4 3:45 4:45 Bureau of Prisons Processing and Considerations Presenter: Rick Stover, Senior Designator, U.S. Senior Designation and Sentence Computation Center 1.0 Hours Mr. Stover will provide a comprehensive outline of the Federal Bureau of Prisons (BOP), including the types of prison facilities with security level breakdowns, factors considered in the designation process, the impact of judicial recommendations, programs available to inmates and BOP contacts for Ohio. 4:45 END PRESENTER BIOGRAPHIES United States District Court Chief Judge Edmund A. Sargus, Jr. Judge Edmund A. Sargus, Jr. currently serves on the United States District Court for the Southern District of Ohio. Since January of2015, he has been the Chief Judge of the Court. The Southern District of Ohio comprises forty-eight of Ohio's eighty-eight counties. He was nominated to the bench by President Clinton and confirmed by the United States Senate on July 22, He is one of three District Court Judges seated in Columbus, together with two judges on senior status. Prior to judicial service, Sargus served as the United States Attorney for the Southern District of Ohio from May 23, 1993 until August 23, In this capacity, he was the chief federal prosecutor for the Southern District of Ohio. Sargus is also an adjunct professor of law at the Ohio State University Moritz College of Law, where he has taught Trial Advocacy since In 1975, Sargus graduated with an honors degree in American History from Brown University in Providence, Rhode Island. In 1978, he graduated from the Case Western Reserve School of Law, where he was Vice President of the Student Bar Association. In November of 1978, Sargus was admitted to the practice of law. He practiced law in Bellaire, Ohio, from 1978 to 1979, and in St. Clairsville, Ohio, from 1980 until May of During his years of private practice, he also served as Special Counsel to the Ohio Attorney General. In 1998, Sargus received the Annual President's Award from CHOICES, which operates the domestic violence shelter and counseling services in Columbus, Ohio. In April of 1999, he received the Annual Public Service Award from the Criminal Justice Research Center of the Ohio State University. In December of 2005, he also received the first Peacemaker's Award from the Tri-County (Belmont, Monroe, and Harrison Counties) Women's Center. In 2006, Sargus received an honorary Ph.D. from Muskingum College. He currently serves as a trustee of the Belmont College Foundation Board. Sargus also serves on the Boards of Directors for the House of Hope, a residential drug treatment program, the Ohio Lawyers Assistance Program, which provides help to lawyers struggling with addiction issues, and the Advisory Board of Star House, a facility operated by The Ohio State University for homeless youth. Sargus and his son, Edmund C. Sargus, are writing a book about Thomas Drummond, an abolitionist, legislator, and editor who was killed in the Civil War. They recently wrote an article about Drummond which was published in The New York Times. United States District Court Judge Thomas M. Rose Judge Rose attended Ohio University where he received a Bachelor of Science degree in Education in He then attended the University of Cincinnati College of Law where he received a Juris Doctor in Judge Rose was admitted to the practice of law before the Ohio Bar in 1973 and was subsequently admitted to practice at all levels of the Federal Court System. Judge Rose began his legal career in Xenia, Ohio, in 1973 as an Assistant Prosecutor in the Greene County Prosecutor's Office. In 1975, he became Chief Magistrate for the Greene County Juvenile Court where he presided over cases involving alleged delinquent, Page 4 of 9

5 abused and neglected children. Judge Rose then became Chief of the Civil Division of the Greene County Prosecutor's Office in As Chief of the Civil Division, he represented a broad spectrum of elected officials, boards and governmental entities. While serving as an Assistant Prosecutor, Judge Rose also maintained a private practice. In his private practice, he litigated personal injury lawsuits, contract disputes, will contests, adverse possession cases, appeals to administrative agencies and domestic relation matters. In 1991, Judge Rose was appointed to the position of Judge of the Greene County Common Pleas Court, General Division. He was subsequently elected to the Common Pleas bench in 1992 and again in As a Common Pleas Judge, Rose presided over civil and felony criminal cases. Judge Rose served as Greene County Common Pleas Judge until June 20, He was then sworn in as Judge of the United States District Court for the Southern District of Ohio on June 21, United States District Court Judge Walter H. Rice Judge Rice was born in Pittsburgh, Pennsylvania. He is a graduate of Northwestern University, receiving a B.A. degree in He attended the Columbia University School of Law and received a Juris Doctorate degree in He also attended the Columbia University Graduate School of Business Administration and received a Master of Business Administration in He received an Honorary Degree, Doctor of Laws, from the University of Dayton, in 1991 and an Honorary Degree, Doctor of Humane Letters, from the Wright State University in Judge Rice began his law career as an Assistant County Prosecutor for Montgomery County, Ohio, in He left that position in June, 1966 and became an associate with the law firm of Gallon & Miller. In June, 1969, Judge Rice returned to the Montgomery County Prosecutor's Office as its First Assistant Prosecuting Attorney. He was elected Judge of the Dayton Municipal Court in November, 1969, and served in that position until July, 1971, when he was appointed Judge of the Court of Common Pleas, Montgomery County, Ohio. He was re-elected to the Court of Common Pleas in 1972 and in On June 4, 1980, Judge Rice was sworn in as Judge of the United States District Court for the Southern District of Ohio, at Dayton, having been appointed to that position by President Carter. Judge Rice served as Chief Judge of the United States District Court for the Southern District of Ohio from October 13, 1996 to October 12, Judge Rice was the recipient of the Thomas J. Moyer award for judicial excellence in United States District Court Chief Magistrate Judge Elizabeth A Preston Deavers Elizabeth Preston Deavers received her B.A. in Political Science with a Minor in Philosophy from the Ohio State University in She received her J.D. in 1994 from Capital University Law School in Columbus, Ohio where she was Editor-In-Chief of the Law Review and Order of the Curia. Magistrate Judge Deavers entered private practice in 1994 as an attorney in the litigation department of the Columbus office of Bricker & Eckler, LLP. From 1997 to 2000, Judge Deavers served as a term law clerk to United States District Judge Edmund A. Sargus, Jr. She returned to Bricker & Eckler following her term clerkship. During her years in private practice, she was involved in complex commercial federal practice, ERISA, False Claims Act proceedings, asset-based health care financing, occupational safety and health law, workers compensation defense, civil rights litigation and class action practice. She returned to the Court as Judge Sargus s career law clerk in 2002, where she served until taking the bench in Magistrate Judge Deavers was appointed to her first eight-year term as a United States Magistrate Judge for the Southern District of Ohio on March 15, United States District Court Magistrate Judge Sharon L. Ovington Page 5 of 9

6 Magistrate Judge Sharon L. Ovington was born and raised in Cincinnati, Ohio. In 1978, she received her B.A. degree, cum laude, from the University of Cincinnati. She received her J.D. degree from the University of Dayton School of Law in From 1981 to 1988, Judge Ovington served as an Assistant County Prosecutor in the Montgomery County Prosecutor's Office. Her work included misdemeanor and felony prosecutions, representation of Montgomery County officials in civil litigation, and approximately two years of work in the appellate division. From 1988 to 1992, Judge Ovington served as a Referee in the Montgomery County Common Pleas Court. Her work involved a total of more than 400 civil cases addressing a wide variety of issues under Ohio law. She graduated from the Harvard Negotiation Project in 1991, and thereafter contributed to the formation of the Common Pleas Court's Alternative Dispute Resolution Program. In 1992 Judge Ovington entered private practice, becoming an Associate at the firm of Bieser, Greer & Landis where she worked in the area of general commercial litigation until From 1995 until her present appointment, Judge Ovington was a Law Partner at the firm of Greger & Ovington. Her practice focused on general civil litigation, misdemeanor and felony defense litigation, and death penalty and habeas corpus litigation. Judge Ovington received an Outstanding Lawyer Award for her support to the Greater Dayton Volunteer Lawyers Project in She served on the Montgomery County Public Defender Board from 1996 to In 1988 she became the Chairman of the Alternative Dispute Committee of the Dayton, Ohio Bar Association, and in 1999 she became the Chairman of the Civil Trial Practice Committee of the Dayton Bar Association. On October 28, 2002, Judge Ovington was sworn in as United States Magistrate Judge for the Southern District of Ohio, Western Division at Dayton, Ohio. United States District Court Magistrate Judge Michael J. Newman Magistrate Judge Michael Newman, appointed in 2011, was previously a partner in the Cincinnati office of Dinsmore & Shohl LLP, where he represented both plaintiffs and defendants, and practiced in the areas of labor and employment, business litigation and appellate litigation. He chaired the firm s Labor & Employment Appellate Practice Group, created and ran the firm s pro bono appellate program in the Sixth Circuit Court of Appeals, and served on the firm s Diversity Committee. He was named a Leading Lawyer, an Ohio Super Lawyer and one of the Best Lawyers in America in Labor & Employment Law. He co-authored a monthly column on labor and employment law for The Federal Lawyer magazine (TFL) and co-edited the Bench- Bar Handbook for the Southern District of Ohio. He serves on the editorial board of both TFL and the Federal Courts Law Review, and was the Judicial Profiles Editor of TFL for more than ten years. He chaired the Federal Bar Association s national Magistrate Judge Task Force, and was recognized thereafter by the Federal Magistrate Judges Association for valuable and dedicated service to all Magistrate Judges. In 2014, the FBA presented him with a President s Award for leadership [and] extraordinary service, commitment and guidance. Judge Newman attended the Advanced Mediation Program at Harvard Law School and is frequently called upon to mediate complex federal disputes. He was a mediator and arbitrator while in private practice. He is a Master in Dayton s Carl D. Kessler Inn of Court and Cincinnati s Potter Stewart Inn of Court, and was named a Fellow by both the Dayton Bar Association Foundation and the Federal Bar Association Foundation. He has taught as an Adjunct Professor at the University of Dayton School of Law, the University of Cincinnati College of Law, and the Chase College of Law at Northern Kentucky University. He served as statewide chair of the Ohio State Bar Association s Federal Courts & Practice Committee, on the Cincinnati Bar Association Board of Trustees, and chaired the Dayton Bar Association s Federal Practice Committee. He co-chaired the DBA s 20 th Annual Bench-Bar Conference and Bench-Bar Media Forum, and chaired the Sixth Biennial Federal Bench-Bar Conference for the Northern & Southern Districts of Ohio. His Federal Bar Association volunteer efforts are extensive, and include service as president of both the Cincinnati and Dayton chapters, as a Sixth Circuit Vice President, and election to the national Board of Directors. During his tenure, Dayton was named a Chapter of the Year and received the Shaw Public Service Award for outreach to younger lawyers. He will be the FBA s national president in Judge Newman is a mentor to many and is known for his diversity and inclusion efforts. He has been recognized by the Black Lawyers Association of Cincinnati (BLAC) and the Summer Work Experience in Law program (SWEL), and sits on the statewide board of directors for the Law & Leadership Institute (LLI). He was a mentor in the Supreme Court of Ohio s mentoring program. In 2014, he chaired the national essay contest, What a Fair and Impartial Federal Judiciary Means to Me and to the United States, sponsored by the Federal Bar Association and the Federal Judges Association. Judge Newman is involved in a wide array of community activities and access-to-justice efforts. In 2010, he was honored to receive the Boots Fisher Public Service Award, given annually to one lawyer in the United States for exemplary community, public and Page 6 of 9

7 charitable service. Such involvement continues; in 2014, he was instrumental in creating a lawyer referral program for military personnel at Wright Patterson Air Force Base. He now presides over the first Federal Veterans Court in the Southern District of Ohio and is active in Re-Entry Court and the Restored Citizens Project, two Federal Court efforts designed to help formerly incarcerated individuals successfully return to society. Judge Newman graduated with honors from the Washington College of Law at American University, and attended New York University as an undergraduate. United States District Court Magistrate Judge Michael R. Merz Magistrate Judge Michael R. Merz is a life-long resident of Dayton, Ohio, where he was born in He is a 1967 graduate of Harvard College (A.B. cum laude) and received his J.D. degree from Harvard Law School in From 1970 to 1977, Judge Merz practiced law with the Dayton firm of Smith & Schnacke. Appointed a Judge of the Dayton Municipal Court in 1976, he was elected to that position in 1977 and re-elected in He was appointed United States Magistrate Judge in 1984 and in March 2011, while serving his fourth term, retired and was recalled to service. He served as Chief Magistrate Judge of the Southern District from 2004 to Judge Merz has taught at the University of Dayton School of Law and for the Ohio Judicial College. Within the legal community, Judge Merz served seven years on the Ohio Supreme Court s Rules Advisory Committee and has chaired the Ohio State Bar Association s Judicial Administration and Federal Courts Committees. He was founder and later President of the Carl D. Kessler Inn of Court and served as President of the Harvard Law School Association of Ohio in He was Sixth Circuit Trustee of the Federal Magistrate Judges Association and the magistrate judge representative on the Sixth Circuit Judicial Council from Judge Merz is a fellow of the Dayton, Ohio State, and the American Bar Foundations. In 2012 Judge Merz received the Dayton Bar Association s Legacy of Excellence award and in 2013 the American Bar Association s Robert B. Yegge Award for Outstanding Contribution to Judicial Administration. Judge Merz s civic activities have included Chair of the United Way of Greater Dayton, President of the Board of Trustees of the Dayton Public Library, and President of the Montgomery County Historical Society. He was given the City of Dayton s Outstanding Service Award in He served from 2004 to 2009 on the National Review Board of the United States Conference of Catholic Bishops. He also serves as a director of the East End Community Services Corp. and the Dayton Metro Library Foundation. Judge Merz is married to Marguerite LeBreton Merz and has two adult sons, Peter (Director of the Ballet West Academy in Salt Lake) and Nicholas (Product Design Engineer with Apple in San Francisco). Alan Dorhoffer, Esq. Alan Dorhoffer, Deputy Director of the Office of Education and Sentencing Practice, has been on the staff of the U.S. Sentencing Commission since He has conducted hundreds of training programs for judges, attorneys, law clerks, probation officers, and federal bar associations on federal sentencing. Alan has also conducted numerous webcasts and broadcasts on the Federal Judicial Training Network (FJTN). During his time at the Commission, Alan has chaired or been a member of policy teams on Immigration, Sex Offenses, Firearms, and Criminal History, among others. Alan specializes in analyzing Supreme Court, appellate court, and district court decisions interpreting the federal sentencing issues, and in presenting complex legal concepts in terms guideline users can readily understand. Alan has been an Adjunct Professor at the George Mason School of Law, and was law clerk to the Honorable Edmund A. Sargus, U.S. District Judge, Southern District of Ohio, in Columbus. Alan is a graduate of Binghamton University and the George Washington University School of Law. Rusty Burress, Esq. L. Russell "Rusty" Burress, Principal Training Advisor in the Office of Education and Sentencing Practice, has been on the staff of the U.S. Sentencing Commission since its inception in He is involved in the Commission s education programs for judges, probation officers, and attorneys on the federal sentencing guidelines. From 1976 to 1992, Rusty was a U.S. Probation Officer, serving the first nine years in the District of South Carolina and the last seven years on detail to the U.S. Sentencing Commission. He accepted a permanent position at the Commission in May A native of Greenville, South Carolina, Rusty holds a Bachelor of Arts degree from the University of South Carolina and a Master of Arts degree in Probation and Parole Studies from Fordham University. 8 Laura Clemmens, Esq. Laura Clemmens is a Deputy Criminal Chief in the United States Attorney s Office for the Southern District of Ohio. She joined the District in 2002 as an Assistant United States Attorney and has served as a Deputy Criminal Chief since She is a leading member of the Miami Valley Anti-Human Trafficking Task Force, and during her career with the Office, Clemmens has handled a number of investigations and prosecutions involving child exploitation and human trafficking. Clemmens grew up in New York and graduated from the College of Wooster with a degree in Geology. She completed the Environmental Management Program at the University of Southern California, School of Public Administration in Los Angeles. For over ten years, Laura worked as an environmental scientist for the Environmental Protection Agency in Washington, D.C. and Denver, Colorado, enforcing the Safe Drinking Water Act and the Superfund program. After leaving the EPA, Laura worked as an expert witness in Federal District Court in the area of Superfund remediation. She received her J.D. from the University of Oregon School of Law in Christy Muncy, Esq. Prior to joining the USAO in 2007, Muncy was First Assistant Commonwealth s Attorney for Kenton County, Kentucky. During her time there, Muncy prosecuted all homicides and violent offenses. Since joining the USAO. Muncy has handled a wide range of matters, including child exploitation offenses, white collar, immigration, drug and gun offenses, among others. Muncy was previously the Project Safe Childhood Coordinator for the district, focusing primarily on child exploitation prosecutions. Currently, Muncy serves as the district s Violent Crimes Coordinator and is assigned to the Organized Crime Drug Enforcement Task Force (OCDETF) Section, where she works with state and local law enforcement to jointly investigate and prosecute gun, drug and violent offenses. Muncy is a 1999 graduate of Syracuse University School of Law where she was a member of the Law Student Senate and the National Trial Advocacy Team. Richard Monahan, Esq. Richard Monahan is the First Assistant in the Federal Public Defender s Office for the Southern District of Ohio and has worked in the office since Previously, he maintained a solo law practice representing clients in criminal defense and juvenile cases. Richard was the valedictorian of his class from Mississippi College School of Law and a graduate of Florida State University, with an undergraduate degree in Theatre. He has been published in the Mississippi College Law Review, the Federal Sentencing Reporter, and the OACDL Vindicator. Richard also is the long-time editor of the Federal Public Defender publication, Precedential Value. He has taught at numerous local CLE seminars in Ohio and Kentucky, as well as several sessions for the Defender Services Office at national training events. Sheila Lafferty, Esq. Sheila Lafferty is an Assistant United States Attorney in the United States Attorney s Office for the Southern District of Ohio. She received a Bachelor of Science in Business Administration from the Ohio State University and her Juris Doctor from the University of Dayton School of Law. She began her legal career as an Assistant Prosecutor in Montgomery County, Ohio. Since 1999, Ms. Lafferty has served as a federal prosecutor in the Criminal Division of the United States Attorney s Office. She began her federal career as a general AUSA, prosecuting a wide variety of criminal matters, ranging from white collar to violent crime prosecutions. Ms. Lafferty was also responsible for prosecution of Project Safe Childhood cases, handling dozens of child pornography and child exploitation cases. Ms. Lafferty is currently assigned to the Organized Crime Drug Enforcement Task Force Section and is the lead attorney for the Heroin Eradication and Apprehension Team Task Force in the Dayton, Ohio area. Lawrence Greger, Esq. (CJA Panel Member) Laura Byrum, Esq. Laura Byrum is an Assistant Federal Public Defender in Columbus, Ohio. She graduated from William and Mary School of Law in After practicing in Virginia for several years, she joined the Office of the Federal Public Defender in She was actively involved in the drug resentencing and Johnson litigation for the FPD office. Deborah Williams, Esq. Deborah Williams took office as the Federal Public Defender for the Southern District of Ohio in April Previously she served as First Assistant Federal Public Defender in the District of Arizona, and worked as a trial lawyer in that office from Her trial experience includes white collar, terrorism, guns, and violent offenses arising in Indian Country. She tried and appealed the first Page 8 of 9

9 DNA case in the District of Arizona and Ninth Circuit Court of Appeals. In 1993 she served a special detail at the United States Sentencing Commission, and she subsequently became the first woman president of the Arizona Attorneys for Criminal Justice. She is a long-standing member of the National Association for Criminal Defense Lawyers. Benjamin C. Glassman, Esq. Benjamin C. Glassman is the United States Attorney for the Southern District of Ohio. He was appointed United States Attorney by the Attorney General of the United States on October 8, 2016, and he was reappointed to that position by the United States District Court for the Southern District of Ohio on February 4, From March 2016 until his appointment as United States Attorney in October 2016, he served as Acting United States Attorney. Glassman previously served as the District s First Assistant, Appellate Chief, Acting Criminal Chief, Professional Responsibility Officer, Reentry and Prevention Coordinator. He joined the District as an Assistant United States Attorney in He has argued more than one hundred cases before the United States Court of Appeals for the Sixth Circuit and has tried multiple cases before district courts to verdict. Mary Beth Young is the Appellate Chief for the United States Attorney s Office for the Southern District of Ohio. Prior to joining the District, Young was in private practice in Columbus and served as a Visiting Assistant Professor at the Moritz College of Law. Young received her B.S. from the University of Kentucky, her M.S. from Georgia Tech, and her J.D. from the University of Chicago. Following law school, Young served as law clerk to Judge David Sentelle of the United States Court of Appeals for the D.C. Circuit, then to Justice Antonin Scalia of the United States Supreme Court. Rick Stover, Federal Bureau of Prisons B.A. in Sociology from Duquesne University (Pittsburgh, PA) 92 M.A. in Criminal Justice from State Univ. of New York (Albany, NY) 94 His career began as a Rehabilitation Counselor for the Virginia Department of Corrections in 95 where his caseload included inmates on Virginia s death row. He then left prison and was employed as a probation/parole officer in Virginia Beach. From there, he gained entrance into the federal prison system where he began as a Case Manager in Forrest City, Arkansas. He has held positions with increasing responsibility including Correctional Program Specialist in the Northeast Regional Office (Philadelphia, PA) and Unit Manager at the Federal Correctional Complex in Beaumont, Texas. When the BOP switched to a centralized designation process in 2005, Rick was among the first group of Senior Designators on board. He has been in his current position for the past 5 years and is a senior member of the team responsible for inmate designations, state placement of offenders, and numerous decisions to assist the BOP in managing the inmate population.
