14 Terms and Conditions RENTAL CONDITIONS Equipment Use: The equipment hired shall be used at all times in a proper manner. The equipment shall be maintained and serviced and returned in a reasonable condition. Cleaning: If upon completion and return the equipment needs to be cleaned, we may debit these costs from the deposit. Damage Waiver: A 10% Charge of the Total Hire Fee is to be charged unless the customer can provide proof of cover for the goods. Upon acceptance and payment by the Hirer of the Damage Waiver fee, L&P agrees to waive its rights to claim for any loss or damage to the equipment for any sum in excess of $ The waiver shall not apply to the following: 1. Damage caused by misuse 2. Damage caused by the operation of the equipment in contravention of these Rental Conditions Charges: The Hirer will pay charges at the same rates specified in this brochure from the commencement of the hire period to the day the equiment is returned. Sub Hire: The equipment must be returned by the Hirer and not sub-leased or assigned to another party. Freight: The Hirer will be responsible for freight costs for delivery and return of the equipment. Breakdown: In the event of a breakdown or failure of the equipment the Hirer shall inform us and return the equipment to our premises, and shall on no account attempt to repair the equipment without our express agreement. Liability: The Owner shall not be liable for any loss or damage caused by lease equipment, whether to the Hirer, the Hirer s property, or any other person, firm or corporation. The Owner s liability if any for furnishing the wrong or defective equipment to the Hirer is limited to a rebate of rental charged. The Hirer hereby indemnifies the Owner from liability for any losses, damage, injuries, claims, demands and expenses of any kind or nature arising from the use of the hired equipment. Notwithstanding all the above, we expect you to deal fairly with us, and we assure you we will deal fairly with you. ADDITIONAL CHARGES WILL BE INCURRED FOR LATE RETURNS AND CANCELLATIONS!
