1 UPPER FREDERICK TOWNSHIP BOARD OF SUPERVISORS MEETING April 13, 2017 The regular monthly meeting for April 2017 was called to order by the Chairman at 7:00 PM. ATTENDING WERE: Scott Rakowski, Chairman; Ray Bortz, Supervisor; David Allebach, Esquire, Township Solicitor; Norm Ulrich, LTL Consultants, Township Engineer; Steve Heller, Road Foreman; Tom Davies, Miller Environmental; Steve Zimmerman, Parks & Recreation; Jackie Tallon, Township Manager; and, Lois Reitnour, Administrative Assistant IN ATTENDANCE: State Representative Marcy Toepel and Bill Bushnell, District Director for Representative Toepel; Jared and Barbara Landis, Westview Drive; and, Lee Eckenrode, Fagleysville Road MINUTES Mr. Rakowski requested that approval of the March 9, 2017 minutes be forwarded to the May 11, 2017, Board of Supervisors meeting. He was not in attendance at the March 2017 meeting and full Board was not present to approve the minutes. Public Comment Mr. Rakowski called for any public comments or additions to the agenda. There were none. TREASURER S REPORT The financial reports submitted include tax collector s monthly report for March 2017, all funds budget and income report, statement of cash balances, and the customer balance report from the Water/Sewer plant at Perkiomen Crossing Development and the Sewer plant at Ivy Ridge Development. Mr. Rakowski made a motion to accept the Tax Collector s and Treasurer s Reports as presented and file for audit. Mr. Bortz seconded the motion. The cash disbursements report for April was included in the Treasurer s Report and is posted for public review. Page 1 of 6 BILLS TO BE PAID LIST The report of expenditures for April 2017 was submitted for approval and is posted for public review. The list of bills to be paid is included at the end of the minutes. The total payables for the time period are $61,876.27; monthly and bi-weekly payroll and Federal Taxes $10,097.12; and, benefits package $3, Grand total disbursements for the period are $75, Mr. Rakowski made a motion to approve payment of the bills and to advance to the Treasurer the funds to pay any needed bills or expenditures, to save penalties or accrue interest and payroll, prior to the next Board of Supervisors meeting on May 11, Mr. Bortz seconded the motion. State Representative Marcy Toepel Mr. Rakowski introduced and welcomed Representative Toepel. Representative Toepel thanked the Board for having her on the agenda tonight and stated that this week is Local Government Week. A Resolution was signed in Harrisburg designating this week as Local Government Week with April 12 th as the actual Local Government Day. A copy of the Resolution was presented to the township. Representative Toepel informed that there are over 4,500 local government units in Pennsylvania. Harrisburg is currently working on the Budget. Representative Toepel advised of an upcoming free shredding event being held on May 13, 2017

2 at New Hanover Recreation Center from 9:00 until 12:00. Representative Toepel informed that her office is located in Gilbertsville and is available to assist with any state related matters. Representative Toepel thanked the Board for allowing her to say hello. Mr. Rakowski thanked Representative Toepel for attending and stated it is always a pleasure to have her at Upper Frederick Township. Mr. Rakowski continued the meeting. EMERGENCY SERVICES Plymouth Community Ambulance/Lower Frederick Division Report received from Lower Frederick Division and posted for public review. Twenty-two (22) calls in Upper Frederick; nineteen (19) were for Frederick Living. Harleysville Area EMS/Community Ambulance Report received from Harleysville/Community Ambulance and posted for public review. There were thirteen (13) calls for Upper Frederick. Fire Company Report Mr. Bolognese, Fire Marshall, was not in attendance. Report will be posted for public review upon receipt. Ms. Tallon informed that the Upper Frederick Fire Company will be having their Easter flower sale on Friday, April 14 th and Saturday, April 15 th on the front lawn of the Township Building. PERKIOMEN CROSSING WATER/SEWER PLANT REPORT IVY RIDGE SEWER PLANT REPORT Mr. Davies, Miller Environmental, reported that there were no violations at either plant. Plants are running well. All reports have been submitted electronically to the DEP. Report is posted for public review. Perkiomen Crossing Waste Water Treatment Plant Routine operation and maintenance activities were performed during the month of March Perkiomen Crossing Water Plant Routine operation and maintenance activities were performed during the month of March March 9, 2017 start installing steps to water tank March 13, 2017 pad poured for water tank steps Ivy Ridge Waste Water Treatment Plant Routine operation and maintenance activities were performed during the month of March Page 2 of 6 PUBLIC WORKS/ROAD REPORT Mr. Heller wanted to thank the Public Works Road Crew for stepping up and handling the department during his recuperation from surgery. The following work was completed during March 2017: Salt shed is up; plywood walls have been installed inside salt shed; old salt building has been taken down; installed lights and put F350 into service; installed spill plate in F750; truck maintenance from winter use; ditch cleaning from snow and rain storms; sold 2003 Mack for $35,600; sold 2001GMC for $4,400; started grass mowing where needed; completed street sign inventory as required by Penndot; and assisted with the Swamp Creek Stomp on April 1, Upcoming: scratch coating Heimbach Road Hill; install Yost Road draining pipe; and, preparing trucks, mowers, and machines for mowing and paving season.

3 ENVIRONMENTAL ENGINEER S REPORT Mr. Rick Sacks, Environmental Engineer, was not in attendance. Monthly report was delivered to the township distributed and is posted for the public to review. Ms. Tallon reported that the Chapter 94 Report for Perkiomen Crossing Wastewater Treatment Plant was completed and submitted to the DEP. The panel for the thermal alarm and the new grinder pump at Perkiomen Crossing are installed and operational. Purchase of the second pump was approved but has not arrived. The concrete pad for the water tank stairs at Perkiomen Water Treatment plant has been installed. Stairs should be completed next week. The Chapter 94 Report for Ivy Ridge Wastewater Treatment plant was completed and submitted to DEP. CIVIL ENGINEER S REPORT Mr. Ulrich, LTL Consultants, was present. Report for April 2017 has been updated, distributed and posted for the public to review. Mr. Ulrich reported that Camp Laughing Waters, Activity Center will be finishing up some minor punch list items now that the weather permits. Frederick Living, The Meadows, construction has picked up. BUILDING INSPECTOR S REPORT Ms. Tallon reported for Mr. John. Seven (7) Building Permits, six (6) Use & Occupancy Permits and no Special Event Permits were issued. Complete report is posted for the public review. PLANNING COMMISSION Mr. Ulrich reported that the Planning Commission held their meeting on March 30, Mr. Stewartz, Barwis Construction, was in attendance for Lords & Ladies and presented the most recent revised parking lot plans. He was hoping to obtain Planning Commission recommendation for approval to present to the Board of Supervisors in an effort to get support before going to the Zoning Hearing Board. Following some discussion, the Planning Commission recommended approval subject to the revisions discussed before presenting to the Board of Supervisors. Mr. Picardi presented his draft Ordinance for the Wireless Communication Facilities. He briefly reviewed, discussed and obtained some feedback from the Commission. Mr. Picardi will redraft and submit to the Commission for their review prior to their next meeting. Zoning Ordinance Amendments Commercial District updates were discussed. The Planning Commission recommended approval to the Board of Supervisors for adoption. Sunrise Trail Swamp Creek Corridor Study second public meeting was held on March 30, Mr. Buckman and Ms. Tackett attended the opening portion of the meeting and reported information from the meeting to the Planning Commission. CPVRPC REPORT Ms. Tallon reported that the CPVRPC held their meeting on March 20, Meeting was attended by our Planner, Ms. Tackett. The Multi-Regional Greenway Stewardship Study was discussed. On April 5, 2017, committee members had a site walk at Wayland Park to see if Wayland Park would qualify as a site study area. Medical Marijuana issued was discussed and suggested that regional municipalities should address the uses issue individually. Road improvements, closures and detours, in the area were also discussed. Mr. Bushnell informed that he would send updates from Penndot to Ms. Tallon on road improvements and closures. Page 3 of 6

4 PARKS & RECREATION BOARD Mr. Zimmerman reported that the Parks & Recreation held their 5 th annual Swamp Creek Stomp 5K/10K run on April 1, There were about 200 runners registered. Even with the muddy conditions, all seem to have a good time. Mr. Zimmerman, on behalf of the Park Board, would like to thank the Public Works Department, Township staff, fire company personnel and all volunteers for their time and assistance. On Your Park Get Set GO will be running their contest again this year. Upper Frederick Parks & Recreation will be participating. Ms. Tallon informed that the total income for the 5K/10K Run was $7, total expenses $5, profit $2, Old Business BUSINESS BEFORE THE BOARD Fisher Road Bridge Project Mr. Ulrich informed LTL has started on the Grant application as well as the updating of the permits. Project is moving forward. Yost Road Project Mr. Ulrich reported the holdup is PECO. Ms. Tallon presented a response from PECO that was received by LTL as to the reason for not moving forward with the moving the electric lines, to the Board. Ms. Tallon prepared an to Ms. Susanne Ryan, regional external affairs representative for Montgomery County to solicit her help with the electrical line issue. LTL will keep contacting PECO. Agricultural Security Area 7 Year Review Mr. Allebach stated that the Township is on schedule for review. Notices to property owners will be going out on May 1, Lords & Ladies Covered under Planning Commission report. Lords & Ladies will be attending the May 11, 2017, Board of Supervisors meeting. Proposed Zoning Ordinance Amendment Commercial District Ms. Tallon informed that the Planning Commission recommended approval to the Board for advertising. The medical marijuana language is included in the amended Ordinance. Mr. Allebach requested a copy of the amended Ordinance for his review. Board approval is deferred to the May 11, 2017, Board of Supervisors meeting. Wireless Communication Facilities Draft not ready for review. Holding Tank Agreement/Resolution Hill Road Montgomery County Property Ms. Tallon informed that agreement has not yet been signed. Dog Park - Update Ms. Tallon informed that advertising for the bid package were Friday, March 10 th and March 17, 2017 with the bid opening on March 31, Only one (1) bid package was received. Package must be re-advertised for bidding. Advertising is scheduled for April 10 th and 17 th, 2017 with the bid opening scheduled for May 1, Ms. Tallon sent the invitation to bid to eight (8) fencing companies in Montgomery and Berks County with the hope of obtaining the required packages necessary. 5 Ivy Ridge I & I Ms. Tallon informed that a report was received from Mr. Sacks, Environmental Engineer, on April 7, 2017, regarding high flows at Ivy Ridge. Flows on the lower end of the line between the driveway to the treatment plant and the lower Fire Reservoir appears to be the source of the problem. Homes on the east side of the lane are the source and indicate the likely use of sump pumps. Recommendation is that another mailing goes out to the Ivy Ridge residents to notify them that the sump pump problem is continuing to have an impact on the wastewater treatment plant and that this results in higher operating costs to all of the residents. Board approved sending letters with the included wording noting that the continued illegal discharges of sump pumps can result in fines under the Township Ordinance. New Business Miller Environmental Agreement Ms. Tallon informed that the Miller Environmental Agreement expires June 30, Mr. Allebach inquired if the Township received any notification of changes to the agreement. There were none. Mr. Allebach stated that the agreement should automatically renew with the same terms. Goschenhoppen Spring Frolic June 5, 2017 Requested Fire Police Letter requesting the assistance of the Upper Frederick Township Fire Police for the Goschenhoppen Spring Frolic, dated April 7, 2017, was received by the Township. Mr. Rakowski made motion to grant the assistance of the Upper Frederick Township Fire Police for the Goschenhoppen Spring Frolic on June 5, Motion was seconded by Mr. Bortz. Goschenhoppen Folk Festival Colonial Road Closure Mr. Rakowski made motion to approve the closure of Colonial Road from Thursday, August 10 th, 12 noon, Friday, August 11 th, Saturday, August 12 th, and Sunday, August 13, 2017, 5:00 pm for the Goschenhoppen Historians Folk Festival. Motion was seconded by Mr. Bortz. Mr. Rakowski inquired if there were additional items to bring before the Board. There were none.
