On 6/7/2016, Blood Alcohol Analyst Robert Parsons, Jr. received the following evidence from the St. Lucie County Sheriff's Office via RENEE PIENIAZEK: Exhibit# : Sealed manila envelope containing three bullets and three cartridge cases test fired in the firearm in Exhibit # Exhibit# : Sealed manila envelope containing three bullets and three cartridge cases test fired in the firearm in Exhibit # PURPOSE: Function examination Comparison Gunshot residue testing RESULTS The firearms in Exhibits # and # were examined for functional defects and test fired. No functional defects were found with either one. The cartridge cases in Exhibits # through # were identified as having been fired in the firearm in Exhibit # The cartridge cases in Exhibits # through # and the bullet fragment in Exhibit # were identified as having been fired in the firearm in Exhibit # The bulleubullet fragments in Exhibits #223256, #223259, #223270, # and # could not be identified as having been fired in the firearm in Exhibit # or the firearm in Exhibit # However, similar class characteristics (caliber and rifling) indicate that they could have been fired in the firearm in Exhibit # or the firearm in Exhibit # The area around the hole in the right middle back of the tee shirt in Exhibit # was microscopically examined and chemically processed for the presence of gunshot residues and none were found. REMARKS The firearms designated as Exhibits # and # were delivered to the Indian River Crime Laboratory by a representative of the St. Lucie County Sheriff's Office for function testing and test firing. The representative was present during the entire examination process and transported the Exhibits along with the generated test fires back to their agency. The test fires were later submitted for comparison purposes as Exhibits # (from the firearm in Exhibit #222766) and # (from the firearm in Exhibit # ). A blood-like substance was visible on the bullet in Exhibit # The submitting authority is requested to pick up the exhibit(s) at their earliest opportunity. These DNA profiles have been entered into the Combined DNA Index System (CODIS) and will be periodically searched against the appropriate indexes, with any matches being reported. Inconclusive DNA profiles were obtained from the following exhibits which are not suitable for comparison due to insufficient DNA quality and/or quantity: swabs of driver's side door panel top (Exhibit ) swabs of driver's side door arm rest (Exhibit ) swabs of passenger door panel top (Exhibit ) swabs of passenger side door arm rest (Exhibit ) swabs of center console (Exhibit ) Insufficient DNA/data was obtained from the following exhibits which are not suitable for comparison due to insufficient DNA quality and/or quantity: swabs of a palm print, windshield frame driver's side (Exhibit ) swabs of a smear, rear driver's side window (Exhibit ) swabs of driver's door window frame (Exhibit ) swabs of a fingerprint, passenger side window midsection (Exhibit ) swabs of a fingerprint, driver's side window (Exhibit ) swabs of a fingerprint, driver's side window (Exhibit ) piece of plastic bag (Exhibit ) No DNA profile was obtained from the following exhibits. For the loci D8S1179, D21S11, CSF1PO, D3S1358, TH01, D13S317, D16S539, D19S433, vwa, and TPOX, the probability that a randomly chosen, unrelated individual would be included as a possible contributor to this mixture is 1 in 182,800 using an African American database. Brian MacNaught (Exhibit ) and Keith Holmes (Exhibit ) are excluded as possible contributors to this mixture. A mixed DNA profile was obtained from the swabs of gear shift (Exhibit ). The male DNA profile obtained from the major component of this mixture matches the DNA profile obtained from the bloodstain card from Demarcus Semer (Exhibit ) at nine loci; comparisons at the remaining six loci (CSF1 PO, D2S1338, D19S433, vwa, D18S51, and FGA) were inconclusive due to insufficient DNA quantity and/or quality. Comparisons to the remainder of DNA present in this mixture sample can not be performed due to limited DNA quality and/or quantity. A complete male DNA profile was obtained from the swabs of back door step (Exhibit ). This DNA profile matches the DNA profile obtained from the bloodstain card from Demarcus Semer (Exhibit ) at all fifteen loci. To a reasonable degree of scientific certainty, in the absence of an identical twin, Demarcus Semer (Exhibit ) is the source of the DNA profile obtained from ~he swabs of back door step (Exhibit ).
