In recent years it has become very challenging to get your visa filed and selected. In 2016, there were 236K H1B applications for only 85K visas. This is how it works: H1B Consultants (Consultants) have usually established relationships with various clients, for example Coca Cola, PayPal, etc. If a client has an open position, the consultant can fill that position by hiring you. Imagine coca cola has an open position for an IT Admin. Coca Cola contacts the consultant and tells him about the opening. The consultant then looks in his pool of potential employees like you for a good fit. That depends on how much the client is paying and how much commission the individual consultant is charging. Going commission rates are between 10%-30%. Let s revisit our previous example: Imagine coca cola is hiring an IT Admin for $100 per hourly (Consultants are usually paid on an hourly basis). The consultant might charge 30% mark up, and you will get $70. The rate might or might not be negotiable. Remember that the markup is their main incentive to sponsor your H1B. Start off with a phone call and explain your situation & background. Next, you are asked to submit your resume. Based on your qualifications and the number of openings that consultant currently has, he will be able to place you at one of the clients. As soon as the consultants are able to place you, they will sponsor your H1B and you can start working for the client (officially you will be employed by the consultant). Consultant files H1B for you When should I use a consultant? There are several reasons you might want to get your H1B through a consultant. One big reason is that it is very challenging nowadays to get an H1B sponsored directly from a company. The uncertainty induced by the H1B lottery makes many employers wary about filing an H1B. This is even more true if you are currently not in the US. The earliest start date for a new H1B filing is 6 months into the future. Employers usually don t like to wait so long. These factors make it very difficult to find a regular company sponsoring your visa. A consultant does not have those reservations as his business model is built around taking a cut from your paycheck. Hence, he has a strong incentive to get as many H1B visa approved and working for him. Another reason to go with a consultant is to increase your chances in the lottery. Each application must be for a truly unique project. If that is the case, having multiple applications is perfectly legal. What s next? I want my H1B this year! If you decided that the consultant route is what you want to do, you need to act fast to make the April 1 st deadline. 1. Call up every single consultant from the list in the appendix. You will find that consultants are grouped by area of expertise. Some consultants focus only on one specialty area (e.g. data analytics) while others are more general and cover a wider array of opportunities. Pick the ones that best fit your skill set. 2. Be prepared to talk about your experience and areas of expertise. Make sure you know what skills you are best suited for.
