Review of November 11, 2013 minutes completed, all Minute items completed without further discussion. 2. Reviewed current financial status and monetary balances of all cemetery fund accounts. CHECKBOOK: $ , 2 ND YEAR FUND: $ , CEMETERY BOND: $ estimated. 3. Updated status of grave excavators for each cemetery, DIRKSE & HUIBREGTSE LLC. replaced Larry Bunkelmann at Holy Trinity and St. Bridget cemeteries. 4. Discussed replacement/repair of holy trinity cemetery sign. It was agreed upon to search out more repair options for the sign, if repair costs do not exceed 25% of the replacement cost ($350 to $450). It is felt that if we could repair at a nominal cost, we could repair and extend the life of the sign for 2 4 years until we set money aside for the replacement of the sign. 5. Discussion of snow-plowing requirements for cemeteries established that the excavator normally completes the plowing for access to the burial site. If part of a parking lot has to be cleared for a burial service then the General Fund would have to be responsible because the parking lot is church property. The only parking lot issue is at St. Matthias and there is a separate St. Matthias fund in the General Fund for that chapel. The other issue was opening the Holy Trinity cemetery driveway for visitors during a holiday It was felt that we could ask a Holy Trinity parishioner who may have done this in the past to volunteer to clear the driveway for Christmas visitors. Cost for this would be negotiated at the time and be born by the Cemetery fund. 6. A transfer of burial rights will not be published and transfers will be accomplished by using a new CERTIFICATE OF RIGHT OF BURIAL form after the original owner gives the parish the authority for the transfer. A fee may be involved to complete the requested Transfer/s. The original Burial Rights form, if available, will be annotated with the transfer date and transferee
2 and then attached to the parish file copy of the new Burial Rights owner CERTIFICATE OF RIGHT OF BURIAL form. 7. It was confirmed that Cemetery employee expense vouchers need to be turned in to rectory for payments, June 10 th (for fiscal year report to the finance committee) and December 10 th (for calendar year end report to the finance committee)). 8. Other open floor issues. a. Jim Leister/Dennis Bingen A new flag has been donated and will be installed at the Holy Trinity West cemetery. b. Jim Leister The committee concurred that a copy of the DECORATIONS allowed paragraph from the cemetery privileges document be published in the Sunday bulletin. All Holy Trinity cemeteries have issues about decorations that were not removed or maintained in accordance with the cemetery Privileges and Regulations published document. c. A suggestion by Kathy Schmidt was approved that a non-paid volunteer Watering Angel be established to maintain live flowers in the cultivated beds for those who want this. Chair will coordinate with Kathy on this suggestion and its implementation. d. The following areas were discussed and have been approved for revision and/or inclusion in the (HOLY TRINITY/ST. BRIDGET/ST. MATTHIAS CEMETERY PRIVILEGES and REGULATIONS) document; COST OF GRAVES, SALE OF BURIAL RIGHTS, DESCENT OF BURIAL RIGHTS TO HEIRS, SECOND BURIALS (CREMATION URNS ONLY) ON A SINGLE GRAVE LOT, TRANSFER OF BURIAL RIGHTS and VANDALISM sections. See highlighted in RED areas in the draft (HOLY TRINITY/ST. BRIDGET/ST. MATTHIAS CEMETERY PRIVILEGES and REGULATIONS) document below. e. Research is being conducted to, allow and/or, set a fee for the Transfer of Burial Rights. f. Alex Bolek indicated that the term Burial Rights and Lot owners may need to be clarified, because purchasers of Burial Rights are not lot owners and this may lead to confusion. Request all to review the below document and make suggestions on this issue. g. Al Weiland indicated that the Holy Trinity West cemetery may need an official Survey of the Grounds in order to determine future Burial plot locations. A survey is only needed if we cannot establish proper boundary markers from previously buried steel pipe markers in the center of the Cemetery. Measurements from these pipes are being conducted at this time to establish and verify accurate lot locations. 9. Next cemetery committee meeting date was not established but will schedule at the end of the cemetery maintenance season (probably late October or early November).

4 SUPERVISION OF CEMETERY Burial Rights owners and visitors are reminded that supervision of the cemetery has been delegated by the Parish Council to the Cemetery Committee. Questions and issues should be directed to the Cemetery Committee through the Holy Trinity Parish Secretary. The HOLY TRINITY/ST.BRIDGET/ST.MATTHAIS CEMETERY COMMITTEE is pledged to providing, from the funds entrusted to it, a cemetery that will always be a place of quiet and abiding beauty. To do this, it is necessary that there be uniformity and simplicity of arrangement and that cost of maintenance be budgeted carefully. It is important that Burial Rights owners be aware that reasonable regulations must be adopted to best serve the interest of all concerned. With this in mind, the Cemetery Committee has revised the regulations in existence. This brochure is prepared so that you may understand your rights and privileges as a Burial Rights owners. Additional Rules and Regulations are available by Request. DECORATIONS Suitable annual flowers may be planted in a cultivated bed directly in front of the headstone, extending no farther than 14 inches from and no wider than the headstone. Perennials, rose bushes, trees or bushes, etc. are no longer permitted. Cultivation and weeding must be done by the Burial Rights purchaser/s or survivors. Other type decoration/s other than annual flowers must be placed within a cultivated bed or on the base of the monument and/or headstone. If the beds, bushes and/or decoration/s become unsightly or neglected the Cemetery Sexton reserves the right to remove and dispose of them. No plantings are permitted at the foot of the Grave. Artificial flowers will be permitted in vases. Glass jars, or tin cans will not be permitted and will be discarded. No artificial flowers may be placed directly in the ground because of the hazards of wire stems getting into power mowers. Winter wreaths, Styrofoam crosses and winter flowers may be placed starting November 15 and will be removed April 15. No winter blankets are allowed because of possible sod damage. Flags on graves of Veterans and Lodge Members will be permitted if inserted in a proper, sturdy holder. These are to be placed next to base of marker on Memorial Day, other special holidays, or after burials. BURIALS Burials should be confined, whenever possible, to week days and Saturday mornings. Exceptions to this policy will be at the discretion of the Pastor of Holy Trinity Parish. GENERAL REGULATIONS Holy Trinity Parish and/or the Cemetery Committee are not responsible for theft or damage to anything placed on graves of lots, including monuments.
5 No person shall be permitted on the cemetery grounds after dark. Children under 10 years of age must be accompanied by a parent or other adult. No dogs shall be permitted in the cemetery. No bicycles, motor-bikes or snowmobiles will be permitted on the cemetery grounds. Loose Flowers, baskets, wreaths, potted plants, etc. left at grave site after a funeral will be removed two weeks after burial. Funeral processions are under the direction of SEXTON. MONUMENTS Permanent grave markers/monuments must be installed/erected within 2 years of burial. The size of monuments permitted depends on the size of burial plot. This is done to prevent overcrowding. Monuments can only be erected by a licensed monument installer/company Monuments must be placed on concrete foundations (Footing for monument should be about 3 deep for frost protection). Costs for repairing failed, damaged or improperly installed monuments is the responsibility of the Purchaser of Burial Rights or their Direct Descendents. The following limitations have been established from this day forward: 5 feet. Large plot of 3 or more graves: maximum monument size, 45 inches in height with base of 2 X 2 grave lots: maximum monument size of 36 inches in height with base of 14 X 48 inches. 1 grave lot: maximum monument size of 24 inches in height with base of 12 X 32 inches. COST OF BURIAL RIGHTS for a GRAVE lot As of July 01, 2013 the cost for Burial Rights for each single grave lot is $ Graves will be purchased through the Holy Trinity Rectory. Prices are subject to change and the Parish Secretary will maintain a current listing of Burial Rights costs for Burial Rights purchaser/s. An additional Burial Rights fee will be accessed for second burials on a Single grave lot, see (SECOND BURIALS (CREMATION URNS ONLY) ON A SINGLE LOT) section in this document. NOTE: All Burial Rights cost per grave lot includes 15% set aside for the perpetual care of the cemetery. NOTE This is not a real estate transaction involving the sale of ground, but a purchase of an intangible asset burial rights (easement) because the entire Catholic cemetery is continuously owned and operated by Holy Trinity parish. An additional charge will be assessed at the time of burial for excavating (opening and closing) the grave and for any grave memorial or memorialization.
6 SALE OF BURIAL RIGHTS a. Anyone wishing to purchase burial rights in a parish cemetery shall contact Holy Trinity Rectory or the appropriate cemetery SEXTON. The official cemetery representative will meet with the intended purchaser/s. b. All monies paid for burial rights shall be made payable to the cemetery fund through the Holy Trinity Rectory. The cemetery has the prerogative of extending payment terms, but ordinarily full payment should be remitted on the day of purchase or within 120 days of purchase. c. Management issues a certificate of burial rights to the purchaser of the lot upon full payment of the purchase price. The certificate (easement), signed by the Pastor or Cemetery Committee Chair is the document that establishes the right of burial. d. The certificate of burial rights is not required to be presented at the time of a burial if the cemetery can satisfactorily determine from their files the proprietary of the burial. e. No person will have burial rights in any space unless his/her name appears on the cemetery records for the space. For new and past purchases, the Burial Right Assignment Form or a Parish Cemetery Purchase receipt, which were used prior to the issuing of the Burial Right Assignment Form, completes this requirement. f. Once purchased, the ownership remains with the original purchaser and his/her/their heirs. See DESCENT OF BURIAL RIGHTS TO HEIRS below for manner that burial rights descend after the original purchaser/s are dead.] g. Local management reserves the right to refuse permission for interment of anyone who, at the time of death, is not the holder of the lot or an authorized descendant or relative of the holder by blood or marriage. h. In at-need situations, the full cost of the space purchase for burial and the internment fee must be paid immediately. The remaining burial space must be paid according to the terms of the agreement. Memorials may not be installed nor plantings placed until the full purchase price has been paid. i. Should the purchaser of burial rights fail to carry out the terms of the purchase agreement, management may declare the said agreement cancelled and all rights of the purchaser in and to the burial space forfeited. Money remitted may held or returned, depending on the situation. Management has the right to remove any interred remains to single graves, without notice, as chosen by management. Likewise, management may remove any grave memorial that may have been placed on said grave(s). j. It is the right and Christian duty of the cemetery committee to make special arrangements and adjustments of prices and fees to accommodate the poor and destitute, the stranger or multiple victims of a disaster to ensure the dignity and care of human remains, especially if they received little dignity in life. k. Reclamation of abandoned lots is governed by the laws of the state of Wisconsin [Statute (2)].
7 DESCENT OF BURIAL RIGHTS TO HEIRS A burial right is an intangible asset, not subject to any will or personal gift. It must be assigned by a legitimate owner of burial right or a group of owners based solely on adopted cemetery policies and practices. Management encourages the use of the CERTIFICATE OF RIGHT OF BURIAL or the Burial Right Assignment Form to avoid uncertainty and conflicts over unassigned burial space in the future. These steps should be followed for unassigned burial space: a. Unassigned burial rights continue beyond the death of the original purchaser/s to blood descendants. Spouses have joint tenancy. The spouses of any direct heirs have precedence in future burials assignments over their children. b. The first to hold burial rights is a surviving spouse. c. If there is no surviving spouse, then to any child/ren; if there is more than one, they all share the rights equally and must all agree to every assignment. d. If there is/are no surviving child/ren, then to any grandchild/ren; if there is more than one, they all share the rights equally and must all agree to every assignment. e. If the purchaser/s has/ve no child/ren and no direct survivors, the burial rights go to the surviving sibling/s of the purchaser/s and those descendants. f. Burial rights can be revised at any time by the rights holder/s to accommodate cremation burial or an accidental/sudden death. Burial rights can be assigned to anyone. g. In at-need situations, the deceased and his/her surviving spouse may be granted burial rights by the holder/s of burial rights. (Wisconsin Statutes ) h. Management has the right and power to make prudential final judgments about complicated and pressing burial arrangements so that the spirit of these steps is kept, even if the precise letter is impossible to attain. i. Reclamation of abandoned lots is governed by the laws of the state of Wisconsin [Statute (2)]. SECOND BURIALS (CREMATION URNS ONLY) ON A SINGLE GRAVE LOT a. Second burials on single grave lots can only be requested by the original Burial Rights owner/s or descendents as described under section DESCENT OF BURIAL RIGHTS TO HEIRS paragraph above. b. For a second burial on a single lot there will be a Burial Rights charge of 50% of the up-to-date and current Burial Rights charges established for a single Burial Rights lot. This charge is not applicable for spouses and 1 st generation Burial Rights survivors. This charge is in addition to the service charge of excavating (opening and closing) of the cremains burial. Compassionate cremains Burial Rights charges
8 may be waived only after a written request, which states specific reason for waiver request, is submitted to the Cemetery committee or the Parish Pastor who are jointly required for approval. c. A second Urn with cremation remains may be placed on a single grave lot. One urn may be placed on a grave with a regular burial with a vault or burial liner used for the regular burial or the first burial is with an approved urn. No more than two cremation burials are permitted on a single grave lot without a vault or burial liner burial. One additional cremation burial is permitted only under a compassionate circumstance and only after that circumstance is submitted to and approved by the Cemetery Committee and the Parish Pastor. Cremation urns must be made of an unbreakable material that can withstand ground pressure, moisture and probing for second burials. SPECIAL NOTE SCATTERING OF CREMAINS The Archdiocese does not allow the scattering of cremains on top of graves or anywhere within a Catholic Cemtery. TRANSFER OF BURIAL RIGHTS a. Anyone wishing to transfer burial rights in a parish cemetery shall contact the Parish office. The official cemetery representative will meet with the intended transferer/s. It should be clear that there is an additional fee for the opening & closing of the burial space after a death and for any grave memorial or memorialization. It should also be clear that this is not a real estate transaction involving the sale of ground, but a transfer of an intangible asset burial rights (easement) because the entire Catholic cemetery is continuously owned and operated by the parish. b. A fee of 25% of the up-to-date and current Burial Rights charges established for a single Burial Rights lot will be accessed for a Transfer of Burial Rights for each lot a Burial Rights transfer is requested. c. Management issues a CERTIFICATE OF RIGHT OF BURIAL to the new transferee of the lot. The certificate (easement), signed by the Pastor / Cemetery Official, is the document that establishes the right of burial. d. The CERTIFICATE OF RIGHT OF BURIAL qualifies the new owner/s the same rights and responsibilities as described under SALE OF BURIAL RIGHTS Sub-paragraphs d. through k. above STANDARD OR GREEN/NATURAL BURIALS Standard Burials consist of a Casket that is placed in a Vault which has a cover/lid installed after the lowering of the Casket and then the grave site is backfilled with soil. Headstone/Marker is required within two years of burial. Green/Natural Burials are only allowed under the following criteria; a. Body will be placed in a Casket that is perforated, Casket is placed directly at the bottom of the grave site, (in direct contact with the ground) in a bottomless Burial liner and then a cover/lid will be
9 placed on the Burial liner. The hole is then backfilled with soil. Headstone/Marker is required within two years of burial. b. Or the Casket is placed directly at the bottom of the grave site (in direct contact with the ground) and then an inverted Vault without cover/lid will be placed over the Casket. The hole is then backfilled with soil. Headstone/Marker is required within two years of burial. VANDALISM a. The cemetery is not to be held responsible for vandalism. If vandalism occurs, the cemetery will file reports with local police. Also the cemetery will repair any vandalism promptly to the ground and other areas maintained by the cemetery. The Parish/Cemetery will not repair any vandalism to monuments and markers. b. Lot owners who can be located will be notified of the vandalism. It is the responsibility of the lot owner to make arrangement for repairs and pay the incurred costs. BURIAL RECORDS All historical and permanent records pertaining to the cemeteries are kept at the Holy Trinity Parish Rectory. Changes or adoption of policies, procedures, rules or regulations The committee and management reserves the right to change any policy, procedure, rule or regulation at any time without previous notice to lot owners, grave owners, contractors, builders, monument dealers or any other persons interested in the cemetery. When any new policy, procedure, rule or regulation is adopted any prior policy, procedure rule or regulation in conflict with the new rule is repealed.
