1 EXHIBIT D Radio Frequency MOU COOPERATIVE RADIO FREQUENCY USE AGREEMENT BETWEEN STATE OF MONTANA, DEPARTMENT OF NATURAL RESOURCES AND CONSERVATION, SOUTHWESTERN LAND OFFICE & FLORENCE, FRENCHTOWN, MISSOULA, AND SEELEY LAKE RURAL FIRE DISTRICTS & MISSOULA CITY FIRE DEPARTMENT & CONFEDERATED SALISH & KOOTENAI TRIBES OF THE FLATHEAD NATION & USDI, BUREAU OF LAND MANAGEMENT, MISSOULA FIELD OFFICE & USDI, BUREAU OF INDIAN AFFAIRS, FLATHEAD AGENCY & USDA, FOREST SERVICE, LOLO NATIONAL FOREST & COUNTY OF MISSOULA, MONTANA HEREINAFTER REFERRED TO AS THE COOPERATORS OF THE MISSOULA COUNTY FIRE PROTECTION ASSOCIATION (MCFPA) ****************************************************************************** The purpose of this agreement is to provide for the sharing among the Cooperators of specific radio frequencies that are authorized and/or licensed to each Cooperator. This agreement is required and authorized in compliance with FCC rules and regulations, part , regarding the sharing of radio frequencies. It is understood by all parties to this agreement that the following conditions will govern the mutual use of their respective radio frequencies specifically identified within this document. 1. All Cooperators agree to provide evidence of authorization or license to operate, for each frequency listed herein, to all other Cooperators upon request, and to immediately notify all other Cooperators when conditions of the authorization and/or license to operate change or the authorization/license becomes invalid. 2. Each Cooperator shall exercise control and be responsible for all radio transmissions on their respective authorized/licensed frequency(ies), and reserves the right to immediately terminate the use of a specific frequency or frequencies by all other Cooperators temporarily when it is deemed necessary by the controlling party. 3. The controlling party for each frequency shall determine the dispatch and management procedures to be used for that frequency. These frequencies may only be used when performing duties in cooperation with or on behalf of one or more of the Cooperators. These frequencies may not be used for the general business or day-to-day operation of the borrowing Cooperator. Special use authorization may also be given with specifics listed at the end of this document. Page 14
2 4. All Cooperators are authorized to use frequencies for radio testing and maintenance purposes. 5. Any Cooperator may terminate this agreement at any time by giving written or oral notification to the other Cooperators. 6. Unless otherwise terminated, this agreement shall remain in effect from the date of approval until the expiration date of the radio frequency authorization(s) or license(s) involved whichever is sooner. In no event shall this agreement remain valid for a period exceeding five years. Short term authorization dates can be listed at the end of this document. 7. Any Cooperator may request that this agreement be periodically reviewed or updated, as conditions dictate. 8. Any use of the frequency(ies) identified herein under conditions other than those identified in this agreement will be reported as interference, and appropriate action will be taken. 9. All Cooperators must abide by any and all rules and regulations set forth by the Federal Communications Committee, OSHA and The Telecommunications Act of Frequency use is authorized for mobile / portable radios only.
