FICPI works for patent and trademark attorneys in the free profession, with issues relating to their daily work as well as IP law issues on a global scale. The membership in FICPI SWEDEN, which is prerequisite for membership in FICPI International, provides a global network of IP professionals, and a possibility to understand and participate in the development of IP law throughout the world. FICPI SWEDEN runs regular seminars in Sweden focusing on current issues and trends in IP. The seminars are open for all, but FICPI members enjoy a reduced registration fee. 4 Speakers Ulla Wennermark, holds an LL.M. from the University of Lund in Sweden. After having worked as inhouse legal counsel at Colgate-Palmolive and thereafter in private practice as Attorney-at-Law and Trademark Agent in Denmark, Ulla was in 2005 appointed as Member of the Boards of Appeal at EUIPO. At EUIPO, Ulla also became an accredited mediator (CIArb) and took part in the setting up of the EUIPO Mediation center. After 10 years at EUIPO, Ulla moved back home to Gothenburg where she started her own law firm (wennermark.eu). As a Member of the Swedish bar association, Ulla provides consultation services to IP professionals in relation to the EU trademark and design systems, and the harmonization directive. Her business portfolio includes e.g. telephone support, second opinions, strategy advices and legal opinions in infringement cases. Ulla was in 2015 appointed as Member of the Board of Appeal for Trademarks both in Denmark (Ankenævnet for Patenter og Varemærker) and in Norway (KFIR). Ulla Wennermark will talk about news in relation to the EU trademark and the Community Design and present user oriented highlights of CJEU judgments. Ulrika Wennersten, Senior Lecturer, School of Economics and Management, Lund University; Doctor of Laws in the subject Private Law, Faculty of Law, Lund University. Ulrika s topic is: Design protected as trademark? Overlaps between design and trademark law. Recent case law from CJEU. More and more companies try to protect design as trademarks. Hence the overlap between design and trademark is becoming more interesting. CJEU has also given guidance on different questions regarding shape marks during recent years. The latest case law from CJEU will be examined, and we will get to the bottom with questions on distinctiveness and the applicability of the range of exceptions from registration.

Previously, the EFTA Court concluded that a trade mark consisting of a work of art may contravene accepted principles of morality or public policy under Article 3 of the Trade Mark Directive if the

Can a famous work of art be contrary to accepted principles of morality or public policy under Article 3 of the Trade Mark Directive, part 2? Previously, the EFTA Court concluded that a trade mark consisting of a work of art may contravene accepted principles of morality or public policy under Article 3 of the Trade Mark Directive if the work of art is important enough. In conclusions, the EFTA court develops more effective tools for the preservation of the public domain. The matter was referred to the EFTA Court by The Norwegian Board of Appeal, who requested a preliminary judgment on this issue. Based on the decision by the EFTA Court, the Board found that the Vigeland trade mark applications are contrary to public order due to the exceptional circumstances of the case. Markus Dahlberg, Training Coordinator at PRV Academy, The Swedish Patent- and Registration Office (PRV). Markus Dahlberg has experience as Design Examiner and Trademark Examiner at PRV, as well as Marketing Manager Information Unit, and Information Specialist he worked as Seconded National Expert at Convergence Central Team of The European Union Intellectual Property Office (EUIPO), and before that as Seconded National Expert at European Cooperation. As a Training Coordinator he organises all kinds of training related to IP, national as well as international. Markus is part of EUIPO Academy Network. Markus will focus his presentation on Convergence Projects involving the Swedish office, EUIPO and other national offices.

Daniel is an Expert Judge in patent litigation at the Vienna Commercial Court and the Austrian Supreme Court; he is President of the Austrian Chamber of Patent Attorneys, and the Austrian delegate of the International Federation of Intellectual Property Attorneys (FICPI) where he also acts as the president of the EU Working Group of FICPI. Daniel will report on the generation and on the main contents of the Directive (including FICPI's positions and interaction with the Commission), the "musts" for transposition into national law and the time plan of this transposition into national law. Håkan Sjöström, partner at GOZZO Lawyers, has a long experience in Intellectual Property, competition law, marketing law, media and trade secrets. His career started at Stockholm City Court and after that at The Federation of the Swedish Industry working with matters regarding the approach and handling of IP for Industry, including legislative issues relating to Swedish national law and the European Union. The next step in the career was as associate to Örjan Grundén, one of the founding partners of Gozzo Advokater. Since then Håkan has acted as legal counsel specialized in IPR, mainly with litigations, but also in contractual matters as well as strategic analysis and advise within the area of IP. Håkan Sjöström has acted as legal counsel for comprehensive proceedings in all kinds of IP-rights, some ending in a successful judgement by Supreme Court. Håkan will give his view on the implementation of the directive into a new Swedish Trade Secret Act; some aspects and consequences. It seems that Sweden has been the only country in the European Union with a special law on trade secrets; what is the impact of that unique situation after the implementation? And how do the changes affect companies with regard to e.g. digitalized information created and collected within the

7 organization? Håkan will also make some reflections on the application of the new law in relation to Intellectual Property Rights. Ulf Maunsbach, Associate professor and head of department at the Faculty of Law, Lund University, with a particular focus on international cross-border conflicts. He has several years of international experience in research and teaching, including aspects of trade secrets and intellectual property rights and he frequently publish research contributions, primarily in the field of private international law. Ulf s presentation deals with Cross-border aspects of trade secrets; Secrets are, similar to intellectual property rights, immaterial by nature and hence problematic to capture within a single territory. The use and miss-use of secrets therefore tends to cross borders, and in that regards trade secrets are not different. While intellectual property rights are well defined legal rights trade secrets may be described as more elusive, but they still give rise to several pertinent private international law issues. Some of which will be discussed during the seminar/lecture Anne Levy, a French and European trademark & design attorney. She is co-managing partner of Brandon IP (formerly Blétry & Associés), a French boutique firm specializing in IP matters since Anne Levy has an extensive background in IP strategy and commercialization. After gaining valuable business and management qualifications in France and the USA, she acquired commercial experience in Europe and USA. In 1991, Anne became involved in the French IP strategy and commercialization firm Brandon Valorisation, where she learned more about intellectual property law and gained experience in IP strategy, IP valuation, patent commercialization and licensing.

8 Anne is involved in the French FICPI association (called ACPI - Association des Conseils en Propriété Industrielle). She joined the Bureau of ACPI in 2012 as the vice secretary and has been the secretary for 5 years. She is still active in the Executive Committee. Internationally, Anne chaired CET Group 8 of the work and study commission of FICPI, which deals with topics relating to intellectual property asset management and commercialization, now moved to the Professional Excellence Commission. Anne Levy will inform us about IP Valuation in general, in which situations do you do IP valuations, and further introduce us to the method used by her firm when dealing with IP valuation and patent monetization.
