Time limit for contract performance: Required time of final delivery is not later than: 14 weeks for task 1; 5 weeks for task 2; 5 weeks for task 3; after the date of signing the contract. It is recommended that technical documentation and software are delivered earlier in order to allow its testing and user training. 3. Conditions for participation in the procedure and the description of the method used for the evaluation of the fulfilment of those conditions: 1 Eligible to compete for a contract shall be economic operators, who according to Art 22/1 of the PZP Act, fulfil the requirements about:

8 1) authorization to perform specific activities or actions, if such authorizations are required by the law; 2) having the necessary knowledge and experience; 3) having technical capacity and persons able to perform the contract; 4) having economic and financial situation ensuring the performance of the contract and are not liable to exclusion in contract award procedure according to Art. 24/1. 2 The procuring entity will check if statements about fulfilling the conditions for the participation in the contract award procedure and about not being liable to exclusion are included. 4. Information concerning declarations and documents to be provided by economic operators to confirm the fulfilment of the conditions for participation in the procedure: 1 Statement about fulfilling the conditions for the participation in contract award procedure according to Art. 22/1 2 Statement about not being liable to exclusion in contract award procedure according to Art. 24/1. 5. Information on the manner of communication between the awarding entity and economic operators, indication of persons authorised to communicate with the economic operators: 1 The awarding entity will contact with economic operators by fax or in writing. 2 Person authorised to communicate with the economic operators: Maciej Zajączkowski fax: (+48 22) Time limit during which an economic operator must maintain its tender: 1 The awarding entity determines the time limit during which tender must be maintained on 30 days from the date of time limit for submission of tenders. 7. Description of the manner of the tender preparation: 1 The tender should be drawn up in Polish or English language in writing, using durable, readable technique. 2 The tender should include: 1) brief technical description of the device; 2) time of delivery; 3) terms of warranty; 3 Every economic operator may submit only one tender. The economic operator, which will submit more than one tender, will be excluded. 4 The tender should relate to whole contract according to requirements and conditions of

9 the specification. Partial tenders are not allowed. 5 All pages of the tender should be numbered, signed and stitched. 6 The economic operator should place the tender in an envelope provided with awarding entity s and economic operator s address and full name, and marked with the inscription: "Postępowanie o udzielenie zamówienia publicznego w trybie przetargu nieograniczonego na zestaw do termicznego naparowywania warstw w systemie MBE [DZPIE/007/2010]" 8. Date and place of the submission and of the opening of tenders: 1 The tender should be deposited in the awarding entity s seat, building I room 101, between 9:00 am and 3:00 p.m. business days, till 10:00 a.m. March 4, For tenders sent by post, the delivery time is the date and time of reception, not the date of the postmark. 3 The opening of tenders will take place in the awarding entity s seat, building I room 203 at 10:00 a.m., on the last day of the tender s submission. 9. Description of the method of the price calculation: 1 The price will be expressed in PLN, EUR or USD. 2 For the purpose of price comparison between the individual offers, price will be converted into PLN according to the mean exchange rate of the National Bank of Poland published on the day of opening the tenders. 3 The total price should take into: price of the products on DDU Warsaw terms. packing, delivery. 10. Description of criteria which the awarding entity will apply in selecting a tender, specifying also the importance of particular criteria and method of evaluation of tenders: 1 Price 100 points 2 Points for the price will be awarded as follows: where: C min the lowest price among valid offers; C bad price of a given offer. 11. Information concerning formalities which should be met following the selection of a tender in order to conclude a public procurement contract: 1 The economic operator, which will award the public procurement contract procedure,

10 should sign the contract in 7 days from the date of the end of time limit for lodging the protests, according to conditions defined in this specification of essential terms of the contract, but not later than time limit during which tender must be maintained. 12. Provisions of essence to the parties which will be introduced into the concluded public procurement contract: 1 Terms of payment: 100% NET 30 from the date of delivery to IP PAS. 2 The economic operator, in case of delay, is obligated to pay in favour of awarding entity penalties 0,1% of value of the contract for each day of delay, starting from the first day after the contractual performance date. The sum of the penalties is limited to 10% of the contract value. 13.
