1 ORDERING A PHOTOGRAPH FOR PERSONAL USE Thank you for your interest in ordering an item for personal use from The Arizona Republic or azcentral.com. To order a photograph, full-page print, graphic, or Benson cartoon for your own personal use that was printed in The Arizona Republic, Phoenix Gazette, Arizona Business Gazette or azcentral.com, you must complete a Personal Photo Order Form. If you are requesting a photograph, article, full-page print, graphic or Benson cartoon to be reprinted or used in a publication (newsletter, promotional brochure, book, etc.) or on a website, please contact the Permission Department at (602) or permission@arizonarepublic.com If anyone other than you is identifiable in the photograph, you must complete the Personal Photo Release, which will obtain the other person(s) permission for us to sell you the photograph. This includes photographs of professional sports figures, celebrities, minors (children under 18 years of age) and any person other than yourself. We can only sell photographs that were taken by our staff photographers. We are unable to sell photos of sports figures and/or celebrities (unless you obtain a release) or photos by wire services such as the Associated Press. The item you request had to appear in the paper or on azcentral.com to allow us to sell you a print of the item. 3 CONDITIONS governing the use of materials from Phoenix Newspapers, Inc. 1. Phoenix Newspapers, Inc. ( PNI ) hereby grants you permission to make a one-time use the photograph, article, full page, artwork or graphic owned by PNI and designated on the front of this contract ( PNI Materials ) in the manner and for the purposes listed on the front of this contract. Permission for any subsequent or different uses of PNI Materials (including reprints, second editions, special editions, editions in different languages, use in electronic or online format, etc.) must be separately applied for in writing and are subject to additional use fees and a separate permission grant. Unless specifically set forth on the front of this contract, this grant of permission to use the PNI Materials does not include the right to syndicate, rent, loan, scan or digitize the PNI Materials, and does not including the right to copy, post or transmit the PNI Materials electronically or online. You may not manipulate, modify or alter the PNI Material in any way and you must reproduce the PNI Materials in their entirety. 2. As part of your use of the PNI Materials, you agree to give PNI proper and full credit for the PNI Materials in the following form: The basic credit line is to include: (c)name of the Newspaper Date of Publication When provided, the photographer, author and artist And the following permission statement: Used with permission. Permission does not imply endorsement. You agree and understand if the appropriate credit line is not used you must pay PNI three times the reprint fee set forth on the front of this contract. a. With printed matter, it is preferred that the credit line appear on the same or facing pages as the reprinted PNI Material. It is mandatory that each item be credited individually. b. With films, filmstrips, multi-media slide presentations and videotapes, include the credit within a Sources section. If a companion guide or manual is produced, credit at the point where the reprinted PNI Material is discussed. c. With exhibitions, credit within the exhibition area, preferably near the reprinted PNI Material. d. With electronic format, the credit and permission information is to be placed at the end of the reprinted PNI Material for each article posted. 3. You will furnish to Phoenix Newspapers one complimentary copy or tear sheet(s) for each publication, except motion pictures, in which reprinted PNI Material appears. If permission has been granted for electronic reproduction, you shall furnish Phoenix Newspapers, Inc. with the Internet, World Wide Web or any other electronic address where the reprinted PNI material will appear. 4. Reprinted PNI material, reproduced as dust jackets, end papers, murals or other uses deemed as special uses are subject to higher use fees. Mass reproduction as unbound material, such as posters, will not be permitted without specifically authorized permission. 5. In authorizing the publication of reprinted PNI materials, PNI does not surrender its own right to publish the PNI Materials or its right to grant permission for others to publish the PNI Materials. You agree that PNI owns all rights to the reprinted PNI Materials and that you have no rights to the reprinted PNI Materials other than the rights specifically set forth herein. 6. You agree to obtain all necessary consents from, and pay any applicable fee to, any individuals who appear in the PNI Materials, as well as any other consents that may be necessary for your use of the PNI Materials. You agree not to use the PNI Materials in a manner that is defamatory of PNI, its newspapers, or any person who appears in the PNI Materials. 7. PNI makes no representations or warranties regarding your use of the reprinted PNI Materials. More specifically, PNI has not obtained any releases covering your use of the reprinted PNI Materials and PNI does not warrant or represent that your use of the reprinted PNI Materials will not infringe the rights of any third parties, including any privacy or publicity rights of any individuals who appear in the reprinted PNI Materials. You agree to indemnify and hold PNI, Gannett Co., Inc. and all of their respective officers, directors, employees, agents, representatives, successors and assigns, harmless from any claims, damages, liabilities, losses, costs or expenses (including reasonable attorneys fees) that may arise out of your use, reproduction or distribution of the PNI Materials. 8. PNI reserves the right to refuse to fulfill any reprint request that it may receive on any ground including without limitation if, in its judgment, fulfillment of the order would involve violation of the copyright law. 01/08
