, so that a consistent interpretation of the claims is ensured. With easy availability of prosecution histories from all major jurisdictions, any deviation in patent prosecution from jurisdiction-to-jurisdiction is a potential opening for an infringer to challenge the validity of the patent.
