3 I. GENERAL TERMS The young au pair will be hosted by the host family for the time of months, starting the until the. 3 During the planned period of stay, the host family enables the young au pair to fulfil the aims of the stay, namely to take part in the day-to-day family life, to improve his/her linguistic skills and to increase his/her general culture by acquiring a better knowledge of the country, by encouraging the young au pair to take part in the cultural activities of the country. II. THE HOST FAMILY S OBLIGATIONS 1. The family undertakes to receive temporarily, a young au pair into the family and to share with him/her the daily family life; in this connection, the family makes the following declaration of which the young au pair takes note: The host family consists of members 4 adults 5 boys, aged of girls aged of years years The family lives in (delete whichever does not apply) a house / a flat, consisting of: rooms including bathroom(s). The main spoken language of the family is: Moreover the family also speaks the following languages: 3 Young au pair placement shall not exceed a period of one year. 4 The host family shall have among its members at least one child who is under 13 years old at the beginning of the young au pair s placement. For children who are under six years old, prove that their day-care placement has been planned for the term of the young au pair s placement. 5 The host family shall provide an extract from police records not older than three months old for all its adult members at the beginning of the young au pair s placement. 3
4 2. The host family shall provide board and lodging for the young au pair and give him/her free access to the house. 3. The family also has to provide the young au pair with a separate room with the following comforts: 4. Every month the host family wires to the young au pair a fixed amount of EUR as pocket money (equivalent to a one fifth (1/5) of the minimum social wage) In exceptional cases and as long as the young au pair does not yet have a personal bank account, the pocket money can be given cash and against a receipt in duplicate copy. 6. The family gives the young au pair adequate time for cultural improvement as well as to attend language classes in 7. The family covers the costs related to language courses attended by the young au pair. 8. The family gives the young au pair at least three free evenings per week, in addition to a whole day off per week and two more days off per month. 9. The family will release the young au pair of his / her tasks to participate in the information session organised by the National Youth Service in the month following his / her arrival. 10. The family draws down the weekly work schedule to be countersigned by the young au pair. 11. In case of sickness or an accident, the host family will continue to provide boarding and lodging as well as all needed care and treatment until the necessary arrangements have been made. 12. The family takes care of potential early repatriation of the young au pair due to illness, accident, withdrawal of the approval or withdrawal of the authorisation of the young «au pair». 13. The family subscribes to a statutory health and accident insurance scheme for the young «au pair» pursuant to Articles 1 and 85 of the Social Security Code and takes out civil liability insurance with a duly approved insurer in Luxembourg for the young au pair for the term of the young au pair placement. 14. The family allows the agents of the National Youth Service (SNJ), who are in charge of the supervision, access to their habitations, pursuant to Article 6 Paragraph 3 of the law on young au pair. 6 The transfer has to be made every month without exception during the term of the placement. Possible periods of inactivity of the young «au pair» are not considered. 4
5 III. THE YOUNG AU PAIR S OBLIGATIONS 1. The young au pair undertakes to participate in light day-to-day family duties, such as 7 ( specify the services the young au pair will be required to perform) during hours per day and hours per week. 2. The young au pair agrees not to exercise any activity in an employed or self-employed capacity during the term of the au pair placement. 3. The young au pair agrees to have taken recognizance of the obligations and the information about the host family and notably to have taken note of the languages spoken by this one. 4. The young au pair declares to speak the following languages and have a basic knowledge of the following languages 8 :. 5. The young au pair agrees to take language lessons, as described under II.4., during his stay. 6. The young au pair agrees to attend a compulsory information session during his arrival organised by the National Youth Service (SNJ). 7. The young au pair agrees to attend a mid-term evaluation meeting organised by the National Youth Service (SNJ). 8. The young au pair takes note of the fact that he can contact the National Youth Service (aupair@snj.lu) in case of problems with the placement. 7 The young au pair s participation in day-to-day family duties and babysitting shall not exceed an average of five hours per day and thirty hours per week. 8 The young «au pair» shall have basic knowlegde of one of the main spoken languages of the family ; furthermore he / she must have sufficient knowledge in English or in one of the administrative languages as stated by the law of 24 February 1984 on the linguistic framework (Luxemburgish, French, German). 5

OTHER PROVISIONS 9 The parties equally have agreed on the following: Arrangement on travel expenses Arrangement on visa and residence permit expenses: Participation of the young au pair person in family holidays : Specific arrangements on days off and free evenings : other : This agreement has been drawn up in three copies, of which one is retained by the young au pair, one is retained by the host family, one is for the National Service of Youth (SNJ). The two parties agree to have taken recognizance of the dispositions relative to the law of 18/02/2013 on young au pair (see Annex): Signed the at Signature of the au pair young person Signature of one representative of the host family 9 It is highly recommended to lay down all other arrangements between the signing parties in the present agreement 6
7 ANNEX: Information sheet The National Youth Service informs about the dispositions relative to the law of 18/02/2013 on young au pair, notably: that the agreement is concluded subject to the host family s approval agreement and the young au pair s authorisation. The young au pair shall have the approval of the Minister of Youth and be in order with the law of 29th August 2008 on free movement of persons and immigrations. The placement may not begin until the National Service of Youth (SNJ) has received the signed agreement and the final start date of the au pair placement. The young au pair s participation in day-to-day family duties shall not be the main purpose of the stay. It may not exceed an average of five hours per day over a period of one week. The weekly participation may not exceed an average of thirty hours over a period of one month or four weeks. Approval shall be withdrawn when he host family ceases to satisfy the conditions for approval, respectively the commitments on the basis of which its granting was submitted, or where, by its actions, it endangers either the safety or the physical or psychological health of the young «au pair». It shall also be withdrawn when the host family does not meet the commitments in the au pair placement agreement concluded with the young au pair. Approval shall be withdrawn when the young au pair has engaged in deceptive practices or has made inaccurate statements to obtain it. It may also be withdrawn when the young au pair does not comply with the conditions or the made commitments on the basis of which the granting of the approval has been submitted. That the au pair placement agreement may be terminated early with immediate effect in case of force majeure or gross negligence by one of the parties and by giving at least one month notice in any other cases. The party that is considering terminating the young au pair placement agreement shall notify the other party in writing with a copy thereof to the attention of the National Youth Service. That, where the host family is considering terminating the young au pair placement agreement before the end of the term, it shall, before any decision, convene the interested person to a meeting where the reasons of the contemplated decision are explained and where the young au pair s explanations are heard. The host family and the young «au pair» have the right to ask for the mediation of a representative of the National Youth Service, provided that they inform the other party thereof beforehand and in good time. 7
